The Issue The issue is whether Respondent, Pritesh, Inc., d/b/a IHOP 36-151 ("IHOP"), committed unlawful employment practices contrary to section 760.10, Florida Statutes (2011),1/ by discharging Petitioner from her employment in retaliation for her complaints regarding racial and religious discrimination in the workplace.

Findings Of Fact IHOP is an employer as that term is defined in subsection 760.02(7), Florida Statutes. IHOP is a restaurant in Leesburg. IHOP is owned by Pritesh Patel, who owns and operates a total of four International House of Pancakes stores in the Leesburg area through his corporation, Pritesh, Inc. Petitioner is a black female who is an observant Jew. Because of her religious beliefs, Petitioner does not work on the Sabbath, from sundown on Friday until sunset on Saturday. Petitioner was hired to work as a server at IHOP on March 19, 2012. She made it clear that she did not work on the Sabbath, and IHOP agreed to respect her religious beliefs. There was some difference in recollection as to the notice Petitioner gave to IHOP. Petitioner testified that she made it clear she could not work until sundown on Saturdays. The store manager, Brian Jackson, also recalled that Petitioner stated she could only work Saturday evenings. Mr. Patel testified that Petitioner said that she could work on Saturday "afternoon." Petitioner's version is credited as being more consistent with her stated beliefs, though there is no doubt that Mr. Patel was testifying honestly as to his recollection. Petitioner was the only black server working at IHOP at this time. Both Mr. Patel and Mr. Jackson credibly testified that IHOP has had many black servers through the years. Mr. Jackson noted that Petitioner only worked for IHOP for a period of two weeks and therefore was in no position to judge IHOP's minority hiring practices. Petitioner testified that assistant manager Hemanshu "Shu" Patel, a relative of the owner, created a hostile working environment for her from the time she started on March 19. She complained that Shu would alter the seating chart so that she would have fewer tables to cover, meaning a reduction in her tips. Petitioner also stated that Shu was disrespectful and rude, in a manner that caused her to believe there was a racial motivation behind his actions. Despite the fact that Shu was subordinate to Mr. Jackson, Petitioner believed that Shu was really in charge because he was a relative of Mr. Patel and therefore "untouchable" as an employee of IHOP. Petitioner's main complaint was that Shu, who was in charge of work schedules for the restaurant, scheduled her to work on Saturdays. Petitioner testified that on the first Saturday of her employment, March 24, Shu called her to come into work at noon. She replied that she could not come in until after sundown. This problem was apparently worked out to Petitioner's satisfaction, and she was not required to report to work on Saturday afternoon. However, when Shu posted the next week's schedule on the following Tuesday, Petitioner saw that she had been scheduled to work on the morning of Saturday, March 31. Petitioner complained. Both Mr. Patel and Mr. Jackson testified that Shu had merely made an error in scheduling that was rectified as soon as Petitioner notified them of the problem. Petitioner did not deny that the problem was resolved mid-week, well before any Sabbath conflict could arise. Mr. Patel testified that he wanted Petitioner to work from 4 p.m. until midnight on Saturday, March 31, so that she would not lose a day's work due to the scheduling error. Shu phoned Petitioner early on Saturday afternoon and asked her to come in. Petitioner told Shu that she could not come in until 8 p.m. Mr. Patel testified that he did not need someone to work a four-hour shift, and that Petitioner was told not to come in. As a further reason for declining to work on Saturday evening, Petitioner testified that she had only been trained for the morning shift. Mr. Jackson testified that the only distinction between the dayshift and the nightshift is that the latter is less busy. All servers are trained for the morning shift. Mr. Jackson stated that, once trained for the morning shift, a server would find the night shift "a piece of cake." Petitioner's reason for not working in the evening was not credible in this respect. Mr. Patel testified that he had no problem with Petitioner's not working on that Saturday, provided that she understood she was going lose a day. Mr. Patel stated that from his point of view the problems began when Petitioner insisted that he give her weekday hours to make up for the lost Saturday hours. Mr. Patel declined to cut another employee's hours for Petitioner. Petitioner came in to work on the morning of Sunday, April 1. Sunday morning is a busy time for IHOP. According to head server Bernadine Hengst, Petitioner stood near her at the register and voiced her complaints about Shu, who was working in the kitchen. Shu heard Petitioner and stepped into the dining room, asking her, "You got something to say to me?" Petitioner and Shu became loud, and their argument was moved outside for fear of disturbing a restaurant full of people. Petitioner finished her shift then went home and composed a letter to Mr. Patel. She made copies of the letter for every employee at IHOP. Ms. Hengst was the first to see the letter. She phoned Mr. Jackson at home to tell him about it, and Mr. Jackson phoned Mr. Patel. The letter read as follows: On March 19, 2012, I was hired to work as a server. I am a professional, pleasant, respectful, prompt and dutiful individual. As the only African-American server, it is imperative that you know since I have arrived at IHOP, I have faced fierce blatant hostility from a manager ("Shu") and co- workers ("C.C., Misti and Cherish"). I feel Shu has deliberately created a divisive and hostile working environment. It is my understanding Shu is a family member yet his behavior is definitely bad for business. On two separate occasions, Shu altered the seating chart that Brian originally created and took two tables from me. He lacks proficient management skills and is totally unprofessional, disrespectful and rude. On Sunday, April 1, 2012, Shu spoke to me in a loud, impolite manner in front of staff and customers. Shu communicated in a very bellicose fashion and for a moment, it felt as though he would physically attack me. You must take it serious that Shu's conduct is detrimental to your business. When Shu hired me I made it clear that I am Jewish and do not work on the Sabbath ("Saturday"). Nevertheless, Shu called me to come into work on Saturday about noon; I told him I would come in after the Sabbath at 7:00 p.m. The following week I was scheduled to work a Saturday, which in turn caused me to lose a day of work. Also on April 1, 2012, Shu assigned me only two booths for the whole day; when I spoke up about it he threatened to take another booth from me. This type of attitude and his unfair behavior cannot be tolerated in the United States of America in 2012. Shu is outwardly mean, discriminative, and racist towards me. He acts like a tyrant, a bully and he feels he is untouchable. On Sunday, April 1, I was only assigned two booths while my co-workers had four to six tables. This was unfair seating arrangements. At the end of the day, Bernie [Hengst] told all the servers to tip out the busboy, yet I did not because I was unjustly treated by only being assigned two tables. This was one-sided and insulting. I am an exceptional waitress and I depend on this job to pay my bills. During my first week, I was scheduled to work 36.10 hours and this week I was only given approximately 23.0 hours. Everyone should be treated fairly and equally. I ask that you continue to give me a full schedule each week. This letter officially informs you of the battles I have dealt with in your establishment and I have not worked here for one whole month. All Americans have the right to work without being harassed. I urge you to intervene and equitably resolve this issue. Ms. Hengst testified that Shu is a loud person who "talks with his hands," but she saw nothing that gave her the impression that Shu would "physically attack" Petitioner. She did not detect that Shu treated Petitioner any differently than he treated other servers. Ms. Hengst saw Petitioner as an equal participant in the April 1 confrontation. As to Petitioner's complaint about the number of tables to which she was assigned, Mr. Jackson testified that servers are always trained on two booths and then moved to four booths after training is completed. He stated that Petitioner was doing a "terrible" job working four booths, which caused Shu to move her down to two. Mr. Jackson stated that it is counterproductive to overwhelm a new server, and that the server must demonstrate the ability to perform the basics before taking on more tables. On the morning of April 2, after reading Petitioner's letter, Mr. Patel went to the IHOP and sat down for a meeting with Petitioner in hopes of addressing her complaints. Mr. Patel testified that the first thing Petitioner asked him was, "Do you know how many black employees you have?" Though he had been willing to discuss Petitioner's grievances concerning scheduling, Mr. Patel decided to fire Petitioner when she started "threatening us" based on claims of "black and white discriminating." He decided to fire Petitioner for the future of his business, because he did not want the problems associated with allegations of discrimination. Mr. Jackson was also at the April 2 meeting, and testified that Petitioner claimed she was being singled out because of her race. Based on all the testimony, it is found that Petitioner had little basis for claiming that IHOP was discriminating against her based on her race or religion during the actual course of her job. She was mistakenly scheduled to work on Saturday, but was not required to come in to the store once she made management aware of the error. She did lose one shift's worth of work for March 31, but that was partly due to her declining to work the evening shift. The evidence established that Shu Patel was loud, somewhat hotheaded, and perhaps not the ideal choice for managing a busy restaurant, but did not establish that he singled out Petitioner for particular abuse because of her race or religion. The evidence established that Petitioner's poor job performance was the cause of at least some of the friction between her and IHOP management. However, Mr. Patel's own testimony established that he dismissed Petitioner in direct retaliation for her complaint of discriminatory employment practices. IHOP offered no legitimate, nondiscriminatory reason for Petitioner's dismissal.

