I am feeling very apprehensive and at this point not sure he will show up for the hearing. What steps do I take from here?
It is unfortunate that you are having a poor experience with your attorney. Lawyers can be very busy so I expect they are busy but will be at your hearing or they will have one of their associate attorneys conduct the hearing.
I suggest to you that you still attend the hearing at the scheduled time (show up early). If the lawyer doesn't show up, let the court staff at the window know that you need to reschedule it because your attorney need to reschedule. It is up to the judge for them to allow a continuance.
These hearing are typically very quick and not easily won. However, we have won these in the past if there is something considerably wrong with the case, the blood results/breath results are not received, or the officer doesn't show up. Sometimes these hearing are lower on the priority list and that may be why your lawyer isn't as responsive as you would like. Either way, I wish you the best and I hope everything goes well at the hearing. If things don't go well, you may consider hiring a different lawyer.
