BILL SALTER OUTDOOR ADVERTISING vs. DEPARTMENT OF TRANSPORTATION, 82-002999 (1982)

Findings Of Fact On June 19, 1981, Bill Salter Advertising entered into a lease with G. L. Atwell to erect signs on the Atwell property which is adjacent to Interstate Highway 110. This lease gave Bill Salter permission to erect outdoor advertising signs at the location .78 miles north of SR 289A on the west side of Interstate Highway 110, inside the city limits of Pensacola. The term of this lease was from June 1981 to June 1982, renewable with $100 per year rental until the signs were erected, and then increasing to $200 per year thereafter, giving both parties certain rights of cancellation. On May 28, 1982, Bill Salter applied to the Department of Transportation for permits to erect signs, one facing north and one facing south on the Atwell property .78 mile north of SR 289-A, and also submitted an affidavit to cancel permits for sign locations facing north and south, .55 mile south of SR 296. These documents were received by the Department on June 1, 1982. By letter dated June 21, 1982, the Department denied the application of Bill Salter Outdoor Advertising for permits to erect signs at the location .78 mile north of SR 289A on the west side of I-110 because of a spacing conflict. Both the application and the affidavit to cancel permits at .55 mile south of SR 296 were returned to Bill Salter Advertising with the denial letter. The spacing conflict requiring denial of this application was an application from Lamar Advertising Company for a location just south of the proposed Bill Salter site, which had received field approval but not final approval because it was also in conflict with another location. However, all of these conflicts have now been resolved, and there are presently no permitted locations within a thousand feet of the proposed Bill Salter location at .78 mile north of SR 289A. On July 9, 1982, T & L Management entered into a lease with James A. McKinney to erect a sign on the McKinney property which is adjacent to I-110. This lease gives T & L Management permission to erect advertising signs at a location .6 mile south of SR 296 (Brent Lane) on the west side of I-110. The lease is for a period of 10 years, giving both parties certain rights of cancellation, with an annual rental of 8300. On July 12, 1982, T & L Management applied for permits to erect signs facing north and south on the McKinney property, .6 mile south of SR 296. The T & L application was received by the Department on July 14, 1982. T & L's application for the .6 mile location shows the distance from the right-of-way as 15 feet; however, the McKinney property is actually located more than 50 feet from the limited access fence which is the highway right-of-way. The application was denied and returned to T & L Management because the .6 mile location was in spacing conflict with permits held by Bill Salter Outdoor Advertising for a location .55 mile south of SR 296 on the west side of I-110. Another lease was entered into between Bill Salter Outdoor Advertising and T. R. Pledger for a location approximately .55 mile south of SR 296. This lease was signed by Mr. Pledger during the summer of 1982, to be effective from March 1, 1982. Payments were made to Mr. Pledger's mother-in-law, Ms. Reeves, who lived on this property located 150 to 200 feet from the interstate right-of- way. Bill Salter applied for and received permits to erect signs at this location, and his application showed the distance back from the right-of-way to be 15 feet. However, it is the usual practice in this locale to indicate the minimum distance required, and locate the sign at a greater distance from the highway right-of-way. Bill Salter Outdoor Advertising cancelled its permits for the location .55 mile south of SR 296 on I-110, by affidavit executed on March 10, 1983. These permits were in conflict with the Salter application at .78 mile, and with T & L's application at .6 mile. Currently T & L's application at the .6 mile location is in conflict with Bill Salter's application at the .78 mile location. Bill Salter's permit application was received by the Department on June 1, 1982, and T & L's permit application was received by the Department on July 14, 1982. Both parties have permission of the property owner in the form of leases to erect outdoor advertising signs at these locations. At the time permit applications were submitted by Bill Salter and T & L during 1982, the Department did not require that written permission of the property owners be submitted with the application, and this policy of the Department continues to the present. However, every applicant is required to certify on the application "...that the sign meets all the requirements of Chapter 479 of the Florida Statutes." Also, where a permit application is denied and a cancellation affidavit had been submitted with the application, it is Department policy to return both the application and the cancellation affidavit unprocessed.

