I hired a lawyer for my dmv hearing and I got the results and lost based on what the cop said
without more info hard to answer.
however, i am sure your lawyer explained DMV hearing are per se hearings. IF you are .08 or higher then you are per se guilty.
your lawyer has a file with all info and i would ask him/her that question.
