Do children have to give back the $13,000 gift per year when the parent files for Medicaid?

If the gifts were made in the last five years the parent will be ineligible for medicaid for roughly 2 months for every $13,000 gift. If the parents needs nursing home care someone will need to pay for those ineliigible months.

Medicaid planning is complex and you should consult with an attorney prior to filing.