Recommendation Based on the foregoing Findings of Fact and Conclusions of Law, it is RECOMMENDED that the Florida Commission on Human Relations issue a final order finding that Pritesh, Inc., d/b/a IHOP 36- 151 committed an act of unlawful retaliation against Petitioner. It is further recommended that the Florida Commission on Human Relations remand this case to the Division of Administrative Hearings for an evidentiary proceeding to establish the amount of back pay/lost wages owed to Petitioner. Findings Of Fact The Parties. The Petitioner, Andrea Bateman, is a female. At all times relevant to this proceeding, Ms. Bateman was 41 or 42 years of age. Ms. Bateman is an attorney. Ms. Bateman failed to prove that she was a member of The Florida Bar during the period of time at issue in this proceeding. The Respondent, the Department of Health and Rehabilitative Services (hereinafter referred to as the "Department"), is an agency of the State of Florida. Ms. Bateman's Employment by the Department. In October of 1990, the Department employed Ms. Bateman as an attorney in the Department's Office of Child Support Enforcement. Ms. Bateman was required to be a member of The Florida Bar. Ms. Bateman's position with the Department was classified as a "Select Exempt Service" position. Pursuant to Chapter 22SE-1.002(5), Florida Administrative Code, and Part V, Chapter 110, Florida Statutes, persons employed in select exempt service positions may be terminated from employment without cause. Ms. Bateman's immediate supervisor was Chriss Walker. Mr. Walker is a Senior Attorney with the Department and, at the time Ms. Bateman was hired, also served as the Assistant Secretary for Child Support Enforcement. As of December 4, 1991, the Assistant Secretary for Child Support Enforcement, and Mr. Walker's immediate supervisor was Anne F. Donovan. At all times relevant to this proceeding, William H. Bentley was an Assistant Deputy Secretary of the Department with supervisory authority over the Department's Assistant Secretary's, including Mr. Walker and Ms. Donovan. "Productivity Enhancement" at the Department. During 1991, the Department was required to evaluate all employment positions at the Department and to reduce those positions in an effort to improve the productivity of the Department. Generally, all positions at the Department and the work performed by the persons filling those positions were considered and decisions were made as to which positions could be eliminated. The Department referred to the elimination of positions as "red-lining". The Department also made efforts to insure that any person affected by the elimination of their position would be placed in another position. Ms. Bateman's attorney position with Child Support Enforcement was identified for elimination. Another attorney position in Child Support Enforcement and Mr. Walker's Senior Attorney position were not identified for elimination. The decision to eliminate one of the attorney positions was based upon conclusion that the administrative duties of the two attorney positions could be handled by a paralegal position and the legal duties could then be handled by one attorney. Efforts to assist Ms. Bateman to find another position were not successful. Ultimately, the Department decided to find a position in which to continue to employ Ms. Bateman rather than to terminate her position and release her. The Department reclassified another vacant position so that Ms. Bateman could continue to be employed as an attorney for Child Support Enforcement. Mr. Walker was directed to create an attorney position for Ms. Bateman by the Assistant Secretary for Human Services. This decision was made during the early Fall of 1991. The Department's decision to continue to employ Ms. Bateman was based in part on the Department's concern about terminating an employee of the Department. The evidence failed to prove that the Department acted unreasonably with regard to the red-lining of Ms. Bateman's position. Ms. Bateman's Performance. During the year after Ms. Bateman began her employment with the Department, Mr. Walker, Ms. Bateman's supervisor, began to develop concerns about the adequacy of her work product. Ms. Bateman also began to evidence behavior which was not acceptable for an attorney of the Department. As a result of Ms. Bateman's odd behavior, Mr. Walker became concerned about Ms. Bateman's mental well-being. Mr. Walker memorialized his concerns about Ms. Bateman in a memorandum to Mr. Bentley dated December 2, 1991. The memorandum was revised December 19, 1991 to eliminate references to a counselor that Ms. Bateman had informed Mr. Walker she was seeing. Ms. Bateman's work deteriorated to an extent which necessitated other employees carrying out some of her duties. Among the difficulties experienced with Ms. Bateman which formed a reasonable basis for terminating her employment were the following: Ms. Bateman had difficulty communicating with other employees and her supervisor. As an attorney, Ms. Bateman was required to communicate orally and in writing. She was unable to do so in an adequate manner. Ms. Bateman failed to demonstrate good judgment and trustworthiness and, therefore, her supervisors were unable to rely upon her judgment as an attorney of the Department. Ms. Bateman's appearance was unacceptable for an employee of the Department who was required to meet and communicate with the public. Ms. Bateman's hair was unkempt and dirty, her clothes were often soiled and wrinkled, she failed to brush her teeth and she appeared not to be bathing based upon her appearance and her strong body odor. Although required to do so by Department policy, Ms. Bateman refused to give her supervisor a permanent home address or phone number. On one occasion Ms. Bateman was found asleep in the offices of the Department at night and on one occasion she was found asleep during working hours. Based upon the inadequacy of Ms. Bateman's performance, the Department had a reasonable basis for terminating Ms. Bateman's employment. Mr. Walker's Evaluation of Ms. Bateman. On December 18, 1991, Mr. Walker presented Ms. Bateman with a Professional Employee Performance Appraisal form he had completed on her performance. The Appraisal was reviewed by Ms. Bateman and signed by her on December 18, 1991. Mr. Walker gave Ms. Bateman's performance a rating of "effective" on the Appraisal. Of the factors evaluated on the Appraisal, Mr. Walker judged Ms. Bateman's performance as "excellent" on one factor, "effective" on eleven factors and "needs improvement" on nine factors. Mr. Walker gave Ms. Bateman's performance an "effective" rating despite his conclusion that her work product was not acceptable and despite his concerns about her inappropriate behavior. He did so because he had recently been directed to create a position to keep Ms. Bateman as an employee of the Department and in an effort to avoid litigation over Ms. Bateman's termination. Mr. Walker did not believe that his supervisors wanted to avoid any difficulties concerning Ms. Bateman employment. Mr. Walker failed to follow Department procedure in presenting the Appraisal to Ms. Bateman. The Appraisal was required to be reviewed and approved by Mr. Walker's immediate supervisor, Ms. Donovan, before it was given to Ms. Bateman. Mr. Walker, contrary to Department policy, presented the Appraisal to Ms. Bateman before Ms. Donovan had seen and approved it. Ms. Donovan was aware of the problems with Ms. Bateman's performance and would not have approved an "effective" rating. Upon receiving the Appraisal, Ms. Donovan discussed the Appraisal with Mr. Walker and rejected it, as it was her right to do. Ms. Donovan, consistent with Department policy, specified that Ms. Bateman would be evaluated again in sixty days. The Department's Request that Ms. Bateman Undergo a Psychological Evaluation. Although the Department had a reasonable basis for terminating Ms. Bateman's employment by the end of 1991 and in early 1992, the Department decided to attempt to discover the cause of Ms. Bateman's decline in performance and the onset of her odd behavior rather than terminate her employment. The Department made this decision in an effort to determine what assistance Ms. Bateman might need. Ultimately, the Department was attempting to determine what work, if any, Ms. Bateman was capable of performing. The Department's decision was based upon a number of incidents involving Ms. Bateman. Those incidents are included in Mr. Walker's Chronology of December 2, 1991 and his Revised Chronology of December 19, 1991 and are hereby incorporated herein. Although not all the incidents described in the chronologies were proved during the final hearing to have occurred, the Department's consideration of the incidents reported by Mr. Walker was reasonable. Due to the Department's concerns about Ms. Bateman, the Department requested that Ms. Bateman voluntarily participate in the Department's employee assistance program. Ms. Bateman refused. In order to determine what could be done to help Ms. Bateman, and to determine what duties and responsibilities she was capable of performing, the Department requested that Ms. Bateman undergo a psychological, or other, evaluation. Ms. Bateman refused. After discussing the matter with Ms. Bateman and legal counsel she had retained, the Department notified Ms. Bateman that her continued employment was conditioned upon her undergoing a psychological evaluation or some other evaluation which would allow the Department to determine what work she was capable of performing. In a letter of February 12, 1992, Ms. Bateman, through her representative, was informed of the following: As you also know, we are attempting to help Andrea address a problem which we believe exists and has been well documented over the past 16 months. In return, we need Andrea's help and cooperation. If Andrea chooses to agree to our request that she undergo a psychiatric evaluation and authorize the release to us of the psychiatrist's prognosis, diagnosis and recommendation for treatment, we will be glad to schedule an appointment for her with a psychiatrist, and will pay for such an evaluation. We will use the evaluation to determine an appropriate course of action. Ms. Bateman's Termination from Employment. Ms. Bateman continued to refuse to undergo any evaluation or to suggest any alternative course of action. Consequently, based upon Ms. Bateman's inadequate and unacceptable work performance, the Department terminated Ms. Bateman's employment with the Department on or about February 13, 1992. Ms. Bateman's termination from employment was effective February 28, 1992. Ms. Bateman was terminated from employment due to the fact that she was not adequately performing her job and she refused to cooperate with the Department to find out what could be done to help her become an effective employee. Ms. Bateman failed to prove that the Department's reason for terminating her employment was a pretext. Ms. Bateman's Charge of Discrimination. On or about September 15, 1992, Ms. Bateman filed a Charge of Discrimination against the Department with the Florida Commission on Human Relations. Ms. Bateman alleged that she had been discriminated against on the basis of sex and a perceived handicap. On February 10, 1993, the Commission issued a "Determination: No Cause" finding "no reasonable cause to believe that an unlawful employment practice has occurred " Ms. Bateman filed a Request for Redetermination on March 4, 1992. On April 12, 1993, the Commission issued a "Redetermination: No Cause" affirming its decision. On May 12, 1993, Ms. Bateman filed a Petition for Relief seeking a formal administrative hearing. In the petition Ms. Bateman alleged that the Department had discriminated against her on the basis of sex, a perceived handicap and, for the first time, age. The Commission requested that the Division of Administrative Hearings assign a Hearing Officer to conduct the hearing requested by Ms. Bateman. Alleged Sex Discrimination. Ms. Bateman failed to prove that any action of the Department was based upon Ms. Bateman's sex: she was not held to any standard or requirement based upon her sex, she was not terminated because of her sex and the Department's efforts to determine the cause of Ms. Bateman's problems was not based upon her sex. Ms. Bateman failed to prove that any Department policy or standard had a disparate impact on female employees. Ms. Bateman failed to prove that she was replaced by a male attorney. Ms. Bateman's grooming habits were discussed with her. Some of those discussions concerned the wearing of panty hose and her makeup. It must be inferred that such discussions were not carried on with male employees. The evidence, however, failed to prove that Ms. Bateman's termination was based upon these matters. Although grooming played a part in the decision to terminate Ms. Bateman's employment, it was grooming related to basic cleanliness and neat appearance required of all employees and not just female employees. Ms. Bateman failed to prove that the Department discriminated against her on the basis of her sex, female. Alleged Age Discrimination. At the time that Ms. Bateman was hired she was 41 years of age, and at the time she was terminated she was 42 years of age. Ms. Bateman failed to prove that age played any part in her treatment by the Department. This finding is supported, in part, by the fact that the difference between Ms. Bateman's age when she was hired and when she was terminated was only one year. Ms. Bateman failed to prove that she was replaced by a younger person. Ms. Bateman failed to prove that the persons who made the decision to terminate her employment were aware of her age. Ms. Bateman failed to prove that the Department discriminated against her on the basis of her age. Alleged Perceived Handicap. The Department did believe that Ms. Bateman was suffering from some mental problem. This belief was based upon Ms. Bateman's odd behavior and a concern that Ms. Bateman was "homeless". It was for this reason that the Department requested that Ms. Bateman undergo a psychological evaluation. Ms. Bateman failed to prove, however, that the Department treated her differently from the manner other employees of the Department were treated under similar circumstances. Ms. Bateman also failed to prove that the Department's request that she undergo a psychological or other evaluation to determine how to assist her to meet the requirements of her employment was made for a discriminatory reason. Under the circumstances, the Department's request of Ms. Bateman was reasonable. Ms. Bateman also failed to prove that she was terminated from employment because of any perceived handicap. The evidence proved that she was in fact terminated from employment due to her inability to satisfactorily carry out her job responsibilities. Ms. Bateman also failed to allege or prove that she has a handicap based upon her mental condition. Ms. Bateman also failed to prove that the Department discriminated against her on the basis of a handicap or a perceived handicap.

