The Issue The issue is whether Respondent, Jian Deng Bao, d/b/a China Gardens Restaurant ("China Gardens") denied Petitioner full and equal enjoyment of the goods and services offered at its place of public accommodation, in violation of section 760.08, Florida Statutes (2011).1/
Findings Of Fact Petitioner, Tracie Inman, is deaf and blind. She uses a service dog to assist with her mobility. She is a resident of Duval County. China Gardens is a restaurant operating at 13740 Beach Boulevard, #112, Jacksonville, Florida 32224. Mrs. Inman is married to Kevin Inman. They have a daughter, Christina, who is of middle school age. Prior to January 18, 2011, the Inman family had dined at China Gardens at least ten times over the past few years. On January 18, 2011, the Inman family went to China Gardens for dinner. On this occasion Mrs. Inman was accompanied, for the first time at China Gardens, by her service dog. As the Inmans entered the restaurant, they were met by Hang Ping Bao, a female employee of the restaurant. Ms. Bao repeatedly stated, "No dog. No dog allowed." Mr. Inman attempted to explain to Ms. Bao that the restaurant was required by law to allow his wife to enter with her service dog. He showed Ms. Bao a "Leader Dog Card" explaining Ms. Inman's right to enter places of public accommodation with her dog. Ms. Bao nonetheless continued to refuse to allow the Inmans to enter the restaurant. She told them that they could order food to take out but they would not be seated in the restaurant. Other customers were seated and eating in the restaurant at the time the Inmans were denied entrance. The family walked out of the restaurant. From the China Gardens parking lot, Mr. Inman phoned the non-emergency line of the JSO to report the incident and request assistance. The dispatcher who answered the call was unaware that denying service in a place of public accommodation based on the presence of a service dog is a criminal offense under section 413.08(4), Florida Statutes. Because she believed the incident described by Mr. Inman constituted only a civil matter, the dispatcher refused to send an officer to assist. Mr. Inman later spoke with the Florida Department of Law Enforcement ("FDLE") to confirm his understanding of the law. The FDLE representative gave Mr. Inman the statutory citations to establish that the incident at China Gardens was indeed a matter for the police. On January 19, 2011, Mr. Inman again phoned the JSO. This time the dispatcher understood the situation and agreed to send an officer to meet the Inmans at China Gardens to follow up on their complaint. Officer N.S. Eddy responded to the call and filed a police report, which was admitted into evidence. Officer Eddy testified that Ms. Bao admitted to him that she had refused to allow the family to enter the restaurant with the service dog. Ms. Bao explained that she was unaware that the law required her to allow entrance to persons with service dogs. She assured Officer Eddy that China Gardens would comply with the law in the future. No criminal prosecution was brought against China Gardens. At the hearing, Mrs. Inman testified that she felt humiliated by the incident on January 18, 2011. Other patrons in the restaurant witnessed the confrontation with Ms. Bao, which caused Mrs. Inman great embarrassment. Mrs. Inman testified that her family has not returned to China Gardens since the incident, and that she is fearful of going into any restaurant with which she is not already familiar.
Recommendation Based on the foregoing Findings of Fact and Conclusions of Law, it is RECOMMENDED that the Florida Commission on Human Relations issue a final order: Finding that Respondent Jian Deng Bao, d/b/a China Gardens Restaurant, committed an act of public accommodations discrimination against Petitioner Tracie Inman; Prohibiting any future acts of discrimination by Respondent; and Awarding Petitioner her costs and a reasonable attorney's fee. The Issue The issue is whether Respondent, Steak n Shake Restaurant (“Steak n Shake”), violated section 760.08, Florida Statutes,1/ by discriminating against Petitioner based on his race.
Findings Of Fact Petitioner is a white male who lives in Ormond Beach, Florida. Petitioner testified that he had been a regular customer of the Steak n Shake at 120 Williamson Boulevard in Ormond Beach for about four years. Petitioner entered the restaurant on March 30, 2015, and was seated by server Amanda Hobbs, a black female. Petitioner testified that neither Ms. Hobbs nor any other server would wait on him. He saw Ms. Hobbs take the order of a black couple who came into the restaurant after he did. Petitioner complained to the manager, Mark Regoli, a male of mixed race. Petitioner testified that he told Mr. Regoli that the service had been poor for several months, and complained about not being served on this occasion. Petitioner stated that Mr. Regoli accused him of being “loud,” but explained that he is hearing-impaired and may sometimes speak in a loud voice. Petitioner testified that Mr. Regoli became angry, “got up in my face,” and blocked Petitioner from leaving the restaurant. Petitioner testified that he left the restaurant. It was only later that he learned that the police had been called by someone at Steak n Shake. Counsel for Steak n Shake did not cross-examine Petitioner. Steak n Shake called no witnesses. Steak n Shake’s documentary evidence consisted of hearsay witness statements that cannot be considered in the absence of admissible evidence that the hearsay may be said to supplement or explain. Therefore, Petitioner’s narrative is the only sworn, admissible evidence before this tribunal. Though Petitioner’s testimony was clearly a self-serving version of the events that occurred at the Steak n Shake on March 30, 2015, it is the only version of events that may be considered under the rules of evidence. Petitioner’s testimony lacks complete credibility only when one compares it with the excluded witness statements of the Steak n Shake employees. If one considers Petitioner’s testimony standing alone, as this tribunal must, the worst one can say is that it is one-sided and incomplete. This state of affairs is not the fault of Petitioner, who was under no obligation to tell anything other than his side of the story. Petitioner represented himself and so is not entitled to attorney’s fees. Petitioner may be entitled to an award of costs.
