Findings Of Fact Petitioner Creola Moore requested a formal hearing after the required informal conference with a supervisor employed by Respondent Department of Health and Rehabilitative Services. On June 17, 1981 Creola Moore, a black female who lives alone, filed a Household Application for low income energy assistance. She was notified hat the application must be accompanied by a properly completed Medical Certification for Cooling. The medical certificate which she filed indicated that her health conditions did not require a controlled temperature to prevent adverse effects which would be life threatening.
Recommendation Based on the foregoing Findings of Fact and Conclusions of Law, the Hearing Officer recommends that a final order be entered by the Respondent Department of Health and Rehabilitative Services denying low income energy benefits to Petitioner. Findings Of Fact Petitioner is a single parent and the head of a household comprising herself and her two children. In her application, Exhibit 1, Petitioner lists her monthly income at $800. The accuracy of this figure was not contested at the hearing. Based upon this income Respondent determined Petitioner was not eligible for Low-Income Home Energy Assistance and denied her application. Petitioner does not contend that she was unfairly discriminated against or that Respondent failed to comply with the regulations determining eligibility for Low-income Energy Assistance payments. Petitioner's sole argument is that because she works to support her family she is denied these payments, while others who are too indolent to work are given these payments from the taxes Petitioner pays.
Findings Of Fact Upon consideration of the oral and documentary evidence adduced at the hearing, the following relevant facts are found: Petitioner timely submitted her application for home energy assistance and the respondent timely notified her that her application had been denied for the reason that her household income exceeded the limit for her household size. Petitioner Randolph resides with her fourteen year old daughter and receives Social Security income in the monthly amount of $522.00. For a household with two persons, the maximum monthly income consistent with eligibility for benefits under the Low-Income Home Energy Assistance Program is $474.00. Rule 10C-29.13(5)(a), Florida Administrative Code. Petitioner Randolph uses oxygen on a twenty-four hour daily basis, and needs to use air conditioning in her home due to a chronic pulmonary condition. This condition, as well as other physical ailments, results in substantial medical bills on a monthly basis.
Recommendation Based upon the findings of fact and conclusions of law recited above, it is RECOMMENDED that petitioner's application for benefits under the Low-Income Home Energy Assistance Program be DENIED. Findings Of Fact Petitioner Rosa Jackson requested a formal hearing after the required informal conference with a supervisor employed by Respondent Department of Health and Rehabilitative Services. On July 7, 1981 Jackson, a black female who lives alone, filed a Household Application for low income energy assistance. She was notified on July 5, 1981 that the application must be accompanied by a Medical Certification for Cooling, and she was requested to submit the certificate that had been forwarded to her. She failed to file the certificate, and another form was forwarded to her on September 3, 1981. No medical certificate has been filed. Petitioner stated at the Hearing that she had intended to mail it but never did. She did not have the required medical certificate with her at the hearing.

Findings Of Fact Petitioner Sidney Darden requested a hearing by a letter received in the office of Respondent on March 20, 1981. After the required informal conference with a supervisor in Respondent Department Petitioner requested a formal hearing. On January 28, 1981 Darden, a black male, filed a household application for low income energy assistance. No one in his household is handicapped or a migrant or migrant farm worker, and no one else in his apartment applied for the low income energy assistance. He lives in a fully subsidized housing project and receives a bill for use of electricity. By Notice of Application Denial mailed February 26, 1981 Petitioner was informed that his household was not vulnerable to rising heating costs. list of Housing Projects for Duval County, District 04, Housing Urban Development, shows that the project in which Petitioner lives pays the heating fuel (gas) and includes it in the rent which has not increased in 1981. At the hearing Petitioner did not dispute the evidence submitted by Respondent Department but explained that he or his mother paid the electric bill and that a fan operated by electricity was necessary to circulate the gas heat provided for his apartment and, without electricity, his apartment was cold. Action was taken by Respondent within 45 days of Petitioner's application, and he was promptly notified of the reason for denial of benefits.
Recommendation Based on the foregoing Findings of Fact and Conclusions of Law the Hearing Officer recommends that low income energy benefits be denied Petitioner. The Issue The issue presented for decision herein concerns the appeal by the Respondent Department of Health and Rehabilitative Services' denial of low energy assistance benefits to the Petitioner.