SHANNON M. SPENCE vs OCALA MANAGEMENT, INC., D/B/A QUALITY INN, 94-006652 (1994)

The Issue The issue is whether the Respondent discriminated unlawfully against the Petitioner by discharging him because of a handicap contrary to Chapter 760, Florida Statutes, and, if so, the nature and extent of financial loss suffered by the Petitioner.

Findings Of Fact The Petitioner, Shannon M. Spence, was employed from March 1993 until May 1, 1993 by the Respondent. The Respondent is an employer as defined by Chapter 760, Florida Statutes. The Petitioner, who earned on average $125/week, was employed by the Respondent as a bouncer and "bar backer", a person who assisted the bartender. On or about April 29, 1993, the Petitioner suffered an on the job injury which was duly reported to the employer and for which the Petitioner was treated at a local hospital pursuant to arrangements made by the employer. The Petitioner's injury was determined to be a right inguinal hernia, and the Petitioner was cautioned against lifting more than 25 pounds and standing for long periods of time. The Petitioner reported for work the following day, and communicated to his supervisor his inability to lift and to stand for long periods of time. His supervisor, Jess Wall or J.W., placed the Petitioner on security detail for the parking lot and entrance. There were additional light duties available for security personnel within the employer's business in which the employee could have been placed. The Petitioner's employment was terminated later that evening. The testimony is conflicting regarding whether the Petitioner was discharged because he was dating another employee, or because he was injured, or quit in sympathy with Jess Wall, who was also terminated on that evening. The most credible evidence is that the Petitioner was discharged because of his injury, but was told it was because he was dating another employee. The prohibition against dating was a new rule, it was applied against the Petitioner without any prior warning, the female employee was not discharged, and the Petitioner was the only person discharged for this activity although there were others who dated employees. The alternative theory that Petitioner quit in sympathy with the head bouncer, Mr. Wall, is specifically rejected for lack of credibility of the various witnesses. The Petitioner subsequently settled his workman's compensation claim arising from this injury with the Respondent for $15,000. No details were received regarding the allocation of moneys for medical and wages. The Petitioner is entitled to back wages from his discharge until the hearing on April 27, 1995, less any mitigation, including any portion of the settlement of his workman's compensation claim attributable to lost wages, occurring after surgical repair of the hernia when the Petitioner was reemployed. The Petitioner is entitled to reasonable costs and attorneys fees.

Recommendation Based upon the foregoing Findings of Fact and Conclusions of Law set forth herein, it is, RECOMMENDED: That the Commission find that the Petitioner was unlawfully discriminated against by the Respondent, and that the Respondent be ordered to pay the Petitioner his lost wages from May 1, 1993 until April 27, 1995 less any amounts the Petitioner earned during this period and any amounts included in the workman's compensation settlement specifically provided for wages; that the Commission retain jurisdiction for the award of damages and attorney's fees and costs; and the Commission remand the matter for a determination of the attorney's fees and costs and to permit the Respondent to present any evidence in mitigation of its damages. The Issue Whether Respondent is guilty of unlawful employment practices; to wit: disparate treatment due to Petitioner's race (Hispanic) and/or retaliation.

