My father is in a care facility, and though I have no role in his care, the facility is sending his bills to me (apparently as my name was given as a contact). Do I have any responsibility to pay?

My father is in a convalesent home. He was admitted 12/10/09. He was divorced from his last wife of 30 years in 2005. My father created a new will. He became ill in 2007 and the exwife remarried him while hesn't in a good mental state. My father was then living with her for about 5 months. His exwife dropped my dad off with my half sister one day and never picked him up. They drained his bank accounts and stocks. I think his new will was changed when they remarried. He is now very sick and my sister ane I are from his first marriage and we are in California. My dad is in New York in a convalesent home and there is no one there for him. We don't know what to do. We want to help him but don't know how. He received mail from exwife today regarding his 2nd divorce. She wants more money and wants money for a home that is in his name only in New Jersey. She wants 14,000 to be repaid for things she did for him during their second marriage. The woman is not okay and is out to get him. How can we get guardianship? Can his bank accounts be frozen so they can't get any more money? Please advise. It would be greatly appreciated.

My grandfather recently passed away in Florida. His second wife has refused to bury him in a plot that he purchased next to his first wife and has also refused to relequish property that was his first wife's and his mother (i.e. my biological grandmother and great grandmother). These items are of sentimental value and not worth much, but due to the strained relationship with the step-grandmother, she has refused to provide these items to me for distriburtion to the great grandchildren. Of importance, there was no will and my grandfather had Alzheimers.

My mother is 87 years old. She is of sound mind right now but her health is failing and of course at her age anything can happen. My sister is the executor of the will. When she passes on, there will be no fights about money or anything because my sister and I will be taking care of a brother and if there is any money (she doesn't have much) we will be using it to take care of him. At this time everything is in mom's name. I told my sister that I thought it would be better if mom changes her checks/accounts etc. to read my sister's name OR mom's name so there is no problem later. We did this when my mother in law started developing signs of alzheimers and it made things so much easier. Do you think this is the right thing to do? Is there anything else I should know about to help us with her estate when the time comes?

My wife will donate her kidney to me (her husbad) when i may need it, it could be now or 10 years from now.The problem is she was just diagnosed with alzheimers. Will i need a legal form now to insure that her wishes will be approved in the future when can't make that decision?

My stepdad has dementiaand was placed in a nursing home for two years. He stormed out of the nursing home in a fit of rage related to his dementia and walked back to my mothers apartment. When the nursing home staff caught up with him they tried to get him to return but when he said he did not want to return they told him he could never come back. My mother tells me that they have since revoked his Medicare eligibility so he must remain at home with her. He is incapapble of caring for himself, he is abusing my mom physically during his mood swings and he elopes frequently. They live on an extremely limited income in subsidized housing. Is there any way we can get him back into a nursing home?

We need to grant Power of Attorney to three people on behalf of one person. This is for financial decisions not emergency health situations. I understand that in health situations the agency would go to Person A, or if Person A is unable or unwilling to act, then Person B, etc. But for non-emergencies is it better to have 3 seperate POA's or one POA granting powers to 3 agents.

My mother was abused in a nursing home. I filed a lawsuit. I apparently signed as arbatration paper. Is that the end of it? What if I don't like was gets decided?

My 79 year old brother had an anyerism and suffered a stroke that severely disabled him both physically and mentally. His wife had him declared mentally incompetent and gained both power of attorney and legal guardianship.Three years have gone by and he's in fantastic physical shape and mentally has miraculously recovered and writes and communicates quite well. It takes a little longer to get the message to the mouth from the brain. But he does indeed get the message across. I hate to admit his memory is better than mine. The relationship between my brother and his wife has been estranged for a long time. They basically have lived separate lives. He says he doesn't belong, nor does he wish to remain, in his current environment and would like to go home, or possibly move closer to family. I spoke with his doctor, of over 30 years, who also thinks he should be home. But it seems to be more convenient for his wife to leave him where he is. She doesn't see him. Assistants at the facility take him for scheduled doctor visits. He has very few, if any, visitors since most of the family live outside the state. I have asked his wife if it could be possible to have my brother reevaluated. She stated she has done this. But there seem to be no records or knowledge of this having ever been done. Is there any way for me to help? Can the mentally imcompetent declaration be revoked? If so, how? Will this negate the power of attorney and guardianship rights of his spouse? What needs to be done to right a wrong.

A few months ago I went to an attorney for help. He informed of his fees and then stated for him to continue he would need a retainer fee of $1000.00. I gave him the retainer, and was to get back to him. After some thought, I decided I did not want to continue with him. I called him and informed him of my decision, and asked for the remainder to the retainer fee. He told me that I should continue with the process. This is my question, who do I write a proper letter asking him to discontinue the case and return the portion of the retainer that I gave to him?

My grandmother unknowingly signed a grant deed while on a visit to the doctor's office with my aunt a few months ago. My aunt's son is a notary, so he notarized it. We're appalled, but we're also at a loss of what to do. I understand there's Elderly Abuse, but how would we be able to prove such a thing happened?

My 90 yr. old mother in Florida has become incapacitated and needs 24 hour care. There are three adult children. My sister live close to my mother. I and my brother live 1,000 miles away. The three of us discussed care whereupon my sister immediately stated she would quit her job, move into my mother's house and provide this care, drawing a "salary" from my mother's social security.

My brother and I are not in agreement with this and wonder how we can account for expenditures by my sister.

Is the "salary" legal? Does my sister have to account for all expenditures?

conflicting Power of Attorneys between brothers

Mom has Alzheimer's. She set up POA before being diagnosed with son A as the POA (three years ago). Also before being diagnosed she decided to build a home with son A to move in and live with him. A few months ago, son B pressured her into setting up new POA designating him as POA. Two weeks later this POA for son B was revoked by attorney at her request. A month ago, she had a stroke and has been in nursing home since then. Son A enacted the POA then. Son B has been moving money around even though his POA had been revoked and will not return the money (40K) that is now needed to care for mom. He also opposed decisions about her care and requested an investigation from Adult Protective Services on false grounds that mother was not being cared for (she had not been declare incompetent until she had the stroke so son A was no legally responsible for anything). Son B is after the money. Son A is now living in the house build for him and his mom and worried that if somehow the POA was overturned if hw couldlose the house that is jointly owed.
