Joint ownership of certificate of deposits

My father has joint ownership with my grandmother on several CD's (JWROS) originally taken out in 1994. She has entered a nursing home and applied for Medicaid. Some of the CD's were transferred last year and her name was taken off and transferred to another bank with better interest (his name, which was originally on the CD remained) and the CD's are now in my father's name and his children's. This accounts for about 1/2 of the CD's. The other 1/2 is the original CD's taken out in 1994. Medicaid allowed him 1/2 of the proceeds of her home (which was also jointly owned), but is not allowing him 1/2 of the CD's stating that my grandmother was the originator and, therefore, owns the full amount on all of the CD's. Shouldn't he be allowed 1/2 of all the CD's since he was originally on all of them? Please help.

Elderly home repair fraud

My elderly parents are in the process of rennovating a home which will become a primary residence when completed. My husband and I live 1000 miles away from them. We are concerned that a plumbing contractor has coerced them into allowing him to do work on their house that is substandard and without any written or verbal job estimate, no written or verbal contract, and no invoices. My step-father is 80 yrs. old, mother is 70. Both are not in very good health. The plumber sent a handwritten bill for over $19,000. My husband has talked to him on the phone and via email. We have requested all written documentation from him (estimate, contract, invoices), and he has become very beligerent and has not provided any of that. He stated that his ''word is his bond and his contract''. We have refused to pay unless he provides the proper paperwork. He has just sent a late notice to my parents. senior neglect

my friend took this old lady out of a nursing home and put her in a private house. she has been diagnosed with dementia and can not take care of herself. During the last two months, she has hurt herself three times seriously and been taken to the emergency room. He also convinced her to sign over $100,000 of her life savings, which he put in a CD. I'm concerned about her hurting herself seriously again, and want to help her get back into a nursing home. She's 82 years old, with diabtes, heart condition and early stages of Alzheimers disease. What can I do?

Death from deceptive ''alternative'' medicine

Hi, my father died a few months ago from prostate cancer. He refused chemotherapy because a ''homeopathy'' doctor told him that it would poison him. He believed the doctor and for months did not take any chemotherapy, even when pushed by his doctor and family. Is there some class action lawsuit I can join against cancer cures from deceptive ''cancer-curing'' homeopathy? Google has failed at providing me any legal information on fighting deceptive alternative medicine, so I wanted to ask a lawyer but I'm unsure where to go. If anything, providing a medicine to people that is provably false

conservator of the estate

we are trying to remove a conservator of the estate for my mother. This professional conservator also has temporary letters as conservator of the person. She is not following the California Conservator Handbook, is limiting our ability to visit and care for our mother. Now she wants to move mom out of town. Can we ask for another? Thank you.

Elder law/land protection

In trying to protect my parents assests/property, is it easier to set up a trust- to facilite estate transfer - or is it easier just to add a name to the deed of the property? I think a trust would avoid some taxes?-But does that restrict the power of the trustee to dispense the property when they want to using their POA?? Would a simple-(I think?-) name addition to the deed - guarantee that the person would receive the property upon death with the leas amount of fuss?

Danger to self and others

My father is 83, chronic alcoholic, COPD, falls 3-4 times a month resulting in bodily injury and refuses help. Recently he fell and broke his arm and did not tell anyone for two days. I called all day and no answer so I went over to his apartment. He was sitting on the toilet because he could not get up and had an emergency call button right next to me. He sat on the toilet over night. This is not the first time either. How can I become his conserviter or guardian?

My sister has taken power of attorney for my dad who is now in a nursing home. She is very secretive and will not share with me anything regarding his estate. My parents who reside in Florida have designated me, their daughter, as power of attorney. Someone has informed me that since I reside in New Jersey, it is not legal for me to be POA for them since I don't live in Florida. Not one institution, ie. banks, nursing homes, etc. has questioned me signing any document as their POA being aware that my residency is out of state. Can you tell me which is correct? Thank you.

Financial exploitation of elderly

83 yr. old mother-in-law lives in ALF in N.Y. Son who lives close by was paying extra $300 a month not covered by mother-in-laws' pension. Now he has stopped paying and we think he's stealing her Social Security check and pension check. We live in California. Please advise on what to do first.

The person who comes down each year to do the tax business in our deceased mothers home has not left the house this year. We are afraid she is waiting for dad to die and then claim squatter's rights. Can she do this?

My brother is ill with cirrohosis of the liver. His wife put him in a nursing home supposedly temporarily. She tells family she is never taking him home & she told him he needed to sign a poa so her insurance would pay. Now she is telling the doctor he needs more meds for agitation & we have reason to believe she is doing it to get him declared incompetent so she can just leave him there & go on her way. One sister asked him if he wanted to get the poa off since it was not needed & he said yes. She is now trying to keep family away by saying someone is giving him extra meds. We have all talked & we want to see our brother helped not just laying here like a zombie. He is 60 & says he feels terrible every day. They are supposed to be giving him PT so he can walk again but he feels so drugged he can't really do the PT. We are heartbroken & feel so helpless. Can the POA be revoked since it is his wife. She told the dr. & nursing home she would sue if they told us anything about his health. Is there anything we can do & where would we start.? Thank you for any insight.