Findings Of Fact Petitioner is an Hispanic female. At all times material, Petitioner was employed as a Registered Nurse, Nursing Supervisor, by Respondent. Respondent is a rehabilitative nursing facility in Gainesville, Florida, which qualifies as an "employer" under Chapter 760, Florida Statutes. Since the situations complained-of by Petitioner occurred, Petitioner has continued to be employed by Respondent with no breaks in service, no decreases in pay, no change in benefits, and no demotions in rank. At all times material, Respondent has employed Caucasians, Hispanics, African-Americans, and persons of Indian sub-continent descent. Petitioner signed on March 23, 2007, and on April 5, 2007, filed a Charge of Discrimination with FCHR. The Charge alleged that the Employer Respondent had perpetrated an unlawful employment practice upon Petitioner due to her race (Hispanic) and in retaliation. On July 25, 2007, FCHR entered and served a Determination: No Cause. On August 27, 2007, Petitioner timely filed a Petition for Relief. However, her Petition for Relief only alleged discrimination on the basis of retaliation. The retaliation named was that "my evaluation would be done in a group because of a meeting with Mr. Hamilton and Mr. Hawkins." There are no references whatsoever to race or national origin within the Petition for Relief. The Petition does not specifically allege pattern, or on-going discrimination. It does not specifically allege harassment or hostile work place. It suggests only that Petitioner feels that she does not get respect and is "attacked without evidence." Via her Petition, Petitioner seeks the remedy of ". . . that they [the employer] pay for all my therapies and medication and pay for the meetings I attended.” Early on September 5, 2006, Petitioner was standing in line to punch-in on her timecard at Respondent’s facility. Barbara Washington, an African-American CNA, was standing directly behind her. Petitioner shielded her social security number from Ms. Washington’s gaze. Later the same day, Petitioner was rolling a medicine cart down the hallway in Unit Two of Respondent's facility. Ms. Washington was taking a dinner break, seated in a position near the nursing station, which permitted her to view the patients assigned to her. Unfortunately, Ms. Washington's position did not permit Petitioner and the medicine cart to pass. Petitioner requested that Ms. Washington move, so as to let Petitioner and the medicine cart pass. Ms. Washington spoke sharply to Petitioner, either because Petitioner asked her to get out of the way of the medicine cart or for reasons of Ms. Washington's own related to the morning punch-in. During a later investigation by Director of Nursing (DON) Lisa Woods Streer, several versions of what Ms. Washington actually said were elicited. However, the best and most credible evidence on this particular point is Petitioner’s testimony that Ms. Washington loudly used profanity (“the F word”) directly to Petitioner. There is, however, no evidence that, whatever the exchange entailed, any patient was disturbed, upset, or even aware of the exchange, and there is no evidence that the statements from Ms. Washington had anything to do with Petitioner’s Hispanic origin or any type of employer “retaliation.” At least three hours later on September 5, 2006, after Ms. Washington had gone off-shift and was standing outside the facility waiting for a ride home, Petitioner handed Ms. Washington a disciplinary form, known as “a counseling slip.” At that point, Ms. Washington refused to sign the counseling slip and, screaming loudly, denunciated Petitioner with additional profanity similar to her earlier verbal abuse. This language was overheard by Yadira Chavala, who was inside the building making out reports. Ms. Chavala stood up and looked out the window so as to determine who was yelling the profanity. Ms. Chavala considered the volume and content of Ms. Washington's comments to be unprofessional and unacceptable, but she did not take it upon herself to report the incident to the DON, who was not present in the facility at that time of the evening. Again, there is no evidence that Ms. Washington was attacking Petitioner’s ethnicity or acting on behalf of the employer in her screams at Petitioner. Petitioner, however, reported to the DON both incidents of loud profanity and insubordination from Ms. Washington towards Petitioner, via a copy of the counseling slip she had given to Ms. Washington and a note slipped under the DON’s door. DON Lisa Woods Streer, found these items when she came on duty the next morning, September 6, 2006. Pursuant to Respondent’s protocol, Ms. Streer asked Unit Director Karen Derrico to take written statements from staff, concerning the med-cart incident which had occasioned the counseling slip from Petitioner. The general tone of the feedback that Ms. Derrico got was that everyone in the facility had heard about the medicine cart incident, but there were no clear and reliable eye witnesses. Ms. Washington did not immediately own-up to her conduct and told DON Streer that Petitioner had made Ms. Washington feel like a thief by covering Petitioner’s social security number when they punched-in together the morning of September 5, 2006. The DON viewed this comment by Ms. Washington as a counter-accusation of some kind (possibly a complaint of discrimination) against Petitioner, and so the investigation continued. At some point, Ms. Chavala came forward to describe what she had heard from inside the building when Ms. Washington was cursing in the patio/parking area. Petitioner did not like the taking of statements and considered the process to be an attack on herself. She also did not like the fact that she was called in for a meeting on September 13, 2006, but was informed after she had arrived that the meeting had been put off to the next day. By September 13, 2006, the decision to discipline Ms. Washington had been made, because by that time Ms. Chavala had come forward concerning the second incident, but because the DON felt that Petitioner “had backed Ms. Washington into a corner” Petitioner required some counseling. Upset that a meeting was to take place the next day, Petitioner telephoned Mr. McKalvane of Respondent’s Human Resources Department in Pensacola, to complain about how the September 5, 2006, situation was being handled. Petitioner testified, without corroboration, that Mr. McKalvane told her that he could not talk to her before the next day’s meeting, but would attend the meeting by speaker phone. On Thursday, September 14, 2006, a two-hour meeting was held at the facility. DON Streer; Administrator George C. Hamilton; Unit Director Derrico; Ruthie Moore, the facility’s Staff Development Coordinator; and Petitioner were present. Streer, Hamilton, and Derrico are Caucasians. Moore is African- American. Mr. McKalvane's race/national origin is not of record, but he did not appear at the meeting, even by telephone. Petitioner felt betrayed because Mr. McKalvane did not attend the September 14, 2006, meeting by telephone. At the September 14, 2006, meeting, Ms. Moore suggested that if Petitioner had known that Ms. Washington was upset, it might have been wise for Petitioner to wait until the next day to hand Ms. Washington her counseling slip. Petitioner was offended by this comment because she believed her delay of three hours after the medicine cart incident before issuing the counseling slip had been sufficient. At the September 14, 2006, meeting, DON Streer suggested that Petitioner might want to get with Ms. Moore for some in-service instruction on how to be a better supervisor. Petitioner was offended by this suggestion, because Petitioner perceived no fault in her handling of Ms. Washington. At no time has Petitioner ever been required by the employer to take supervisory in-service training as a result of the September 5-14, 2006, events. In fact, Petitioner has not taken such training or any similar one-on-one training or in- servicing with the employer, and she has not been penalized for not doing so. As a result of Petitioner’s counseling slip concerning the September 5, 2006, incidents with Ms. Washington, Ms. Washington was suspended from work for one day without pay, but Petitioner was not disciplined in any way concerning Ms. Washington’s accusations. Petitioner suffered no discipline or loss in pay, position, or benefits as a result of the September 5, 2006, or September 14, 2006, events. Petitioner submitted that the employer’s punishment of Ms. Washington was somehow discriminatory against Petitioner because it took management nine days to come to the one-day suspension of the person that Petitioner wanted to be disciplined. However, the only comparator that Petitioner was able to offer was a situation which occurred a year later, in 2007. On that occasion, an oral confrontation occurred between an African-American female worker and a Caucasian female supervisor. There is no specific evidence concerning how similar the 2007 incident was to any of the September 5, 2007, incidents involving Ms. Washington and Petitioner. However, in the 2007 incident, the African-American female immediately admitted wrong-doing, and the very next day, the employer suspended her for one day without pay, just as the employer had suspended Ms. Washington for one day without pay in 2006, in response to Petitioner's counseling slip. Ms. Streer testified credibly that in 2007, the investigation and counseling period was shortened by the subordinate’s immediate admission of wrong-doing and lack of accusations against her reporting supervisor. Approximately September 20, 2006, Petitioner sent a 19- page, typewritten letter of complaint to Respondent’s corporate headquarters. The scope of this letter is not clear because it is not in evidence. Petitioner was supposed to be evaluated annually each September, but she did not receive her evaluation in September 2006. She reminded the DON in November 2006, that she had not yet been evaluated. Shortly thereafter, Petitioner received her annual evaluation which bears a date of October 5, 2006, signed on October 22, 2006, by Weekend Nursing Supervisor Sneha Rema, R.N. Supervisor, and signed-off on by DON Sterer on October 31, 2006.1/ Ms. Rema received no input for her 2006 evaluation from the DON or Administrator. By observation, Ms. Rema appears to be a member of one of the ethnic groups originating on the Indian sub-continent. She rated Petitioner as "exceptional" in categories "work quality," "work quantity/productivity," and "compliance & adherence to policies," and as "meets expectations" in categories "core values" and "leadership skills." Under the 2006, evaluation's heading, "Areas of Improvement, Developmental and/or Upcoming Objectives," Ms. Rema put this comment about Petitioner: May improve her leadership skills by attending seminars on interpersonal relationship and how to influence others to accomplish goals in constructive way and team building from a constructive point-of- view. Ms. Rema approaches evaluations with the belief that each employee has different levels of education and skills, should be encouraged to constantly improve, and can best improve if supervisors point out to the employee performance areas susceptible of improvement by the employee. This viewpoint was Ms. Rema’s sole motivation in making the foregoing comment. Ms. Rema views these types of comments as a way of pointing out goals, not failures. Contrariwise, Petitioner holds the personal belief that unless every single nurse received identical language on the foregoing part of his or her respective annual evaluation, regardless of that employee’s individual circumstances and regardless of who wrote the evaluation, then Petitioner has suffered a personal attack and discriminatory treatment by the employer. There is no evidence that the 2006, evaluation caused Petitioner any loss of pay, position, benefits, or hours. In fact, she received a raise. If the raise was delayed by one month, that information does not appear in the record. At some point between September 20, 2006, which was the date of Petitioner’s letter, and the end of November 2006, (the exact date is not of record), Mr. Ken Hawkins, a consultant of Respondent’s corporate personnel office in Tampa, journeyed to the facility and met with Petitioner to try to resolve her concerns. Mr. Hawkins race/national origin is not of record. The meeting was more acrimonious than harmonious and ended with Mr. Hawkins advising Petitioner that her concerns “were history” and he was not going to go over everything that had already been addressed. Petitioner was offended by Mr. Hawkins’ description of the events that concerned her as “history”; because she felt he yelled at her; and because she felt he had made her come to the facility for a live meeting when he could have just told her “no” over the phone. The two-hour September 14, 2006, counseling meeting and the brief meeting sometime after September 20, 2006, during which Mr. Hawkins told Petitioner he was not going to go over her concerns again are the meetings for which Petitioner feels Respondent employer should pay her. Sometime after her meeting with Mr. Hawkins, Petitioner filed a discrimination complaint with the City of Gainesville Office of Equal Opportunity. The date of this complaint is uncertain. However, it had to precede March 9, 2007, because on that date, in response to the city action, and in accord with Respondent’s Human Resources Office’s instructions, Administrator Hamilton wrote Petitioner and provided her with the Respondent’s 1-800 telephone number to report discrimination. Respondent has an anti-discrimination policy and also posts the 1-800 number in its facilities. Petitioner also filed an EEOC discrimination complaint, and the underlying discrimination complaint herein was filed with FCHR on April 5, 2007. Because her FCHR complaint was signed on March 23, 2007, the undersigned takes it that the EEOC complaint was filed at approximately that time. Petitioner has complained that, as a result of her September 20, 2006, letter to corporate headquarters, she was told, either by Ms. Streer or by Mr. Hawkins that she must be evaluated “in a group.” Her testimony on this issue as to who told her this vacillated, and the group rating was not confirmed by any other witness nor by the signatures on the 2006 and 2007 evaluations in evidence. Although Ms. Streer signs-off as the next level of management on evaluations, that action hardly constitutes "group rating." The evidence as a whole provides the overall sense that Petitioner has been, in the vernacular, “prickly” about what she perceives as situations of disparate treatment, none of which were supported by credible evidence in the instant case, and that as a result of Petitioner’s heightened sensitivity, none of Petitioner's on-site superiors want to expose themselves to old or new accusations by her, but the greater weight of the credible evidence is that in 2007, Theresa Volk, Unit Manager of Station One, supervised Petitioner for only two days per week, so Ms. Volk believed that Petitioner's supervisor for the remainder of the week should have input to Petitioner's 2007 evaluation. Ms. Volk’s name and that of Ms. Rema appear on the first page of Petitioner’s 2007 evaluation, but only Ms. Volk signed as her “evaluator” on October 9, 2007. In that 2007, evaluation, Ms. Volk rated Petitioner “exceptional” in “work quality” and “work quantity/productivity,” and “meets expectations" in “customer service,” “compliance & adherence to policies,” “core values,” and “leadership skills.” Under “areas for improvement,” she made a comment about wound care documentation intended for Petitioner’s improvement. After receiving her September 2007, evaluation, which had been signed by Ms. Volk on October 9, 2007, Petitioner suffered no loss in pay, position, or benefits, and, once again, received her annual raise. Petitioner testified that she got her 2007 raise “late” but did not quantify how late. Petitioner wrote Ms. Volk a letter treating Ms. Volk’s evaluation comment for improvement as a criticism related to a particular past incident, and was offended when Ms. Volk refused to stop the work she was doing to read Petitioner’s letter. Respondent has a policy which requires employees to request personal paid time-off 30 days in advance. Petitioner testified that under this system, she properly requested time off for October 20, 2007, and November 3, 2007, but that shortly before those dates, Ms. Streer told her she could have only one date or the other, but if Petitioner wanted to take off both days, Petitioner had to get a replacement for one day. While this much of Petitioner’s testimony is unrefuted, Petitioner was not persuasive that she ever got written approval of the dates, and she did not establish any connection between the denial of two days' leave and either her Hispanic heritage or as retaliation for her prior letter to corporate headquarters or as retaliation for any of her discrimination complaints in March or April 2007. Petitioner presented no evidence that she lost pay, position, promotion or benefits at any time, on the basis of retaliation or her Hispanic heritage. Petitioner testified that she had to go into therapy and pay for medications as a result of the stress that the foregoing incidents have caused her. She presented no corroborative medical testimony or evidence of any professional diagnosis and further presented no medical or pharmaceutical bills to establish any damages therefor.

Recommendation Based on the foregoing Findings of Facts and Conclusions of Law, it is RECOMMENDED that the Florida Commission on Human Relations enter a final order dismissing the Complaint of Discrimination and the Petition for Relief. The Issue The issue to be resolved in this proceeding concerns whether the Petitioner was the victim of an unlawful employment practice, by allegedly being subjected to discriminatory terms and conditions of employment, based on her race.