Recommendation From the foregoing Findings of Fact and Conclusions of Law, it is RECOMMENDED that the application of T & L Management, Inc., for permits to erect signs facing north and south on I-110 .6 mile south of State Road 296 in Escambia County, be DENIED, and that the application of Bill Salter Outdoor Advertising for permits to erect signs facing north and south on I-110, .78 mile north of SR 289-A in Pensacola, Escambia County, Florida, be GRANTED, subject to authorization from the City of Pensacola to erect signs at the .78 mile location. LAMAR ADVERTISING COMPANY vs. BILL SALTER ADVERTISING, INC., AND DEPARTMENT OF TRANSPORTATION, 82-001444 (1982)

Findings Of Fact There are four sign locations involved in this case. The first is on the property of J. S. Lee and is located 0.5 mile west of State Road 89 on the south side of U.S. 90 in Santa Rosa County. The second site is located 30 to 35 feet west of the Lee property and is also described as being miles west of State Road 89 on the south side of U.S. 90. The third location is described as 0.6 miles west of State Road 89 on the south side of U.S. 90, fifteen (15) feet from the right of way of U.S. 90. The fourth location is within the vicinity of 0.6 mile west of State Road 89 on U.S. 90, and is also described as 10.6 miles east of the Escambia County line in Santa Rosa County, Florida. U.S. 90 is a Federal-Aid Primary Highway. On February 25, 1982, Bill Salter Advertising, Inc., entered into a lease agreement with J. S. Lee to erect a sign on his property adjacent to U.S. This lease gave Bill Salter permission to erect outdoor advertising signs at the location 0.5 mile west of State Road 89 on the south side of U.S. 90 in Santa Rosa County. On February 25, 1982, Bill Salter Advertising, Inc., applied to the department of Transportation for a permit to erect a sign on the Lee property at 0.5 of a mile west of State Road 89 on U.S. 90, facing east. On March 10, 1982, Bill Salter Advertising, Inc., made application to the Department of Transportation for a permit to erect an outdoor advertising sign on the Lee property at 0.5 of a mile west of State Road 89 on U.S. 90, facing west. Subsequent to the filing of these applications by Bill Salter Advertising, Inc., a representative of the Department of Transportation advised an employee of Bill Salter Advertising, Inc., that the application for the outdoor advertising sign facing east could be approved, but that the Department could not approve the application for the sign facing west. Notwithstanding this representation, the Department of Transportation disapproved both applications submitted by Bill Salter Advertising, Inc., for permits to erect two signs at 0.5 of a mile west of State Road 89 on U.S. 90, facing east and west. On February 25, 1982, Bill Salter Advertising, Inc., executed a permit cancellation affidavit to cancel a permit for a ten foot by thirty-two foot outdoor advertising sign, tag number 2156-8, located on U.S. 90 approximately 10.6 miles east of the Escamhia County line. This location is close to the location known as .6 miles west of State Road 89 on U.S. 90. This permit was cancelled so that Bill Salter could apply for permits to erect outdoor advertising signs at 0.6 mile west of State Road 89 on U.S. 90. On February 25, 1982, Bill Salter Advertising, Inc., made application to the Department of Transportation for permits to erect signs located 0.6 mile west of State Road 89 on U.S. 90, facing east and west. This property located at .6 miles west of State Road 89 on U.S. 90 is owned by William O. Salter, and has been owned by him at all times pertinent to this proceeding. On January 1, 1973, William O. Salter leased this property to Bill Salter Advertising, Inc., to erect outdoor advertising signs thereon. Subsequent to the application filed by Bill Salter Advertising, Inc., for two permits to erect signs located at 0.6 mile west of State Road 89 on U.S. 90, facing east and west, an employee of Bill Salter met with a representative of the Department of Transportation to ascertain the exact location of the signs to be erected at 0.6 mile west of State Road 89. At this meeting the employee of Bill Salter Advertising, Inc., showed the Department's representative exactly where the proposed signs would be located. When Bill Salter Advertising, Inc. cancelled its permit at a location close to 0.6 mile west of State Road 89 on U.S. 907 and applied for two permits at an exact location 0.6 mile west of State Road 89 on U.S. 90, Bill Salter had not removed its sign at the cancelled permit location. Based upon this fact, the Department of Transportation initially returned the permit application to Bill Salter Advertising, Inc., because of the policy of the Department that all existing structures had to be removed before new permits could be issued. Subsequently, the Department of Transportation changed this policy with respect to removal of signs, and determined that Bill Salter Advertising, Inc., could have its permit application approved at 0.6 mile west of State Road 89 on U.S. 90, even though it had not removed its sign at the location where it had requested the permit cancellation. The application for permits submitted by Bill Salter Advertising, Inc., was received by the Department of Transportation on February 29, 1982. On March 15, 1982, the Petitioner, Lamar Advertising Company, submitted its application for permits to erect two outdoor advertising signs located 0.5 mile west of State Road 89 on U.S. 90, facing east and west. The Department of Transportation made the determination that the application submitted by Bill Salter Advertising, Inc. , for permits located 0.6 mile west of State Road 89 on U.S. 90 was received before the permit applications submitted by the Petitioner, Lamar Advertising Company, for locations at 0.5 mile west of State Road 89 on U.S. 90. In addition, the Department determined that the prior submission of the Salter application precluded approval of the application submitted by the Petitioner, Lamar Advertising Company, beacuse of the 500 foot spacing requirements on Federal-Aid Primary Highways. Based upon these determinations, the Department of Transportation denied the application submitted by the Petitioner, Lamar Advertising Company and approved the application submitted by Bill Salter Advertising, Inc.

