The Issue The issues are whether Respondent engaged in a discriminatory housing practice by allegedly excluding Petitioner from participating in a homeowner’s meeting on January 14, 2009, or ejecting Petitioner from the meeting, based on Petitioner’s religion and alleged handicap, in violation of Section 760.37 and Subsections 760.23(2), 760.23(8), 760.23(8)(2)(b), and 784.03(1)(a)(l), Florida Statutes (2008),1 and, if not, whether Respondent is entitled to attorney fees and costs pursuant to Section 120.595, Florida Statutes (2009).

Findings Of Fact Respondent is a condominium association defined in Section 718.103, Florida Statutes. Respondent manages a condominium development, identified in the record as Tregate East Condominiums (Tregate). Tregate is a covered multifamily dwelling within the meaning of Subsection 760.22(2), Florida Statutes. Petitioner is a Jewish male whose age is not evidenced in the record. A preponderance of the evidence presented at the final hearing does not establish a prima facie case of discrimination on the basis of religion, ethnicity, medical, or mental disability, or perceived disability. Rather, a preponderance of the evidence shows that Respondent did not discriminate against Petitioner in the association meeting on January 14, 2009. In particular, the fact-finder reviewed the videotape of the entire meeting that took place on January 14, 2009. The meeting evidenced controversy, acrimony, and differences of opinion over issues confronting the homeowners present. However, the video tape did not establish a prima facie case of discrimination based on Petitioner’s religion, ethnicity, or alleged handicap. Respondent seeks attorney’s fees in this proceeding pursuant to Section 120.595, Florida Statutes (2009). Pursuant to Subsection 120.595(1)(c), Florida Statutes (2009), this Recommended Order finds that Petitioner has participated in this proceeding for an improper purpose. Petitioner participated in this proceeding for a frivolous purpose within the meaning of Subsection 120.595(1)(e)1., Florida Statutes (2009). The evidence submitted by Petitioner presented no justiciable issue of fact or law. Petitioner provided no evidence to support a finding that he suffers from a handicap defined in Subsection 760.22(7), Florida Statutes. Petitioner claims to have a disability based on migraine headaches but offered no medical evidence to support a finding that Petitioner suffers from migraine headaches or any medical or mental disability. Petitioner’s testimony was vague and ambiguous, lacked precision, and was not specific as to material facts. Petitioner called four other witnesses and cross-examined Respondent’s witnesses. Petitioner’s examination of his witnesses and cross-examination of Respondent’s witnesses may be fairly summarized as consisting of comments on the answers to questions and argument with the witnesses. Petitioner repeatedly disregarded instructions from the ALJ not to argue with witnesses and not to comment on the testimony of a witness. Petitioner offered no evidence or legal authority that the alleged exclusion from the homeowners meeting on January 14, 2009, was prohibited under Florida’s Fair Housing Act.3 Petitioner offered no evidence that he is a “buyer” or “renter” of a Tregate condominium within the meaning of Section 760.23, Florida Statutes. Rather, the undisputed evidence shows that Petitioner is not a buyer or renter of a Tregate condominium. Petitioner attended the homeowners meeting on January 14, 2009, pursuant to a power of attorney executed by the owner of the condominium. If a preponderance of the evidence were to have shown that the owner’s representative had been excluded from the meeting, the harm allegedly prohibited by the Fair Housing Act would have been suffered vicariously by the condominium owner, not the non-owner and non-renter who was attending the meeting in a representative capacity for the owner. The condominium owner is not a party to this proceeding. A preponderance of the evidence does not support a finding that Petitioner has standing to bring this action. Petitioner was neither an owner nor a renter on January 14, 2009. Petitioner’s only legal right to be present at the meeting was in a representative capacity for the owner. The alleged exclusion of Petitioner was an alleged harm to the principal under the Fair Housing Act. Respondent is the prevailing party in this proceeding, and Petitioner is the non-prevailing party. Petitioner has participated in two or more similar proceedings involving Respondent. The parties resolved those proceedings through settlement. The resolution is detailed in the Determination of No Cause by the Commission and incorporated herein by this reference. Respondent seeks attorney’s fees totaling $3,412.00 and costs totaling $1,001.50. No finding is made as to the reasonableness of the attorney fees costs because Respondent did not include an hourly rate and did not submit an affidavit of fees and costs. However, the referring agency has statutory authority to award fees costs in the final order pursuant to Subsection 760.11(7), Florida Statutes.

Recommendation Based on the foregoing Findings of Fact and Conclusions of Law, it is RECOMMENDED that the Florida Commission on Human Relations enter a final order dismissing the Petition for Relief and requiring Petitioner to pay reasonable attorney’s fees and costs in the amounts to be determined by the Commission after hearing further evidence on fees and costs in accordance with Subsection 760.11(7), Florida Statutes. MARIA THORNHILL vs ADMIRAL FARRAGUT CONDOMINIUM ASSOCIATION, INC., 09-004715 (2009)

The Issue The issues in this case are, one, whether Respondent unlawfully discriminated against Petitioner on the basis of her alleged handicap in violation of the Florida Fair Housing Act; and, two, whether Respondent subjected Petitioner to acts of coercion or retaliation as a result of Petitioner's exercise, or attempted exercise, of a protected housing right.

Findings Of Fact Petitioner Maria Thornhill ("Thornhill") owns and lives in a unit in the Admiral Farragut Condominium Apartments. Respondent Admiral Farragut Condominium Association, Inc. ("AFCA"), manages the property of which Thornhill's condominium is a part. This case continues a dispute between Thornhill and AFCA which began in 1997, when Thornhill——without first securing AFCA's permission——installed three wooden steps leading from her rear balcony down to a patio located about 30 inches below. AFCA disapproved of the steps and directed Thornhill to remove them, which was done long ago. In the past, Thornhill has alleged, among other things, that AFCA and its individual directors unlawfully discriminated against her in denying her many requests to reinstall the steps, which she claims are needed as a reasonable accommodation for her handicap.2 Consequently, the parties have been pitted against each other for years in one legal proceeding after another, in various forums including DOAH. Thornhill has lost many battles in this protracted litigation——and consequently been ordered to pay tens of thousands of dollars in sanctions, court costs, and attorney's fees. Still, she presses on. In this case, Thornhill argues, as she has for more than a decade, that she needs to attach steps to her rear balcony because she is physically unable to traverse the 30 inches which separate the balcony from the ground and hence would be trapped if a fire were to block both of the unit's two doors to the outside. Not for the first time, Thornhill alleges here that AFCA discriminated against her on the basis of handicap when it denied her request(s), the most recent of which was made in January 2004, for approval of the steps. In addition to her claim involving the steps, Thornhill alleges that AFCA has discriminated or retaliated against her, in some unspecified way(s), in connection with a boat slip, which she is, evidently, "next in line" to rent, once the lease expires under which another unit owner currently enjoys the right to use the slip. Finally, Thornhill contends that, in its efforts to collect the various money judgments it has been awarded, AFCA has retaliated against her unlawfully. Determinations of Ultimate Fact With regard to the steps, Thornhill presented no evidence suggesting that such a modification is reasonable, nor any proof that installation of such steps is necessary to ameliorate the effects of her particular handicap. There is no evidence that any of AFCA's decisions concerning the boat slip were motivated in any way by discriminatory animus directed toward Thornhill. There is likewise no evidence that AFCA ever undertook to execute or otherwise enforce the judgments it has obtained against Thornhill because of discriminatory animus. In sum, there is not a shred of competent, persuasive evidence in the record, direct or circumstantial, upon which a finding of any sort of unlawful housing discrimination, coercion, or retaliation could possibly be made. Ultimately, therefore, it is determined that AFCA did not commit any prohibited act.

