The Issue The issue in this proceeding is whether the Department of Children and Family Services should revoke the foster care license of Joey and Donna Tolbert.
Findings Of Fact At all times material to this proceeding, the home of Joey and Donna Tolbert was licensed by the Department as a foster home. They were initially licensed provisionally in December of 1998 for one year. They received a regular license in 1999 and retained a regular license until December 1, 2000, when they were issued license number 1200-008-2, a child specific license with a capacity of two children. The Relicensure Process Prior to issuing the child specific license, two Department employees of the Department, Mary Martin, a relicensing counselor for foster homes, and Ann Brock, a family services counselor, conducted a relicensing visit to the Tolbert's home on October 12, 2000. Donna Tolbert was present but Joey Tolbert was out of town. During the home visit, a Bilateral Service Agreement (Agreement) was signed by Mrs. Tolbert and Ms. Martin. The Agreement was signed and dated by Mr. Tolbert and again by Ms. Martin on October 17, 2000. The relicensing visit resulted in a Foster Home Relicensing Summary written by Mary Martin. The Summary recommended that the Tolberts be issued a regular license effective December 1, 2000 through December 1, 2001, for the capacity of two children. The Summary was signed by Mary Martin on October 26, 2000, and read in pertinent part as follows: The Tolbert family is an invaluable asset to this Department. They have made themselves available on a regular basis for the placement of children when needed. Both Mr. and Mrs. Tolbert are experienced in childcare and they have three (3) children with special needs whom they adopted prior. They should not be asked to take numerous children with severe behavioral problems or teenagers. It appears Mr. and Mrs. Tolbert have satisfied the Florida Administrative Code, Chapter 65C-15, requirements. It is respectfully recommended that the Tolbert family be issued a REGULAR license, effective December 1, 2000, through December 1, 2001, for the a capacity of two (2) children, ages birth (0) through twelve (12) years of either gender. Children with severe behavioral problems and teenagers are not to be placed in the Tolbert home. However, Ms. Martin later wrote an addendum to the licensing summary. According to Ms. Martin, she was asked by her supervisor, Jill Green, to write the addendum. The addendum is undated but references the October 12, 2000, home relicensing visit that resulted in her original recommendation. There is also an entry dated October 16, 2000, which is a date prior in time to her signature to the original relicensure summary, and an entry dated November 17, 2000. The addendum relates to matters concerning the Tolberts and their adopted son, Mi.1/ Richard Messerly has worked for the Department for approximately 22 years and works in protective investigations in Pensacola. From June 1999 through September 2001, he was the program operations administrator for the central licensing unit of the Department. In that position, he had authority over foster care licensure. He supervised Mary Martin and her supervisor, Jill Green. Mr. Messerly signed Ms. Martin's relicensure summary on December 4, 2000, and initialed both pages of her addendum. He also created a written history of the Tolbert foster home which concluded with a recommendation that the Tolberts' foster home license be revoked: SUMMARY/RECOMMENDATIONS The Tolbert family has a positive licensing history of capably caring for many of our foster children. However, a serious change has occurred in the family's willingness to work with our staff, including rebuffing our attempts to offer them assistance with the disruption of an adoptive placement. The Tolberts have attempted to convince others that they had been requesting assistance for M for a very long period of time and that this is flatly not borne out in licensing records. The matter was never brought to our attention until the visit in October 2000, at which time the matter was promptly referred to the adoptions unit, who responded promptly. Since that time the family has not cooperated with any attempts to assist them in that matter, and they seem to be insensitive to M's plight, and are completely focused on regaining their prior licensed status, as if nothing had happened. Contacts with Pat Franklin, Kathi Guy, Sally Townsend and others reflect the absence of any prompt attempts to get help dealing with M's behaviors, yet many requests were made regarding foster children in their care with similar problems during the same time frame. It appears the family was more focused on attending the needs of foster children to the exclusion of sensitivity to their own (adopted) child's cries for help. Even when the needs were identified, the family was unwilling to become involved in attempts to remedy the problems and appeared to have given up on the child. I am very uncomfortable with the inappropriate position this family has taken in regard to our family safety staff, as well as licensing staff, and do not see how we can hope to interact positively with them given their recent radical behaviors and threats. I feel that they have violated the Bilateral Service Agreement and have failed to "Treat all members of the foster care team with respect and courtesy." I recommend that we revoke the license using the violation of the agreement in conjunction with their other oppositional behaviors, omissions, and misrepresentations reflected in family safety foster care and adoptions records. On December 1, 2000, Mr. Messerly signed a letter on behalf of Charles Bates addressed to the Tolberts which read: Dear Mr. And Mrs. Tolbert: Your home has been relicensed for the continuance placement of D and M.R. only. No other placements or overcapacity requests will be authorized at this time. A regular license is issued for twelve months pending the outcome of matters presently before the Circuit Court. If you have questions or wish to discuss this further, please contact Jill Greene, Foster Care Licensing Supervisor at (850)- 595-8451. On June 4, 2001, Mrs. Tolbert met with Charles Bates, District Administrator for District 1 of the Department. This meeting was at Mrs. Tolbert's request regarding her foster care licensure status. During that meeting, Mrs. Tolbert complained to Mr. Bates about certain adoption case workers. On August 24, 2001, Charles Bates sent a letter to the Tolberts notifying them of the revocation of their license. The letter reads in pertinent part as follows: RE: Revocation of Foster Home License. Dear Mr. and Mrs. Tolbert: This letter is to inform you that the Department of Children and Families has made a decision to revoke your foster home license. The basis for this decision is your failure to comply with Florida Administrative Code 65C-13 and the Bilateral Service Agreement (form CF-FSP 5226) which you executed. Florida Administrative Code 65C-13.009(1)(e)5. states: Work in a partnership. Develop partnerships with children and youth, birth families, the department, and the community to develop and carry out plans for permanency. Florida Administrative Code 65C-13.010(1)(c)1. states: Substitute care parents are expected to work cooperatively with the counselor as a member of a treatment team in seeking counseling, participating in consultation, and preparing and implementing the performance agreement or permanent placement plan for each child. Florida Administrative Code 65C-13.010(4)(i) states: The substitute care parents must be able to accept supervision by department staff and participate in and support case plans for children in their homes. Specifically, substitute care parents must be included in the development of performance agreements or permanent placement plans, and in the carrying out of these plans. As part of your foster care licensing, you executed a bilateral Service Agreement. The Bilateral Service Agreement that you signed enumerated the Administrative Code responsibilities and detailed responsibilities of foster parents. The paragraphs violated are listed below in pertinent part: h. To notify the department immediately of a potential change in a family composition, significant health changes or any other condition that may affect the child's well- being. Obtain authorization from the department prior to spending money for which repayment is expected. To accept the direction and supervision given by department to assist in caring for the foster child. To work cooperatively with the department to attend scheduled meetings to discuss the child and his family and to meet the needs of the child. To treat all members of the foster care team (i.e., the department, child's family, and GALS) with respect and courtesy. As stated in the service agreement, non-compliance with any of the above provisions can result in termination of the service agreement and may also result in the department revoking the home's license. You have failed to comply with the above code citations and service agreement provisions in that you have accused departmental staff of failing to disclose complete information to you and of misrepresenting statements that you have made. You have not worked cooperatively with the department employees who offered to assist you and your child; and have not worked in partnership with the department. Specifically, you have previously stated you were obtaining therapy for a child, didn't agree with the therapist's recommendation, and were obtaining a psychiatric evaluation and assessment for the child, when in fact you did not do any of those things. A review of the department records reflected concerns you mentioned to the department in October 2000, regarding your child's disruptive behavior. However you would accept no assistance even though the department offered extensive assistance. You surrendered your adopted child later that same month. Further, you have stated to a department employee that Ms. Peggy Custred and Ms. Sally Townsend should not work for the department, have accused them of wrongdoing, and have stated that you "will have their jobs." You have failed to treat members of the department with respect and courtesy. Given the above problems, I find that it would not be in the children's best interests to continue licensing your foster home and am permanently revoking your license. The Tolberts as foster parents The overwhelming evidence shows that the Tolberts were excellent foster parents. Jane Crittenden, licensing supervisor for the Department, who was a foster care supervisor at the times material to this proceeding, acknowledged that