The Issue Whether Respondent committed a discriminatory act based on Petitioner's disability, in violation of the Fair Housing Act.
Findings Of Fact Ms. Prado rented an apartment using a Housing Choice Voucher in Miami, Florida. Florida Quadel entered into a contract with Miami-Dade County in 2009. Florida Quadel, pursuant to this contract, administers the Housing Choice Voucher Program on behalf of the County. During a routine quality control review of the program's files, Ms. Prado's file was randomly selected for a more in-depth quality control review. A review of the file revealed that Ms. Prado was a single individual residing in a two-bedroom apartment, utilizing a voucher that allowed for a two-bedroom unit. There was insufficient documentation in the file to justify the need for a two-bedroom unit; therefore, paperwork requesting a reasonable accommodation was forwarded to Ms. Prado for completion. The paperwork required that Ms. Prado's health care provider indicate the medical necessity for any reasonable accommodation being requested. Ms. Prado's health care physician did not provide a statement of medical necessity for the second bedroom; therefore, Quadel made numerous additional requests for the physician to provide the necessary statement. The physician never made such a statement. Quadel then conducted an on-site inspection of the dwelling. During this inspection, Ms. Prado told the inspector that the second bedroom was used for guests. There was no indication during the inspection that a second bedroom was for housing Ms. Prado's medical equipment. Ms. Prado's voucher was amended from a two-bedroom voucher, to a one-bedroom voucher. This amendment did not require that Ms. Prado vacate the two-bedroom unit, but it did reduce the amount of subsidy Ms. Prado received. Ms. Prado filed a grievance as to this determination. At the grievance committee meeting, Ms. Prado stated that she slept in one bedroom, and the other bedroom was used when her daughter and husband visited and spent the night. Based on the absence of any documentation indicating the medical necessity of a second bedroom, coupled with Ms. Prado's own statements to Quadel, the grievance was denied. Ms. Prado then filed a complaint of discrimination with the Florida Commission on Human Relations. Ms. Prado presented no evidence of discrimination in the housing decision. Quadel's decision to amend the voucher from a two-bedroom unit to a one-bedroom unit was based on legitimate, non-discriminatory reasons.
Recommendation Based on the foregoing Findings of Fact and Conclusions of Law, it is RECOMMENDED that the Florida Commission on Human Relations enter a final order determining that Respondent did not commit a discriminatory housing practice based on Ms. Prado's disability. The Issue The issue is whether Respondent is guilty of housing discrimination against Respondent based on her race and disabilities, in violation of the Florida Fair Housing Act, Sections 760.20-760.37, Florida Statutes.
Findings Of Fact Petitioner is African-American, although the record fails to disclose any physical or mental disability. Due to her pending eviction at an apartment complex known as the Tennis Club in Fort Lauderdale, Petitioner visited the Venice Cove apartment complex, also in Fort Lauderdale, in the summer of 2002. Deciding that she liked Venice Cove, Petitioner applied for a one bedroom apartment on September 16, 2002. In accordance with its customary practice, Respondent obtained a credit report and learned that Petitioner owed a utility payment, possibly a cable television box. Respondent advised Petitioner that she would have to satisfy this debt to rent an apartment, and Petitioner did so. At some point, Petitioner decided that she wanted a two bedroom/two bathroom apartment, and Respondent tentatively assigned her a unit of this type, pending final approval of her application to lease. Petitioner changed her preferences for type of apartment several times. Respondent was able to accommodate immediately all but one of these preferences. In early December, Petitioner mentioned to Respondent's representative that she was being evicted from the Tennis Club. This is the first time that Petitioner disclosed any eviction to Respondent. Examining the file, Respondent's representative realized that she had failed to order the more thorough credit report that Respondent had been using since November 2002. This report would reveal evictions, among other things. Respondent's representative ordered the more thorough credit report, which revealed that Respondent had been evicted three times. Respondent's policy precluded renting to a person with this rental history, and Respondent's representative promptly informed Petitioner that she was denying Petitioner's application. There is no evidence whatsoever that Respondent denied Petitioner's application on the basis of Petitioner's race or any disability from which she may suffer.
Recommendation It is RECOMMENDED that the Florida Commission on Human Relations enter a final order dismissing Petitioner's Housing Discrimination Complaint. The Issue Whether Petitioners were subject to discrimination in the rental of a dwelling, or in the terms, conditions, or privileges of rental of a dwelling, based on their race or familial status, in violation of the Florida Fair Housing Act, chapter 760, Part II, Florida Statutes.