Recommendation Based on the foregoing Findings of Fact and Conclusions of Law, it is RECOMMENDED that the Florida Commission on Human Relations issue a final order: Finding that Respondent, Steak n Shake Restaurant, committed an act of public accommodations discrimination against Petitioner, Virgil W. Findings Of Fact On August 2, 1983, the Petitioner, Donald D. Mayfield, took the examination to practice acupuncture administered by the Department of Professional Regulation. The Petitioner's performance on the practical examination is completely documented in Joint Exhibit 3. This exhibit reflects that the Petitioner passed all portions of the practical examination except Part IV, which part must be passed in order for an applicant to be licensed. Pages 2 and 3 of Joint Exhibit 3 reflect the Petitioner's scores on specific requirements upon which he was examined. Specifically, the Petitioner takes issue with the scores on times numbered 8, 10, 13, 15, 18 and 20. These items relate to insertion of the needle and withdrawal of the needle. The Petitioner failed to obtain at least an average score of 3 on item number 13 as graded by one grader, on item number 10 as graded by the other grader, and on item number 20 as graded by both graders. The instructions received by the Petitioner prior to the examination were contained in Joint Exhibit 1. The instructions received by the Petitioner at the examination were received as respondent's Exhibit 1. The Petitioner stated that these instructions were not read to him in full when he was beginning the practical examination. No evidence to the contrary was received, and the testimony of his examiners was not offered. The instructions received by the Petitioner directed him to perform required procedures in the manner he would perform them in his clinic. The Petitioner performed these operation without angling the needle in the direction of the flow of force and without regard to leaving the hole open or closed. This is the manner in which he performs these operations in his clinic, and this method of acupuncture is a widely accepted practice among more modern schools of acupuncture. These methods are, however, contrary to the classic Chinese procedures. The examiners deducted points because the classic technique was not used. Nothing in the instructions would have indicated that the classical technique was required except directions contained in Respondent's Exhibit 1, which contained the language that the procedures should be performed by "properly angling the needle." These instructions were not read to the Petitioner. In the absence of these instructions, the Petitioner could not reasonable be aware that the examiners expected him to use classical techniques. The failure of the examiners to score the Petitioner's performance on the basis of the instructions which he received, i.e., "perform the procedures as you would in your own clinic," constitutes an essentially unfair means of grading the examination.
Recommendation Having found that the Petitioner, Donald D. Mayfield, has proven that the examination give by the Department of Professional Regulation was not scored reasonably and fairly in consideration of the directions of Petitioner was given, and that the Petitioner did perform acceptably under the instructions he was given, and that his amended scores totaled more than 3 on Part III of the examination (the only part which he initially failed), it is recommended that the Department issue the Petitioner a license to practice acupuncture. Findings Of Fact Based on the oral and documentary evidence presented at the formal hearing and on the entire record of this proceeding, the following Findings of Fact are made: Petitioner, Shawn Sutton, is physically disabled and entitled to the protection of the Florida Civil Rights Act. Respondent is the owner of Golden Corral Restaurant, which is a structure for public accommodation. On July 8, 2007, Petitioner, accompanied by his parents, grandmother and siblings, visited Respondent restaurant for the purpose of eating therein. The total number in the group that accompanied Petitioner was approximately 15. Prior to July 8, 2007, Petitioner's family was a frequent customer of Respondent restaurant and had eaten there on approximately 50 occasions. There had never been a request for special accommodations for Shawn Sutton on any previous occasion. Respondent has a sign on the front door of the restaurant that reads as follows: "Please remain with your party until seated. For guests with special needs, please see the manager. Golden Corral." Respondent is a buffet restaurant. Patrons pay for meals upon entry and prior to being seated. Respondent has a seating policy that requires all persons on the same receipt of payment to remain seated together until a waitress takes their beverage order, verifies that all persons in the party are included on the receipt, and delivers a plate to each person. The members of a party are then free to sit wherever they choose. On July 23, 2007, after a visit to the same restaurant on that day, Petitioner's mother emailed Golden Corral three times complaining about rudeness and lack of professionalism on the part of restaurant employees. In one email, she makes her only reference to the matter at issue in this case, indicating that when told that her son was disabled, a restaurant employee, "Tangie," "changed the entire tone and tried to accomidate [sic] us the best she could." While Petitioner's disability is such that he needs assistance carrying his plate (and food) from the buffet line to his seat, he is able to feed himself without assistance. On July 8, 2007, the entire family sat together and Petitioner was able to eat after his mother and grandmother assisted him in obtaining his food. The evidence revealed that Petitioner's mother's complaint was substantially directed to the "rudeness" she perceived from Respondent's employees.