Recommendation Based on the foregoing Findings of Fact and Conclusions of Law, it is RECOMMENDED that the FCHR enter a final order finding AFCA not liable for housing discrimination and awarding Thornhill no relief. The Issue Whether Respondent discriminated against Petitioner in the rental of a dwelling based on her race, in violation of Florida Fair Housing Act, chapter 760, Part II, Florida Statutes (2015).

Findings Of Fact The following Findings of Fact are based on the exhibit admitted into evidence and testimony offered by witnesses at the final hearing. Ms. Smith is a Black female and currently resides in Gainesville, Florida. Saul Silber Properties is a company that manages Oak Glade located at 3427 Southwest 30th Terrace, Gainesville, Florida 32608. Respondent provides residential rental apartments in Gainesville, Florida. Saul Silber is the owner of Saul Silber Properties. Ms. Smith is a former resident of apartment number 54I of Oak Glade.1/ Ms. Smith rented the apartment pursuant to a residential lease agreement entered into on January 15, 2014.2/ The lease was for a one-year renewable term. Ms. Smith filed a complaint with the Commission alleging Respondent issued her a Notice of Non-Renewal of her lease agreement on the basis of her race. The Commission issued a “No Cause” determination and Ms. Smith filed a Petition for Relief, which is the matter before the undersigned. During her tenancy at Oak Glade, Ms. Smith had raised numerous complaints with the property manager regarding matters involving her neighbor, Anne E. Dowling. Ms. Dowling, who was White, was a former resident of apartment number 54H. Ms. Smith’s issues with Ms. Dowling included complaints concerning smoking, loud music, non-residents living in the apartment, the number of visitors outside Ms. Dowling’s apartment, and Ms. Dowling’s cat scratching her car. All of the complaints were addressed and resolved by the property manager. The incident that led to the major blow-up between the neighbors involved Ms. Smith and Ms. Dowling’s daughter. Ms. Smith and Ms. Dowling’s daughter were involved in a verbal altercation after Ms. Smith verbally reprimanded Ms. Dowling’s granddaughter (age range of 7-9 years old) and her friend. Ms. Smith testified that the two girls turned their backs to her, bent over, and wiggled their buttocks in a side-to-side motion. Ms. Smith understood this gesture to be disrespectful and a suggestion to “kiss their behinds.” Ms. Dowling’s daughter was not a resident of the apartment complex. The altercation was so loud that Ms. Osteen heard people “screaming” while she was in her office. Ms. Osteen discovered Ms. Smith and Ms. Dowling’s daughter involved in a screaming match. Ms. Osteen later consulted with the senior property manager about the incident and it was determined that both Ms. Dowling and Ms. Smith would be issued a Notice of Non-Renewal. On March 15, 2016, Respondent issued Ms. Smith and Ms. Dowling a Notice of Non-Renewal, which was posted on the door of each tenant’s respective apartment. The notices did not state a reason for non-renewal. Ms. Dowling’s lease would expire effective May 30, 2016; and Ms. Smith’s lease would expire effective December 30, 2016. Prior to expiration of her lease, Ms. Dowling advised Ms. Osteen that she was terminally ill and requested that she be permitted to stay at Oak Glade. Ms. Dowling explained that her support system was located in the area and due to financial limitations, moving from the complex would create a hardship for her. For these reasons, Ms. Dowling was permitted to enter a new lease and was moved to a different apartment. The decision to permit Ms. Dowling to remain at the complex was made by the senior property manager. Ms. Dowling passed away approximately four months later, on September 28, 2016. Other than her mistaken belief that Ms. Dowling did not receive a Notice of Non-Renewal, Ms. Smith did not offer any evidence to support her claim of housing discrimination in violation of the Florida Fair Housing Act.

Recommendation Based on the foregoing Findings of Fact and Conclusions of Law, it is RECOMMENDED that the Florida Commission on Human Relations issue a final order: finding that Respondent, Saul Silber Properties, LLC, did not commit a discriminatory housing practice against Petitioner, Ms. Smith; and dismissing the Petition for Relief filed in FCHR No. 2017H0320. The Issue The issue is whether any of the respondents is guilty of unlawful discrimination against Petitioner in the rental of a dwelling, in violation of section 760.23(2), Florida Statutes (2018).

