resturant In reference to the walk-in cooler temperature on a number of dates listed

9/9/03 -{at request of owmer) installed cooler door air curtain to prevent loss of
temperature due to opening of door.
9/12/03 return visit determined unit was leaking freon outside on condenser unit,
repaired leak and recharged with freon.
9123/03 -retumed to find unit had developed another freon leak inside walk-in on the fan
unit. System was repaired and recharged. Recommend to replace fan unit inside walk-in
and condenser unit outside due to age/deterioration.
40/03/03 -rapiaced fan unit inside watk-in cooler.
40/08/03 -replaced condenser unit outside.
tn my opinion the owner of Casa Dol Dio acted ina timely manner to resoive this matter
swhile making the responsible decision to replace the oxisisting units with new
equipment.

MOTION TO STRIKE THE PLEADINGS
Petitioner, The School Board of Miami-Dade County, Florida (hereinafter “Petitioner” or
“School Board”), by and through undersigned counsel, pursuant to Fla.R.Civ.P. 1.160, Rule 28-
106.204, F.A.C., and § 120.569, Fla.Stat. (2003), files this its Memorandum in Opposition to
Respondent’s Motion to Strike and states as follows:
1. Petitioner’s Notice of Specific Charges in this cause was filed on April 28, 2004.
2. Respondent filed a motion to strike on May 12, 2004. Respondent’s motion must be
denied for it is groundless, and lacks any factual or legal basis.
MEMORANDUM OF LAW
3, Respondent’s motion seeks to strike paragraphs 5, 10, and 13-15, 25-27 and 36-39
of Petitioner’s Amended Notice of Specific Charges.
4. The facts alleged in Paragraphs 5 and 10 of Petitioner's Amended Notice of Specific
Charges (hereinafter referred to as “NSC”) specifically refer to actions pursued by the School Board
upon uncovering the Respondent’s arrest for theft. The pleaded facts specifically shed light on the
School Board’s attempts to remedy Respondent's behavior and the disciplinary ground work for the

present action. Thus, the facts plead in Paragraphs 5 and 10 of the NSC are part and parcel of the
School Board’s claim that Respondent received progressive discipline as required by the contract
between Miami-Dade County Public Schools and the American Federation of State, County, and
Municipal Employees (hereinafter referred to as “AFSCME Contract”).
5. Additionally, the undersigned is unaware of any case that prohibits an employer from
discussing the prior disciplinary history of an employee at a hearing regarding the appropriateness
of the employee’s dismissal from further employment.
6. Moreover Paragraphs 5 and.10 of the NSC evince the Petitioner’s attempt to correct
Respondent’s unseemly behavior by putting Respondent on notice of the inappropriateness of her
prior behavior, and of the proper course of conduct for a School Board employee. Consequently the
School Board’s conduct is evidence that must be included in the record as it demonstrates the
administrative practice utilized to bring Respondent into conformity with the rules and practices of
the School Board. Consequently, Paragraphs 5 and 10 of the NSC contain facts which support the
introduction of future evidence.
7, Respondent’s motion attempts to raise a double jeopardy defense, which is available
in acriminal proceeding, in this civil matter. However, the double jeopardy clause enunciated in the
Fifth Amendment of the U.S. Constitution does not apply to civil proceedings, only to proceedings
that are essentially criminal in nature. Breed v. Jones, 95 S.Ct. 1779, 1785 (1975); Schellenbach
v. SE.C,, 989 F.2d 907 (7th Cir. 1993). Specifically, the prohibition against double jeopardy does
not apply in an administrative proceeding seeking the removal of an employee.
8. Additionally, Respondent's protection against double jeopardy remains intact, as the
purpose of the August 29, 2002 written reprimand was remedial. As noted by the United States
Supreme Court, a civil sanction only offends the prohibition against double jeopardy when the acts

goal is punitive rather than remedial. See United States v. Halper, 490 U.S. 435, 448 (1989); see also
Brown v. Department of Professional Regulation, 602 So.2d 1337 (Fla. 1st DCA 1992)... The court
in Brown held that “(t)he doctrine of collateral estoppel bars a party from litigating ina second action
issues that were adjudicated in prior litigation between the same parties or their privies.” Brown,
602 So.2d at 1341. This is the first time that issues regarding Respondent’s employment and her
prior disciplinary history are being litigated. Paragraphs 5 and 10 of the NSC merely illustrates the
School Board’s attempt to remedy Respondent’s proclivities for theft by instruction, with no punitive
action pursued. As such, no aspect of either Paragraph 5 or 10 of the NSC violates any component
of the AFSCME Contract.
9. Respondent’s motion allegation that the School Board did not conduct and audit are
incorrect. Paragraph 13 of the NSC specifically refers to an audit
investigation supplying a factual basis for the charges against the Respondent. Said audit
investigation is relevant and germane to the matters before the Court. Furthermore the facts
illustrated by Paragraph 13 of the NSC by their very terms have a direct connection to the audit
investigation conducted by the School Board which frame the issues in this matter.
10. Respondent’s allegation that Paragraphs 14 and 15 constitute hearsay is equally
without merit. The Miami-Dade County Schools Police Department’s (hereinafter referred to as
“School Police”) preliminary investigation report was not offered as proof that Respondent
committed theft. Instead “[t]he documents merely establish that an . . . investigation was conducted
and it’s conclusions.” See Dade County Police Benev. Ass’n v. Town of Surfside, 721 So. 2d 746,
747 (Fla. 3d DCA 1998). Thus the report does not violate the prohibition against hearsay as it
simply establishes that a thorough investigation has been conducted into the charges against the
Respondent without alleging Respondent’s guilt. Id. Respondent's assertion that the Paragraphs 14