the Tolberts received the award of Foster Parents of the Year in May of 2000 for the year 1999. She also acknowledged that as far as she knew, the Tolberts excelled as far as their work as foster parents; the foster children in their care did quite well; the Tolberts always seemed to provide a loving, nurturing home to foster children placed there; the Tolberts were called on by the Department to take extra children beyond their cap, which they agreed to do; and the Tolberts cooperated with her and her case workers during the period of time she worked with them. Arlene Johnson, a former guardian ad litem for a foster child in the Tolberts' home from December 1998 until July 1999, visited the Tolbert home about twice a week during that time. She has been in a lot of foster homes and described the Tolberts' home as "the best one I've been in." Gerald Reese, a family service counselor for the Department, worked with the Tolberts over a period of 6 to 7 months in 1999 and 2000 while he was a case worker. During that time, Mr. Reese did not have problems dealing with the Tolberts, did not observe any instance in which the children were not adequately provided for, and observed that the foster children in the Tolberts' home were happy. Richard Messerly acknowledged that the Tolberts were exemplary foster parents as far as the care they provided to the foster children in their care. Mr. Messerly also acknowledged that the only staff the Tolberts had problems with were particular members of the adoption staff, not the Department's foster care staff. The wallpaper expense Carlita Bennett was employed by the Department from 1986 until March of 2002. When she was working for the Department in the capacity of a foster parent recruiter in May of 2001, she sent an e-mail message to Mary Martin regarding the Tolberts which contained the following: 11/04/99 A restitution claim form was submitted by Mrs. T for damage to wallpaper caused by 2 yr. Old. The bill total was $1,151.04 to replace wallpaper in living room, dining room, kitchen and hall. PS Counselors were not made aware of the damage until repairs were made. According to Ms. Bennett, it is regular procedure for someone from the department to go out to a foster home and look at damage before repairs are made. The Bilateral Services Agreement requires the foster parents to obtain authorization from the Department prior to spending money for which repayment is expected. According to Ms. Bennett, this policy was not followed in this instance. Ms. Bennett did not explain why she sent the e-mail message on May 30, 2001, to Mary Martin referencing an incident that took place two and one-half years earlier. According to Mrs. Tolbert, a former two-year-old foster child in her care ripped the wallpaper in the dining room and the living room. Her dining room, kitchen, and hallway are all one color. According to Mrs. Tolbert, she gave an estimate of the repair work to Shiela Campbell, an employee of the Department. Richard Messerly acknowledged that this matter of the expense for wallpaper would not in and of itself have resulted in the Department revoking the Tolberts' foster care license. At most, the Department would have only talked to the Tolberts had there not been other issues about which the Department was concerned. Notification to Department of change of condition The August 24, 2001, revocation letter from Mr. Bates alleged that the Tolberts failed to notify the Department of a potential change in conditions in the home that might affect the well-being of foster care children in the home. This allegation relates to behavior problems of the Tolberts' adopted son, Mi. The Tolberts adopted Mi. in September of 1998. They signed surrenders of Mi. in November of 2000. The Tolberts' surrender of Mi. was central to the Department's decision to revoke the Tolbert's foster care license.2/ Mi. began having serious behavior problems in 1999. Mrs. Tolbert recalls telling Gerald Reese, the foster care worker assigned to the Tolberts at that time, about problems with Mi. Mr. Reese acknowledged that Mrs. Tolbert mentioned to him problems she was having with Mi. to which he responded that she should bring it to the attention of the adoption case worker. The Tolberts' adoption case worker was Sally Townsend. Mrs. Townsend recalls that Mrs. Tolbert stopped by her office three times when Mrs. Tolbert was in the Ft. Walton Beach Service Center to see other department employees. Mrs. Townsend acknowledged that Mrs. Tolbert told her of behavior problems with Mi. the first time she stopped by Mrs. Townsend's office. The second time Mrs. Townsend recalls that Mrs. Tolbert told her Mi.'s behavior problems were better. The third time, however, Mrs. Tolbert informed Mrs. Townsend that Mi.'s behavior was much worse. Mrs. Tolbert remembers these encounters with Mrs. Townsend differently. According to Mrs. Tolbert, she met with Mrs. Townsend approximately 10 times during which she spoke to her about Mi.'s behavior problems. According to Mrs. Townsend's case notes, Mrs. Tolbert told her on October 24, 2000, that Mi. was urinating all over the house, had gotten a butcher knife out of a drawer in the kitchen, and shoved a puppy's head under a piece of furniture. Evidence was presented at hearing regarding whether or when the Tolberts received notice that Mi. had significant problems before he was adopted by the Tolberts. However, what is important for purposes of this proceeding is when was the Department notified of Mi.'s problems. The Department knew of Mi.'s previous problems prior in time to the Tolberts adopting Mi. and were told as early as 1999 that the Tolberts were experiencing behavior problems with Mi. Kathi Guy is an adoption program specialist for the department. She met with the Tolberts immediately after Mrs. Tolbert met with Mr. Bates on June 4, 2001. On June 21, 2001, she wrote a memorandum to Charles Bates concerning the issues relating to the Tolberts. Regarding the issue of the Tolberts' responsibility of notifying the Department of Mi.'s behavior in relation to the foster children in the home, Ms. Guy wrote, "It is unclear what responsibility the Tolberts had to inform Central Licensing of M's behaviors that may have had injurious effects on foster children in their care." Working in partnership The June 24, 2001, revocation letter alleges that the Tolberts failed to work in partnership with the Department and did not obtain certain services for Mi. although they were offered. It is important to remember that the provisions to which Mr. Bates' revocation letter references are part of the Bilateral Services Agreement that pertained to the Tolberts' role as foster parents. However, Mi. was their adopted son, he was not a foster child at that time. Further, there is ample evidence in the record that the Tolberts sought and received services for Mi. over time, although they were in disagreement with the Department regarding certain services during the time immediately preceding the surrender of Mi. Marianne Vance is a first grade teacher. Mi. was in her class for two years. According to Ms. Vance, Mi. received testing in school for learning disabilities and for "everything possible." When Mi.'s behavior problems became worse during his second year in Ms. Vance's class, Mrs. Tolbert sought assistance from the school. The school counselor worked with Mi. and Mrs. Tolbert. According to Ms. Vance, the Tolberts did everything possible in seeking help or assistance.
Recommendation Based upon the Findings of Fact and Conclusions of Law, it is RECOMMENDED: That the Department of Children and Family Services enter a final order rescinding its revocation of the Tolberts' foster care license. The Issue The issue is whether Petitioner may revoke Respondent's foster home license for her use of corporal punishment in violation of Rule 65C-13.010(1)(b)5.f, Florida Administrative Code.
Findings Of Fact Respondent has been a mother for 45 years. Five years ago, she became a foster parent because her children were grown and other children needed homes. As a foster parent, Respondent has cared for more than a dozen foster children. Due to an unrelated incident in the summer of 2001, Petitioner's representative counseled Respondent about the prohibition against the use of corporal punishment against foster children. At that time, Respondent signed a Therapeutic Foster Care Agreement, statement of Discipline Policy, and Agreement to Provide Substitute Care for Dependent Children. Each of these documents restates the prohibition against the use of corporal punishment. In March 2002, Respondent took her 10-year-old foster child in her care to a McDonalds restaurant to meet his mother, who had been forced to place him in foster care due to his aggressive behavior. The mother and her three daughters were at a table with Respondent, the foster child, and another child. The foster child began to misbehave and Respondent warned him that she was the law and, if he failed to behave, she would drop him off at the detention center. Respondent is a uniformed crossing guard and is employed by the St. Lucie County Sheriff's Office. In response to Respondent's warning to behave, the child replied, "You're not the law. You're just a crossing guard." Respondent slapped the foster child in the mouth. The force of the slap to the mouth did not cause the child to cry, but did leave a red mark. The mother reported the incident to Petitioner. In dealing with cases of corporal punishment administered to foster children, Petitioner does not invariably revoke the foster parent's license. Instead, Petitioner attempts first to determine the likelihood that the foster parent can be rehabilitated so as not to use corporal punishment. Among the factors justifying revocation are that Petitioner had recently reinforced the corporal punishment prohibition with Respondent, Respondent displayed a blatant disregard or ignorance of the policy by striking the child in front of his mother, and Respondent falsely denied the incident during the course of the investigation and at the hearing. In some respects, the last factor is the most serious because Respondent's lack of candor and remorse for the incident undermine the trust that Petitioner necessarily places in foster parents whom it licenses.
Recommendation It is RECOMMENDED that the Department of Children and Family Services enter a final order revoking Respondent's foster home license. The Issue Whether the Department of Children and Family Services (DCF) may revoke Respondent's family foster care license due to her continued contact with her husband after he was convicted of sexual molestation of their teen-aged daughter.