Findings Of Fact At all material times, Petitioner has been an individual with a disability because he is infected with the human immunodeficiency virus (HIV). He is required regularly to take medication to control the disease. At all material times, Respondent Scandinavian Properties, LLC (Respondent Scandinavian) has owned a small complex of rental units in Miami Beach consisting of one or more Airbnb units at the back of the property and two duplex units at the front of property in a two-story building. This case involves one of the two-bedroom, one-bath duplexes with the address of 7910 Byron Avenue, Unit 1 (Unit 1), which was the ground-floor duplex. At all material times, Respondent Renes has been a managing principal of Respondent Scandinavian, and Respondent Bourguigne has been an employee of a property management company retained by Respondent Scandinavian to manage the complex. In an effort to find a suitable rental unit, Petitioner employed the services of a real estate broker or associate, who contacted Respondent Renes to discuss the rental of Unit 1, which had just undergone extensive renovations of two years' duration. Petitioner was recovering from recent surgery, so, as a favor to the real estate agent, Respondent Renes agreed to rent Unit 1 to Petitioner with a background check, but not the customary face-to-face meeting that Respondent Renes required with prospective tenants. Thus, Respondent Renes had limited, if any, contact with Petitioner during the lease negotiations. Petitioner and Respondent Scandinavian entered into a 12-month lease commencing November 1, 2018 (Lease). The Lease prohibited keeping any pets, smoking "in the Premises," creating any "environmental hazards on or about the Premises," keeping any flammable items "that might increase the danger of fire or damage" on the premises without the consent of Respondent Scandinavian, destroying, defacing, damaging, impairing or removing any part of the premises belonging to Respondent Scandinavian, and making any alterations or improvements to the premises without the consent of Respondent Scandinavian, although Petitioner was allowed to hang pictures and install window treatments. The Lease required Petitioner to ensure that all persons on the premises acted in a manner that did not "unreasonably disturb any neighbors or constitute a breach of the peace" and permitted Respondent Scandinavian to adopt or modify rules for the use of the common areas and conduct on the premises. The Lease assigned to Petitioner the responsibility for maintaining smoke detectors, locks, keys, and any furniture in the unit. The Lease permitted "[o]ccasional overnight guests," who could occupy the premises for no more than seven nights per month, and required written approval for anyone else to occupy the premises. Among the rules of the complex was a prohibition against disabling smoke detectors. However, without reference to the Lease provision applicable to pets, one rule allowed one dog or one cat. Another rule assured that management would help tenants gain access to their units when locked out. Within a few weeks of the commencement of the Lease, Petitioner's visitors violated two provisions of the Lease by smoking outside and allowing a dog to run loose in the common area. Respondent Renes or Bourguigne advised Petitioner of the violations, which do not appear to have resulted in any penalties. Admitting to the presence of the dog, Petitioner testified only that the video of the dog violation, if not also the smoking violation, led him to believe that he was being watched. Petitioner's complaint of individual surveillance became an ongoing issue--in his mind. The minimal staffing and small area occupied by the small complex, as a practical matter, both precluded individual operation of cameras to trace the movements of Petitioner and his visitors in the common area and facilitated the surveillance of all, or nearly all, of the common area with relatively few cameras. The evidence fails to support Petitioner's claim that the respondents at any time conducted video surveillance particularly of Petitioner or his visitors. Subsequently, Respondent Renes or Bourguigne advised Petitioner that someone had been shouting his name outside the gate of the complex during the evening hours. This incident is not prohibited by the Lease because the person, while perhaps acquainted with Petitioner, was not his invitee onto or about the premises. Nonetheless, Petitioner's sole reported reaction to this disturbance was to demand a copy of any video--and complain when the respondents failed to comply with his demand. Another of Petitioner's visitors parked a car outside the gate in a space reserved for occupants of the Airbnbs. When, evidently in the presence of Petitioner, Respondent Bourguigne confronted the visitor, the visitor replied that he had only been parked there for 20 minutes. Respondent Bourguigne stated that she had seen the car parked in the spot for 43 minutes. Again, Petitioner's sole response was not to deal with the violation, but to complain about surveillance, evidently of the parking area. The most serious violations of the Lease were discovered on January 28, 2019, when Respondent Renes conducted an inspection of Unit 1. Respondent Renes inspected all rental units of the complex every two or three months to check for safety issues that could imperil tenants or the complex itself. In her inspection, Respondent Renes found that Petitioner had disconnected the smoke alarms and encased them in plastic tape to render them inoperative. She also found that Petitioner had crowded the unit with furniture to the point of impeding egress and constituting a fire hazard. Although not involving safety issues, Respondent Renes found that Petitioner had attached screws to metal doors and kitchen cabinets, damaging these new fixtures. Additionally, Respondent Renes noted the presence of a cat. As noted above, the rules conflicted with the Lease as to the presence of a single dog or cat. In any event, by this time, the respondents were aware that the cat, as well as a human, routinely shared Unit 1 with Petitioner, and the respondents had impliedly consented to these cohabitations. Again, Petitioner's reaction to the Lease violations found by Respondent Renes on January 28 was not to address the problems. Instead, he objected to the inspection as singling him out. By letter delivered to Petitioner on February 14, 2019, Respondent Scandinavian advised that he was in violation of the Lease for allowing an unauthorized person and a cat to occupy the unit, for wrapping the smoke detectors in plastic, for damaging the unit's fixtures by attaching screws into the metal doors and kitchen cabinets, and by cluttering the interior of the unit so as to impede internal movement. The letter demands that Petitioner correct the violations within seven days, or else Respondent Scandinavian would terminate the lease. Respondent Bourguigne's main involvement with this case involves an incident that occurred on the evening of February 15, 2019, when Petitioner locked his keys in his unit and was unable to unlock the door or otherwise enter the unit. Petitioner called the office, but Respondent Bourguigne, who responds to such requests during her normal working hours of Monday through Friday from 9:00 a.m. to 5:00 p.m., did not receive the call until the following morning when she listened to messages. Respondent Bourguigne promptly called Respondent Renes for guidance, and Respondent Renes directed her to summon the complex's handyman, who, as soon as he could, which was 1:00 p.m. on February 16, drove to the complex and opened Unit 1 for Petitioner. Rather than call a locksmith when the respondents failed to respond immediately to his call to the office, Petitioner and a companion attempted to break into Unit 1 with a screwdriver at about 1:30 a.m. Although unaware of the lockout, Respondent Renes learned of the attempted break-in through an automated security system, so she called the police, who reported to the scene and, after briefly interrogating Petitioner, determined that no crime had taken place. Petitioner wrongly concluded that Respondent Renes had been watching him in real time and called the police, knowing that the apparent perpetrator was really Petitioner and no crime was taking place. While locked out of his unit, Petitioner had also sent emails to Respondent Renes. In one of them sent on February 16, Petitioner advised for the first time that he was diagnosed with HIV and dependent on medication that was locked in his unit. Respondent Renes testified that she did not see these emails until days later. At minimum, it is clear that, prior to February 16, no respondent was on notice of Petitioner's disability, so the seven-day notice letter delivered two days earlier could not have been motivated by a discriminatory intent. Despite the seven-day deadline contained in the letter of February 14, by email or text dated February 21, Petitioner advised Respondent Renes that, by 2:00 p.m. on February 22, he "will have remedied each of the … listed [violations]." This was one day past the deadline. Because Petitioner failed timely to meet the conditions of the February 14 seven-day notice letter, Respondent Scandinavian commenced an eviction proceeding on February 22 and, after a hearing, obtained a judgment ordering the eviction of Petitioner. Petitioner failed to prove any discriminatory intent on the part of any of the respondents in their dealings with him, any incidental discriminatory effect in their acts and omissions, or any failure or refusal to accommodate Petitioner's disability. To the contrary, as to discrimination, Respondent Renes chose to forego eviction and instead give Petitioner a chance timely to remedy the Lease violations; when Petitioner failed to do so, Respondent Scandinavian proceeded to evict Petitioner. Nor has any act or omission of any respondent had a discriminatory incidental effect on Petitioner. Lastly, the availability of Respondents Renes and Bourguigne or other employees of Respondent Scandinavian to open units to locked-out tenants and occupants was reasonable and in no way constituted a failure to accommodate Petitioner's disability, for which Petitioner never requested or, on these facts, needed an accommodation.

Recommendation It is RECOMMENDED that the Florida Commission on Human Relations enter a final order finding the respondents not guilty of the charges set forth in the Petition for Relief. The Issue Whether Petitioner's housing discrimination complaint alleging violations of the Florida Fair Housing Act, chapter 760, part II, Florida Statutes (2020) (FFHA), was timely filed.1 1 Unless otherwise indicated, all federal and state statutory and administrative rule references are to the 2020 versions.