Recommendation From the foregoing Findings of Fact and Conclusions of Law, it is RECOMMENDED that the application of Lamar Advertising Company for permits to erect signs facing east and west on U.S. 90, 0.5 miles west of State Road 89 in Santa Rosa County, be DENIED. The Issue Whether the subject signs of Respondent should be removed.

Findings Of Fact A notice of violation and a notice to show cause was sent to the Respondent, Harry Moody Signs and delivered on September 13, 1977 alleging violations of Chapter 479, Florida Statutes and violations of Rule 14-1O.4. The violation notice was marked Petitioner's Composite Exhibit 1 and entered into evidence. The notice cited six signs and for clarity the Hearing Officer numbered the signs from one through six on the violation notice. Testimony and evidence was taken on each sign as follows: Sign One: This sign was withdrawn from consideration by consent of both parties. Sign Two: The parties agreed that a permit would be issued for this sign within the city limits of Weeki-Wachee, Florida providing it was removed from the state's right-of-way and moved back some 51 feet. Sign Three: This double faced sign has no permit. The sign consists of a small sign stating "This is Beacon Country" which is attached to and on the top of a large sign that states "See ten different models, Beacon Woods, Beacon Homes by Hoeldtke"; on the poles at the bottom of the signs is a third sign reading "P G A Golf-Restaurant- Shopping Turn Right." Sign Four: This sign has an expired 1972 permit tag attached to it. Sign Five: This sign has no current permit tag attached thereto. Sign Six: This sign has no current permit or 1974 tag attached thereto. The Respondent admitted that this sign was in violation of the outdoor advertising law. The Respondent disclaimed any interest in Sign One and the Petitioner moved to withdraw the charges. Sign Two is located on the state's right-of-way and is within the city limits of Weeki-Wachee. It was stipulated that the sign would be removed or relocated within 20 days from date of the hearing but the Respondent has not so notified the Hearing Officer of removal. The double faced sign marked as Sign Three was the subject of argument by both attorneys who requested to submit & memorandum of law as to whether the sign was in violation of Section 479.16(3). No memorandum of law has been received from either attorney although the 30 days allotted to submit said memorandum has expired. Signs marked Four and Five have no current permit tag attached thereto. The Respondent admitted that there was no current permit for Sign number Six and the sign was in violation. The parties agreed that the sign may not be eligible for a permit.