Findings Of Fact Lila and Charles Dean were licensed foster parents from 1986 through 1991, when they adopted their daughter who was then six years old. The couple subsequently had two natural daughters. In January 2001, the 16-year-old adopted daughter reported that Charles Dean had been sexually abusing her for approximately two years. Lila Dean immediately had Charles Dean move out of the family home. She has been consistently supportive of their daughter and went with her through the whole abuse and rehabilitation system. Charles Dean was convicted in 2001 of sexually abusing his adopted daughter and is a registered sex offender. Lila Dean has been separated from Charles Dean since January 2001, but she has not filed for divorce. On March 13, 2002, Lila Dean was relicensed by DCF as a family foster parent. George Payne, DCF Family Counselor III, testified that during the family foster home re-licensing process prior to March 13, 2002, Lila Dean admitted to him that she was seeing her husband away from the home once every two or three months to discuss child support, insurance, etc., and that he had no contact with the children. She also admitted that with the permission of his probation officer, Charles Dean had come to the home, while the children were at school, to make needed repairs. At Mr. Payne's urging, she promised to get someone else to make any future repairs. The licensing process took eleven months because of DCF's concerns about Mrs. Dean's contacts with her husband, but DCF licensed her individually on March 13, 2002, because of her previous excellent record as a foster parent in another district supervised by Mr. Payne from 1985 to 1989. On May 13, 2002, upon receiving an abuse report that Mrs. Dean had been having regular contacts with her husband; that Mrs. Dean had made comments in the community that Mr. Dean's sexual abuse was not that serious because the girl was his adopted, not his biological child; and that Mrs. Dean had spoken on Mr. Dean's behalf requesting that he be spared a prison sentence, DCF removed the two non-verbal, toddler, foster children who were then in Mrs. Dean's foster care and instituted a further abuse investigation. After the abuse report had been received regarding Mrs. Dean's 2002 contacts with her husband, she told Mr. Payne that she was not looking for a relationship with any other men because they might want a sexual relationship with her, but that sex was not an issue with her husband, so she felt comfortable with him. The abuse report, which related the couple's more frequent contacts, suggests the family is "working toward reconciliation," something Mrs. Dean has denied to Mr. Payne. The abuse report verifies the old abuse information as to the adopted daughter. It does not verify the tipster's allegation that Mrs. Dean does not view Mr. Dean's molestation of their adopted daughter as less serious than it would have been with a natural daughter. There is no direct testimony or otherwise reliable evidence on this issue, on the issue of whether or not she has spoken publicly on his behalf, or on the issue of whether or not a reconciliation is anticipated. There is no evidence that Charles Dean has been in the home since Lila Dean was relicensed. DCF sent a license revocation letter to Mrs. Dean after becoming aware of the increasing frequency of her contacts with her husband. The basis for revocation was given as: . . . pursuant to Section 409.175(8)(b)3. [now Section 409.175(9)(b)3] Florida Statutes, because your continued and repeated contacts with Charles Dean are inconsistent and incompatible with your role as a foster parent. It is not in the best interests of vulnerable foster children to be placed with a foster parent who considers it appropriate to have a relationship with a registered sex offender. [Clarification of statutory citation agreed-to and supplied]. Mr. Payne was unaware of any DCF rules Mrs. Dean broke by having contact with her husband. Mr. Payne has no indication that any children, natural or foster, were at greater risk post-licensing than pre- licensing due to Mr. And Mrs. Dean's increased contact. DCF cannot constantly monitor a foster parent to ensure that the children in her care are not placed at risk by her personal associations.
Recommendation Based on the foregoing Findings of Facts and Conclusions of Law, it is RECOMMENDED that the Department of Children and Family Services enter a final order reinstating the family foster home license of Lila Dean and specifically limiting any appearance on the foster home premises by Charles Dean. Findings Of Fact Petitioners are licensed by Respondent to provide foster care to children in Petitioners' home. Substantially prior to the incidents in question, Petitioners received written materials from Respondent confirming that the foster children at all times remain under the supervision and control of Respondent and that Respondent's discipline policy "[p]rohibits any form of corporal punishment ...." On at least two occasions during the latter half of 1992, a representative of Respondent reminded Petitioners of the policy against corporal punishment. Despite numerous reminders of Respondent's policy against corporal punishment in a foster care setting, on January 29, 1993, Vivian Griffin spanked a 2 and 1/2 year old boy who was in their foster care. He had soiled his diapers during a visit by Mr. and Mrs. Griffin to a commercial lender. As Mrs. Griffin removed him from the office, she threatened, "I'm going to take you outside and I'm going to take your pants down." She took the toddler to her van where she struck the boy at least five to ten times with her bare hand in the area of his buttocks. The incident drew the attention of two office workers, one of whom went out to the van and intervened. When asked by the office worker if she could help, Mrs. Griffin responded, "He shit in his pants." Petitioners' parenting skills are deficient. Mrs. Griffin in particular has a high frustration level with the young children who have been placed in their home. During one home visit by a representative of Respondent, Mrs. Griffin followed around a two year old who was exhibiting normally inquisitive behavior in her home. Rather than remove objects that the toddler should not have touched, Mrs. Griffin hovered over the child, inappropriately threatening at one point a two-minute timeout if the behavior persisted. Both Petitioners have displayed a strong lack of affection, considerable nervousness, and much agitation with the foster children who have been placed with Petitioners. At the same time, Mrs. Griffin constantly resisted help offered by Respondent's representatives and instead complained about these and other persons available to help her. Respondent has offered Petitioners free day care, parenting classes, and individual counselling. But Mrs. Griffin refused to go to the parenting classes or take the children to day care. She reluctantly attended one or two sessions of individual counseling, but soon quit going.

The Issue The issue is whether Petitioners' foster home license should be revoked.
Findings Of Fact At all times relevant to this proceeding, Petitioners were licensed to operate a family foster home. Their most current license was effective through April 7, 2004. Petitioners have served as foster parents for about five years. There has been no report of child neglect or child abuse in their foster home prior to the time period relevant here. A. H. is a 10-year-old male. At all times relevant here, A. H. was in the fourth grade. Sometime prior to October 3, 2003, Respondent removed A. H. from his mother's custody and placed him in an initial foster home. A. H.'s first foster home shall be referred to hereinafter as the Gs' foster home. Thomas Munkittrick worked for Respondent as a family service counselor. A.H. was one of Mr. Munkittrick's clients. A. H. had separate visitations with his mother and father on October 6, 2003. Mr. Munkittrick supervised both visits. During a visit to the Gs' foster home on October 14, 2003, Mr. Munkittrick noticed a rash on A. H.'s stomach. The rash appeared to be a ringworm. Mr. Munkittrick did not observe any bruises on A. H.'s arms. On or about October 15, 2003, Mr. Munkittrick spoke to Petitioners to determine whether they would accept A. H. in their home as a foster child. For reasons that are not clear, Respondent changed A. H.'s placement to Petitioners' foster home that same day. On October 16, 2003, Mr. Munkittrick took A. H. to see a medical doctor at Express Care of Belleview. Mr. Munkittrick and A. H.'s mother were present for the medical examination, during which A. H. removed his shirt. Mr. Munkittrick did not observe any bruises on A. H.'s arms. A. H.'s medical record dated October 16, 2003, indicates A. H. had a scratch/bruise on his nose, a ringworm on his stomach, and a rash on his wrist. According to the doctor's notes, A. H. reported that he accidentally injured his nose while playing football with Petitioners' dogs. The doctor's notes do not refer to any bruises on A. H.'s arms. On October 23, 2003, Mr. Munkittrick visited A. H. in Petitioners' home. Mr. Munkittrick saw no visible marks or bruises on A. H. Instead, Mr. Munkittrick observed what he believed was dirt on A. H.'s arms. Mr. Munkittrick also observed that A. H. was slightly flushed from playing outside with Petitioners' dogs, two large Doberman Pinchers. During a visit to Petitioners' home on October 30, 2003, Mr. Munkittrick observed multiple bruises on both of A. H.'s wrists and arms. The bruises were round and as large as quarters. There were no scratch or bite marks on A. H.'s arms. Prior to October 30, 2003, Petitioners had not advised Respondent about the bruises on A. H.'s arms. During the October 30, 2003, home visit, Petitioner R. B., the foster mother, indicated that she had never seen the bruises on A. H.'s arms before Mr. Munkittrick pointed them out. She relied on A. H. to explain how he was injured. During the hearing, Petitioner R. B. admitted that she saw blue/purple bruises on A. H.'s arms for the first time two or three days after his medical examination on October 16, 2003. Despite the inconsistency of Petitioner R. B.'s statements, the greater weight of the evidence indicates that Petitioner R. B. had no first-hand knowledge as to the cause of the bruises. Her testimony that she did not cause the bruises on A. H.'s arms is credible. On October 31, 2003, Mr. Munkittrick went to A. H.'s school to photograph the bruises on his arms. He then took A. H. for an examination by Respondent's child protection team. The examination included an evaluation of the bruises by an advanced registered nurse practitioner. The nurse was qualified by training and experience to assess pediatric injuries resulting from physical and sexual child abuse. The nurse was unable to reach a conclusion as to the exact source of the bruises. She could not rule out that they were self-inflicted. However, the nurse's testimony provides competent evidence that the bruises on A. H.'s arms were consistent with being grabbed by another person and that they were inconsistent with injuries resulting from roughhousing with dogs. Bruises heal in stages identified by colors beginning with red and ending with brown before they disappear. The colors of bruises in order of healing are red, blue, purple, green, yellow, and brown. In general, a bruise is: (a) red within one to two days of infliction; (b) blue within one to four days of infliction; and (c) yellow/green from the fifth or sixth day up to the tenth day after infliction. A. H.'s bruises ranged in color from red to yellow/green to yellow. The yellow and yellow/green bruises were located on both of A. H.'s upper extremities. He had two forearm bruises with a red component. It is highly unlikely that A. H. received the bruises prior to October 6, 2003. It is more likely that the injuries causing the bruises were inflicted approximately one to two weeks prior to October 31, 2003, i.e., between October 18, 2003, and October 31, 2003. A. H. was living in Petitioners' home and attending public school during this period. On the evening of October 31, 2003, Respondent's staff decided to move A. H. to a third foster home. Respondent's child protective investigator took A. H. back to Petitioners' home to pick up his clothes and belongings. Petitioner R. B. became excited and increasingly emotional when she learned that Respondent was changing A. H.'s placement to another foster home. Petitioner R. B. began yelling, in A. H.'s presence, that he was a liar and a "schizo" just like his "schizophrenic mother." The child protective investigator had to ask A. H. to leave the room when Petitioner R. B. began calling him and his mother names. Petitioner R. B.'s behavior on the evening of October 31, 2003, was inappropriate. However, the deputy sheriff, who was assisting with the change in placement, did not make any arrests. On the evening of October 31, 2003, and during the hearing, Petitioner J. B., the foster father, admitted that he had seen the bruises on A. H.'s arms sometime during the week before October 31, 2003. On both occasions, Petitioner J. B. stated that A. H. was crazy. Petitioner J. B. had no first-hand knowledge as to the cause of the bruises. During the hearing, Petitioner J. B. provided credible testimony that neither he nor his dogs caused the injuries. In order to operate a foster home, foster parents must undergo training on an annual basis. The training includes knowing when to advise Respondent about injuries to their foster children. The requirement to report injuries is a part of the annual service agreement signed by Respondent's staff and foster parents.
