Na STATE OF FLORIDA DEPARTMENT OF HEALTH DEPARTMENT OF HEALTH PETITIONER, 4° u vs. CASE NUMBER: 9T-2ROT- JOSEPH MICHAEL ANTHONY CO Bi0Zre RESPONDENT. / ADMINISTRATIVE COMPLAINT COMES NOW, the Petitioner, Department of Health, hereinafter referred to as "Petitioner", and files this Administrative Complaint before the Board of Chiropractic against, John Michael Anthony hereinafter referred to as "Respondent", and alleges: 1. ) Effective July 1, 1997, Petitioner is the state agency charged with regulating the practice of chiropractic pursuant to Section 20.43, Florida Statutes (Supp. 1996); Chapter 455, Florida Statutes; and Chapter 460, Florida Statutes. Pursuant to the authority of Section 20.43(3)(f), Florida Statutes, the Petitioner has contracted with the Agency for Health Care Administration to provide consumer complaint, investigative, and prosecutorial services required by the Division of Medical Quality Assurance, councils, or boards, as appropriate. 2. Respondent is, and has been at all times material hereto, a licensed chiropractic physician in the State of Florida, having been issued license number CH 0006721. Respondent’s last known address is 6607 W. Boyton Beach Blvd., Boyton Beach, FL 33437. 3. On or about Friday October 10, 1997, Patient B.M. presented to Respondent’s office for a scheduled appointment. Y | UU 4. When signing in Patient B.M. noticed her daughter-in-law’s (S.M.) signature on the office sign in sheet and commented, “I didn’t know of any appointment.” 5. Respondent’s receptionist told B.M. that S.M. did not have an appointment and had not been in the office. 6. Respondent sent a letter of explanation to Patient B. M. on a date not specified. He also admits signing S.M.’s name to the sign in sheet, and contends he got the idea to fabricate names from a license renewal seminar, in order to make patient load look fuller. 7. Based on the foregoing, the Respondent’s license to practice chiropractic in the State of Florida is subject to discipline pursuant to Section 460.413 (1)(k), Florida Statutes, for making misleading, deceptive, untrue, Or fraudulent representations in the practice of chiropractic or employing a trick or scheme in the practice of chiropractic when such trick or scheme fails to conform to the generally prevailing standards of treatment in the chiropractic community ~ . v7) WHEREFORE, Petitioner respectfully requests the Board of Chiropractic to enter an order imposing one or more of the following penalties: revocation or suspension of the Respondent's license, restriction of the Respondent's practice, imposition of an administrative fine, issuance of a reprimand, placement of the Respondent on probation, and/or any other relief that the Board deems appropriate.