Recommendation Remove each of the subject signs designated; Sign Two, Three, Four, Five and Six. Invoke the penalties provided for by Section 479.18 to wit: "479.18 Penalties. - Any person, violating any provision of this chapter whether as principal, agent or employee, for which violation no other penalty is prescribed, shall be guilty of a misdemeanor of the second degree, punishable as provided in Sec. 775.083; and such person shall be guilty of a separate offense for each month during any portion of which any violation of this chapter is committed, continued or permitted. The existence of any advertising copy on any outdoor advertising structure or outdoor advertising sign or advertisement outside incorporated towns and cities shall constitute prima facie evidence that the said outdoor advertising sign or advertisement was constructed, erected, operated, used, maintained or displayed with the consent and approval and under the authority of the person whose goods or services are advertised thereon." Findings Of Fact The Respondent's sign which is the subject of this proceeding was erected on Bennett Road, approximately 280 feet north of the intersection of Bennett Road with State Road 50, in Orange County, Florida. This location is approximately 1.4 miles west of SR 436, as alleged in the violation notice. The subject sign is located on the west side of Bennett Road facing north and south which is parallel to State Road 50. State Road 50 is a federal-aid primary highway. Bennett Road is a non-controlled road. The parties stipulated that it was the position of personnel of the Fifth District of the Department of Transportation prior to May of 1985 that state permits for outdoor advertising structures were not required when such structures were to be erected on a non-controlled highway, although said structures might be within 660 feet of a federal- aid primary highway. In 1984, the Respondent had applied for a permit to erect a sign along a non-controlled road within 660feet of a federal-aid primary highway, and had been advised by Department personnel that a state permit was not required (See Case No. 85- 3017T which was heard contemporaneously with the subject case). The sign which is the subject of this proceeding was erected without a permit based on the Respondent's knowledge of the Department's position that a permit was not required, as expressed to the Respondent previously in 1984. The subject sign is visible to traffic on State Road 50, although it is perpendicular to Bennett Road and parallel to State Road 50. There is another permitted sign owned by National Advertising Company located on the north side of State Road 50, east of the Bennett Road intersection, approximately 114 feet from the subject sign. The National sign faces east and west, not north and south, and it is not on Bennett Road. Another permitted sign owned by Peterson Outdoor Advertising is located on the north side of State Road 50, approximately 475 feet west of the Bennett Road intersection. This sign faces east and west, not north and south as the subject sign does, and it is not on Bennett Road as the subject sign is.

Recommendation Based upon the foregoing Findings of Fact and Conclusions of Law, it is RECOMMENDED: That the charges against the Respondent, Peterson Outdoor Advertising Corporation, in the violation notice issued on August 21, 1985, be dismissed, and that the sign which is the subject of this proceeding be given the classification of non-conforming sign. The Issue Whether the outdoor advertising signs of Respondent are in violation of Florida Statute 479.07(1), sign being erected without a State permit. Whether the subject signs are in violation of the setback requirements of Section 479.11, Florida Statutes. Whether subject signs are new and different signs inasmuch as they have new copy, are materially elevated from the location of the previous signs and have catwalks and lights added, thus requiring a new application and permit. Whether subject signs are in violation of federal and State laws, rules and regulations and should be removed. Whether the federal regulations adopted in Section 479.02, F.S., would have to be adopted as a rule under Chapter 120, F.S.

Findings Of Fact The Respondent sign company has a sign located approximately 12.81 miles north of Dunn Avenue on the east side of I-95 facing south containing the following copy: "Ramada Inn Exit 7 Miles U.S. 17" The sign was increased in height from under ten (10) feet to twenty feet from the ground to the bottom of the sign, lights were added, and the catwalk was added to accommodate the change in advertisers. This extensive alteration was done in June of 1975 and copy was changed. The original sign was erected in May of 1968 and advertised "Shell Oil." Respondent sign company has a sign located approximately 8.81 miles south of Bowden Road on the west side of I-95 facing north and containing the following copy: "Family Inn of St. Augustine" The revised sign is located in an area zoned open rural, has been elevated and has had lights and catwalk added. The original sign had different copy and was erected and permitted in October of 1968. Permits had been issued for the two subject signs in the approximate location with different copy on them in October of 1968 or shortly thereafter. The new advertisers wanted the signs lighted and pay approximately $30 more per month for the lighted signs. The new signs now are much more visible. Both signs were elevated approximately ten (10) feet, new copy put on them and lights and catwalks added in April of 1976. Permits were applied for but the Petitioner Department of Transportation refused to issue permits stating that they were new signs, no new applications had been made and were obviously ineligible for permits inasmuch as the signs violated the setback requirements of Chapter 479 and the federal laws, rules, and regulations adopted by the Florida Legislature.

Recommendation Remove subject signs if said signs have not been removed by the owner within ten (10) days after entry of the final order herein, as no applications for permits were made or granted. Findings Of Fact The Petitioner has applied for a permit, and proposes to erect an outdoor advertising sign on the north side of SR 424A, 650 feet east of I-4, in Orange County, Florida. State Road 424A is also known as Fairbanks Avenue. This location is within 660 feet of Interstate 4, and the proposed sign would be visible to traffic on I-4. The Department of Transportation has issued a permit to Peterson Outdoor Advertising for an outdoor advertising sign located approximately 375 feet from the Petitioner's proposed signsite on the same side of I-4, and a sign has been erected by Peterson Outdoor Advertising at this point.