Recommendation Based on the foregoing Findings of Fact and Conclusions of Law, it is RECOMMENDED: That Respondent enter a final order revoking Petitioners' foster care license. The Issue The issue in this case is whether HRS should grant the Petitioner's application a license to operate a foster care home for dependent children.
Findings Of Fact The Petitioner, Christopher Murphy, is a single male, born July 27, 1966. He wants to be a foster care parent for up to two teenagers, same sex, including those with a history of having been abused. In approximately September, 1994, the Petitioner approached the Children's Home Society (CHS), located in Orlando, Florida, to inquire about applying for licensure to operate a foster care home for dependent children. CHS is and was under contract with the Department of Health and Rehabilitative Services (HRS) to screen prospective licensees. The screening process included, among other things: interviews with the Petitioner; a home study; review of written personal references on behalf of the Petitioner; evaluation of the Petitioner's participation in the HRS-approved Model Approach to Partnerships in Parenting (MAPP) program. After conducting its training and screening of the Petitioner, CHS recommended the Petitioner for licensure "for two children, same gender, ages 12 to 18 years," and the Petitioner filed his application for licensure on or about May 3, 1995. The Petitioner and the "relief persons" he designated in his application underwent background screening, and no disqualifying information was found. However, by letter dated July 11, 1995, HRS gave notice of intent to deny the Petitioner's application for the following reasons: According to Florida Administrative Code Chapter 10M-6, it is the opinion of the Department that based on your own experience with depression, your single lifestyle and your sexual orientation that your desire to be a foster parent is not in the best inte- rest of the children in the custody of Health and Rehabilitative Services. You have indicated that you have doubts about your ability to work with HRS in seeking rehabilitation of the families with children in foster care, that you have limited patience with bureaucracy, and that you would not like to see the foster children in your care return to their parents. Professional counseling to relieve distress over your sexual orientation did not resolve that issue. These consider- ations lead HRS to believe that it would not be in the best interest of children in state custody to be placed with you in foster care. The Petitioner's Mental and Emotional Status The evidence is that the Petitioner experienced some difficulties growing up as one of ten siblings. His mother was very religious but, at the same time, appears to have been a strict disciplinarian and, at times, almost "cruel" to the children. In addition, the Petitioner tended to be a loner during his early years. He was physically weak and was susceptible to being bullied by other children. In addition, he played differently from other boys his age, preferring to spend his time reading Jane Austen and the Bronte sisters rather than playing with friends. As the Petitioner grew older, he increasingly recognized signs that he was homosexually oriented. These signs disturbed him because a homosexual orientation was contrary to his desires and to what he understood to be the morals of his family and religion. When the Petitioner went to college in the mid-1980's, he still would have been considered a "social isolate," and the combination of stresses from leaving home, living on his own at college and dealing with his sexual orientation resulted in depression requiring individual psychotherapy and medication (at first Impramine and later, in 1992, Prozac). Dealing with his mother's death in 1988 caused the depression to recur, but the Petitioner was able to recover with the help of the psychotherapy and medication. Since 1988, the Petitioner has suffered periodic bouts of mild depression. (Medication he takes for rapid heartbeat tends to cause some depression as a side effect.) However, the Petitioner's major depression is in remission, and he has been able to control the mild depression by the appropriate use of medication. The Petitioner's physicians advise him to continue on medication and seek therapy as necessary. In recent years, the Petitioner has resolved his conflicted feelings about his mother, as well as many of the conflicts he had with members of his family. The Petitioner also has made great strides to resolve his conflicted feelings about his sexual orientation. At the same time, he still rejects the values and lifestyle of the gay world and continues to accept most of the basic tenets of traditional values and lifestyle. As a result, there is no indication that the Petitioner is trying to use the foster parent program in order to make a political statement about gay rights. However, the difficulty the Petitioner will continue to face is that traditional society does not necessarily always accept him. This probably will make being a foster parent more difficult for the Petitioner. The Petitioner also has made considerable progress making and maintaining viable personal relationships. He has been able to work responsibly and well in the positions he has held with Universal Studios in Orlando and has made and maintained several positive and valuable friendships through work and elsewhere. In the words of a licensed psychologist who evaluated him in August- September, 1995, the Petitioner is "on the mend" in this regard; by this he meant that the Petitioner is making good progress in the right direction. If major depression were to recur, the Petitioner obviously would have difficulty persevering, and probably would be unable to persevere, in seeing a foster child through to the end of his or her temporary placement. But in recent years the Petitioner has been able to control depression by appropriately using his antidepressant medication, monitoring himself for symptoms of depression, and seeking appropriate therapy as needed. As long as he continues to do so, it is not anticipated that major depression will recur. HRS has licensed others with mental and emotional status similar to the Petitioner to be foster parents. It is true that there is a possibility that the stress of being a foster parent could cause the Petitioner's depression to recur. In many ways, teenage is the most difficult age bracket for foster care, and abused teenagers can present even greater difficulties. But HRS maintains control over the children to be placed with the Petitioner, and an effort could be made not to place the most difficult foster care challenges with the Petitioner, at least initially. In addition, HRS and the Petitioner could cooperate in monitoring the effects that the stress of being a foster parent have on the Petitioner. There is a good chance that the Petitioner's depression will not recur as a result of being a foster parent. The Petitioner's Parenting Experience The Petitioner has no children of his own and has no parenting experience. He grew up in a family of ten children but tended to spend much of his time apart from them. The Petitioner did some baby-sitting during his teens. But otherwise, through his college years, the Petitioner did not exhibit much inclination or desire to be around or work with children. The Petitioner changed as he reached adulthood. He now has a very strong desire to help teenage children by acting as their foster parent. In recent years, he has had the opportunity to work with families having their pictures made at the Universal Studios park in Orlando and has found that he had success interacting with the young members of those families. While he has not had much experience taking care of teenagers, he also has enjoyed spending considerable time in recent years interacting with the young children of friends and other family members. (Living in the a vacation center, many siblings and other members of his family have taken advantage of the opportunity to visit him since he moved to Orlando.) The Petitioner seems to interact well with the children in several arenas--facilitating play, sharing snacks and meals, helping with homework, going on picnics and other outings, suggesting and participating in other positive family activities. His friends' children like him, and his friends trust him with tending to their children. On the other hand, the Petitioner's experience taking care of children is limited. The Petitioner's experience as the sole caretaker responsible for children is relatively sparse and of relatively short duration. While the Petitioner has done some baby-sitting for family and friends, most of the time he has spent with children has been while their parents were around. The Petitioner has not had occasion to be responsible for children overnight or for extended periods of time (certainly not for 24 or more hours). He also has not had much other experience working with children in other settings. He has not, e.g., worked or volunteered as a counselor for church or civic youth groups or camps. Due to the nature of the Petitioner's experience with children, and his lack of experience with teenagers, it is not certain that the Petitioner will succeed as a foster parent of teenagers, or children of any age. It also is not certain that the Petitioner himself will thrive as and enjoy being a 24- hour a day foster parent. It would be desirable both for the Petitioner and for the children to be placed with him for the Petitioner to get more experience before beginning to act as a foster parent. But, on the other hand, the same probably could be said for most first-time parents. It is hard to truly know what it is like to be a parent until you become one. HRS has no non-rule policy establishing clear minimum experience standards for licensure as a foster parent. HRS has licensed others to be foster parents with as little or less parenting experience compared to the Petitioner. The licensing administrator who testified for HRS stated that HRS never has issued a provisional license to a first-time applicant and that HRS would not issue one for the purpose of evaluating the provisional licensee while the licensee gains additional parenting experience. The Petitioner's Ability to Be a "Team Player" On the "Strengths/Needs Work Sheet" for various sessions of the Petitioner's MAPP training, the Petitioner wrote: (Needs as a Result of Meeting 2) I am intolerant of those who hurt children and may have a difficult time holding back and/or editing my language in their company (during visits). I have limited patience with bureaucracy. If something is not getting done, I will do it myself regardless of who gets offended. (Needs as a Result of Meeting 5) I probably will assume I am a better parent than the child's birth parents, and I don't think I'll want the child to return to his biological family. As CHS conducts MAPP training, prospective foster parents are encouraged to use the "Strengths/Needs Work Sheet" to honestly express their deepest concerns about their ability to succeed as foster parents. Then, the trainers help the trainees deal with those concerns. CHS' MAPP trainers believed that, during the course of the training sessions, the Petitioner was able to work through his concerns and grow through the training process. He was open to the trainers' ideas and actively participated in the sessions. In their estimation, the Petitioner's comments, even when in the fifth session, should not be taken as an indication that the Petitioner would not be able to work in partnership with HRS and birth families as a team player. The licensing administrator who testified for HRS was not familiar with how CHS conducted MAPP training and was not in a position to conclude, as she did, that the Petitioner's statements on the "Strengths/Needs Work Sheet," in and of themselves, show that the Petitioner will not be able to work in partnership with HRS and birth families as a team player. The Petitioner has had no difficulty working within the bureaucracy at Universal Studios. He has had good relationships with his supervisors and has had no difficulty accepting their authority over him. Nothing about his employment experience would indicate that the Petitioner would have difficulty working in partnership with HRS and birth families as a team player. The Petitioner's Single Life Style On the "Strengths/Needs Work Sheet" for various sessions of the Petitioner's MAPP training, the Petitioner wrote: (Needs as a Result of Meeting 2) I am responsible, but do not lead a structured