Findings Of Fact Respondent holds Certificate No. 11680. The Complaint, Notice of Hearing, and receipt of certified mail were offered into evidence as requested without objection and marked Exhibit 1. Respondent failed to have her photograph with her certificate of registration after repeated warnings by the employee of the Board whose duty is to see that Chapter 477, F.S., and the rules and regulations promulgated thereunder are adhered to by those persons holding certificate of registration from the State Board of Cosmetology.
Findings Of Fact Respondent held a salon registration certificate at the time of this violation. The salon certificate of registration was not displayed inasmuch as the certificate was for a salon from which Respondent had moved and Respondent had not secured a certificate for the salon in which she was operating. Respondent has secured a certificate of registration to operate the beauty salon in which she is not operating. The Notice to appear, Complaint, and receipt for certified mail was entered into evidence as Composite Exhibit 1 without objection.

The Issue Whether Respondent's Deloris Overstreet license should be revoked, annulled, withdrawn or suspended for the reason that she failed to have or to display a certificate of registration.
Findings Of Fact At the time of the inspection by Ms. Artie Mitchell, Respondent had no certificate of registration. Ms. Mitchell left an application form with Respondent and Respondent procured the certificate of registration within fifteen (15) days thereafter. Ms. Overstreet, Respondent, has secured her certificate of registration and has it on display in the beauty shop owned by Respondent doing business as Dee's Beauty Boutique.
The Issue Whether the certificate of registration No. 866914 should be revoked, annulled, suspended or withdrawn for violation of Chapter 477, Florida Statutes, and the rules and regulations promulgated thereunder, for practicing without a license.
Findings Of Fact Receipt for certified mail notifying Respondent of this hearing was offered into evidence as Exhibit 1 and marked without objection. The Election of Remedies, a composite exhibit marked Exhibit 2, was entered as requested without objection. Respondent was charged for practicing cosmetology without a license. Respondent admitted the violation and submitted such plea to the Board which was included in the Board's Exhibit 1. After the violation for which Ms. Gould was noticed and for which this hearing is held, Respondent took the examination for master cosmetologists, passed the examination, and was issued a Florida license.

Findings Of Fact Based upon the record evidence, the following Findings of Fact are made: Respondent is now, and has been at all times material to the instant case, a State of Florida-licensed cosmetologist (license number CL 0127356) and the owner and operator of Marie's Beauty Salon, a State of Florida-licensed cosmetology salon (license number CE 0040980) located in Fort Lauderdale. Leonard Baldwin is an inspector with the Department. Baldwin has conducted various inspections of Marie's Beauty Salon. His last inspection was conducted on April 24, 1992. 2/ Nancy Victor is not now, nor has she ever been, licensed to practice cosmetology, or any specialty area thereof, in the State of Florida. Victor was hired by Respondent to work as a shampooist in Respondent's salon. Her first day of work was April 24, 1992. At around noon on that day the mother of a young customer walked into the salon to pick up her daughter. The daughter, however, was not ready to leave. She still had rollers in her hair. The mother was in a hurry. She approached Victor and asked her to remove the rollers from her daughter's hair. Victor obliged the mother and began removing the rollers. Respondent, who was working on the hair of a customer seated in the chair next to the one in which the daughter was seated, overheard the discussion between the mother and Victor. Respondent was aware that it was unlawful for a person to practice cosmetology in the State of Florida without a license. Furthermore, she knew that Victor did not have a license to practice cosmetology in this state. Nonetheless, inasmuch as she was busy with another customer and Victor did not have any shampooing that she needed to do, Respondent allowed Victor to remove the rollers from the daughter's hair. As Victor was removing the roller's from the daughter's hair, Baldwin entered the salon to conduct a routine inspection. When Respondent saw Baldwin, she instructed Victor to stop what she was doing and leave the area. Victor did what she was told and went to the rear of the salon. Respondent then went over to the daughter and finished removing the rollers from her hair.
Recommendation Based upon the foregoing Findings of Fact and Conclusions of Law, it is hereby RECOMMENDED that the Board of Cosmetology enter a final order finding that Respondent violated Section 477.029(1)(c), Florida Statutes, as alleged in the Administrative Complaint, and fining her $75.00 for having committed said violation. Findings Of Fact A copy of the Complaint with attached license, the certificate, and receipt for certified mail were entered into evidence as requested and marked Exhibit 1 without objection. Respondent entered a guilty plea, a copy of which was entered into evidence as requested without objection and marked Exhibit 2. Respondent Jackson did operate without a current registration required by Chapter 477, Florida Statutes. Respondent secured her master cosmetologist certificate within a time laps after the filing of this Complaint.
Findings Of Fact Respondent, Rhonda Welker, is a licensed cosmetologist operating under License No. CL0116241. Her original license was issued on November 24, 1980, and expired on June 30, 1982. On November 9, 1982, Respondent was employed as a cosmetologist, and acting as such, by Coiffures by Kenneth, a beauty salon owned and operated by Respondent's father and mother, located at 887 Semoran Boulevard, Apopka, Florida. At that time, her license had expired and was denied renewal by the Board because she had failed to take 16 additional hours of continuing professional education subsequent to issuance of her license, but instead had only taken eight. As a result, she did not meet the Board requirements for renewal of her license, which became inactive at the date of expiration. When Valerie Flowers, an inspector for the Board of Cosmetology, performed her follow-up inspection of the salon where Respondent worked, on November 17, 1982, she observed Respondent styling a customer's hair. At this time, though Respondent had completed the required 16 hours of continuing professional education, her license had not yet been renewed. Respondent Rhonda Welker's current license was issued on January 30, 1983, and expires on June 30, 1984. Respondent failed to secure the required 16 hours of continuing professional education on the honest but mistaken belief that she only needed eight hours' worth. She felt that since her licensure was initially issued for less than two full years, she would only need the eight hours of continuing education for one year, which she had. Under the circumstances, Respondent, Rhonda Welker, was holding herself out as a cosmetologist when she did not have an active current Florida cosmetologist's license.
Recommendation In light of the foregoing, it is, therefore, RECOMMENDED: That Respondent be ordered to pay an administrative fine in the amount of $50.