Findings Of Fact The following Findings of Fact are made based on the exhibits and testimony offered at the final hearing, the stipulated facts, and the additional documents accepted for official recognition as indicated above. The Lease Petitioner, Ross Couples, leased a house located at 11635 Meadowrun Circle in Fort Meyers, Florida (Property), from Respondent Xuan Ren. At all times relevant to this case, Respondent Ren owned the Property. At all times relevant to this case, Respondent Timothy Cloud managed the Property and served as an agent for Respondent Ren. The Property was part of Marina Bay Homeowners' Association (HOA) and subject to the HOA's rules and regulations regarding lease arrangements. On December 12, 2018, Respondent Ren and Petitioner executed a year lease for the Property from January 15, 2018, to January 15, 2019. The lease included the following provision for its renewal: 18. RENEWAL/EXTENSION. The Lease can be renewed or extended only by a written agreement signed by both Landlord and Tenant, but the term of a renewal or extension together with the original Lease Term may not exceed 12 months. … A new lease is required for each period of lease. At some point prior to January 15, 2019, Respondent offered Petitioner another lease agreement. Petitioner refused to pay a $100 leasing fee required by the HOA. The parties did not renew or enter into another 12-month lease, nor did Petitioner move out. As a result, after January 15, 2019, the parties switched to a month-to- month arrangement.4 This arrangement, however, was not approved by the HOA. On February 23, 2019, Petitioner sent an email to the HOA manager and Respondent Cloud. In that email, Petitioner made numerous complaints and mentioned the need for a larger hot water heater for his hydrotherapy tub, which he claimed he needed for health issues. He also discussed at length his opposition to the $100 fee imposed by the HOA for entering into a new lease. On February 27, 2019, Respondent Cloud issued a "Notice of Termination of Month-to-Month Tenancy Notice to Vacate" (Notice) to Petitioner. The Notice indicated that the current leasing arrangement had 4 No written lease agreement for the month-to-month arrangement was offered into evidence. been terminated and Petitioner was to vacate the Property on or before May 15, 2019. Petitioner did not move out of the Property on or before May 15, 2019. On May 20, 2019, Respondent Ren filed the eviction action against Petitioner in the appropriate court. A final judgment in the eviction action was rendered on June 6, 2019, and a writ of possession was issued for the Property on June 7, 2019. Petitioner vacated the Property and turned over possession to the Lee County Sheriff on June 12, 2019. Housing Complaints Petitioner testified that on April 5, 2019, he filed a complaint of discrimination with the U.S. Housing and Urban Development (HUD) regarding his claim of disability discrimination against Respondents. On January 17, 2020, HUD issued a letter to Respondent Cloud (HUD Letter) indicating it was dismissing the case brought by Petitioner, and specifically finding "that no reasonable cause exists to believe that a discriminatory housing practice has occurred. … No evidence was found to support Petitioner's contention that his disability was used as a basis to evict him." The HUD Letter does not indicate Petitioner could re-open the HUD case or file anything else with HUD based on the same facts. It does not mention the FFHA or FCHR, and it does not provide any instruction or information on how to pursue claims pursuant to state housing discrimination laws.5 Petitioner claims a HUD employee, Mr. Jordan, told him he had a year from his last date of possession of the Property to "file the proper paperwork." 5 The HUD Letter does mention that Petitioner could file a civil lawsuit "in an appropriate federal district court or state court within two (2) years of the date on which the alleged discriminatory housing practice occurred or ended." The letter also has instructions as to what Petitioner may be able to file if he was retaliated against for filing the HUD complaint. This proceeding does not involve either of those situations. Petitioner also states Mr. Jordon told him he could file a claim with either HUD or the Florida Fair Housing Commission.6 It is unclear when this conversation occurred, what Mr. Jordan's role was at HUD, and whether the discussion was in person or over the phone. Regardless, this testimony is hearsay and not corroborated by any non-hearsay evidence or documentation. There is no credible evidence to establish that anyone at either HUD or FCHR informed Petitioner that he had one year from the last date of possession of the Property to file an FFHA discrimination complaint with FCHR. The date Petitioner filed his FFHA Complaint with FCHR is contested. Petitioner testified he contacted the "Florida Fair Housing Commission" on June 10, 2020, regarding his FFHA claim. He admits he did not file his FFHA complaint immediately. Rather, at that time, he spoke with an "intake clerk," who sent him a complaint form, which he then filled out and returned. There is no competent evidence corroborating Petitioner's assertion in his Response that he filed the Complaint with FCHR on June 10, 2021. Rather, the top of the front page of the Complaint is dated July 22, 2020, and indicates Petitioner verified the facts in the Complaint on July 21, 2020. Moreover, the Determination dated September 18, 2020, also references that the Complaint was submitted on July 21, 2020. Based on Petitioner's testimony and the date that Petitioner verified the Complaint with his signature, the undersigned finds Petitioner's Complaint was filed with FCHR on July 21, 2020. 6 The undersigned is unaware of an agency operating under the name of "Florida Fair Housing Commission." The undersigned assumes that Petitioner is referring to FCHR. See § 760.22(1), Fla. Stat. (defining “Commission” to mean the Florida Commission on Human Relations).

Recommendation Based on the foregoing Findings of Fact and Conclusions of Law, it is RECOMMENDED that that the Florida Commission on Human Relations issue a final order dismissing the Petition for Relief filed by Ross J. The Issue Whether Respondents engaged in a discriminatory housing practice in violation of the Florida Fair Housing Act, as amended, sections 760.20 through 760.37, Florida Statutes (2011)1/.