Findings Of Fact Petitioners, Rolstan and Leticia Hodge, are African- American and currently reside in Virginia Beach, Virginia. Petitioners have six children. Respondent, Watson Realty Corp.,1/ is a real estate and property management company with offices throughout the state of Florida and an office in Georgia. Wendell Davis is the company’s Executive Vice President in charge of Watson Realty Management Division, including its Jacksonville office located at 4456 Sunbeam Road, Jacksonville, Florida 32257. On June 3, 2013, Petitioners completed applications to rent a property from Respondent located at 2314 Creekfront Drive in Green Cove Springs, Florida (the Property). Petitioners’ applications were taken by Gayle Aljets, Secretary at Respondent’s Westside office. Ms. Aljets sent, via facsimile transmission, Petitioners’ applications, along with copies of their photo identification, social security cards, and proof of income, to Anne Fletchall, Application Specialist in Respondent’s Sunbeam office.2/ Ms. Fletchall entered pertinent information from Petitioners’ applications, including personal identification and income information, into a system run by LexisNexis, a company with which Respondent contracted to conduct background, criminal, and financial screening of applicants.3/ LexisNexis screens applicants based on criteria selected by Respondent. For example, Respondent requires applicants to establish income of three times the rental amount, applies the combined income of multiple applicants for the same property (roommates), and requires criminal background checks on applicants 18 years of age and older. On debt issues, Respondent screens applicants for legal debts (e.g., judgments) of $1,000 or more within the most recent 48 months; as well as tax liens, landlord debt, and utility debt within the most recent 24 months. The screening system allows for exceptions, or “overrides,” on negative results for specified criteria. For example, if an applicant has a legal debt of $1,000 or more in the most recent 48 months, or a tax lien, landlord debt, or utility debt within the most recent 24 months, the system will return an override code of “800,” allowing approval of the applicant with a co-signor, or guarantor. The override determinations were made by Respondent at the time Respondent contracted with LexisNexis. Ms. Fletchall entered Petitioners’ information separately as two roommates applying for the Property. LexisNexis reported to Ms. Fletchall that Mr. Hodge had a legal debt of $1,000 or more within the last 48 months, thus failing one of the screening criteria. However, the program assigned an override code of “800,” meaning the application could be approved if Mr. Hodge obtained a guarantor. Mrs. Hodge passed all the LexisNexis screening criteria. LexisNexis further reported Petitioners’ rent-to- income ratio as 24.73 percent, based on a monthly rent of $1,195.00 and a combined income of $5,055.00. According to the criteria established by Respondent when setting up the screening process, a guarantor must establish an income of three and one-half times the amount of the monthly rent. Mrs. Hodge’s individual verified income was approximately $1,400.00, less than three and one-half times the monthly rental amount. Ms. Fletchall sent an email to Heather Cornett, property manager in the Westside office, informing her that Mr. Hodge was approved conditioned upon obtaining a guarantor. Ms. Cornett informed Mr. Hodge by phone that he would need a guarantor in order to qualify to rent the Property. Mr. Hodge asked why a guarantor would be required, but Ms. Cornett was unable to explain. Ms. Cornett informed Mr. Hodge that he would receive a letter from the third-party screening company that explained the details. During that telephone conversation, Mr. Hodge requested a telephone number for LexisNexis. Ms. Cornett did not have the LexisNexis telephone number and informed Mr. Hodge she would have to call him back with the number. Ms. Cornett obtained the number and made a return call to Mr. Hodge with the telephone number the same day. Through contact with LexisNexis, Mr. Hodge learned that a judgment against him by Freedom Furniture and Electronics had caused him to fail the applicable screening criteria, thus triggering the need for a guarantor. Mr. Hodge contacted Ms. Cornett and informed her that the debt had been satisfied. Ms. Cornett asked Mr. Hodge to obtain a letter from the debtor on the debtor’s letterhead verifying the debt had been satisfied. Mr. Hodge subsequently met with Ms. Cornett in her office and presented a letter from Freedom Furniture and Electronics. The letter represented that Mr. Hodge had entered into a payment agreement to satisfy the debt and that, thus far, payments had been made on time. Ms. Cornett faxed the letter to Ms. Fletchall to submit to LexisNexis as additional information. Ms. Fletchall called Ms. Cornett and told her the letter was only proof that payments were being made on the debt, not that the debt had been satisfied. Ms. Cornett called Mr. Hodge and informed him that the letter did not change the status of his application, and a guarantor