life. I eat when I'm hungry, sleep when I'm tired, have ice cream for breakfast . . . (Needs as a Result of Meeting 3) I may not be able to go out all night and do things as spontaneously as I do. (Needs as a Result of Meeting 5) It's just me - one on one. If I had a spouse to back me up when making rules or administer- ing discipline, things would be easier. On the other hand, the Petitioner also counted among his strengths: (Needs as a Result of Meeting 3) It's just me. . . . A foster child has only one person to adjust to. (Needs as a Result of Meeting 4) I have no other people living in my home and can devote a majority of my free time to my foster child. (Needs as a Result of Meeting 5) As a single male with no children, I will be the only one affected. These comments indicate an awareness on the Petitioner's part that his life will change if one or two foster children are placed in his home. As he recognizes, being single will make it more difficult in some ways, but somewhat easier in other ways. What can make being a single foster parent most difficult is not having the emotional and intellectual support and help of another adult in the home. A single foster parent must attempt to compensate by having adult family and friends who are willing and able to serve some of those needs. Several of the Petitioner's friends are willing and able to serve in this role for the Petitioner. All have met HRS's screening requirements. One thing a single foster parent cannot replace is the inability to demonstrate (and teach through) a successful marriage. But this inability clearly is not disqualifying. The Petitioner's Sexual Orientation HRS's notice of intent to deny the Petitioner's application mentioned the Petitioner's sexual orientation. But at final hearing HRS took the position that sexual orientation itself was not a ground for denial of the Petitioner's application. While not disqualifying in itself, being a homosexual foster parent undeniably will present special problems. First, it already has been mentioned that it can be a challenge for a homosexual to function in traditional society, and trying to function as a foster parent in traditional society surely will present its own special challenges. Along those lines, it is foreseeable, e.g., that a foster parent's homosexuality could be unacceptable to the birth family. In addition, since unmarried cohabitation by two or more adults is disqualifying, the Petitioner would be restricted to living alone. Lastly, many foster parents later adopt children placed with them, but the Petitioner will not be able to because homosexuality is disqualifying for purposes of adoption.
Recommendation Based on the foregoing Findings of Fact and Conclusions of Law, it is recommended that the Department of Health and Rehabilitative Services enter a final order issuing the Petitioner a license to operate a foster home for up to two children, same sex, ages 12 to 18 years of age. Findings Of Fact Based on my observation of the witnesses, their demeanor while testifying and the entire record complied herein, the following relevant facts are found. Respondents, Robert and Melody Chinnici, completed their foster care parent training program during September 16, 1991 (MAPP), and were thereafter licensed as foster care parents in October 1991. The MAPP training included Petitioner's discipline policy which is in the form of a written statement that was given to and acknowledged by Respondents. During times material, Respondents were entrusted to care for foster children Tonya Wilson, a 13-year-old, who resided with Respondents from approximately October 1991 through May 1992, and Jonathan, who was approximately 10 years of age. During this time frame, Respondents' natural son, Christopher Chinnici, also resided with them. During times material, Respondents used a form of "time out" to discipline the foster children when they were disruptive in church. The time out procedure utilized was one whereby the disruptive child would stand and face the wall for periods of five to fifteen minutes. When "time out" was imposed, the church services were over and most of the parishoners had left the parish. On at least one occasion, Respondent, Melody Chinnici, discussed with a foster parent a means of circumventing Petitioner's disciplinary policy respecting the pulling of foster children's hair. There was no evidence that Respondents in fact circumvented HRS' policy. Respondents attempted to serve meals to their foster children in an orderly fashion. During the course of serving meals, there was no evidence that Respondents withheld or otherwise utilized food as a means to discipline foster children in their care. Likewise, Respondent Melody Chinnici did not administer corporal punishment to foster children in her bedroom out of the view of other children.
Recommendation Based on the foregoing findings of fact and conclusions of law, it is RECOMMENDED that: Petitioner enter a final order rescinding its proposed revocation of Respondents' foster care license and issue said licence forthwith assuming Respondents comply with other relevant criteria for the reissuance of their foster care license. The Issue The issue for consideration in this matter is whether Petitioner should be granted an exemption from disqualification to serve as a foster parent because of the matters alleged in the Department's letter of denial dated June 7, 1996.
Findings Of Fact At all times relevant to the issues herein, the Department of Health and Rehabilitative Services was the state agency responsible for the licensing of, inter alia, foster homes and foster parents in Florida, and for the granting of expemptions from disqualification for licensing for persons who otherwise would net be eligible for licesning due to prior misconduct. Petitioner, Robert Mallan, was convicted in Circuit Court in Hillsborough County of kidnapping and grand theft - 3rd degree, on November 12, 1991. The kidnapping related to the ten year old son of the boyfriend of a female friend of the Petitioner, Ms. Lilly. While admitting his participation and liability for the incident, Petitioner contends that the boy was taken by the young lady in an effort to exact revenge against her lover, the boy's father, for abusing her and to scare him so he would not touch her aqain. Petitioner's part, he asserts, was to rent the motel room where the child was taken for the woman and her accomplice sister, and when the plot began to fall apart, the two women implicated him. Ms. Lilly's testimony in a deposition given in August, 1991, prior to the criminal trial, paint a far more sinister participation by the Petitioner. Regardless of the motive for the act, Petitioner was found guilty of the offenses alleged, including the grand theft charge, and because some members of the jury hearing his case recommended clemency, he was sentenced as a youthful offender and was incarcerated for approximately eighteen months as a result thereof. Petitioner's wife, Jennifer Mallan, met and developed a relationship with two children in February, 1992. These children, the two S. boys, were the natural children of Johnnie Marie Roye, whose parental rights have been terminated. Desiring to take care of the children, Ms. Mallan undertook training as a foster parent through the Family Enrichment Center in Hillsborough County which trains, educates and assesses potential operators of foster homes for licensure. Ms. Mallan's home was subsequently licensed as a foster home in October 1994, prior to her marriage to the Petitioner, and became the foster home to the two S. boys. Petitioner met the children in August 1992, well before he and Jennifer were married, and he developed a good relationship with them. Once Ms. Mallan married the Petitioner, it becamae necessary for him to receive the foster parent training as well in order for the two S. boys to remain in the Mallan home. Therefore, as a part of the paper work incidental to his licensure, which, according to Ms. Wiliams, the Executive Director of the FEC, consisted of approximately twenty separate documents, Mr. Mallan filled out the form to initiate a background check. This check when completed in December 1994, revealed no record of any conviction. For some reason, however, a second background check, to include fingerprints, was required in the latter part of 1995. Incidental to that check, Petitioner filled out an Affidavit of Good Moral Character in September 5, 1995 on which, under penalty of perjury, he attested that he had not been found guilty of any of the criminal violations listed thereon, including kidnapping under Section 784.01, Florida Statutes. This affidavit is generally prepared by the trainee, under the supervision of the trainer, Ms. Davis, in conjunction with a training session. In this case, because Mr. Mallan had indicated he would not be available to attend training sessions on Thursdays, (one half the course), Ms. Williams cannot be sure whether he receive the standard verbal instructions given to applicants that they shyould not try to hide anything in their backgrounds. However, both Ms. Williams and Ms. Davis gave all the trainees their home phone numbers and offered to help in the prepartion of the documents after hours. Neither lady was contacted by Respondent with questions about any of the documents. Petitioner signed the affidavit at the spot provided therefore on the back of the form where someone had placed an "X". The form is self-explanatory and easy to read. Alicia Miller, the licensing worker at the Family Enrichment Center,who helped Ms. Mallan obtain her foster care license, and who was also helping Petitioner to obtain his, claims she explained the contents of the affidavit to him during the one and a hours she spent at his place of employment going over the forms with him, and he did not request an explanation of the affidavit form. Others who took the FEC's foster parent training, including Steven Link and Noel Perez, filled out the same affidavit and neither had any trouble comprehending the language on the form. Mr. Link indicates they were given many forms to fill out, some of which were read by the teacher. Others were self-explanatory. Not all the forms were given out on the same night. The results of the second background investigation revealed Petitioner had a conviction for kidnapping. This information was discovered by James Thomas, the background screening unit coordinator for the Department, who in turn informed Alicia Miller of the fact and that that conviction disqualified Petitioner from obtaining clearance as a caretaker for children. Ms. Miller passed this information on to Mr. Mallan who requested an exemption. All foster parents must be screened for violations of the law, some of which may disqualify a person from serving as a caretaker of children or from obtaining a foster caer license. When a person is disqualified because of a particular violation, that individual must seek an exemption from the agency before he or she can be licensed. A hearing was held on this request on May 10, 1996, In addition to his oral presentation, Mr. Mallan also provided the agency with numerous reference letters from people in the community who have known his through his church involvement. The informal exepmtion hearing of May 10, 1996 was attended by Mr. Thomas, Don McNair, the operations management consultant who specializes in the licensing of shelter and foster homes, Mr. and Mrs. Mallan, Alicia Miller, Randy White and Mark katherin Moers. As a result of this hearing, on May 20, 1996 the agency advised Mr. Mallan by letter that his request for exemption had been denied. The reason given for the denial was that Mr. Mallan did not show adequate remorse for his actions in kidnapping the child taken nor was he sufficiently forthright in explaining his involvement in the crime. Before recommending denial of Petitioner's request for exemption, Mr. Thomas reviewed the court records relating to the kidn apping charge and concluded that Mr. Mallan's version of the crime at the exemption hearing was not consistent with what was shown in the records. Mr. Mallan's story tended to indicate his involvement in the actual kidnapping was minimal, but an investigator from the Hillsborough County Sheriff's Office, who participated in the investigation of the crime, indicated that was not so. After the committee which heard Petitioner's request for examption met and recommended denial of the exemption, Mr. Mallan requested a second exemption hearing at which he could present his reasons for granting the exemption. Though such a hearing is not normally