Recommendation Based upon the foregoing Findings of Fact and Conclusions of Law, it is RECOMMENDED that the Florida Commission on Human Relations enter a final order dismissing with prejudice the Petition for Relief for failure to establish an unlawful discriminatory act by Respondent. Findings Of Fact Parties and Jurisdiction Petitioners are African Americans who reside in the State of Ohio, who visited Orlando, Florida, in June 2011 and stayed at Lake Eve Resort beginning on June 21, 2011. Respondent, Eve Management, Inc./KA and KM Development, Inc., was the owner of Lake Eve Resort, located at 12388 International Drive, Orlando, Florida, at all times relevant hereto. Each Petitioner filed a Complaint of Discrimination with the Commission as follows: Jessica Austin – July 20, 2012 Denise Austin – July 21, 2012 Tracie Austin – January 18, 2013 (Amended Complaint)2/ Bonlydia Jones – July 11, 2012 James Austin – July 31, 2012 Dionne Harrington – August 1, 2012 Esther Hall – January 28, 2013 (Amended Complaint)3/ Boniris McNeal – March 27, 2013 Summer McNeal – March 27, 2013 Derek McNeal – March 27, 2013 In each Complaint, the Petitioner alleges that the most recent date of discrimination is June 22, 2011. On June 21, 2012, Petitioners Esther Hall, Summer McNeal, Boniris McNeal, Derek McNeal, and Dionne Harrington, each filed a Technical Assistance Questionnaire (TAQ) with the Commission. Each TAQ is signed by the named Petitioner, is stamped received by the Commission on June 21, 2012, and contains the specific facts alleged to be an act of discrimination in the provision of public accommodation by Respondent. Allegations of Discrimination On or about May 23, 2011, Petitioner, Boniris McNeal, entered into a Standard Group Contract with Lake Eve Resort (the Resort) to reserve 15 Resort rooms for five nights at a discounted group rate beginning June 21, 2011.4/ The rooms were to accommodate approximately 55 members of her extended family on the occasion of the Boss/Williams/Harris family reunion. Petitioners traveled from Ohio to Orlando via charter bus, arriving at the Resort on the evening of June 21, 2011. Erika Bell, a relative of Petitioners, drove a rental car from Ohio to Orlando. She did not arrive in Orlando until June 22, 2011. Petitioners checked in to the Resort without incident. However, one family member, John Harris, was informed that the three-bedroom suite he had reserved for his family was not available due to a mistake in reservations. He was offered two two-bedroom suites to accommodate his family. Petitioner, Boniris McNeal, dined off-property on the evening of June 21, 2011, to celebrate her wedding anniversary. Petitioner, Bonlydia Jones, left the Resort property shortly after check-in to shop for groceries. Petitioners, Dionne Harrington and Esther Hall, were very tired after the long bus trip and went to bed early on June 21, 2011. Petitioner, Denise Austin, arrived in Orlando with the family on June 21, 2011. On the morning of June 22, 2011, Ms. Jones received a call from Mr. Harris, informing her that the Resort management wanted to speak with them about his room. That morning, Ms. Jones and Mr. Harris met with two members of Resort management, Amanda Simon and Marie Silbe. Mr. Harris was informed that he needed to change rooms to a three-bedroom suite, the accommodation he had reserved, which had become available. Mr. Harris disputed that he had to change rooms and argued that he was told at check-in the prior evening he would not have to move from the two two-bedroom suites he was offered when his preferred three-bedroom suite was not available. After some discussion, it was agreed that Mr. Harris would move his family to an available three-bedroom suite. The Resort provided an employee to assist with the move. Following the meeting with management, Ms. Jones went to the pool, along with Ms. Harrington and other members of the family. After a period of time which was not established at hearing, Mary Hall, one of Ms. Harrington’s relatives, came to the pool and informed Ms. Harrington that the family was being evicted from the Resort. Ms. Harrington left the pool and entered the lobby, where she observed police officers and members of Resort management. She approached a member of management and was informed that she and her family were being evicted from the Resort and must be off the property within an hour. Ms. Harrington left the lobby and returned to her room, where her mother, Ms. Hall was sleeping. Ms. Harrington informed Ms. Hall that the family was being evicted from the Resort and instructed Ms. Hall to pack her belongings. Ms. Jones’ cousin, Denise Strickland, came to the pool and informed her that the family was being evicted from the Resort. Ms. Jones entered the lobby where she was approached by a member of management, who introduced herself as the general manager and informed her that the family was being evicted. Ms. Jones requested a reason, but was informed by a police officer that the owners did not have to