Findings Of Fact Background Respondents Hoyt and Nancy Davis (the Davises) own a residential property located at 1856 Cross Pointe Way, St. Augustine, Florida (the Property). The Property is utilized exclusively as a rental. Respondent Florida Coastal Jacksonville Realty, Inc. ("Florida Coastal") and its principal John McMenamy ("McMenamy") acted as listing agents for the Property (collectively, the "Broker Respondents"). Mr. McMenamy and his company have managed the rental of the Property for approximately six years. In association with their listing of the Property, the Broker Respondents were responsible for advertising, showing, accepting applications for and assisting in the selection of tenants for the Property. At the time of the events in question, the Property was being offered for lease at a rate of $1,450 per month. Generally, due to its location within a St. Johns County golf community and proximity to good schools, the Property rents easily and quickly. The Rental Applications On May 14, 2010, Petitioner Jaime Terry (Mrs. Terry) contacted McMenamy regarding the Property. McMenamy instructed Mrs. Terry on the rental application process. On the afternoon of Sunday, May 16, 2010, Petitioners submitted via e-mail their rental application, dated May 15, 2010. On their application, the Petitioners disclosed that they had previously declared bankruptcy. The bankruptcy was entered in December 2007 and discharged in January 2009. Petitioners also disclosed that they were currently living with Mrs. Terry's parents. The application included a statement of the Terrys' monthly income, and also disclosed that they had three children residing with them -- aged eleven, five and two at the time. A memo attached to the application elaborated on the bankruptcy and other details of their employment and financial situation. Mrs. Terry testified that during the application process the Respondents did not solicit additional information concerning her employment history. On May 18, 2010, McMenamy ran a credit check on the Terrys using the "Online Rental Exchange." The credit report for Jaime Terry reflected a credit score of 664, while Steven Terry's assigned score was 649. However, both reports noted "conditional" approval because of the bankruptcy filing. Although the exact date is unknown, at approximately the same time that the Terrys submitted their application, another couple, Rick and Jessica Egger (the Eggers) contacted McMenamy regarding their interest in possibly renting the Property. On the evening of Thursday, May 20, 2010, the Eggers formally submitted an application to rent the Property. The Eggers' application disclosed that, unlike the Terrys', they did not have a bankruptcy in their history. In addition, the Eggers' combined monthly income was higher than the Terrys'2/ and the younger of their two children was nine years old. The credit report obtained for the Eggers reflected a credit score of 672 for Jessica Egger and 696 for Rick Egger, with an unconditional approval rating. Respondents' Tenant Selection Process McMenamy testified that in evaluating applications, potential tenants must meet certain minimum criteria. Factors he considers in assessing applicants include credit checks, criminal background checks, employment status, and rental history. However, he agreed that the evaluation process he uses is subjective. McMenamy acknowledged that bankruptcy would not automatically disqualify a potential tenant, and in fact, confirmed that he has rented to tenants who have a bankruptcy in their history. With regard to credit scores, McMenamy testified that he considered a score below 500 to be unacceptable. Mrs. Davis testified that McMenamy manages the entire process of renting the Property on behalf of herself and her husband. Once McMenamy determines the suitability of a prospective tenant, he discusses that tenant with the Davises. McMenamy does not discuss applicants with the Davises that he does not consider eligible. The Davises do not participate in the background screening process and they do not review applicants' credit ratings. However, Mrs. Davis was aware of McMenamy's process for selecting tenants, and she confirmed her understanding that applicants must meet certain minimum requirements. In selecting a tenant, McMenamy looks not only for a candidate that is financially qualified, but also one who will rent the property for a significant period of time, will take good care of the property, and will make monthly rent payments in a timely manner, according to Mrs. Davis. Denial of Petitioners' Lease Application Mr. Davis testified that he and Mrs. Davis discussed the Petitioners' application with McMenamy. At hearing, Mr. Davis recounted that conversation as follows: Cross-examination by Mr. Organes: Q. Mr. Davis, you stated that you had discussed with Mr. McMenamy the application of Steven and Jaime Terry? A. Yes. Q. And that’s a common practice with Mr. McMenamy as when he receives reasonably qualified applicants, he discusses them with you? A. Yes. Q. And that’s what he did with the Terrys? A. Yes. Q. And you said you did not tell him not to rent to them because of their children? A. That is true, we did not tell him. Q. The issue of children wasn’t discussed at all? A. No. Q. What reason did you give him to tell them why their application was being denied? A. Because of their past rental history and their bankruptcy foreclosure. Q. In general if you don’t approve of an applicant, what reason would you give for denying that applicant? A. I would give that reason, that we didn’t feel that, you know, we probably would get a better applicant and the reason we turned them down is because we didn’t feel that they were suitable for our rental. There is no evidence in this record as to precisely when the above conversation between the Respondents took place, although based upon Mr. Davis's statement that "we probably would get a better applicant" it is reasonable to infer that it was prior to the Eggers submitting their application on the evening of Thursday, May 20, 2010.3/ Early on the morning of Friday, May 21, 2010, McMenamy sent an e-mail to Ms. Terry, which read: Jaime I left a message yesterday but did not hear from you. I spoke to the owner about the application and she was concerned about not really having any rental history and the number of small children. She is a perfectionist and just had the home professionally painted. The one family who lived there had small children and there were handprints all over the walls so that it needed to be repainted. So this was her main concern and therefore does not want to rent to you and the family. If you have any questions please call. Sincerely, John At hearing, Mrs. Davis maintained that the Petitioners' children were not the determining factor in the decision to deny their application. Rather, it was based on their finances and lack of rental history. Consistent with Mr. Davis's testimony, Mrs. Davis also testified that she and her husband did not instruct McMenamy to reject the Petitioners' application because of their children. After being informed that their application was denied, Petitioners immediately began searching for alternate housing. Mrs. Terry testified that their primary concern was to locate a rental in a high quality school district. Within a couple of weeks of receiving the denial e-mail from McMenamy, the Terrys located a home at 983 Lilac Loop, St. Johns, Florida. Petitioners entered into a lease for this property on June 6, 2010; the rent was $ 1,200 per month. Although the Lilac Loop home was acceptable, the Terrys considered it to be inferior to the Property, and Petitioners paid to have the home repainted and wired for cable access. The cable installation fee was $150.00. On September 22, 2010, Petitioners were notified that the Lilac Loop house was in foreclosure. Petitioners appealed to a default-law organization in an attempt to enforce their one-year lease, but were ultimately unsuccessful. As a result of the foreclosure, Petitioners were forced to seek alternative housing within the same school district, and in November 2010, leased a property at 1528 Summerdown Way, Fruit Cove, Florida, 32259. The monthly rent at 1528 Summerdown Way was $1,600 monthly. Petitioners also incurred additional expenses necessitated by hiring a moving service, in the amount of $773.50. At of the hearing, Petitioners continued to reside in the Summerdown Way rental. The Commission Investigation On August 16, 2010, the Terrys filed a Housing Discrimination Complaint with HUD alleging they had been unlawfully discriminated against by Respondents based upon their familial status. Thereafter, the Commission opened an investigation of the allegation. As part of that investigation, Respondents were invited to submit written statements setting forth their version of the events at issue, and any defenses to the allegation they wished to raise. On August 19, 2010, the Davises submitted a written statement to the FCHR. In the first paragraph of that submittal the Davises stated: To Whom it May Concern: We enlisted realtor John MaMenamy to find a new tenant for our rental house at 1856 Cross Pointe Way, St. Augustine, FL 32092. Mr. McMenamy was told that we preferred not to rent to someone with more than one, if any, very small children at this particular time. The reason being we just had to have the interior of the house professionally repainted and repairs made to several areas, the walls in particular. Additionally, in light of the fact there were several highly qualified persons interested in and looking at the house concurrently. The submittal continued by identifying four former tenants of the Property, as well as the current tenants (the Eggers), all of whom had children living with them. It is found that McMenamy's e-mail of May 21, 2010, and the Davises' letter of August 19, 2010, constitute direct evidence that Respondents' decision not to rent to Petitioners was based upon their familial status. The testimony of McMenamy and the Davises that familial status was not the reason for refusing to rent to Petitioners is rejected as not credible.

Recommendation Based on the foregoing Findings of Fact and Conclusions of Law, it is RECOMMENDED that the Florida Commission on Human Relations enter a final order finding Respondents guilty of a discriminatory housing practice against the Terrys in violation of section 760.23(1) and (2), and prohibiting further unlawful housing practices by Respondents. The Issue The issue to be determined is whether Respondents engaged in prohibited conduct against Petitioner by discriminating against him based on his race and/or national origin in the terms and conditions, privileges, or provision of services or facilities in the sale or rental of real property in violation of Section 760.23, Florida Statutes (2009).