Recommendation Based upon the foregoing Findings of Fact and Conclusions of Law, it is RECOMMENDED that the application of Cory Outdoor Advertising, Inc., for a permit to erect an outdoor advertising sign on the north side of SR 424A, 650 feet east of I-4, in Orange County, Florida, be denied. The Issue The issues in this case are whether the Department of Transportation properly issued a Notice of Violation for an illegally erected sign to Lamar of Tallahassee and whether the Petitioner's applications for a sign maintained at the corner of SR366/West Pensacola Street and Ocala Road, in Tallahassee, Leon County, Florida, should be granted as a non-conforming sign or because the Department did not act on either the 2005 or 2007 application for the same sign in a timely manner.

Findings Of Fact Under Chapter 479, Florida Statutes, the Department is the state agency responsible for regulating outdoor advertising signs located within 660 feet of the state highway system, interstate, or federal-aid primary system. Lamar owns and operates outdoor advertising signs in the State of Florida. On March 15, 2005, Lamar applied for a permit from the Department to erect the subject sign. The permit was denied because it was within 1,000 feet of another permitted sign owned by Lamar that is located on SR366/West Pensacola Street. The review process for Lamar’s application for a sign permit involved a two-step process. Initially, Mr. Strickland, the State Outdoor Advertising Administrator, reviewed Lamar’s application. He determined that the sign was within 1,000 feet of another permitted structure. On April 12, 2007, he preliminarily denied Petitioner’s application, prepared the Notice of Denied Application reflecting a denial issuance date of April 12, 2005, and entered his preliminary decision on the Department’s internal database. On the same date, Mr. Strickland forwarded the permit file along with his preliminary decision and letter to his superior, Juanice Hagan. The preliminary decision was made within 30 days of receipt of Lamar’s application. Ms. Hagan did not testify at the hearing. However, at some point, Ms. Hagan approved Mr. Strickland’s preliminary decision and entered the official action of the Department on the Department’s public database. That database reflects the final decision to deny the application was made on April 20, 2005, outside of the 30 days of receipt of Lamar’s application. On the other hand, Ms. Hagan signed the Notice of Denied Application with an issuance date of April 12, 2005. Her signature indicates that her final approval, whenever it may have occurred, related back to April 12, 2005, and was within 30 days of receipt of Lamar’s application. Lamar received the Department’s letter denying its application, along with the return of its application and application fee. The letter contained a clear point of entry advising Lamar of its hearing rights under Chapter 120, Florida Statutes. However, Lamar did not request a hearing concerning the denied application as required in Florida Administrative Code Rule 14-10.0042(3). Nor did Lamar inform the Department’s clerk in writing that it intended to rely on the deemer provision set forth in Section 120.60, Florida Statutes. Absent a Chapter 120 challenge to the Department’s action, the Department’s denial became final under Florida Administrative Code Rule 14-10.0042(3). After the denial, Lamar performed a Height Above Ground Level (HAGL) test on the proposed sign’s site. The test is used to determine whether the sign face can be seen from a particular viewing location. Lamar determined that the South face could not be seen from SR366/West Pensacola Street due to some large trees located along the West side of Ocala Road and behind the gas station in front of the sign. Pictures of the area surrounding the sign’s proposed location, filed with the 2005 permit application, show a number of trees that are considerably taller than the roof of the adjacent gas station and utility poles. These trees appear to be capable of blocking the view of the sign face from SR366/West Pensacola Street and support the results from Lamar’s HAGL test. Since the sign could not be seen from a federal aid