Findings Of Fact Based upon my observation of the witnesses and their demandor while testifying, documentary evidence received and the entire record compiled herein, I hereby make the following relevant findings of fact. Mrs. Borbala Batu submitted an application for home energy assistance to the Department of Health and Rehabilitative Services on November 26, 1983. (Respondent's Exhibit 1) On December 22, 1983, Respondent advised Petitioner by letter that in order to determine her eligibility for energy assistance, Petitioner must submit written verification of her income room 551 by providing a statement from that office; verification of cash from relatives or others for November, 1983 by providing a statement from the source, all of which must be received by Respondent on or before January 9, 1984. In that directive, Petitioner was further advised that she should call Respondent's Home Energy Unit Payments Worker, Bijan Jamkhu. (Respondent's Exhibit 2) Petitioner failed to respond to the request for verification of the additional information requested by Respondent and, by letter dated February 8, 1984, Respondent advised Petitioner that her application for assistance under the low income home energy assistance program was being denied pursuant to Sections 409.026 and 409.508, Florida Statutes, and Rules 10C-29.11 and 29.15, Florida Administrative Code. (Respondent's Exhibit 3) Respondent was able to independently determine that the Petitioner was receiving an amount ranging from $189 to $209 per month in 851 benefits. Upon independently learning of this amount, Respondent confronted Petitioner with that information and Petitioner reluctantly acknowledged that she was receiving benefits in the above amount. Further, Petitioner, through her spokesman, represents that Petitioner suffers from a language barrier and was unable to provide the information as requested by Respondent. In this regard, an examination of the documentary evidence herein reveals that the Petitioner submitted a completed application in detail and was advised by Respondent in the letter seeking additional information dated December 22, 1983 that Petitioner should call her Home Energy Unit payments Worker respecting her incomplete application. Based thereon, it is factually concluded that the Petitioner was not suffering from a language barrier to the point wherein she was unable to provide the requested information.
Recommendation Based on the foregoing findings of fact and conclusions of law, Petitioner's appeal of Respondent's denial of her application for low income' home energy assistance benefits be DENIED. Findings Of Fact Petitioner Christie Neilsen requested a hearing by a letter written on March 25, 1981. After the required informal conference with a supervisor in respondent Department Petitioner requested a formal hearing. On January 15, 1981 Neilsen, a white male, filed a Household Application for low in home energy assistance. No one in his household is a migrant or migrant farm worker, and no one else has applied for the low income energy assistance. He lives with his wife and receives a bill for use of kerosene for heating. By Notice of Application Denial mailed February 10, 1981 Petitioner was informed that he was denied assistance for the reason that his monthly income exceeded the maximum income for a household of his size. The action was taken by Respondent within 45 days of the application, and Petitioner was promptly notified of the reason for denial of benefits. Petitioner did not dispute the evidence presented by Respondent Department but was convinced the income limit by household size was unfair, especially since the price of fuel has increased. Under Rule 10 CER 80-11.D7, Determination of Eligibility Based on Income, Florida Administrative Code, and the applicable chart Petitioner Neilsen's household income exceeds the income limit of $418.00 for a household of two (2) persons.
Recommendation Based on the foregoing findings of Fact and Conclusions of Law the Hearing Officer recommends that low income energy benefits be denied Petitioner. Findings Of Fact Petitioner applied for benefits under the LIHEAP program in December 1984 with the assistance of Teresa Lopez, a friend who handles paperwork for him. Ms. Lopez sent the application to Respondent and it was received by Respondent on December 17, 1984 which was the deadline date for applications. Respondent returned Petitioner's application since it had not been dated prior to submission. Ms. Lopez then had Petitioner back date his application with the date December 13, 1984 and resubmit it. When it was received by Respondent this second time, it was after the December 17 deadline and was therefore rejected as late filed. The only deficiency in Petitioner's application when it was initially submitted and received on December 17 was that it was not dated.
Recommendation Based upon the foregoing, it is recommended that a Final Order be issued denying Petitioner's application for benefits. Findings Of Fact On November 1, 1983, Petitioner submitted Household Application for Home Energy Assistance on which he listed as income VA benefits in the amount of $118 per month; unemployment compensation of $597.12 per month; and cash from his family of $300-$400 per month. Petitioner is a one-member household. He was involved in a motorcycle accident in May, 1983, and has been unable to return to his job at Martin Marietta since that time. He received benefits of $160 per week from Martin Marietta's insurer from date of his accident until January 6, 1984, when his benefits were reduced to $80 per week because of his possible entitlement to Social Security disability benefits. Payments were suspended on January 13, 1984, pending Petitioner's submission to the insurance carrier a statement of continuing total disability (Exhibit 1). Petitioner acknowledged on the witness stand that he receives VA disability compensation which is mailed to his bank monthly; however, he testified he has authorized the diversion of those funds to pay debts he owes, so that money is not available to him for daily living expenses. The maximum monthly income a one-member household can receive and be eligible for home energy assistance is $405 (Exhibit 3).

Findings Of Fact Petitioner Robert William Stewart requested a formal hearing after the required informal conference with a supervisor employed by Respondent Department of Health and Rehabilitative Services. On June 17, 1981 Stewart, a white male who lives with his wife, filed a Household Application for low income energy assistance. He was notified on July 15, 1981 that the application must be accompanied by a Medical Certification for Cooling showing that his health condition or the health condition of his wife was life-threatening without cooling. No medical certificate has been filed to show a life-threatening condition, and in fact the medical certificate filed shows the statement relative to a life-threatening condition requiring cooling was purposefully blotted out before the physician signed the certificate.
Recommendation Based on the foregoing Findings of Fact and Conclusions of Law, the Hearing Officer recommends that a final order be entered by the Respondent Department of Health and Rehabilitative Services denying low income energy benefits to Petitioner.