was still required. Mr. Hodge requested Ms. Cornett submit the matter to a manager for review. Ms. Cornett took the Hodge’s applications, the letter, and the LexisNexis report to Terri Brown, Respondent’s Regional Manager. Ms. Cornett spoke to Ms. Brown via telephone, who confirmed that a guarantor would still be required for approval. Ms. Cornett again called Mr. Hodge with this information. Mr. Hodge did not obtain a guarantor and did not make another application, or otherwise arrange with Respondent to rent the Property. On June 10, 2013, Respondent received an application from a different set of applicants to rent the Property. The applicants were white and listed on their application that they had three children.4/ Ms. Fletchall processed two separate applications for the applicants as roommates, just as she did with Petitioners’ applications. The LexisNexis report showed that the male applicant failed three of the screening criteria, while the female applicant passed all the criteria. The system assigned an override code of “800” for the male applicant’s prior landlord debt, triggering the requirement for a guarantor. The system also assigned an override code of “920” based on the male applicant’s prior issue with a personal check, triggering a requirement that the male applicant pay monthly rent by certified funds. On June 21, 2013, the new applicants entered into a lease for the Property. The tenants obtained a guarantor who signed a lease guarantee which was incorporated into the lease.
Recommendation Based on the foregoing Findings of Fact and Conclusions of Law, it is RECOMMENDED that the Florida Commission on Human Relations issue a final order dismissing the Petition for Relief filed in FCHR No. 2014H0082. The Issue Whether Respondent discriminated against Petitioner on the basis of handicap in violation of the Florida Fair Housing Act and, if so, the relief to which Petitioner is entitled.
Findings Of Fact At times relevant to this proceeding, Petitioner, a female born in October 1953, received housing assistance from a federally funded assistance program referred to as the Section 8 Choice Voucher program (the Section 8 program). The Section 8 program relevant to this proceeding is administered by Respondent and has eligibility criteria that a participant must meet. A participant receives a voucher from the Section 8 program that pays part, but not all, of the participant’s rent. Petitioner has also received Supplemental Security Income (SSI) at all times relevant to this proceeding. Respondent knew that Petitioner received SSI, but it had no information as to why she qualified to receive SSI. At the times relevant to this proceeding, Petitioner’s landlord was named Rupert Phipps. On May 27, 2007, Mr. Phipps issued to Petitioner a notice styled “Three-day Notice for Non- payment of Rent pursuant to Florida Statutes" (Notice). After stating the amount owed and the address of the rented premises, the Notice demanded “. . . payment of the rent or possession of the Premises within three days (excluding Saturday, Sunday and legal holidays). ” Petitioner was evicted from her apartment. The date of the eviction was not established. After being advised by Mr. Phipps that Petitioner had failed to pay her rent, Ms. Smith mailed to Petitioner a certified letter dated July 6, 2007, stating that she would be terminated from the Section 8 program effective August 6, 2007. The stated reason for the termination was Petitioner’s failure to pay rent to the landlord, which is considered a serious violation of the lease and, therefore, a violation of 24 C.F.R. § 982,511(4)(c), which prohibits a participant in the Section 8 program from committing any serious or repeated violation of the lease with the participant’s landlord. Ms. Smith’s letter also contained the following statement: . . . If you wish to appeal this decision, you have the right to an informal hearing. The request must be submitted to this agency in writing within 10 days from the date of this letter. Your request should be directed to Alex Morales, Executive Director. The ten-day period for the appeal is part of Respondent’s written policies and is consistent with the requirements of 24 C.F.R. § 982.554(a), that require an agency such as Respondent to have a written appeals process. Respondent has consistently treated the failure of a participant to pay his or her share of the rent as a serious violation of a lease. Petitioner was familiar with Respondent’s appeal process because she had successfully appealed a prior notice of termination of her participation in the Section 8 program. Ms. Smith’s letter was received by Petitioner on July 7, 2007. At some undetermined time between July 7 and July 19, 2007, Ms. Tennie called Ms. Smith and told Ms. Smith that she was sick. Ms. Smith told Ms. Tennie that she would have to follow the instructions set forth in the letter and respond in writing if she wanted an informal appeal. On July 19, 2007, Petitioner sent the following letter to the attention of Ms. Smith and Mr. Morales: Would you give me Mae Tennie another hearing because I got the letter to [sic] late and I was in