STATE OF FLORIDA EDUCATION PRACTICES COMMISSION CHARLIE CRIST, as Commissioner of Education, Petitioner, vs. CASE NO. 012-2163-Q BETTY N. GOGGINS, b4- O18 PL Respondent. / ADMINISTRATIVE COMPLAINT Petitioner, Charlie Crist, as Commissioner of Education, files this Administrative Complaint against BETTY N. GOGGINS. The Petitioner seeks the appropriate disciplinary sanction of the - Respondent’s Educator’s Certificate pursuant to Sections 231.262 and 231.2615, Florida Statutes, ‘and pursuant to and Rule 6B- 1.006, Florida Administrative Code, Principles of Professional Conduct for the Education Profession in Florida, and said sanctions specifically set forth in Sections 231.262(7) and 231.2615(1), Florida Statutes. The Petitioner alleges: JURISDICTION 1. The Respondent holds Florida Educator’s Certificate 467712, covering the area of Elementary Eduvation, which is valid through June 30, 2007. 2. At all times peitinent hereto, the Respondent was employed as a Ist Grade teacher at Niblick Elementary School in the Columbia County School District. MATERIAL ALLEGATIONS 3. On or about April 9, 2000, Respondent violated standardized testing procedures w} :ie proctoring the SAT-9 Test for her first grade class. She failed to insure that students’ desks were appropriately separated and/or read the sample question and the first question of each section aloud. She walked around the classroom observing students’ work and/or telling students that they had marked wrong answers to certain questions and should go back and fix them, and/or telling them that they had skipped certain questions. She also gave the students extra time to complete one section of the test. All of these actions were contrary to SAT-9 Test proctoring policy and procedure and Test Security Statutes and Laws, for which Respondent had received training on or about April 5, 2000. As a result of Respondent's actions, the reading portion of the SAT-9 Test given to BETTY N. GOGGINS Administrative Complaint Page 2 of 3 Respondent's class was invalidated due to errors in testing procedures. Students were administerec another reading assessment the following week by another teacher to replace their reading scores. 4. On or about April 12, 2002, the Columbia County School District conducted an investigation conceming the testing violations. As a result, Respondent was suspended without pay from May 21, 2002 through May 28, 2002. On or about July 30, 2002, the Columbia County School Board approved Respondent's transfer from Niblick Elementary School to Westside Elementary School, effective August 5, 2002. She continues to be employed. , STATUTORY VIOLATIONS COUNT 1: The allegations of misconduct set forth berein are in violation of Section 231.2615(1)(c), Florida Statutes, in that Respondent lias been guiity of gress immorality or an act involving moral turpitude. : COUNT 2: The allegations of misconduct set forth herein are in violation of Section ~ 231.2615(1)(i), Florida Statutes, in that Respondent has violated the Principles of Professional Conduct for the Education Profession in Florida prescribed by the State Board of Education. RULE VIOLATIONS COUNT 3: The allegations of misconduct set forth herein are in violation of Rule 6B- 1.006(3)(a), Florida Administrative Code, in that Respondent has failed to make reasonable effor: to protect the student from conditions harmful to fearn ing and/o: to the student’s mental healih and/or physical and/or safety. COUNT 4: The allegations of misconduct set forth herein are in violation of Rule 6B- 1.006(4}{b), Florida Administrative Code, in that Respondent has intentionally disiorted or misrepresented facts concerning an educational matter in direct or indirect public expression. COUNT 5: The allegations of misconduct set forth herein are in violation of Rule 6B- 1.006(5)(a), Florida Administrative Code, in that Respondent has failed to maintain honesty irr afl professional dealings. COUNT 6: The allegations of misconduct set forth herein are in violation of Rule 6B- 1.006(5)(h), Florida Administrative Code, in that Respondent has submitted fraudulent information on a document in connection with professional activities. WHEREFORE, the Petitioner recommends that the Education Practices Commission impose an appropriate penalty pursuant to the authonty provided in Sections 231.262(7) and 231.2615(1), Florida Statutes, which penalty may include a reprimand, probation, restriction of the BETTY N. GOGGINS Administrative Complaint Page 3 of 3 authorized scope of practice, administrative fine, suspension of the teaching certificate not to exceed three years, permanent revocation of the teaching certificate, or combination thereof, for the reasons set forth herein, and in accordance with the Explanation and Election of Rights forms which are attached hereto and made a part hereof by reference.