Findings Of Fact The Petitioner Rosa Pearl McDonald is an African- American female. She was employed at times pertinent to this dispute as a driver, delivering meals to elderly clients of the Walton County Council on Aging. The Petitioner is also a Licensed Practical Nurse (LPN). The Respondent, Walton County Council on Aging is a charitable social services agency, domiciled in Walton County. As pertinent to this case, it delivers and serves meals to elderly clients throughout the county, through the use of hired and volunteer drivers. The Petitioner was a recently-hired driver, of less than 30 days' employment, when the operative facts occurred. The Petitioner was still in probationary employment status. The Petitioner contends, in effect, that she was subjected to disparate terms and conditions of employment due to her race. She states she was the only black driver and that her supervisor, Kay Brady, is white. The Petitioner noticed after hiring, that the food delivery boxes had the assigned drivers' names on them. The box she was assigned had only the route name. She states she had asked Ms. Brady to place her name on the box, but the route name was placed on the box instead. The Petitioner acknowledged, upon cross-examination, that she did not know who placed the route label on the food box. She was still a probationary employee at this time. The probationary period was 90 days, and the Petitioner resigned only 30 days or less, after her hiring. Inferentially, it may be that the probationary status was the reason her name was not used, or it may have been an oversight. There is no evidence other than the Petitioner's stated opinion, that the labeling situation was due to racial animus. In fact, the Petitioner had been hired, and fired, by the Respondent twice in the past, and yet it still re-hired her shortly before the subject situation arose. Moreover, Ms. Brady gave the Petitioner extra hours of work when she requested them. These facts tend to negate the existence of racial bias in the imposition of any term or conditions of the Petitioner's employment. The Petitioner also contends that she was treated disparately, compared to other drivers. She maintains that a white driver, "Margaret," on occasion had guests ride along with her on her deliveries. The Petitioner states that she asked twice to be allowed to have friends ride with her on deliveries, but Ms. Brady would not allow it. Ms. Kay Brady was the Petitioner's supervisor. She established with her testimony, that the Respondent has a regularly-adopted policy of allowing no riders to accompany route drivers, other than trained volunteers or office personnel, who occasionally go along on deliveries to ascertain that client services are being provided appropriately. Occasionally spouses of regular drivers make deliveries when the driver is ill or must miss work for any reason. The Respondent also uses volunteer drivers, as well. In both situations, however, the spouses or volunteers are given training before being allowed to make deliveries to clients, chiefly because of the privacy requirements of the "Hippa Privacy Law" and the Respondent's client confidentiality policy. The point is, the Petitioner sought to have friends ride with her on deliveries (for reasons which are unclear) and her friends were not trained and oriented to the Respondent's job requirements. The Respondent had a policy of not allowing friends or family to simply accompany drivers without such training, and for reasons which did not relate to job requirements, except in unusual circumstances. One such circumstance involved a driver who needed to be allowed to take her grandchildren with her on a delivery or deliveries, when she was unable to engage a baby sitter. This was an isolated and unusual occurrence, during a time when the children were out of school for Christmas break. On such rare occasions, the Respondent has allowed children to accompany drivers on short trips, on routes near their homes and where children can safely remain in vehicles during deliveries. The above circumstance was probably the one involving driver "Margaret" which the Petitioner described in her testimony. In any event, however, the Respondent had a regular written policy regarding requirements and qualification for persons making deliveries to clients and it followed it, with the above rare exceptions. The employee handbook, Council on Aging Handbook and the Employee Handbook receipt, in evidence as Respondent's Exhibits 5, 6, and 4, respectively, show this policy and the fact that the Petitioner was informed of it. The Petitioner's friends, whom she sought to have accompany her, were not shown to be qualified under the Respondent's requirements. Because the reasons for requesting the accompaniment of proposed "riders" were different for employees other than the Petitioner, referenced in the above examples of policy exceptions, these other drivers were not shown to be similarly-situated exemplar employees, who received more favorable treatment. In fact, the Petitioner was favored in a different way. The Respondent was able to give the Petitioner extra hours of work "sitting" with elderly clients when their caregivers were absent. The Respondent and Ms. Brady would learn about such needs through its normal service contacts with clients and their families. Because the Petitioner is an LPN, the Respondent would refer her for extra work, to her benefit. In summary, the preponderant evidence and above facts show that no adverse employment action occurred. There were no verbal or other acts or adverse employment directives toward the Petitioner at all, much less any that evidence racial animus, by supervisors or employees. Therefore, there was no racially hostile environment, so there could not be one in which her terms and conditions of employment were altered. Moreover, since there were no disciplinary actions toward the Petitioner, nor adverse employment directives or conditions (in fact she was favored with extra hours), there could be no constructive termination. There certainly was no actual termination. The Petitioner, in fact, resigned her position, telling both Ms. Brady and Mr. Moore that it was for health reasons. She admitted as much in her testimony.

Recommendation Having considered the foregoing Findings of Fact, Conclusions of Law, the evidence of record, the candor and demeanor of the witnesses, and the pleadings and arguments of the parties, it is, therefore, RECOMMENDED that a final order be entered denying the Petitioner's Petition for Relief in its entirety. The Issue The issue is whether Respondent committed an unlawful employment practice by discriminating against Petitioner based upon her race.

Findings Of Fact Respondent is an "employer" within the meaning of section 760.02(7), Florida Statutes. Petitioner, an African-American female, submitted an application for employment directly with the store manager, Jerry Wienhoff. Mr. Wienhoff personally interviewed Petitioner and hired her within 48 hours of her application for the afternoon clerk position. She began working for Respondent on July 21, 2009. Petitioner received a notice of a disciplinary issue on March 9, 2010. Respondent cited Petitioner for failure to complete her work in a timely manner. Petitioner was warned that if her work did not improve, her employment would be terminated. Not long after issuance of this disciplinary notice, Mr. Wienhoff, the store manager and Pensacola Regional Manager for 17 years, began receiving complaints about Petitioner's behavior. One complaint came from a long-time customer, while another came from a co-employee. The complaints were that Petitioner treated them rudely. During her employment, Petitioner complained that her work duties were heavier than those of the morning clerk. Mr. Wienhoff relieved Petitioner of certain duties related to tagging each garment dropped off during the afternoon shift. None of the other stores out of the four area stores had similar requests to remove this duty. Petitioner testified that the morning clerk, a white female, Amanda Sidner, was given a lighter workload. Petitioner further testified that Ms. Sidner was given additional hours during Petitioner's vacation, yet Petitioner was not given additional hours during Ms. Sidner's vacation. Mr. Wienhoff testified and Petitioner admitted that she took vacation days during the same week that Ms. Sidner took vacation days. Further, Petitioner was given additional hours during the days Ms. Sidner was on vacation, and the balance of those hours that Petitioner was not interested in working went to Petitioner's daughter, Anastarsia Martinez, also an African- American female. On December 14, 2010, Petitioner was issued her second and final corrective action report by Mr. Wienhoff. At that time, Mr. Wienhoff terminated Petitioner due to the ongoing complaints about her behavior in the workplace. Respondent also established the racial composition of every employee under Mr. Wienhoff's supervision. The company profile in Pensacola shows a racially diverse mix of employees. Petitioner candidly testified that she never heard Mr. Wienhoff make racially insensitive comments to her or any other employee. Her claim of discrimination is based upon favoritism. She believes that other employees were treated better than she, but did not tie this perceived favorable treatment to their race.

Recommendation Based upon the Findings of Fact and Conclusions of Law, RECOMMENDED that the Florida Commission on Human Relations enter a final order finding that no act of discrimination was committed by Respondent and dismissing the Petition for Relief. The Issue Whether Respondent violated the Florida Civil Rights Act of 1992, as alleged in the Charge of Discrimination filed by Petitioner on January 16, 2001.

