ADMINISTRATIVE FINE LICENSE No. DC-3191-S OWNER OF Academy of Early Learning Respondent. ) ADMINISTRATIVE COMPLAINT Petitioner, Department of Children and Family Services, by and through undersigned counsel, files this Administrative Complaint against Respondent Licensee, Vinson & Vinson Inc., owner of Academy of Early Learning, License No. DC-3191-S, to impose a fine in the amount of $200.00. As grounds for the imposition of this penalty, the Department states the following: 1. The State of Florida, Department of Children and Family Services, has jurisdiction over Respondent by virtue of the provisions of Sections 402.301-402.319, Florida Statutes, and Rule 65C-22, Florida Administrative Code. 2, The Respondent, Vinson & Vinson, Inc., is licensed to operate as a Child Care Facility in compliance with Section 402.301, Florida Statutes, and Florida Administrative Code, Rule 65C-22. Respondent committed a violation of Section 402.305(4), of the Florida Statutes and 65C-22.001(4)(a)(b) 1,2 of the Florida Administrative Code, in regard to ratios. The facility was cited on Inspection Reports dated 7/16/02, 7/2/02 and 11/2/01 for noncompliance of staff to child ratios. A wamning letter addressing ratio violations was sent to the facility on 11/9/01. 4. Respondent also committed a violation of 65C-22.001(5)(a), of the Florida Administrative Code, in regard to supervision. On 3/8/02, a child was injured with a pair of scissors. This was the result of the lack of proper supervision on the part of the categiver. This incident was cited on Inspection Report dated 7/2/02. 5. The processing of this administrative complaint was delayed due to the retirement of the handling supervisor and concurrent misplacement of the complaint outline. 6. The above-referenced violations constitute grounds to levy this civil penalty pursuant to Sections 402.310(1)(a) and 402.310(2), Florida Stavutes, in that the conduct of Respondent constitutes a violation of the minimum standards, rules and regulations for the operation of a child care facility, 7.
