I. DISCUSSION
This action is a pro se civil rights complaint filed pursuant to 42 U.S.C. § 1983 by a state prisoner. The Court entered a screening order on April 30, 2014. (ECF No. 3). The screening order imposed a 90-day stay and the Court entered a subsequent order in which the parties were assigned to mediation by a court-appointed mediator. (ECF No. 3, 6).
The Office of the Attorney General has filed a status report indicating that settlement has not been reached and informing the Court of its intent to proceed with this action. (ECF No. 7 at 2). In the status report, the Office of the Attorney General states that the parties had engaged in informal settlement discussions but had not been able to reach a settlement. (ECF No. 7 at 2 n.1). The Office of the Attorney General also notes that the early mediation conference is scheduled for August 22, 2014, and that the parties plan to attend the mediation in good faith. (Id.).
The Court directs the Office of the Attorney General to file another status report on or before August 29, 2014, informing the Court of the results of the early mediation conference. If the parties are unable to reach a settlement at that time, the Court will issue an order on the matter of the filing fee and service.
II. CONCLUSION
For the foregoing reasons, IT IS ORDERED that the Office of the Attorney General shall file a status report on or before August 29, 2014, informing this Court of the results of the early mediation conference scheduled for August 22, 2014.