and 15 of the NSC are “not relevant or germane” is mistaken as the existence of the School Police
Preliminary Report lays the foundation for the School Board’s basis of action and will support the
revelation of additional components of the case against Respondent.
11. As Respondent has failed to support her contentions, Petitioner knows of no basis to
allege that Paragraphs 14 and 1 5 of the NSC violate either the Collective Bargaining Agreement or
the Administrative Procedure Act of either the State of Florida or the Federal government.
12. Respondent’s claims that the charges asserted in Count I violate her Due
Process/Master Contract rights are not only without factual support, they are contrary to the available
facts. Pursuant to Article XI § 1 of the AFCSME Contract, Respondent was provided with required
degree of Process, as illustrated by institution of several forums of administrative review and
opportunities for Respondent to contest The School Board’s actions. Additionally Respondent’s
present appearance before this Court makes certain that the contractually required degree of process
has been provided.
13. Contrary to Respondent’s assertions and pursuant to Article XI § 1 of the AF SCME
Contract, the School Board has provided ample opportunities for Respondent to air grievances and
respond to the charges of Gross Insubordination and Willful Neglect of Duty. Once again,
Respondent’s appearance before this Court makes certain that the contractually required degree of
process has been provided.
14. Lastly, Fla. R.Civ.P. 1.140(f), provides in pertinent part that:
A Party may move to strike redundant, immaterial,
impertinent, or scandalous matter from any pleading
at any time.
Respondent has not advanced any of the grounds enumerated in Rule 1.140(f) as a basis for the

allegations that Respondent seeks stricken violate her constitutional right to due process of law.
Absent from Respondent’s motion is any indication that Respondent has been denied due process
of law. Moreover, motions to strike are disfavored and all doubts are to be resolved in favor of the
pleadings. Costa Bella Development Corporation v. Costa Develo ment Corp., 445 So.2d 1090 (Fla.
3rd DCA 1984)

PENDING SETTLEMENT NEGOTIATIONS
Claimant MARTIN BALUJA and Defendant Oscar Mendez-Turino jointly move the
Honorable Chief Arbitrator to stay the assessment arbitration hearing in this matter pending the
outcome of on-going settlement negotiations. In support, the parties state:
1. This case is currently set for Arbitration Hearing on June 10, 2004,
2, Beginning Friday, May 28, 2004, during the Defendant’s deposition, the parties
entered into settlement discussions in earnest.
3. The Defendant’s deposition was adjourned to allow these discussion to progress and
they are still on-going.
4. In light of this, the parties have stipulated to hold further discovery and proceedings
in abeyance ~ including the proceeding for injunctive relief filed by the Defendant
in the 11" Circuit Court, Case No. 04-11652 CA 20 — pending the outcome of these
negotiations.
$. Therefore, the parties respectfully request the Chief Arbitrator to take the assessment
hearing off the calendar.

At your request I have reviewed and analyzed the Investigative Report and all exhibits including
the appraisals on the above referenced case.
There arc numerous omissions and false information with faulty reasoning and the possibility of
calculated deception, The reports have quality, completeness, and accuracy problems which
would misicad the readers of these documents.[ would not agree with the value conclusions on
any of the reports or the soundness of the value analysis and the value conclusions. The
information used in cach report has not been adequately researched or confirmed with the
resources available to the appraiser. Therc are erfors in all three reports in reference to past
sales, current owners, rent roll representations, listing representations, and prior sales
information.
The reports do not reflect the proper distances between the subject property and the comparables.
Many of the arcas are superior with no comments or adjustments or explanation as to why there
are no adjustments. The adjustments that are used are not reasonable or consistent in the reports.
In the income approach scctions of the appraisal there is no supporting data or confirmation of
the data which leads to an incorrect analyzed opinion. The appraisals do not appear to he those of
an individual offcring an independent and impartial third-party opinion of valuc, but of an
individual acting as an advocate. In my opinion the properties have all been over appraised and
grossly misrepresented.
In addition, therc are numerous violations to the Preamble and Standards 1 and 2 of the USPAP.