highway, it did not require a permit. Therefore, around August or October 2005, Lamar built the subject sign on the west side of Ocala Road and 222 feet north of SR 366/West Pensacola Street in Tallahassee, Leon County, Florida. As constructed, the sign sits on a large monopole with two faces, approximately 10 1/2 feet in height and 36 feet wide. The sign’s height above ground level is 28 feet extending upwards to 40 feet. The north face of the sign does not require a permit since it can only be seen from Ocala Road. Likewise, at the time of construction and for some time thereafter, the south face of the sign did not require a permit since it was not visible from a federal aid highway. Following construction of the subject sign, some of the large trees were removed. The removal caused the south face of the sign to be clearly visible from the main traveled way of SR366/West Pensacola Street. On March 21, 2007, the sign was issued a Notice of Violation for an illegally erected sign because it did not have a permit. The Notice of Violation stated: YOU ARE HEREBY NOTIFIED that the advertising sign noted below is in violation of section 479.01, Florida Statutes. An outdoor advertising permit is required but has not been issued for this sign. The Notice cited the wrong statute and, on June 12, 2008, an amended Notice of Violation for an illegally erected sign was issued by the Department. The Amended Notice changed the statutory citation from Section 479.01 to Section 479.07, Florida Statutes. Both the original Notice and Amended Notice stated the correct basis for the violation as: "An outdoor advertising permit is required but has not been issued for this sign." On December 18, 2007, Lamar submitted a second application for an Outdoor Advertising permit for an existing sign. The application was denied on January 8, 2008, due to spacing conflicts with permitted signs BX250 and BX251. The denial cited incorrect tag numbers for the sign causing the spacing conflict. The incorrect tag numbers were brought to the attention of Mr. Strickland. The Department conducted a field inspection of the sign’s area sometime between December 20, 2007 and January 20, 2008. The inspection confirmed that the spacing conflict was caused by signs BZ685 and BZ686. The signs were within 839 feet of the subject sign and owned by Lamar. An Amended Notice of Denied Application was issued by the Department on January 24, 2008. However, the evidence was clear that the Department made the decision to deny the application based on spacing conflicts on January 8, 2008. The fact that paperwork had to be made to conform to and catch up with that decision does not change the date the Department initially acted upon Lamar’s application. Therefore, the 2007 application was acted upon within 30 days. The Department’s employee responsible for issuing violation notices is Lynn Holschuh. She confirmed that if the south sign face was completely blocked from view from the main traveled way of SR366/West Pensacola Street when it was originally constructed, a sign permit would not be required from the Department. Ms. Holschuh further testified that if a change in circumstances occurred resulting in the subject sign becoming visible from the main traveled way of Pensacola Street, the sign might be permitted by the Department as a non-conforming sign, if it met the criteria for such. In this case, the south face of the sign was once legal and did not require a permit because several large trees blocked the sign’s visibility from a federal aid highway. The removal of the trees that blocked the sign caused the sign to become visible from a federal aid highway. In short, the south sign face no longer conformed to the Florida Statutes and Rules governing such signs and now is required to have a sign permit. However, the sign has not been in continuous existence for seven years and has received a Notice of Violation since its construction in 2005. The evidence was clear that the sign does not meet the requirements to qualify as a nonconforming sign and cannot be permitted as such. Therefore, Petitioner’s application for a sign permit should be denied and the sign removed pursuant to the Notice of Violation.

