My Mother and I have had joint bank accounts for several years, she has lived with me for the last 3 years and I have been taking care of her for the past 9 years, she is now in the nursing home. What are my legal rights when it comes to these bank accounts and CD's?

my mother has about 150,000 in the bank and a home worth about 105,000.she suggested she sell the home and buy a larger one with the sale proceeds and cash in the bank,and have myself and family move in . upon her death the house would revert to me. the fear I have is if she needs 24/7care in a nursing home will medicaid take the home if its her name? If so should I put it in her name?What is the best way to protect myself? Life estate?

With a durable power of attorney in NH for my elderly mother, is that legal and binding in MA., or any other state if she goes to an extended nursing care facility there?

Voluntary conservatorship and untrusting friend

My mother has dementia, is in assisted living, and been declared incompetent to handle financial matters. Her long time ''friend'' drove her to her bank to withdraw part of her large savings for ''safe keeping''. I called APS and filed a complaint. I feel APS did not take this seriously because it has been 3 months and I haven't heard back. My mother's ''friend'' has now taken my mom to an attorney to have my mom sign a voluntary conservatorship. Would this be considered a conflict of interest? What rights do I give up as Power of Attorney if I allow this to go through? I really can't afford to fight this in court but am concerned this lady will somehow get access to my mom's money. Lastly, is APS required to give a report of finding at some point? Thanks so much.

93 year o ld mothers finances

Five years ago my 93 year old mother put all her savings (except for a shared account to pay her bills...under 3,000 to pay bills ...she has a monthly income from social security and a small pension totalling $1500) into my name. 5 years ago she also put her house in my name. She lives a very modest simple life style, has no stocks or investments of life insurance. She still lives in her home. If there came a time when I needed to put her into a long term care facility, would Medicaid pay the bill. Also when she passes do I need to do anything since everything she owns is in my name? Probabe? Any information you can give me would be appreciated

Nursing home patient being sued

My mother in law is in a nursing home with Alzheimers, can she be served? She has no income because it is all going to medicaid for the nursing home. There is nothing to pay the past due bills with and when they tried serving us the papers I said she no longer lived there. Can they go to the nursing home and serve her? Is she protected from this? I try to deal with the nasty creditors but they want the POA, my sister in law and she doesn't want to talk to them either. What should we do or is there anything we can do?

Conserveratorship with undue influence

Hi,

I took care of my mother for 3 years before she had to be placed in assisted living. Six months later a friend of hers took her to an attorney for a conservatorship. Because she has been declared incapacitated, she was told she has to mark the box that says 'undue influence'. This same lady who wants my mother conserved took her to her bank and tried to withdrawal her large savings. We filed a complaint with APS but, instead, has been investigating us on statements/lies from her friend. My question is should I sign something that says 'undue influence'? I have all receipts and records while taking care of my mom. I just believe this lady is preying on my mom and my mom believes whatever she says.

When we go to court, can I submit my paperwork to a judge for review? Am I allowed to bring witnesses that can testify to my mom's illness and her friends attempt at stealing my mom's money? This is just so confusing and emotional. Thank you so much

My father is 70 years old and in his right mind however he has fallen fray to scam artists and keeps sending them money would we have a case if we tried to file a conservativeship on him?

76 yr old mom repeatedly making unwise financial decisions

My mother who is 76 has repeatedly lived beyond her means. My brother and I have bailed her out on 3 occassions. We finally moved her to and apt. in NH paid off all her outstanding charges...she is now retired and living on a fixed income and in the last year has somehow managed to charge $14,000 on 3 or 4 new charge cards she managed to obtain!!!! We all have our own children and families to provide for...we just can't do this again... what can we do...we have repeatedly explained to her that she will never be able to pay off these charges...she thinks she can and says she can't live without them...My brother threatens her that he'll call the creditors and cancel the cards....what can we really do legally?? My brother thinks we can't do anything unless she was declared incompetent...which she isn't...she just keeps making incredibly crazy financial decisions. What are our recourses as adult children to protect ourselves and prevent the situation from getting any worse...it's really tearing up our family.

My father received a pension from the Transit Authority of NYC. He recently passed away, what happens to his pension? Does it cease? My mother predeceased him by 7 years. What about the last check he received, does it have to be returned if it was deposited on the same day that he passed away. thank you for any information.

Overturning POA

My g-mom has 3 surviving children and 1 of them decided to get POA without the knowledge of the others. My g-mom frequents the hospital, but her doctors have never mentioned any dementia or alzheimers. Just moments of forgetfulness. Can one of the other children fight the POA or will the 2 have to fight collectively? And what needs to be done to start the process?

I have two daughters and i don't want them to have difficulty. will the house go right to them? or will it still have to go into probate? what is the procedure to follow? should I still get written documentation from a lawyer?
