No objection having been filed, I herewith approve the Report and Recommendation of Magistrate Judge Andrea K. Johnstone dated June 4, 2019. PennyMac's partial motion for judgment on the pleadings (doc. no. 15) is granted as to Count 1 and denied as to Counts 2 and 3.