Findings Of Fact Based on the oral and documentary evidence adduced at the final hearing and the entire record in this proceeding, the following Findings of Fact are made: The Florida Commission on Human Relations is the state agency charged with investigating complaints of discriminatory housing practices and enforcing the Fair Housing Act. It is also charged with investigating fair housing complaints filed with the federal Department of Housing and Urban Development under the Federal Fair Housing Act, 42 U.S.C. Section 3601, et seq. Petitioner, Emmanuel Agbara, is an adult, black male, who is of Nigerian decent. On or about September 18, 2008, Petitioner submitted an offer to purchase Condominium 406 in Orchid Springs Village. Because the real property sought to be purchased was a part of a condominium, there were several contingencies imposed by the declaration of condominium and associated house rules. Respondent, Orchid Springs Condominium, No. 200, Inc., is a non-profit corporation charged with the management of the condominium. Incidental to this responsibility, in conjunction with Bay Tree Management Company, the board of directors has the responsibility to approve or disapprove of the sale of a condominium to a third party. In the event the board of directors or Bay Tree Management Company disapproves of the sale, the condominium documents outline a procedure wherein the proposed sale can be pursued by the property owner and prospective buyer (Petitioner herein). After Orchid Springs advised Petitioner that it had not approved his sale, this alternative was not pursued. Orchid Springs is a part of a mixed-use development of condominiums, patio homes, and private [single-family] residences and is diverse in terms of religion, national origin and income. Prospective buyers, and the Petitioner herein, were required to complete an application that inquired into the prospective buyer's background, intended use of the property, and required three character references. In addition, prospective buyers were required to pay for a "background" check. On September 20, 2008, Petitioner traveled from his home in Maryland to meet with Respondent, John Carroll, president of the condominium board of directors. As they met, an inspection of the condominium unit was being conducted by a home inspection professional. Petitioner anticipated that he would meet with Carroll and two other board members for the personal interview required by the condominium documents as a prerequisite for board approval. The two board members were not available to meet with Petitioner during his September 20, 2008, visit. During the course of the discussion between Petitioner and Carroll, it became apparent that Petitioner anticipated being an "absentee landlord." Carroll advised Petitioner that the owner/residents had various problems with renters, including recent police activity incidental to a drug laboratory in one of the rented condominium units. Carroll also related that four of the absentee owner units were in foreclosure and that placed an economic burden on the remaining owners. During the discussion between Petitioner and Carroll, Petitioner inquired as to whether he could do the three-board member interview by telephone. Mr. Carroll advised him that a telephone conference might be arranged, but that one board member could not do it alone. On October 8, 2008, Petitioner submitted his Association Application. As a part of the application process, Petitioner certified that he had been supplied copies of the Articles of Declaration of Condominium Ownership and By-Laws of Orchid Springs Village, No. 200, Inc.; the Service and Maintenance Agreement; and the manual, "Condominium Living--The Seville." The Association Application includes the following language: "[A]pplicant purchasing Condominium certifies that he/she has . . . read [and] agrees to abide by" the foregoing documents. The Association Application states that "[i]mmediately after submission of the application, Applicant is requested to arrange with the President for a personal interview with at least [three] Board Members present. Such personal interview is a firm requirement [and] may not be waived." Following receipt of a prospective buyer or renter's Association Application, the tasks of conducting the customary background and criminal checks are divided among board members. In this instance, Mrs. Thibodaux, now deceased, did the background check; and Mrs. Douglas did the criminal background check, which, apparently, was a local records check utilizing the county records available through the internet. Testimony reveals that Mrs. Thibodaux reported that she had some problems with two of Petitioner's character references and that the Social Security number he provided was incorrect. This testimony is discounted as Mrs. Thibodaux is dead and not available to testify, and there is no indication that Petitioner's Social security number is incorrect. In addition, two of Petitioner's character references testified at the final hearing. Mrs. Douglas' local criminal background check revealed a January 13, 1997, arrest for battery--domestic violence. The case was "nolle prossed" after the Petitioner was placed in pre-trial diversion. Orchid Spring's critical examination and appraisal of prospective buyers and renters is apparently "slipshod," but not atypical when the prospective cost of a thorough examination that would involve an investigation of an individual's credit history and a thorough criminal and background check. Concern raised by the background and criminal check prompted Carroll to contact Petitioner and request that he come to Florida and meet with three board members for the interview required by the condominium documents. Petitioner was unable to meet with the interview committee. On November 7, 2008, Petitioner was advised by Respondents that his application had been denied. No evidence of damages was advanced by Petitioner.

Recommendation Based on the foregoing Findings of Fact and Conclusions of Law, it is RECOMMENDED that the Florida Commission on Human Relations enter a final order dismissing the Petition for Relief. The Issue Whether Respondent, Ameron Homes, Inc., discriminated against Petitioner, Carolyn Henke, in violation of the Florida Fair Housing Act; and, if so, the relief to which Petitioner is entitled.

Findings Of Fact On March 12, 2015, Petitioner entered into a contract with Ameron to build a new home in Micco, Florida. Petitioner selected Ameron because of the reasonable price it offered to construct her house, as well as the fact that Ameron could immediately begin work. The total contract price for Petitioner’s new house was $198,052. This figure included a base price of $170,000, plus “extras” that Petitioner requested in the amount of $27,552. Ameron completed construction of Petitioner’s house in September 2015. Petitioner moved into her home on September 25, 2015. She paid her final bill to Ameron on September 29, 2015. Petitioner complains that Ameron failed to construct her home using the required standard of care. She also maintains that Ameron overcharged her for certain building materials. Petitioner specifically alleges that the house Ameron built for her did not include several of the details, features, or “extras” that she specifically requested. Petitioner further asserts that she paid approximately $8,500 for items that should have been covered in her “extra” charges. Petitioner claims that she found a number of deficiencies when she moved in. Petitioner’s issues include: Storm shutters: Ameron provided storm shutters for Petitioner’s exterior windows as part of its standard contract. Petitioner represented that the shutters delivered to her home were made of steel. Petitioner explained that steel shutters are much too heavy for her to hang over her windows. Petitioner insisted that she should have been given aluminum shutters instead of steel shutters. Petitioner complained that Mr. Brognano never discussed the different types of shutters that Ameron could have offered with her contract. Flooring: Petitioner disliked the laminate flooring Ameron installed in her home as part of its standard contract. Therefore, she purchased wood-like, tile flooring on her own. Petitioner was upset that she had to pay an additional cost (above the “extras”) for the tile she selected (approximately $2,000). Kitchen cabinets: Petitioner was upset at the poor quality of her cabinets. Petitioner asserts that under her contract, she was entitled to select the cabinets for her kitchen. Instead, Petitioner declared that Ameron installed cabinets with a very cheap exterior coating. Petitioner testified that the finish on her cabinets is beginning to peel. Front door: Petitioner complains that her front door does not fit tightly into the doorframe. In addition, the front door needs to be adjusted to eliminate a gap at the bottom of the doorway. Sod and soil: Petitioner is upset that she had to pay extra for part of the sod laid around her home (approximately $1,000). Furthermore, after rain eroded soil away from her home, Petitioner believes that Ameron should have corrected the situation. General construction complaints: Petitioner complained about the general quality of her home, as well as its condition upon completion. Petitioner asserted that she found dust, nails, and gobs of plaster scattered throughout her house. Petitioner claims that she has plumbing and sewer issues. In addition, a ceiling register is broken and some grout and cement is cracked and worn away. Finally, Petitioner complains that Ameron failed to make several modifications she requested as she moved into her home. Petitioner alleges that Ameron inadequately or failed to include handicap accessible features in her bathroom. These features most notably included grab bars in her shower. Petitioner also asserted that Ameron failed to account for her disability when it installed the soap dish and fixtures in her shower. They are positioned too high for her to safely reach or adjust. (As explained below, at Petitioner’s request, Ameron hired and paid a third party to install grab bars in Petitioner’s shower. At the final hearing, Petitioner testified that, at this time, the grab bar is broken.) Petitioner believes that Ameron took advantage of her because she is a woman, elderly, alone, and handicapped. Petitioner asserts that when she expressed her frustration at the manner in which her house was built, Ameron never listened to her. Petitioner also believes that Ameron overcharged her for the inferior “extras” it added to her home. Petitioner asserts that Ameron would not have ignored her complaints if she was a man. Petitioner was 87 years old at the time of the final hearing. Respondent does not dispute that Petitioner suffers from a physical disability.4/ Petitioner testified that she sent her initial complaint to the Commission alleging a discriminatory housing practice by Ameron on October 31, 2016.5/ Ameron is owned by William and Todd Brognano. At the final hearing, William Brognano testified on Ameron’s behalf. Mr. Brognano relayed that Ameron has been building homes since 1981. Mr. Brognano asserted that Ameron has a fine reputation for the quality of the homes it constructs. Mr. Brognano expressed that Ameron builds between 100 and 170 homes a year. Ameron has built many homes for women and handicapped persons. Mr. Brognano denied building Petitioner’s home in a faulty manner. He further denied that Ameron discriminated against Petitioner in any way. Mr. Brognano explained that Petitioner contracted with Ameron to construct a single-family home for the base price of $170,000. In addition, Petitioner requested “extras” to her home in the amount of $27,552. These “extras” included certain enhancements and modifications, such as a two-foot addition to her bedroom, different laminate and tile for certain floors, walls, and countertops, additional lighting, a tile roof, and the relocation of several palm trees in her yard. Mr. Brognano asserted that all the standard features of Petitioner’s home, as well as each “extra” that Petitioner requested, were clearly itemized in her contract. In response to Petitioner’s specific complaints, Mr. Brognano offered the following: Windows: Mr. Brognano commented that all standard homes are built with windows and shutters that meet Florida Building Code requirements. Ameron could have installed impact windows on Petitioner’s house for an additional charge. However, Petitioner specifically declined impact windows because of the cost. Storm shutters: Mr. Brognano explained that Petitioner’s contract did not specify the type of storm shutters to include with her home. In addition, Petitioner specifically declined upgraded shutters because of the cost. Therefore, Mr. Brognano believed that Ameron initially provided steel shutters, which are standard. (Steel shutters are heavier, but stronger, than aluminum shutters.) However, Mr. Brognano testified that after Petitioner notified Ameron of her desire for aluminum shutters, Ameron agreed to arrange for a third-party shutter company to deliver aluminum shutters to Petitioner’s home at no extra charge. (The bill from the company that supplied the shutters referenced “aluminum” shutters. However, Petitioner maintains that the storm shutters she received were steel.) Flooring: Ameron installed floor coverings, including carpeted bedrooms, vinyl kitchen flooring, and tile, as standard features in Petitioner’s home. Petitioner, however, wanted to use laminated wood flooring in parts of her home. Therefore, in June 2015, on her own, Petitioner bought wood tile flooring from a third-party tile company. The additional tile cost Petitioner $2,331.29. Ameron agreed to pay a subcontractor to install the tile Petitioner purchased. Kitchen cabinets: Mr. Brognano refuted Petitioner’s assertion that her cabinets were made of cheap material. Mr. Brognano relayed that, not only did Petitioner select the cabinets that Ameron installed, but they were of nice quality. Sod and soil: Per the specific terms of Petitioner’s contract, Ameron provided 8,000 square feet of Bahia sod for Petitioner’s property. However, Petitioner’s lawn required a total of 10,625 square feet of sod. Mr. Brognano asserted that Petitioner was obligated to pay the additional cost. Mr. Brognano further testified that Ameron fixed the parts of Petitioner’s lawn affected by erosion at no additional cost. General construction complaints: Mr. Brognano commented that Petitioner’s complaints reveal that she does not understand how home construction works. The presence of sawdust, nails, and construction materials is common in most homes during, or immediately after, construction. Just before Petitioner moved in, Ameron paid to have her house professionally cleaned (as is its common practice). Mr. Brognano further testified that everything in Petitioner’s home meets building code standards. Mr. Brognano also claimed that Ameron addressed a number of Petitioner’s complaints. Finally, upon completion, Petitioner’s home was inspected, and no construction issues were found. Regarding Petitioner’s shower, Mr. Brognano explained that Petitioner first notified Ameron about the issues in her shower just after Ameron had completed her home, but before she took occupancy on September 25, 2015. Mr. Brognano relayed that Petitioner’s contract did not contain any provisions regarding grab bars. Instead, Petitioner personally bought grab bars and requested Ameron install them. (Petitioner produced a purchase receipt from Lowe’s showing that two grab bars were purchased on September 10, 2015.) Mr. Brognano testified that Ameron agreed to pay for the installation of both the grab bars and the soap dish at no extra charge to Petitioner. (At the final hearing, Petitioner asserted that she personally paid the individual Ameron hired to install the grab bars.) Ameron hired Chuck Velek, who has worked as a carpenter for over 30 years, to install the grab bars. At the final hearing, Mr. Velek testified that when he reported to Petitioner’s home, she provided him with a grab bar and instructed him to place it in her shower. Mr. Velek declared that he installed one grab bar in Petitioner’s shower. Mr. Velek stated that Petitioner’s friend directed him where to position the grab bar in the shower. Mr. Brognano testified that, when she moved into her home on September 25, 2015, Petitioner did not alert Ameron to any issues with her shower. On the contrary, Petitioner told Mr. Brognano that she loved her house. Based on the evidence and testimony presented at the final hearing, Petitioner did not demonstrate, by a preponderance of the evidence, that Ameron discriminated against her based on her age, sex, (aloneness) or handicap in violation of the FHA.