give a reason. In the lobby, Ms. Jones observed that an African- American male was stopped by police and asked whether he was with the Boss/Williams/Harris reunion. He was not a family member. Ms. Jones observed that no Caucasian guests were approached in the lobby by management or the police. Ms. Austin was on a trolley to lunch off-property on June 22, 2011, when she received a call from her cousin, Ms. Strickland. Ms. Strickland informed Ms. Austin that the family was being evicted from the Resort and she needed to return to pack her things. Ms. Austin returned to the property, where she was escorted to her room by a security guard and asked to pack her belongings. Ms. McNeal was en route to rent a car and buy groceries on June 22, 2011, when she received a call from Ms. Strickland informing her that the family was being evicted and that she needed to return to the Resort to pack her belongings. Upon her arrival at the Resort, Ms. McNeal entered the lobby. There, she was approached by Resort staff, asked whether she was with the Boss/Williams/Harris reunion, and informed that the Resort could not honor the reservations and the family was being evicted. Ms. McNeal observed that Caucasian guests entering the lobby were not approached by either the police or Resort management. Ms. McNeal was escorted to her room by both a police officer and a member of management and instructed to be out of the room within 30 minutes. Ms. McNeal inquired why they were being evicted, but was told by a police officer that the Resort was not required to give a reason. Erika Bell received a call from her mother, Ms. Austin, while en route to the Resort on June 22, 2011. Ms. Austin informed Ms. Bell that the family was being evicted from the Resort and asked her to call the Resort and cancel her reservation. Respondent gave no reason for evicting Petitioners from the property. Respondent refunded Petitioners’ money.

The Issue Whether the Respondent failed to have the seating capacity required of a licensee in its category as alleged by the Notice to Show Cause and, if so, what disciplinary action should be taken.
Findings Of Fact At all times pertinent hereto, Respondent, EDM of Key West, Inc., d/b/a/ Portside, was the holder of a special restaurant license issued by Petitioner, Division of Alcoholic Beverages and Tobacco, Department of Business Regulation. This license, Series 6-COP, Number 54-00999SRX, authorizes Respondent to sell alcoholic beverages, subject to regulation by Petitioner and other authorities, in conjunction with its restaurant business. On November 16, 1988, Petitioner's law enforcement investigator, David Myers, inspected Respondent's premises to determine whether Respondent was in compliance with the regulations applicable to licensees such as Respondent. Two violations were discovered. The first was that the establishment failed to have sufficient seating for patrons under the covered portion of the premises. The second was that the establishment failed to keep adequate records of its sales of food and of its sales of alcohol as required by regulation. Official Notices were issued by Petitioner to Respondent for both violations. Investigator Myers told Respondent's dining room manager on November 16, 1988, that the establishment was required to have seating sufficient for at least 150 dining patrons under a permanent roof and that the seats located outside the roofed area could not be counted toward that requirement. This advice is consistent with Petitioner's interpretation of Rule 7A-3.014, Florida Administrative Code. Prior to December 12, 1988, Investigator Myers advised the management of Respondent that he intended to make a follow-up inspection on December 12, 1988. On December 12, 1988, there were 132 seats for dining patrons within the roofed area. Other seats for dining patrons were located in an uncovered area. Petitioner filed a Notice to Show Cause subsequent to its inspection of December 12, 1988, against Respondent alleging, in pertinent part, the following: On December 12, 1988, you, EDM OF KEY WEST INC., failed to have accommodations for service of 150 patrons at tables on your licensed premises . . . . The Notice to Show Cause did not cite Respondent for failure to keep adequate records of sales. On May 22, 1989, an inspection revealed that there was seating for only 118 dining patrons under the roofed area. On June 5, 1989, Respondent was found to be in compliance with the seating requirement. Respondent filed a timely request for hearing and therein denied the factual allegations of the charge brought against it.
Recommendation Based on the foregoing findings of fact and conclusions of law, it is RECOMMENDED that a final order be entered finding Respondent guilty of having failed to have accommodations for the seating of 150 dining patrons as required by Section 561.20(2)(a)4, Florida Statutes, and by Rule 7A-3.014 and Rule 7A-3.015, Florida Administrative Code, and which imposes an administrative fine of $500.00 against Respondent.