Recommendation Based on the foregoing Findings of Fact and Conclusions of Law, it is: RECOMMENDED that the Department of Transportation enter a final order denying Petitioner a permit for the sign located on the west side of Ocala Road, 222 feet North of SR366/West Pensacola Street and enforcing the Notice of Violation for said sign and requiring removal of the south sign face pursuant thereto. The Issue Whether the signs of Respondent should be removed for violating the spacing requirements of Florida Statutes and State Laws, Rules and Regulations.

Findings Of Fact An application for a permit was filed by the Respondent, Lamar-Citrus Outdoor Advertising, for a location and construction of a billboard sign. The application designated U.S. 41 not within the city limits in the county of Lee. The nearest highway intersection was designated as Bonita Beach Enterance, Highway 865 and 1200 feet North from the intersection. The permit was approved May 13, 1976, and the approval designated the sign location as "Sec 309N 01.32 15R f/s." The direction that the sign would face was checked. The lighted block was not checked. Thereafter a 12 x 25 double-face lighted sign was erected by the Respondent on the West side of United States Highway 41, a four-lane highway. On May 2, 1977, the Petitioner, Department of Transportation, issued an "alleged violation of Chapter 479, Florida Statutes, and Notice to Show Cause." The violation notice stated "Signs were approved in this section, but they were for 309 North, not South." Petitioner requested an administrative hearing. Petitioner contends: he properly constructed his signs pursuant to his application and the permit issued by the Respondent. He contends that the spacing problem is caused by another outdoor advertising sign and not his own. Petitioner further contends that the application forms have been changed to clarify the location of signs since his application was filed and his permit was granted. Respondent contends: that Petitioner failed to locate his sign in the location for which he applied and for which the permit was issued; that because of the failure to properly locate his sign, his sign is in an unpermitted location and is an unpermitted sign; that Petitioner's sign is in violation of the spacing requirements of Section 479.02(2) inasmuch as a properly permitted sign is within 200 feet of Petitioner's sign; that the Petitioner has been applying for and has been granted permits for outdoor advertising along the highways of the State of Florida for at least nine and a half years and that the same method of describing the location for the construction of billboards has been used by the Respondent and has been used by the Petitioner and that it is a logical and practical way to describe a permitted location for a sign along a highway; that it is true that new forms are being used to further clarify the position of signs but that the application form used by the Petitioner when applying for the sign and obtaining a permit for the subject sign is clear on its face and the method of location has been well known to the Petitioner for many years. Upon observing the demeanor of the Petitioner and Respondent and listening to the testimony of the witnesses and argument of counsel, the Hearing Officer further finds 1) the Petitioner knew or should have known that the area in which he was permitted to erect a sign was East of the highway inasmuch as the location and construction form expressly stated that the nearest highway intersection was Number 865 and that the direction from the intersection was North. The permit states Sec. 309 North and indicated the sign faces South. A driver of a vehicle going North from the intersection must be in the right hand two lanes of U.S. 41 and that to proceed 1200 feet a sign would be on the right hand or the East side of the four lane highway. The "modus operandi" for location of signs is statewide and well known to the Petitioner as well as the Respondent. To ascertain a location on the West side opposite the area in which the Respondent approved for Petitioner's sign would have required a vehicle to travel North in the South bound lanes of U.S. 41 in order to drive the distance from the stated intersection to the location. Throughout the state the sections are usually designated on the permits so that they show the direction in which to drive, North, South, East or West. The signs are located on the right side of the highways as the vehicle travels.

Recommendation Require the Petitioner to remove the subject sign or remove it at the expiration of appeal time. DONE and ENTERED this 12th day of January, 1978, in Tallahassee, Florida. DELPHENE C. The Issue Whether a sign owned by Henderson Sign Company located approximately one- tenth of a mile east of the junction of State Road 73 and U.S. 90 containing as old copy "Key Drug Center" and new copy "Best Western Motor Inn" is in violation of the permit (Section 479.07(1) and (6), F.S.), spacing (Sections 479.02 and 479.111(2), F.S.), and setback (Section 479.11(1),F.S.) requirements.

Findings Of Fact The respondent owns and maintains an outdoor advertising structure adjacent to U.S. Highway 90 approximately one-tenth mile east of its intersection with State Road No. 73 within the corporate limits of the City of Marianna. This structure is a double billboard, with one advertisement for "Key Drug Center," erected in August of 1974, and the other for "Best Western Motor Inn" erected in April of 1976. It is located approximately five (5) feet from the edge of the sidewalk approximately 10 to 15 feet from the edge of the north side of Highway 90. At the time of the Respondent's erection of the first sign, he obtained a permit from the City of Marianna but not from Petitioner Department of Transportation. Before erection of the second sign, in 1976, the Respondent submitted an application to the Petitioner, but the application was denied. There is no other outdoor advertising structure bearing a properly issued permit from the Petitioner in existence within 500 feet from the Respondent's advertising structure although there is a non-permitted sign within 120 feet facing in the same direction. Petitioner has entered into evidence a copy of the zoning ordinance of Marianna, Florida. Petitioner contends: that the signs of Respondent violate the set-back, space and permit section of Chapter 479, Florida Statutes, and of The Governor's Agreement of 1972. Respondent contends: that the Petitioner has not proved where the edge of the right-of-way of Federal Highway 90 is located, that the other sign, if any, is not a lawful sign, having no permit, so the spacing violation, if any, is not enforceable and that the requirement of Chapter 479, Florida Statutes, does not apply to incorporated cities.

Recommendation Remove subject signs for violation of the 660 foot setback requirements of a federal aid highway, Section 479.11(1), and the spacing requirements of the Governor's Agreement of January 27, 1972. The zoning ordinance of Marianna, Florida does not show that there is effective control of outdoor advertising by the City of Marianna.