Findings Of Fact Petitioner was employed by Respondent, Toucan's Restaurant, as a cocktail waitress. The record is unclear as to when she began her employment there. Her last day on the job was March 18, 2000. The record is not entirely clear as to the exact legal entity that owned Toucan's Restaurant (the restaurant). However, Mary Ann Pistilli was an apparent officer of the corporation which owned the restaurant and acted in the capacity of manager. There is no evidence in the record showing that Mary Ann Pistilli's husband, Craig Pistilli, was an owner or manager of the restaurant. However, he was sometimes at the restaurant. The extent or frequency of his presence at the restaurant is also unclear. According to Rene Brewer, a bartender at the restaurant, Mr. Pistilli "wasn't there a lot." While present at the restaurant, Mr. Pistilli would sometimes give direction to employees on certain issues. For example, he directed Ms. Brewer as to the amount of liquor she put in a customer's drink. It was Ms. Brewer's understanding that Mrs. Pistilli knew that Mr. Pistilli would sometimes direct employees regarding such employment tasks. However, Mrs. Pistilli did not testify as to her knowledge of Mr. Pistilli's actions of giving any direction to employees, and, therefore, the extent of her actual knowledge of Mr. Pistilli's actions regarding directing employees on employment matters was not established. On Friday nights, Karaoke entertainment was offered at the restaurant. During a certain song, Petitioner would perform a dance. Petitioner was not asked to perform this dance by her employer and did so voluntarily. Mrs. Pistilli was opposed to Petitioner dancing in this manner. Petitioner would stand on a chair near the Karaoke machine with her back to the patrons, let down her hair, and unbutton her shirt giving the appearance she was undressing. However, she wore a t-shirt under the shirt she unbuttoned. When she turned to face the patrons, it became clear that she wore the t-shirt underneath the shirt she unbuttoned. Then she would dance around the restaurant and its bar area and patrons would give her money for dancing. The money was given to her by both male and female patrons in various ways. For example, when a male patron would put money in the side of his mouth, she would take it with her teeth. Petitioner's dancing was not sexual in nature but was more in the nature of a fun part of the Karaoke. On March 18, 2000, Petitioner was in the bar area of the restaurant. Petitioner's description of what happened is as follows: I was at work, and Craig had come in with one of his friends. It was his friend's birthday. And the bar wasn't very busy at all. I had two customers that just came in. And he was just being loud, and he came over and asked me if I'd get up on the bar and dance, and I told him no. He set me up--at the end of the bar is like a long, and then there's a little like an L, and that part lifts up. The lift-up part was down, and he set me up on top of that. And I told him, you know, to leave me alone. And when I got down, he slapped me on the rear. And then he backed up, he unbuttoned his shirt, he unzipped his pants and said I ought to go in the dining room and dance around like this….Craig's friend was sitting at the bar, and Craig came over and said I got twenty dollars in my pocket, I want you to dance, it's Chris' birthday, and I told him no. And so a few minutes later he came over, he grabbed my arms, he shoved me against-- lifted my arms over my head, shoved me in the corner of the bar. I told him he was hurting me . . . . After the third time of me telling him that he was hurting me, he finally let go and he backed up and he went 00-00-00. And I was very upset. I went into the kitchen, I was crying very hard . . . . While Petitioner's description of what happened contains hearsay statements purportedly made by Mr. Pistilli, Petitioner's testimony describing Mr. Pistilli's actions and her reaction to the incident is deemed to be credible. Petitioner sustained physical injuries as a result of this incident with Mr. Pistilli.2/ Ms. Brewer was behind the bar on Petitioner's last day of employment. She saw Mr. Pistilli come into the restaurant with a friend. Mr. Pistilli appeared to her to be intoxicated. She saw Mr. Pistilli hug Petitioner in front of the bar. She did not see any other contact between Mr. Pistilli and Petitioner on that day. However, she had seen Petitioner hug Mr. Pistilli on other occasions. She also saw Petitioner hug restaurant patrons on other occasions. Teresa Woods was another bartender who worked at the restaurant. On Petitioner's last day of employment, Ms. Woods briefly saw and spoke to Petitioner in the kitchen of the restaurant. Petitioner was upset and told Ms. Woods that her neck and back were hurt. Petitioner then left the building and did not say anything further to Ms. Woods. Petitioner did not return to work. Mrs. Pistilli was not at the restaurant on March 18, 2000. She did not see any of the events that occurred between Petitioner and her husband. She had heard about the allegation that her husband hugged Petitioner but was unaware of the other allegations: Q: When did you first become aware that Mrs. Youngs had filed a workers' compensation claim? A: I can't recall exactly when it was. They did call me. I can't tell you exactly how long a period of time-- Q: Can you give us your best approximation of how close it was in time to--if you assume that the date-- A: A month. A month maybe. I don't know. It was well after. * * * Q: And did the comp carrier tell you the nature of the injury or how Mrs. Youngs contends that it happened? A: Yes, And he came in and I spoke with him, and they said that they'd be back in touch, and never heard from them. Q: And what did they tell you or what was their understanding of what Mrs. Youngs was contending happened after that conversation? A: All I know is my husband hugging her. This stuff I heard today is all new stuff about zippering pants. I never heard of any of that. I never heard any of that. While Mrs. Pistilli was generally aware of an ongoing workers' compensation claim by Petitioner against the restaurant, she was unaware of the most egregious allegations made regarding her husband until well after the fact. While she understood that her husband hugged Petitioner on March 18, 2000, her knowledge of that was gained approximately one month after the fact when finding out about a workers' compensation claim. Moreover, she had knowledge that during Petitioner's period of employment at the restaurant, Petitioner occasionally hugged her husband and some restaurant patrons. No competent evidence was presented that Mrs. Pistilli knew or should have known that Mr. Pistilli engaged in the behavior described by Petitioner that took place on March 18, 2000. Petitioner acknowledged that other than the incident on March 18, 2000, Mr. Pistilli did not make any references to Petitioner about her body during her employment at the restaurant.

Recommendation Based upon the foregoing Findings of Fact and Conclusions of Law set forth herein, it is RECOMMENDED: That the Florida Commission on Human Relations enter a final order dismissing the Petition for Relief. The Issue The issue is whether Respondent, Agency for Health Care Administration (“AHCA” or “the Agency”), discriminated against Petitioner, Bridget D. Nelson, now Levens (“Petitioner”), based upon her sex, race, or age, in violation of section 760.10, Florida Statutes (2017),1/ and/or whether the Agency retaliated against Petitioner for the exercise of protected rights under section 760.10.