granted, at the direction of the District Administrator, Mr. Taylor, Mr. Mallan was granted a second exemption hearing at which he could discuss the progress he has made since his imprisonment. At this second hearing, held on May 31, 1996, Petitioner was heard by Harriet Scott, a district program manager; Mr. Thomas; and Mr. McBride, an agency licensing supervisor. The District Administrator, Mr. Taylor, also sat in for a part of the hearing but did not ask any questions of Mr. Mallan. During this second hearing, Petitioner claimed he was "railroaded" at his criminal trial by the prosecution and his two co-defendants, Ms. Lilly and Ms. Parmenter. When asked why he had a gun in his possession at the time of the kidnapping, Mr. Mallan explained he was going to use the gun to committ suicide and denied he used it during the commission of the kidnapping. However, when he was arrested by a Leon County Deputy Sheriff in a Tallahassee motel, he made several inconsistent statements regarding the location of the weapon. At the time of his arrest, he was dressed in a tuxedo and waiting for his girlfriend, now his wife, to pick him up to atten a formal sorority function. The decision to deny Petitioner's request for edxemption from disqualification was a difficult one for the committee to make. The evidence indicates that the two S. boys have been doing well in the care of Mr. and Mrs. mallan and want to return to their home. However, the initial decision to deny the request was made by Mr. Taylor, the District Administrator. Both members of the first committee appointed to review the case recommended denial of the request, and Mr. Taylor agreed only after reading all materials furnished to him by the committee. Several days after the denial letter was sent out, Mrs. Mallan called Mr. Taylor and before he could respond, Mr. Mallan also called to express his concern over the denial, indicating he did not feel he had been given a chance to present his full story. Based on this, and on the fact that Mr. Taylor had some additional questions to ask of the Petitioner, the second hearing was granted. Mr. Taylor classifies this case as one of the 4 or 5 most difficult decisions and the most difficult exemption decision he has had to make during his tenure as District Administrator. His concerns, which ultimately culminated in his decision to deny exemption, were: He did not feel Petitioner was entirely truthful at his first hearing and was evasive and misleading in the information given to the FEC. Petitioner did not express any remorse for his actions. During the period Mr. Taylor sat in during the second exemption hearing, Petitioner appeared almost arrogant and defiant in his approach to the committee. Taylor did not feel Petitioner accepted responmsibility for his actions. Throughout the hearing, Petitioner denied, minimalized and trivialized what he had done and consistently tried to place the blame on others. Many of the concerns expressed by Mr. Taylor were also felt by other committe members such as Ms. Scott. She, too, had the feeling that Petitioner was dissembling and not telling the whole truth. She concluded that the five years which had passed since the conviction was not enough time for Petitioner to be rehabilitated. Once the second hearing was over, Mr. Taylor had no doubts as to those factors cited in the paragraph next above, but he had great concern for the two children involved. He had to weigh these concerns. Before making his final decision, Mr. Taylor read and accepted as sincere all the letters sent in by Petitioner's friends and supporters. Mr. Taylor has no doubt that Petitioner is recognized as having done considerable good in the community, but all this has a hollow core, and without sincere remorse, the rest does not ring true for him. To Mr. Taylor the issue was not whether the two children in issue had a good home or whether Petitioner has done good, but whether Petitioner has been sufficiently rehabilitated, and based on what he has observed, Mr. Taylor concluded Petitioner has not. None of the staff of the Family Enrichment Center, including Olga Williams, the Director, Delores Davis, a training coordinator and teacher of the the Model Approach to parenting and Pertnership (MAPP) classes, or Alicia Miller, all of whom knew the Mallans through contact at the FEC, were ever informed prior to the marriage that Jennifer was going to marry Petitioner, nor were they informed by either that Petitioner had been convicted of kidnapping. Mr. Mallan is currently employed by the South Tampa Christian Center, (STCC), where he and his wife are members. He has been involved in community volunteer work since his release from prison. He is an active participant in a church program called "Conquering Force" in which he speaks to inner city children to convince them that the decisions they make today will affect their future. Though in these talks he has admitted to a prior conviction and incarceration, he has never discussed in detail with any audience the nature of his offense and the circumstances surrounding it. In addition to his work at STCC, Mr. Mallan has volunteered and worked at other community organizations which serve children's needs. It appears from Mrs. Mallan's recounting of the relationship amongst herself, Petitioner and the two S. boys has been quite good. When she and Petitioner decided to marry, and she realized both she and he would have to be liecensed as foster parents, she claims she advised the Department of Petitioner's conviction and also advised her MAPP teacher, asking if it would be worthwhile to continue with the trainin in light thereof. She claims to also have told Ms. Miller who, she relates, also told her the conviction would not be a problem so long as Petitioner has been clean since his release from prison. Once they were married, she contends, they both advised the relevant agency authorities of his conviction. Ms. Mallan contends that Petitioner should receive an exemption b ecause since he got out of prison he has lived rehabilitation for himself and others. He works with children to help and assist in decision making. He has never shown anything contrary to rehabilitation ahd wants to have a positive influence on youth. To her knowledge, parents of the children with whom he comes into contact are grateful for the time and efforts he has expended in Florida, nationally and internationally. Mr. Mallan became a Christian two weeks after he went to prison. He immediately worked in the chapel and has never backslid, but has been consistent and committed since he gave his life to the Lord. Mrs. Mallan disagrees with the Department's conclusion that Petitioner is not remorseful over what he did. She has heard him publicly speak about it and he has contacted the victim's father to see that the boy is all right. Petitioner's good wirk is noted by Henry Blanton who served on a committe for a crime forum for the Boy Scouts which was made up of judges, police officials and others related to law enforcement and at which Petitioner was involved. Mr. Blanton had known Petitioner for several years and saw what he was doing for youth, and asked him to get involved. Mr. Blanton's son has been involved with the petitioner through church activities and feels he knows Petitioner quite well. Mr. Blanton is aware of Petitioner's record from Petitioner's public recounting of it as a part of his ministry, and is shocked by the Department's position that Petitioner has not been rehabilitated. Blanton is unequivocally convinced that Petitioner has been rehabilitated and has done much for young people in the community. In Blanton's words, Petitioner "should be commended for what he has done - not castigated and raked over the coals." Tough he his aware of Petitioner's conviction for kidnapping, Mr. Blanton is not aware of the details. As he recalls, Petitioner has referred to the kidnapping as a "prank." Mr. Blanton knows nothing bad about the Petitioner other than his conviction and is not aware of any drug or grand theft charges. He also was not aware that Petitioner was not honest on his affidavit of good moral character, and feels that lying is not evidence of good moral character. Several other responsible individuals were convinced of Petitioner's worth, having heard of his incarceration through their relationship with him. None was advised of the reason for his imprisonment, however. Nevertheless, all, including a marital counselor and a school community specialist, believe Petitioner is committed to a Christian lifestyle and to God. Mrs. Mallam's uncle, a Hillsborough County Circuit Judge, has known Petitioner for about five years, before the trial and incarceration. He cannot say whether Petitioner has changed because he did not know Petitioner well before his imprisonment. In the Judge's opinion, it is hard to measure rehabilitation, but he seems to have seen a change in the Petitioner's life style which makes him moere committed to the improvement of youth. Petitioner never denied his crime to this Judge nor did he try to minimize them, but he also never brought the subject up and the Judge never questioned Petitioner about it. All of the responsible individuals such as teachers and school administrtors who have been in contact with the two S. boys attest that they have done well living with the Petitioner and his wife. Pastor Randy White of STCC first met the Petitioner right after Mr. Mallan was released from prison. At that time, Petitioner was dating Ms. Mallan and wanted to attend his church. For over a year therafter, Petitioner did community service for the church as a part of his probation. He told the pastor he had b een convicted of kidnapping and grand theft and appeared to be remourseful, neither denying nor minimalizing his offenses. After he completed his period of community service, Petitioner came on staff at the church as outreach director. He performed well and was offeded the position of youth pastor in which capacity he is still employed. In the words of Pastor White, Petitioner has done a "tremendous" job. Churches from all over the country have contacted him seeking to hire him. Both pastor White and the church sponsored Petitioner in a one year "Master pastor" intern program which gave him thirty college credits. Petitioner successfully completed the program. Pastor White has no reservations about Petitioner's rehabilitation or that he is a productive member of society. Petitioner has now beenb ordained as a minister and has all the qualities of a minister. In Pastor White's opinion, Petitioner has a stable marriage to a woman who is involved in his ministry and woulod not turn to crime. Recognizing that truth is a part of rehabilitation, Pastor White believed also that an intentional misrepresentation is evidence of bad character. He is aware of Petitioner's reference to his misdeed as a "prank", but also contends that Petitioner told him he had told the Department's representatives of his criminal record. Pastor White has no reason to doubt Petitioner on any level. In that regard, Petitioner counselled with Paul Hollis, the Director of Counseling for STCC in the Fall of 1992. Petitioner wanted to make sure thee was nothing in his background to cause a problem for the church. In the course of the counselling, petitioner gave a full account of his criminal conviction and the details involved. He was very open and did not try to conceal anything. As a rsult of their sessions, Mr. Hollis felt that Petitioner was remorseful and anxious to insure that what happened in his past would never happen again. At that time, Mr. Hollis felt Petitioner was already rehabilitated and nothing has occurred since to cause him to have a question as to Petitioner's rehabilitation. In fact, Petitioner is now helping to rehabilitate others. Arlene Freed-Vest, Petitioner's probation officer for the fourteen months he was on probation after his release from approximately nine months in prison, supervised him closely during the period of community service he performed upon his release. Petitioner had initially been placed on three and a half years of probation, but she recommended early termination of probation based on her satisfaction he was rehabilitated. This determination was based on a review of his entire file from confinement on and she was satisfied he had received all the benefits he could from prob ation and would not benefit from it further. She concluded that Petitioner took responsibility for his actions and has shown continuing remorse. The fact that he has tried to get on with his life does not mean he is not owning up to his offense.