Recommendation Based on the foregoing Findings of Fact and Conclusions of Law, it is RECOMMENDED that the Florida Commission on Human Relations issue a final order dismissing the Petition for Relief filed by Petitioner, Carolyn Henke, for lack of jurisdiction based on Petitioner’s failure to timely file her petition under the Florida Fair Housing Act. Alternatively, it is RECOMMENDED that the Florida Commission on Human Relations issue a file order concluding that Respondent, Ameron, did not commit a discriminatory housing practice against Petitioner and dismiss her Petition for Relief. The Issue The issue for determination in this matter is whether Respondents engaged in acts of housing discrimination against Petitioners on the basis of race in violation of the Florida Fair Housing Act.

Findings Of Fact Petitioners, Donald Travis and Lisa Harrell, are a bi-racial couple (Mr. Travis is African-American and, therefore, belongs to a class of persons subject to protection under Florida's Fair Housing Act, Sections 760.20 through 760.37, Florida Statutes, and Ms. Harrell is white). They have two sons who are bi-racial (one is African-American and white, the other is white and Asian). Petitioners lived in Apartment 163 at 10075 West Highway 98, Pensacola, Florida 32506. Respondents, John and Anne Cutler, are the owners of two four-plex apartments at 10075 West Highway 98, Pensacola, Florida 32506, including the unit occupied by Petitioners that gave rise to this matter. They are both retired educators who own and operate their apartment rental business in their retirement. In their teaching and professional careers, both have instructed students of various races and national origins. Petitioner, Donald Travis, is a veteran of Desert Storm and has been treated for Post Traumatic Stress Disorder. He regularly takes medications to treat anxiety and depression. On April 4, 2008, Petitioners moved into Apartment 163, which had been recently painted, carpeted, and had a new ceiling fan and light installed in the living room. Everything went smoothly between Petitioners and Respondents for several months. Mr. Cutler had to unplug the downstairs toilet with a plunger a few times, but everything else seemed to be in working order. Both Mr. and Ms. Cutler considered Petitioners to be good tenants. As summer approached, Mr. Travis asked Mr. Cutler about installing a screen door for the sliding glass doors. This could not be done without replacing the entire sliding glass doors. When Apartment 131 became vacant, its screen door was moved to Petitioners' apartment. The screen door had a slit in it, which Ms. Cutler repaired with tape. When Apartment 132 became vacant, the good screen door from that apartment was used to replace the taped one in Petitioners' apartment. Respondents tried to keep everything in working order in Petitioners' apartment. When Petitioners' refrigerator door would not close, Respondents replaced the refrigerator. Respondents thought Petitioners were happy with their apartment. Petitioners called Respondents about a plumbing leak and said feces was running down the wall. The leak and pipe were fixed by B & G Plumbing. Petitioners were shown the water shut-off valve in case of future leaks. Petitioners believe that Respondents treated them differently from other tenants in the apartment buildings. Petitioners believe that other tenants were allowed to keep pets in their apartments while they were not. Respondents allowed tenants who had pets when they purchased the apartments to keep them, but banned pets on all future rentals. The rent for Petitioners' apartment, including water, sewer, and garbage, was $650.00. Petitioners always paid their rent on time. Petitioners asked to be moved into a better unit since they believed their unit was inferior to others in the complex. Petitioners wanted to move into Apartment 162 which, in their opinion, was in much better shape than their unit. Respondents offered to put new carpet into Apartment 162 before Petitioners moved in, but they refused. Petitioners decided to leave the apartment because they believed the maintenance was not properly performed. On December 5, 2008, the day Petitioners made known their desire to leave the apartment, Mr. Travis confronted Mr. Cutler. Mr. Cutler offered Apartment 132 to Petitioners because it was ready for occupancy after its occupants had moved out. Apartment 133 would soon be ready, and was also offered to Petitioners. Mr. Travis angrily refused to move into any apartments in the two four-plexes. He yelled at Mr. Cutler and told him he hated him. This exchange was witnessed by a neighbor, Gary Denton. Mr. Cutler offered to let Petitioners move out without penalty, and agreed to return their $650.00 deposit. Petitioners accepted the offer and received the deposit in full as well as a waiver of the first five days' rent for December and an additional four days of rent to allow them time to pack and move. Petitioners accused Respondents of renting one four-plex to whites only and the other to minorities. At the time Petitioners moved out, both four-plexes had tenants of different races. As of the date of the hearing, five of the six total units rented were to non-white tenants. Only one was rented to a white couple.