Findings Of Fact The Agency is an employer as that term is defined in section 760.02(7). Petitioner, an African American female born on July 23, 1968, was hired by the Agency as a Program Administrator in the Bureau of Recipient and Provider Assistance (“RPA” or “Bureau”) on September 13, 2013. She worked in that job position until her employment was terminated on May 18, 2017. Petitioner’s position was classified as Select Exempt Service (“SES”). SES employees serve at the pleasure of the agency head and are subject to suspension, dismissal, reduction in pay, demotion, transfer, or other personnel action at the discretion of the agency head. Such personnel actions are exempt from the provisions of chapter 120, Florida Statutes. § 110.604, Fla. Stat. At the time she was hired, Petitioner supervised two employees. Luis Diaz was a fellow Program Administrator who sat at a desk next to hers. Both Petitioner and Mr. Diaz were supervised by Damon Rich. Petitioner had, prior to her employment with the Agency, worked with Mr. Rich and Mr. Diaz at Affiliated Computer Services (“ACS”), a private sector company. Mr. Rich testified that he supervised Petitioner for a time at ACS and that he became friends with Petitioner and her husband. Mr. Diaz also worked in a higher position than Petitioner at ACS. Petitioner testified that when Mr. Rich hired her to work at the Agency, he advised her that she should consider herself an equal to Mr. Diaz and that she should not let Mr. Diaz make her feel that she was answerable to him. Petitioner testified that Mr. Diaz often had conflicts with female employees and would look to Petitioner for assistance. Petitioner testified that she assumed supervision of Ivis Suarez, one of Mr. Diaz’s employees, at his request because he could not make her understand what he needed her to do. Petitioner stated that Ms. Suarez filed a complaint against Mr. Diaz. Petitioner disagreed with the complaint at the time but attributed her disagreement to not yet understanding the full dynamics of the situation in the office. Petitioner only knew that the working environment was not good. Petitioner testified that she was able to work with Ms. Suarez, who eventually resigned her position with the Agency. Petitioner described a similar situation that occurred in 2014. Another subordinate of Mr. Diaz, Natasha Hampton, complained to Petitioner that she did not understand the training she was receiving. Mr. Diaz complained to Petitioner that Ms. Hampton was not catching on to the job. Petitioner agreed to take over the supervision of Ms. Hampton. Petitioner testified that she asked Mr. Diaz for copies of Ms. Hampton’s workplace “coachings” because she was taking over her supervision in the middle of the year and needed to know where Ms. Hampton stood in terms of her annual evaluation. Petitioner stated that Mr. Diaz ignored her repeated requests for the coachings. By 2016, Mr. Rich had been promoted to Bureau Chief and Mr. Diaz had been promoted to a supervisory position that made him Petitioner’s direct superior. Petitioner was upset that she was not consulted about Mr. Diaz’s “elevation.” Mr. Rich believed that Petitioner’s subsequent problems in the workplace were attributable to her resentment at having to answer to Mr. Diaz. For her part, Petitioner claimed that Mr. Diaz created a hostile working environment. She testified that every time Mr. Diaz had a problem with a female employee, she would end up as that employee’s supervisor. She stated that Mr. Diaz once told her that if an order were given to downsize their unit, he would recommend eliminating all of her subordinates but one. One incident that especially galled Petitioner was Mr. Diaz’s procrastination in signing a tuition waiver that would allow her to take the final class required for her college degree. Mr. Rich explained that the delay in approving Petitioner’s waiver was because her unit was about to implement a procurement. Mr. Rich and Mr. Diaz needed to make sure that accommodating Petitioner’s request to attend class would not adversely affect the Agency’s business needs. Petitioner nonetheless complained to the HR department about the delay in processing her tuition waiver, which was eventually signed by Mr. Diaz. Petitioner testified that she resented being required to go to HR for something so minor and attributed her problem to the hostile environment created by Mr. Diaz, who did everything he could to make things more difficult for her. Mr. Rich testified that school attendance seemed a greater priority for Petitioner than her job duties. Petitioner offered other examples of what she termed Mr. Diaz’s hostile behavior. A former employee, Ms. Suarez, had expressed an interest in coming back to work at the Agency but Mr. Diaz declined to interrupt a meeting to speak with her on the phone. Petitioner stated that other employees were constantly coming to her with problems because they were afraid to talk to Mr. Diaz about them. Petitioner stated that Mr. Diaz would leave her out of meetings. A rumor circulated that Mr. Diaz and Mr. Rich had received raises at a time when no one else in the unit had received a raise for several years, which made the employees feel underappreciated. Petitioner complained that Mr. Diaz required her to submit leave requests for his approval, whereas Mr. Rich had not done so. Petitioner believed that as a supervisor, she should not be required to ask for time off. She met with Mr. Rich, who explained to her that every manager deals with things a little differently and that even the Secretary of the Agency must obtain the Governor’s approval to be out of the office. Mr. Rich’s practice had been to respond to leave requests only when he intended to deny them, which he believed may have left Petitioner with the impression that she did not have to obtain approval. Mr. Diaz wanted to affirmatively grant the leave requests. Mr. Rich testified that Petitioner’s leave requests were not handled any differently than those of any other employee in her unit. He did not consider the issue worth the time Petitioner was taking to argue about it. After the leave request dustup, Mr. Rich sent Petitioner an email, dated August 15, 2016, stating his intention to schedule a meeting with Mr. Diaz and her, “to get to the root of communication and other underlying issues to determine the best way forward. We cannot continue to have this type of fragmented leadership and disagreement about routine functions between you and your supervisor, Luis [Diaz].” A follow-up email from Mr. Rich indicated that the meeting was somewhat successful, but the resolution was not to be lasting. Petitioner complained about her annual evaluation. She stated that during a full year of working under Mr. Diaz, she had received no one-on-one coachings. Petitioner conducted monthly coachings with her subordinates so that they would know exactly where they stood on their evaluations. Petitioner testified that she felt blind-sided when she received her annual evaluation from Mr. Diaz for 2015-16 and it was substantially lower than her 2014-15 evaluation done by Mr. Rich. She submitted a written rebuttal to the evaluation and declined to sign it until she could meet with Mr. Rich to discuss it. In his testimony, Mr. Rich made it clear that by this time, he was tiring of Petitioner’s inability to work out her disputes with Mr. Diaz without involving him or other Bureau- level personnel. When he hired Petitioner, Mr. Rich was overseeing 17 employees. Petitioner was part of his leadership team and he had the time to meet regularly with her and deal with her complaints. However, Mr. Rich was now a Bureau Chief in charge of 230 employees. Petitioner was no longer part of Mr. Rich’s leadership team and no longer directly reported to him. Directly dealing with Petitioner’s complaints now meant that Mr. Rich was forced to put aside other duties. Petitioner testified that HR was pressuring the unit to submit the performance evaluations, but that she continued to resist signing hers. Mr. Rich met with her and agreed to change one score on her evaluation. Petitioner then signed the evaluation “under duress.” Petitioner complained about the lack of input she was allowed into her performance expectations for the following year, 2016-17. She stated that Mr. Rich used to ask for her input and give her plenty of time to respond. Mr. Diaz sent her an email with the draft performance expectations for Petitioner and her subordinates two days before the final version was to be submitted to HR. He asked her to go over the expectations with her staff. Petitioner stated that her staff was confused and did not understand the proposed expectations. Petitioner again took the issue to Mr. Rich. Mr. Rich explained that the performance expectations had been set by him in conjunction with his leadership team, which did not include Petitioner. Mr. Rich testified that, at Petitioner’s suggestion, he met one-on-one with each person on her staff to learn the nature of their problems with the draft performance expectations. He stated that he met with them in this manner to hear their independent opinions and to allow them the confidentiality to speak frankly. None of Petitioner’s subordinates reported any concerns with the performance expectations. On September 14, 2016, Petitioner filed a grievance with HR that was investigated by the Agency’s Office of Inspector General. Petitioner complained of a hostile working environment and gender discrimination. The factual allegations involved the performance evaluation, performance expectations, and tuition waiver disputes discussed above. The investigation disclosed no statutory, rule, or policy violations, and found insufficient evidence to prove or disprove Petitioner’s hostile working environment claim. By way of a written report dated October 11, 2016, the case was closed with no further activity recommended by the Office of Inspector General. Both Mr. Diaz and Mr. Rich testified that they were unaware of Petitioner’s grievance at the time she filed it. Mr. Rich testified that he received a copy of the Inspector General’s report and only then became aware of the grievance. Mr. Rich testified that Petitioner never told him that she felt discriminated against because of her sex, age, or race. Petitioner testified that in early 2017 she began finding particles of some white powdery substance in her office and on the path she walked to her office. She did not know what the substance was but stated that it triggered her asthma. Petitioner was convinced that someone at the Agency was putting the white substance in her office. She eventually changed offices, but the white substance began appearing there as well. Mr. Rich testified that he investigated the situation. He noted that Petitioner was an inveterate user of air fresheners and cleaners, to the point that other employees complained that the fumes coming from Petitioner’s office were making them nauseous. Mr. Rich, and then-HR Bureau Chief Cynthia Mazzara, went into Petitioner’s office after hours to seek the source of the white powder. They sprayed one of the air fresheners. When the particles dried on the desk, they turned white. This solved the mystery to Mr. Rich’s satisfaction, though Petitioner remained convinced she was being sabotaged. Mr. Rich testified that Petitioner’s behavior and attitude continued to worsen over time, especially after the Office of Inspector General found no cause to credit her claims of a hostile working environment and gender discrimination. She refused to comply with a section-wide requirement that office doors remain open. She continued to expect the Agency to accommodate her frequently changing school schedule. Petitioner continued to over-complicate work assignments and challenge directions from her superiors. She even requested that Mr. Rich cease using the color red for emphasis in his emails because red “denotes yelling and angry emotions.” The final straw for Mr. Rich came in early May 2017, when Petitioner encouraged and facilitated another employee’s falsification of a time sheet. The employee was out of annual leave but expressed a desire to go home and deal with a situation involving a relative. Petitioner sent the employee home, then falsely reported that the employee was not feeling well so that she could use sick leave. In a memo to HR dated May 2, 2017, Mr. Rich outlined his reasons for wishing to terminate Petitioner’s employment. The memo stated as follows, in relevant part, omitting references to attached documents: This memo is to provides [sic] a summary of expressed concerns regarding the conduct of employee Bridget Nelson. * * * During her employ, Ms. Nelson has occasionally displayed instances that border [on] insubordination, but recently there has been an increased [sic]. Of specific concern is her ability to “resolve any difference with management in a constructive manner.” Her communications are almost always accusatory in nature, taking no consideration of her own accountability in related issues. Additionally, her behavior is becoming more disruptive to the work environment, sometimes affecting those outside the Bureau. The following are some examples where Ms. Nelson has not been constructive in her interactions with management and/or caused disruption in the work place. On August 11, 2016, Ms. Nelson submitted a rebuttal to her performance expectations . . . . Mr. Diaz and I had previously met with Ms. Nelson to discuss her concern and there were few concerns expressed compared to the document sent to Mr. David Rogers (my boss), Mr. Diaz and myself. On the same day, I responded to Ms. Nelson concerning her email and informed her that I would meet with her and her staff to evaluate the concerns. During the week of August 15, 2016 I met with Ms. Nelson individually, followed by individual meetings with her staff. Her staff was unaware of the concerns to which Ms. Nelson was referring and understood their performance expectations. On August 15, 2016 Ms. Nelson had an adverse reaction to an email sent by her supervisor, Mr. Luis Diaz. She characterized the email as “unprofessional” and seemed to imply that managers have special privileges in the context of the issue raised [i.e., Petitioner’s belief that as a manager, she was not required to have leave requests approved by Mr. Diaz]. Ms. Nelson does not take the time to properly read and respond to emails in context. There is a sense of entitlement by Ms. Nelson that the Agency work is second priority to her needs. In or around March of 2017 Ms. Nelson had to be relocated to a different office after allegations that someone had sabotaged her office by spraying some foreign substance, which produced a strong odor, and “white residue” in her office.[3/] On March 9, 2017 I sent an email directly to Ms. Nelson about discontinuing the use of chemicals in her new office and sent a general email to all staff on the floor to the same effect after receiving complaints about “strong odors” in the vicinity of her new office. On the morning of March 17, 2017 I receive[d] more complaints regarding a strong odor coming from her office. I reminded her of the previous email from the 9th. Additionally, during a meeting with Ms. Nelson on April 18, 2017 I [had] to remind Ms. Nelson of the policy concerning the closing of office doors which had previously been sent to all staff on 4/4/16, 9/16/16 and 11/18/16. I was informed by others in the area, during a different incident concerning her new office and foreign substances that she was still spraying things in her office, which may be why she continued to keep the door close[d]. Ms. Nelson often escalates issue[s] unnecessarily, which contributes to confusion, conclusion jumping and increase[d] work for others. Ms. Nelson is confrontational and often misapplies Agency or other state policy in a manner that comes across as a veiled threat. Most recently it came to my attention that Ms. Nelson may have attempted to encourage an employee to falsify their timesheet because they did not have any Annual Leave remaining and had a family issue. Based on the email sent by Ms. Nelson, it appears that she implied, on behalf of the employee, that they had to leave because they were not feeling well. In summary, I am not sure how to continue with Ms. Nelson in the employ of the Agency or what next steps should be taken. Her behavior as a manager is disruptive to the portion of the Agency mission for which the Bureau of RPA is accountable. Although Ms. Nelson has been a part of the Agency for more than 3 years, she seems not to have grasped the means to perform her duties in a constructive manner. By letter dated May 18, 2017, Mr. Rich informed Petitioner that her services were no longer required by the Agency, effective at the close of business on that date. At the hearing, Mr. Rich credibly testified that the termination was not based on the grievance filed by Petitioner eight months earlier, nor based on Petitioner’s sex, race, or age. The termination was based on the documented instances of Petitioner’s insubordination, her inability to resolve differences with management in a constructive manner, her accusatory communications, her inability to accept her own accountability when disputes arose, and the fact that her behavior was becoming increasingly disruptive to the work environment at the Agency both in and outside of the Bureau. At the hearing, Petitioner essentially abandoned any claim that her dismissal was based on her race or her age. She offered no evidence or argument regarding race or age discrimination. Petitioner’s focus was on sex-based discrimination by Mr. Diaz. Petitioner asserted that Mr. Diaz’s actions demonstrated that he has a “problem with women,” and that her treatment by Mr. Diaz was motivated by his bias toward women. Petitioner offered no corroborating evidence regarding the female employees she claimed were moved from Mr. Diaz’s supervision to hers. Petitioner also offered her personal view that Mr. Diaz was generally more deferential to his male subordinates than to the females. Petitioner presented no other witnesses to corroborate her opinion on this point. Mr. Diaz and Mr. Rich credibly testified that Petitioner never made a contemporaneous complaint to them that any of her many office disputes had anything to do with her sex. Petitioner offered no credible evidence that any adverse employment actions taken against her had anything to do with her sex. The evidence established that Petitioner was a disputatious employee in the best of times. Her resentment at having Mr. Diaz elevated to the position of her supervisor led Petitioner to question and undermine virtually any action taken by Mr. Diaz, no matter how inconsequential. Petitioner claimed that Mr. Diaz had conflicts with some female employees, but could point to no adverse actions Mr. Diaz ever took against her. Petitioner took great offense at Mr. Diaz’s insistence that she submit leave requests like any other Agency employee. However, Petitioner’s subjectively felt outrage does not transform this trivial workaday directive into an adverse employment action. Petitioner’s termination was the only actual adverse employment action in this case and it was effectuated by Mr. Rich, the Bureau Chief, not Mr. Diaz. The evidence established that, perhaps because of their prior relationships with Petitioner at ACS, Mr. Diaz and Mr. Rich continued attempting to mollify and work with Petitioner well after Mr. Rich would have been justified in terminating her employment for insubordination and constant disruption of the workplace. Subsequent to her dismissal by AHCA, Petitioner applied for a position at the Department of Highway Safety and Motor Vehicles (“DHSMV”). She interviewed for that job in August 2017. Petitioner stated, without corroboration, that DHSMV assured her that she would be hired if her references were good. In September 2017, Petitioner was advised that DHSMV would not be hiring her. From this sequence of events, Petitioner concluded that she was not hired by DHSMV either because AHCA gave her a negative reference or because of something inappropriate in her AHCA personnel file, in retaliation for actions while an employee of AHCA. Petitioner offered no direct evidence that anyone from AHCA gave her a poor reference. She offered the testimony of Robert Kennedy, a person who agreed to let Petitioner use him as a reference. Mr. Kennedy testified that no one from DHSMV ever called him about Petitioner. Based on his experience in hiring employees, Mr. Kennedy found it “odd” that he was not contacted. Jamie Skipper, Chief of the Agency’s HR Bureau, testified that AHCA’s policy on job references is to give only the job title, salary, and dates of employment, without any qualitative assessment. AHCA will make the affected employee’s personnel file available upon request. Ms. Skipper testified that all requests for employee references are routed through her office, and that her office had no record of DHSMV ever asking about Petitioner. Ms. Skipper testified that she had no reason to believe anyone from DHSMV ever reviewed Petitioner’s personnel file. In any event, Petitioner’s personnel file simply reflects that she was involuntarily separated from AHCA in May 2017. Mr. Diaz and Mr. Rich both testified that their consistent practice is to forward any employee reference requests to HR. Both men testified that they never received a reference request from anyone, including DHSMV, regarding Petitioner. There is no record evidence that anyone, including DHSMV, sought an employment reference from AHCA about Petitioner or that anyone at the Agency provided a negative reference regarding Petitioner. In summary, Petitioner offered no credible evidence that the Agency retaliated against her for engaging in protected activity. Petitioner offered no credible evidence disputing the legitimate, non-discriminatory reason given by AHCA for her termination. Petitioner offered no credible evidence that AHCA’s stated reason for her termination was a pretext for discrimination based on Petitioner’s race, age, or sex. Petitioner offered no credible evidence that AHCA discriminated against her because of her race, age, or sex in violation of section 760.10.