Recommendation Based on the foregoing Findings of Fact and Conclusions of Law, it is recommended that the Department of Health and Rehabilitative Services enter a final order granting Robert Mallan an exemption from disqualification from residing in a licensed foster home. The Issue May the Department of Children and Family Services (DCF) revoke Respondent's foster home license for violating Section 409.175 (8)(b) 1., Florida Statutes, in that Respondent intentionally or negligently committed acts that materially affected the health and safety of children, to-wit: inadequate supervision of a minor child entrusted to her care?
Findings Of Fact R.G. is the biological mother of the infant female, A.G., born out of wedlock. R.G. gave birth to a male child before A.G. That son was taken away from R.G. by DCF. Both A.G. and R.G., while R.G. was yet a minor under the age of 18 years, were adjudicated dependent children, subject to placement by DCF, pending DNA testing of A.G. and two putative fathers. R.G. had been placed with a licensed foster home other than Respondent's licensed foster home. That home requested R.G.'s removal because R.G. would not follow its rules. R.G. with A.G., was then placed in the licensed foster care home of Respondent. Although the placement of A.G. with Respondent raised Respondent's home population to one more live foster child than Respondent's licensed capacity, a situation to which Respondent objected, DCF personnel informed Respondent that the infant A.G. would be counted as part of R.G.'s placement. Therefore, despite A.G. and R.G. being two separate persons, DCF would not consider Respondent to have exceeded her license's capacity. It was not explained on the record how DCF intended to pay board to Respondent for care of A.G., if A.G. were not considered a whole person, but it is clear that DCF personnel resented Respondent's asking how she would be compensated for A.G.'s care. At all times material, R.G. and A.G. were subject to a Circuit Court Order which permitted only "unsupervised day visitation" by R.G. with A.G. (Emphasis in the original). By implication of the Circuit Court Order, and by her own understanding from instructions by DCF personnel, Respondent knew that R.G., the minor mother, was not permitted to have unsupervised night visitation with the dependent infant, A.G. DCF's and Respondent's understanding of the Circuit Court Order was that Respondent, R.G., and A.G. were required to be in Respondent's home after dark, but Respondent was not required to "eyeball" R.G. and A.G. all night, every night, while they were present in Respondent's foster home. Gracie Rager, DCF foster care worker, authorized Respondent to allow R.G. to take A.G. out of Respondent's foster home during the day for unsupervised visitation. Ms. Rager also authorized Respondent to allow R.G. to take A.G. to R.G.'s older natural sister's home to spend some nights, including weekends. R.G.'s older natural sister was married and licensed for foster care. Accordingly, DCF personnel, including Ms. Rager, presumed that the older sister was sufficiently responsible and qualified to provide supervision of R.G. and A.G. at night. DCF reasonably concluded that R.G.'s presence with A.G. in her sister's home at night would constitute supervised night visitation and comply with the Court's Order. Ms. Rager never authorized Respondent to allow R.G. to take A.G. out at night by herself, but Ms. Rager reasonably saw no impediment, including the Circuit Court Order, to R.G. taking A.G. with her anywhere she wanted to take the baby during the day. R.G. openly resented being placed with Respondent because Respondent is Black. R.G. wanted to return, with A.G., to a white foster home placement. As a result, R.G. was never cooperative with Respondent. When R.G. turned 18 years of age, she became openly defiant of Respondent. R.G. insisted that she alone, would do everything for A.G., who was still under two years old. R.G. refused all assistance from Respondent concerning A.G. Respondent asked DCF to remove R.G. and A.G. or at least A.G., from her foster home. DCF had no other placement for them and asked Respondent to keep them until another placement was found. R.G. had a part-time day job. To get there, she would "catch a ride" with others. She would not accept a ride from Respondent. Sometimes, R.G. would take A.G. with her to work and go directly from work, with A.G., to her older, licensed sister's home. On these occasions, R.G. and A.G. might be gone for a night or a weekend. When R.G. did not return to Respondent's foster home, Respondent sometimes called R.G.'s older, licensed sister's home to be sure that R.G. and A.G. had arrived there safely. Sometimes, Respondent asked this sister to call her when R.G. and A.G. arrived. However, Respondent did not always contact R.G.'s older, licensed sister or otherwise check-up on R.G.'s and A.G.'s whereabouts overnight or over a weekend. When R.G. and A.G. returned after a night or weekend away, Respondent did not always check up on where they had been. Respondent was under the impression that a different, adult sister of R.G.'s was also a suitable adult supervisor for after dark, even though that sister was not licensed for foster care. Indeed, there is nothing in the Circuit Court Order requiring that supervised night-time visitation of R.G. with A.G. could not be undertaken by any other adult, regardless of whether that person were licensed for foster care. Respondent never checked to see if R.G. and A.G. were with R.G.'s unlicensed sister. At no time did Respondent report to law enforcement or DCF that R.G. had gone off and failed to return or that R.G. was taking A.G. away on weekends. At some point, R.G.'s authorized and licensed older sister called Ms. Rager and said R.G. had taken A.G. out all night with R.G.'s boyfriend and had not returned. It is unclear from Ms. Rager's testimony whether R.G.'s and A.G.'s departure point for their night or weekend of unsupervised visitation was Respondent's home or R.G.'s licensed sister's home. On February 9, 2001, Ms. Page, a DCF protective investigator, responded to an abuse hotline call and met with Respondent in the lobby of a DCF facility. During her interview of Respondent, Ms. Page knew nothing of where either R.G. or A.G. had been picked up, or how long they had been unsupervised at night, but Ms. Page "understood" from Ms. Rager that R.G. and A.G. had been removed from Respondent's home and that Respondent had come to the DCF facility voluntarily. Ms. Page was particularly concerned because of a comment Respondent made in the course of this interview, to the effect that Respondent guessed she had "handled it all wrong" because she had only asked to have the baby, A.G., removed from her care instead of reporting R.G.'s rebelliousness. DCF Investigator Page testified that she "verified" in an abuse report that Respondent was guilty of neglect by failure to notify authorities of R.G.'s unsupervised night visitation with A.G. There is insufficient evidence to determine of Respondent ever had a chance to challenge the abuse report or if the report was ever "confirmed." There is no evidence R.G. or A.G. suffered harm as a result of this incident.
Recommendation Upon the foregoing findings of fact and conclusions of law, it is RECOMMENDED: That the Department of Children and Family Services enter a final order dismissing charges against Respondent and restoring her foster care license. The Issue In this case Petitioner seeks to revoke the Respondents' foster home license premised upon allegations set forth in a complaint letter dated September 27, 1991 and under authority found in Section 409.175, Florida Statutes.
