STATE OF FLORIDA ar EDUCATION PRACTICES COMMISSION JIM HORNE, as Commissioner of Education, Petitioner, VS. CASE NO. 012-1 834-C YVONNE D. DUNSON, 0d D3 PL Respondent. . ADMINISTRATIVE COMPLAINT Petitioner, Jim Horne, as Commissioner of Education, files this Administrative Complaint against YVONNE D. DUNSON. The Petitioner seeks the appropriate disciplinary sanction of the Respondent’s educator’s certificate pursuant to Sections 1012.795 and 1012.796, Florida Statutes, and pursuant to Rule 6B-1.006, Florida Administrative Code, Principles of Professional Conduct for the Education Profession in Florida, said sanctions specifically set forth in Sections 1012.795(1) and 1012.796(7), Florida Statutes. The Petitioner alleges: JURISDICTION 1. The Respondent holds Florida Educator’s Certificate 787744, covering the area of English, which is valid through June 30, 2006. 2. At all times pertinent hereto, the Respondent was employed as an English Teacher at Lake Weir High School, in the Marion County School District. MATERIAL ALLEGATIONS a 3. On or about February 7, 2002, the Respondent intentionally exposed a student, D.M., whose date of birth is October 23, 1984, to unnecessary embarrassment or disparagement by advising him sarcastically in front of the entire class that if he “cannot read the board, go back to kindergarten,” or words to that effect. She also used inappropriate means to discipline students by sending D.M. and another student, D.H., whose date of birth is October 18, 1984, out of the classroom to stand in the rain. After fifteen minutes, D.H. went back inside in the classroom and asked the Respondent to write her a pass to the dean's office because she did not want to leave YVONNE D. DUNSON Administrative Complaint Page 2 of 3 without permission, The Respondent refused to write the Pass to the dean's office, and told D.H. to "get back out there now,” or words to that effect. Without arguing, D.H. went back out and stood in the rain for an additional five minutes. The Respondent never went to retrieve D.H. and D.M., so STATUTE VIOLATIONS Saat tt VIOLATIONS COUNT1: The Respondent is in violation of Section] 012.795(1)(b), Florida Statutes, in that Respondent has proved to be incompetent to teach or to perform duties as an employee of the public schoo] System or to teach in or to Operate a private school]. COUNT2: The Respondentis in violation of Section 1012.795(1)(i), Florida Statutes, in that Respondent has violated the Principles of Professional Conduct for the Education Profession Prescribed by State Board of Education mules, RULE VIOLATIONS MLL YIOLATIONS COUNT 3: The allegations of misconduct set forth herein are in violation of Rule 6B- 1.006(3)(a), Florida Administrative Code, in that Respondent has failed to make reasonable effort to protect the student from conditions harmful to learning and/or to the Student’s mental health and/or physical health and/or safety. COUNT 4: The allegations of misconduct set forth herein are in violation of Rule 6B- 1.006(3)(e), Florida Administrative Code, in that Respondent has intentionally exposed a student to unnecessary embarrassment or disparagement, YVONNE D. DUNSON Administrative Complaint Page 3 of 3 WHEREFORE, the Petitioner recommends that the Education Practices Commission impose an appropriate penalty pursuant to the authority provided in Sections 1012.795(1) and 1012.796(7), Florida Statutes, which penalty may include a reprimand, probation, restriction of the authorized scope of practice, administrative fine, suspension of the teaching certificate not to exceed three years, permanent revocation of the teaching certificate, or combination thereof, for the reasons set forth herein, and in accordance with the Explanation and Election of Rights forms which are attached hereto and made a part hereof by reference.