Recommendation Based on the foregoing Findings of Fact and Conclusions of Law, it is RECOMMENDED that the Florida Commission on Human Relations enter a final order dismissing the Petition for Relief. The Issue Whether Petitioners have been subjected to an unlawful housing practice by Respondents, as alleged in the Housing Discrimination Complaint filed by Petitioners on March 13, 2004.

Findings Of Fact Petitioners, Ingrid Gomez and Luis Moran, are married. They and their son moved into Coral Gardens Apartments in early 2000. Petitioners entered into a one-year lease on January 13, 2000. The lease was not renewed at the end of one year, and Petitioners, thereafter, lived in their apartment as month-to- month tenants. Coral Gardens Apartments is a 36-unit apartment complex located in Naples, Florida. Many of the residents are minorities. Respondent DeMarco Investments is the absentee owner of the complex, which is managed through a Fort Myers company called Services-Taylor Made, Inc. Respondents Jim and Judy Hill were hired to manage the complex in March 2003. At some point in June 2003, Ms. Hill sent a notice to all tenants that stated as follows, set forth verbatim:1/ Now we have [sic] ask you to please make sure that when you give your children snacks, drinks, or what ever [sic] to eat that you the parent would make sure your children discard the trash inside the unit or in the dumpster. Apparently this went in one ear and out the other. Now all unit [sic] has to suffer this price because no one wants to help keep the trash up by disposing of it yourself [sic]. The adults are getting just as bad. So every unit is going to pay an additional $35.00 a month trash clean up fee. You want to live trashy MOVE across the street. So when you pay your July Rent pay an extra $35.00 to pay for the person that has to clean up YOUR trash. I sent out letters to everyone that it was $25.00 and if it didn't improve I would raise it. Well I didn't inforced [sic] the $25.00 and it hasn't changed at all. So it [sic] in effect for sure now [sic]. YOU WILL PAY $35.00 WITH JULY'S RENT. Now you don't want to pay it next month then start picking up the TRASH! Also from now on you put furniture out at the dumpster it will cost you $50.00 first piece and $15.00 per piece after that. They charge me to come and get the stuff then I charge you. The camera's [sic] will be watching and don't get caught. I hate to inform all of you we are not the old managers, the old owners, the old maintenance personal [sic]. We are new and we are the LAW here. We are working to improve this place and if you can't help with keeping this place clean then I DON"T [sic] want to here [sic]. I AM NOT GOING TO LIVE IN A TRASHY PLACE! After receiving this notice, Mr. Moran and Mr. Novarro went to the manager's office to discuss the propriety of the proposed $35.00 trash pick-up fee. Mr. Moran stated to Ms. Hill that he believed an imposition of such a fee on tenants was against the law. Mr. Moran testified that Ms. Hill stated, "I am the law." Mr. Moran demanded that Ms. Hill give him the phone number of Mr. DeMarco. He told her, "I want to talk to the owner of the circus, not the clowns." Mr. Moran testified that at this point, Ms. Hill became apoplectic. She called Mr. Moran "a fucking nigger Latino." Mr. Novarro, whose English was very sketchy, confirmed that Ms. Hill used those words. Ms. Gomez, who speaks relatively fluent English, testified that on another occasion Ms. Hill stated that she was "tired of the fucking negros Latinos." This raised a question whether Ms. Hill also used the term "negros" in her confrontation with Mr. Moran and whether it became "nigger" only in the imperfect translation. In any event, Ms. Hill's use of the word "fucking" was unambiguous and certainly indicated a racial animus against Mr. Moran, who is indeed a black Latino. In a second notice to all tenants dated June 22, 2003, Ms. Hill acknowledged tenant complaints about the $35.00 fee. She had "consulted the Florida Landlord/Tenant Act and state officials in Tallahassee," and concluded that she was required to rescind the $35.00 trash fee. Thus, the controversial fee was never collected. Dennis Gomez, Petitioners' middle-school-aged son, testified that Ms. Hill told him she would pay him $5.00 per week to pick up trash on the property. Mr. Moran told Dennis not to accept, because tenants paid Ms. Hill $10.00 per month to clean up the property. Dennis testified that after he refused the offer, Ms. Hill told him that he had to pick up the trash anyway because he "was a slave." When Dennis asked why he was a slave, Ms. Hill stated that Dennis' father was a "nigger and a slave," and that made Dennis a "slave, too." Dennis Gomez' testimony is not credible. There is undoubtedly a kernel of truth in his story, but Dennis' obvious embellishments of his conversations with Ms. Hill render his testimony of doubtful probative value. At some point in June 2003, Ms. Hill served Petitioners with a seven-day notice to vacate the premises, because of her confrontation with Mr. Moran. However, the notice was never enforced and the Petitioners stayed on until August 1, 2003, when they voluntarily terminated their tenancy. There was a problem with the return of Petitioners' deposit. Ms. Gomez contacted Mr. DeMarco, who returned the deposit to Petitioners after a two-month delay caused by cash flow problems with his businesses. Mr. DeMarco credibly testified that he knew nothing of the controversy between Petitioners and Ms. Hill until he received the Housing Discrimination Complaint. His only contact with Petitioners was the telephone conversation with Ms. Gomez in August 2003 concerning the Petitioners' deposit. From the weight of the testimony, it is apparent that there was a great deal of animosity between Petitioners and the Hills. The notices authored by Ms. Hill were crude and insulting, but were not directed toward Petitioners in particular. There is credible evidence that on at least one occasion Ms. Hill uttered a derogatory and insulting racial comment to Mr. Moran. However, the record evidence does not demonstrate that Ms. Hill took any action against Petitioners on the basis of their race or familial status. The $35.00 trash fee notice was provided to all tenants. The fee itself was never collected. Petitioners were given a seven-day notice, but it was never enforced. Petitioners chose to vacate their tenancy. No adverse action whatever was taken against Petitioners. DeMarco Investments was unaware of the hostile situation between Petitioners and the Hills. Mr. DeMarco's delay in returning Petitioners' deposit was due to legitimate business reasons.

Recommendation Based upon the foregoing Findings of Fact and Conclusions of Law set forth herein, it is RECOMMENDED: That the Florida Commission on Human Relations enter a final order dismissing the Petition for Relief.