Findings Of Fact Respondents hold a family foster home license issued pursuant to Section 409.175, Florida Statutes. That license expires in April, 1992. (The Respondents had been initially issued a license for the period April 1990 through April 1991.) The license was issued following rigorous training provided to the wife Jean Burgett and a more abbreviated explanation of the responsibilities of foster parents that was provided to the husband, Richard Burgett. The wife is principally responsible for providing foster care under the terms of the license in that the husband's employment requires him to be away from the home frequently. It is the conduct by the wife that has subjected the license issued for the foster home at 17 Teak Course, Ocala, Florida to be placed in jeopardy premised upon allegations set forth in the complaint letter dated September 27, 1991. In the initial training received by Jean Burgett and in the renewal of the license which took place in April 1991, Jean Burgett was made aware of Petitioner's disciplinary policy concerning children placed in foster care. That policy is especially important given the nature of the children who were placed with the Burgetts. The background of those children was that of young people who were abused, neglected or dependent. The initial training which Ms. Burgett was subjected to concerning matters of discipline was a setting in which the general emphasis was that of positive reinforcement of the children in an effort to promote self esteem and eventually gain control over any aberrant behavior and this general emphasis was tied into a more discrete block of training which was a three hour presentation on disciplinary matters. In furtherance of this instruction Jean Burgett was provided the Petitioner's policy manual which spoke to matters of discipline. In addition the Burgetts were made aware of the need to ensure confidentiality concerning the background of the children who were placed with them as it pertained to protections set out in Section 415.513(2), Florida Statutes. By this agreement the Respondents promised not to willfully or knowingly make public or disclose information that was contained in the child abuse registry or records of any child abuse case and to hold that information that came to the attention and knowledge of the Burgetts as privileged and confidential and not subject to disclosure to anyone other than authorized persons. In agreeing to the terms set forth in the family foster home license Mrs. Burgett was made aware that the children in her care as a foster parent were not to be subjected to corporal punishment. Emphasis was placed on the need to promote self-esteem and the importance of this attempt because of the nature of the background of the children and the trauma that the children had been subjected to. An explanation was made to Mrs. Burgett that she was to be gentle and that she was to build up the self-esteem in the children as opposed to tearing down their self esteem. A great deal of time was spent in the training in that Mrs. Burgett had revealed that she was the subject of harsh discipline as a child and had noted her concerns about what was described as the "soft approach" to discipline contemplated by the Petitioner. Nonetheless, Mrs. Burgett agreed to undertake the methods contemplated by the Petitioner in dealing with disciplinary matters associated with foster children in her charge. The complaint letter speaks of a general lack of judgment on the part of Mrs. Burgett concerning care of the children that were placed with her under the foster care program and the fact that the Petitioner's staff had participated in discussions with Mrs. Burgett about this problem. These observations are accurate for reasons which will be described below related to particular inappropriate conduct Mrs. Burgett is held accountable for. One incident involved a four year old boy, Bucky, who had been placed with the Burgetts for foster care, in particular it was respite care from a shelter. That child had been undergoing toilet training and had been taken out of diapers and placed in what is referred to as "big boy pants" before he came to stay with Mrs. Burgett. Apparently for matters of her convenience she changed that regime and placed the child back in diapers. He resisted and went into a tantrum. Mrs. Burgett's response to that conduct was inappropriate and contrary to the training which she had received from Petitioner concerning responses to those episodes by a child. Mrs. Burgett threw the child on the bed striking his head and covered the child up with a pillow and placed herself on top of that pillow as a means of controlling the child. Mrs. Burgett was counseled by Patricia Gilman, an employee with Petitioner, concerning the inappropriate nature of this conduct. In December 1990 Tina 16, Tracy 9, Trevor 7 and an infant Jordan were in foster care with Mrs. Burgett. Mrs. Burgett and the children had been to "Toys R Us" and in the course of that trip Tracy and Trevor caused a scene in the toy store. Mrs. Burgett responded to this situation by returning the children to her vehicle and proceeding to a Burger King restaurant to get something to eat. While at the restaurant Trevor said something that made Tina angry and Tina responded by throwing a drink on Trevor. In the fracas Mrs. Burgett tried to restrain Trevor by putting a hand over his mouth and in struggling with her in an attempt to get away Trevor banged his head on the back of the booth. These circumstances caused the manager of the restaurant to come over to where Mrs. Burgett and the children were located and while the manager was there and other persons were watching Mrs. Burgett remarked to the manager, "these are foster children and they have been damaged." This was an inappropriate comment which would not further the underlying goal of promoting self-esteem in those children. In describing the incident Mary J. Rogers, an operations program administrator for Petitioner, said that no license disciplinary action was taken at that time because Mrs. Rogers regarded the children as difficult to deal with and thought that Mrs. Burgett had demonstrated a willingness to become an acceptable foster parent when interviewed about the December 1990 incident at Burger King by improving her approach with the children in her care. With the advent of other inappropriate conduct by the Petitioner that took place beyond the point in time the Burger King incident occurred, the Petitioner was confronted with conduct so serious as to call for revocation of the foster home license. Another incident about this time by Mrs. Burgett was attempting to counsel an 11 year old girl, Judy, who was in foster home placement with Mrs. Burgett. The subject of the counseling concerns sexual activity, and it included having the child draw male sex organs. Mrs. Rogers discussed this matter with Mrs. Burgett in December 1990 in the course of which conversation Mrs. Burgett said she was trying to help the child. Mrs. Burgett was advised that it was not appropriate for Mrs. Burgett to undertake counseling with the child because Mrs. Burgett was not qualified to do so. In the December 1990 conference concerning the performance of Mrs. Burgett as a foster parent, the Petitioner agreed with the Respondent that no teenage foster children would be placed in Mrs. Burgett's home because Mrs. Burgett acknowledged having difficulty dealing with those children. Nonetheless, such placement was made in September 1991 upon agreement by Mrs. Burgett to such placement. This involved one teenage child from another foster home in which three children had been placed. The eldest child was a 13 year old girl, Rhonda K. and the other two children were younger brothers to Rhonda K., whose ages were 8 and 4. At the time of the placement of the children from the other foster home Mrs. Burgett was caring for three other foster children, Jeremick 5, Amanda 3, and an infant. The arrangement for respite care did not work out, in part due to the manner in which the Mrs. Burgett responded to Rhonda. This led to a request by Rhonda to be removed from Mrs. Burgett's home sooner than anticipated. The reason for the placement of the three children from the other foster home concerned the need by that foster parent to tend to her dying father. Among the inappropriate actions by Mrs. Burgett concerning Rhonda was a remark to the effect that it was the child's fault that her "grandfather", meaning the father of the regular foster parent, was dying with cancer. As Rhonda described at the hearing, this remark by Mrs. Burgett "didn't make her feel good." While Rhonda was staying with Mrs. Burgett, Mrs. Burgett asked Rhonda to slash the tires of the neighbor's vehicle and spray paint that neighbor's house. This was a neighbor that Mrs. Burgett did not get along with. Whatever disagreement Mrs. Burgett had with the neighbor, it was inappropriate behavior to recruit Rhonda to pursue Mrs. Burgett's ideas of unacceptable relations with a neighbor. It taught Rhonda the wrong social skills and commended inappropriate behavior. In a couple of instances, Mrs. Burgett shown a flashlight into the bedroom window of the 4 year old twins of Theresa Kennedy, a neighbor of Mrs. Burgett. This was done in a harassing manner in the Spring or Summer of 1991. On another occasion in which Theresa Kennedy was at the house of Linda Smith, the neighbor whom Mrs. Burgett had advised Rhonda to slash the tires of the neighbor's vehicle, and paint the Smith house, Mrs. Burgett stood for several hours at the end of the driveway of the Smith home. This followed an argument at the Smith home between Mrs. Burgett and Mrs. Smith in the presence of the children, Jeremick and Amanda, which led to the sheriff's office being summoned by the Smiths. The children were then taken back to Mrs. Burgett's home and given that no other adult appeared to be in the home, and in particular Mr. Burgett, this meant that the children, Jeremick and Amanda and an infant, were left unattended for several hours. Mrs. Smith had observed Mrs. Burgett yelling at Jeremick on a number of occasions. At times Mrs. Burgett would tell Jeremick "You can't play with other children in the neighborhood because they are bad." Twice she saw Mrs. Burgett yank Jeremick by the arm. Although Mrs. Smith did not believe that this contact was sufficient to cause physical damage to the child, she was concerned about the manner in which it was done. Mrs. Rogers has observed a deterioration in Mrs. Burgett's attitude over time and an unwillingness to acknowledge that Mrs. Burgett has acted in an inappropriate way; an example being, that she denied the events that have been described relating to Rhonda or Mrs. Burgett's neighbors. In particular, Mrs. Burgett remarked that personnel with the Petitioner should believe Mrs. Burgett and not the children. Mrs. Burgett's attitude is one of hostility in the latter conference of September 13, 1991 between personnel of the Petitioner and Mrs. Burgett, in contrast to the interview of December 1990 in which a willingness had been expressed to work with the requirements incumbent upon Mrs. Burgett under Petitioner's policies on foster care. Mrs. Rogers expresses a reasonable belief that Mrs. Burgett might lose her temper and become physically abusive of the children in her care. Mrs. Burgett's attitude is one of deceit, and demonstrates an inclination to blame others for inappropriate conduct that is attributable to her.
Recommendation Based upon a consideration of the facts found and conclusions of law reached, it is recommended that a Final Order be entered which revokes the family foster home license of Respondents to operate and provide foster care at 17 Teak Course, Ocala, Florida.