Recommendation Based on the foregoing Findings of Fact and Conclusions of Law, it is RECOMMENDED that the Florida Commission on Human Relations issue a final order finding that the Agency for Health Care Administration did not commit any unlawful employment practices and dismissing the Petition for Relief filed in this case. The Issue The issue to be resolved in this proceeding is whether Petitioner was the subject of an unlawful employment practice based on his age.

Findings Of Fact Currently, Petitioner is a retired, 68-year-old male. He retired from Respondent at the age of 66. Petitioner began his employment with Respondent as a truck driver. The position of truck driver, involves many long hours of driving (sometimes over 56 hours) various interstate and intrastate truck routes, along with some lifting and exposure to diesel fumes. Petitioner attributed a variety of illnesses and health problems to his work as a truck driver. Some of the illnesses and health problems are hypertension and heart blockage and failure, which resulted in the implantation of a pacemaker, carpal tunnel syndrome, polyneuropathy, muscular and autonomic system problems and pathological hyper-insomnia. Petitioner offered no evidence that any of these conditions resulted from his employment with Respondent. Prior to September 9 or 10, 2000, at the age of 64, Petitioner was hospitalized for heart problems. Around September 9 or 10, 2000, Petitioner was released from the hospital. Upon his return to work, he gave his employer a physician’s note indicating that his work duties be limited to 40 hours a week. Petitioner met with Respondent’s transportation manager regarding whether less lengthy routes were available or whether his schedule or work duties could be adjusted. The employer did not have the ability to adjust the length of the routes, but added a second driver to ride and help with the driving on any route that Petitioner drove. Petitioner inquired about office work and was told that if he was interested in such work he needed to apply at the main office to see what was available. In part, because Petitioner liked driving and in part because the lesser number of hours involved in office work would cause Petitioner to earn less, Petitioner elected not to pursue and did not apply for such office work. No adverse employment action was taken against Petitioner, and Petitioner continued to work for Respondent. At some point during this meeting, Petitioner alleges that the transportation manager said, “Why don’t you just retire.” Petitioner offered no specific context for this statement other than it was a general conversation about his health and closeness to retirement age relative to the adjustments that could be made to his driving duties. One isolated statement such as the one above does not demonstrate any intent to discriminate on Respondent’s part based on Petitioner’s age, especially since no adverse employment action was taken against Petitioner and Petitioner continued to work for Respondent. Around January 1, 2001, for medical reasons, Respondent approved a Leave of Absence with pay for Petitioner. In June or July, 2002, Petitioner filed his first workers compensation claim with Respondent. Petitioner’s claim was turned over to Respondent’s workers' compensation insurer, Kemper Insurance Company. Petitioner did not offer any evidence that Kemper was under the direction or control of Respondent in any decisions Kemper made regarding paying or litigating Petitioner’s claim. In any event, Petitioner’s claim was contested. The main reason the claim was contested was that Kemper alleged that Petitioner’s “injuries” were not work-related. Over the years, Petitioner has amended his claim to include, among other health claims, the health problems listed above. Kemper has maintained its defense. During a mediation session on December 11, 2002, at which the employer was not present and in response to an inquiry regarding Kemper’s defense, Kemper’s representative stated that except for the carpal tunnel claim, all of Petitioner’s medical conditions were due to the natural aging process. Petitioner claims this statement demonstrates an intent on his employer’s part to discriminate against him based on his age. Such an isolated statement does not demonstrate such an intent especially since such conditions can be age related, there was no expert medical evidence demonstrating the cause of Petitioner’s health problems, the statement did not come from the employer, and there was no evidence that the insurer was under the direction or control of the employer regarding decisions to litigate or the factual basis for the defenses that the insurer would raise. The workers' compensation litigation continues to date. In the interim, Petitioner remained on a leave of absence with pay until January 1, 2003. He retired thereafter. There was no evidence that Respondent discriminated against Petitioner or that Petitioner suffered any adverse employment action based on his age. Therefore, the Petition for Relief should be dismissed.

Recommendation Based upon the Findings of Fact and Conclusions of Law, it is RECOMMENDED: That the Florida Commission on Human Relations enter a final order dismissing the Petition for Relief. The Issue Whether Petitioner was discriminated against by the Respondent based on race, and/or retaliated against due to the filing of a charge of discrimination with the Florida Commission on Human Relations.

Findings Of Fact Petitioner, Ronald Wilson, is an African-American male. Petitioner was employed with TMH on June 21, 1999, as an environmental services technician. On January 19, 2001, Petitioner received a disciplinary corrective action for discourtesy to a hospital visitor who had complained about Petitioner’s rude and overbearing behavior towards her in a visitor’s waiting area. After admitting the essential facts, Petitioner was suspended for two days for this infraction. On June 27, 2001, Petitioner filed a charge of discrimination with the FCHR, alleging he was wrongfully suspended because of his race. On September 5, 2001, Petitioner was told that his loan application with TMH Federal Credit Union had been denied. Petitioner told a credit union employee, Grace Chambers, that “God doesn’t appreciate people being treated this way” and “Someone is going to have some bad luck,” or words to that effect, when she advised him that his application had been denied. Although Petitioner was speaking metaphysically and did not intend to threaten Ms. Chambers, Ms. Chambers was upset by Petitioner’s comment, perceived Petitioner's comment as a threat and reported it to her supervisor, Marion McCaskey, President of the TMH Credit Union. McCaskey and Chambers, in turn reported Petitioner's threat to Charles Garner, Director of Security at TMH. Ms. McCaskey also reported that Petitioner was known for being unduly persistent in obtaining approval for a loan to the point she had become uncomfortable, albeit not physically threatened, in dealing with Petitioner. Mr. Garner reported Petitioner's conduct to his supervisor, Ron Dorsey. On September 6, 2001, Mr. Dorsey filled out a disciplinary action form recommending Petitioner's discharge because of his comment to Ms. Chambers. Because of Petitioner’s disciplinary history of insubordination and discourtesy, the recommendation was approved by TMH Human Resources, and Petitioner was given notice of his discharge on December 11, 2001. TMH's policy prohibits discourtesy to visitors and other employees, and threats to co-workers. Both of these violations are grounds for discharge. Petitioner produced no evidence that any other non- minority employee was charged with breaking these rules and was treated better. Without such evidence, Petitioner failed to establish any direct evidence that his suspension and discharge were racially motivated. Likewise, Petitioner failed to establish any circumstantial evidence of racial discrimination, since Petitioner’s statements to Ms. Chambers could arguably be considered a threat directed towards her, and there was no evidence that Ms. Chambers’ reaction was not genuine. Petitioner produced no evidence that Dorsey, Garner, Chambers, or McCaskey had notice or knowledge of his charge of discrimination when he was discharged. Therefore, Petitioner has failed to establish that he was discharged on September 11, 2001, in retaliation for filing the charge of discrimination on June 27, 2001. Petitioner produced no evidence that he suffered any past or future wage loss as a result of his discharge from TMH.

Recommendation Based on the foregoing Findings of Fact and Conclusions of Law, it is RECOMMENDED: That the Florida Commission on Human Relations enter a final order dismissing the Petition for Relief.