the hospital due to an anurism [sic] stroke at the brain their [sic] was blood on my head and I’m still rehabilitating the after affects [sic] of this serious condition. In the case of my Section 8 voucher being terminated I plead for another hearing due to the terms [sic] of my hospitalization. Respondent received Petitioner’s letter on July 23, 2007. Petitioner’s written request for an appeal was after the ten-day deadline for filing the request. By letter signed by Mr. Morales and dated July 25, 2007, Respondent denied Petitioner’s request contained in her letter dated July 19 as follows: I am in receipt of your letter requesting a hearing. Please be advised that your request for a hearing cannot be granted because your request was not made within the required 10 day period. For this reason, your case will remain closed. No further action was taken by either party to this proceeding until December 2007, when Petitioner sought the services of Legal Services of Greater Miami, Inc. On December 20, 2007, Mr. Lewis, as counsel for Petitioner, sent the following letter to Mr. Morales: This office represents Ms. Mae Tennie regarding her participation in the Section 8 program administered through the Hialeah Housing Authority (“HHA”). Ms. Tennie has been a participant of Section 8 through HHA for the past 25 years. On July 6, 2007, HHA served Ms. Tennie with notice of its intent to terminate her Section 8 assistance on the basis that she violated one of her obligations under the program. The notice informed Ms. Tennie of her right to appeal the decision and to attend an informal hearing. The written request was to be submitted to HHA within 10 days of the date of the letter. Ms. Tennie faxed her written request for an appeal on July 19, 2007. A copy of Ms. Tennie’s letter is attached as “Attachment A.” In her request, she notified HHA that she was unable to submit her request within the time required because she [had] been, and still was, recovering from a brain aneurism.[2] On or about July 31, 2007, HHA notified Ms. Tennie that her request was denied because it was submitted too late. Ms. Tennie requests that HHA reconsider its denial and provide Ms. Tennie with an informal hearing to appeal the termination. Ms. Tennie is an elderly woman in failing health. In June 2007, Ms. Tennie was hospitalized twice at Jackson South Community Hospital as a result of suffering an “intracranial hemorrhage.”[3] I have attached copies of supporting medical documentation as “Attachment B.” As a result of this very serious medical condition, Ms. Tennie’s cognitive abilities were significantly diminished. Ms. Tennie was bed-bound and only able to communicate under great strain. The Fair Housing Act, the Americans with Disabilities Act, and Section 504 of the Rehabilitation Act of 1973, prohibits [sic] any agency or landlord receiving federal funds to deny equal access for individuals with disabilities to housing or other program benefits and services. To ensure individuals with disabilities have equal access to those services and benefits, an agency or landlord is required to provide reasonable accommodations to that person’s disability. One form of reasonable accommodations is the modification of a program rule or policy. The right to a hearing to appeal the termination of Section 8 assistance is a benefit that Ms. Tennie, as a participant, was entitled to. Ms. Tennie made clear in her letter to HHA that she was unable to comply with HHA’s time requirement because of her disabling medical condition. Ms. Tennie also asked that the policy be modified to accommodate her disability. HHA should have reasonably accommodated Ms. Tennie’s disability by simply modifying the time period by adding 3 extra days for her to submit her request for a hearing. By failing to do so, HHA effectively denied Ms. Tennie equal access to federal benefit under the Section 8 program, that of having a hearing to appeal her termination. Ms. Tennie is therefore renewing her request to HHA for reasonable accommodations to her disability by modifying the time limit to request a hearing. For the above reasons, Ms. Tennie requests that HHA reconsider its denial and provide Ms. Tennie a hearing to challenge her termination from Section 8. Please do not hesitate to contact me with any questions or additional information at ... . [telephone number omitted.] [Footnotes omitted.] By letter dated December 26, 2007, Respondent denied the request set forth in Mr. Lewis’s letter. Thereafter, Petitioner filed the complaint with HUD that culminated in this proceeding as described in the Preliminary Statement of this Recommended Order. Ms. Tennie was hospitalized June 7, 2007, and discharged June 14, 2007. Mr. Lewis attached to his letter a discharge summary from Jackson Memorial Hospital, which contained the following diagnoses on discharge: Intracranial hemorrhage with intraventricular extension secondary to uncontrolled hypertension. Diabetes. The discharge summary reflects that Petitioner had fallen the Saturday before admission and had hit her head on a doorknob. The discharge summary reflects that on discharge she was awake, alert, and oriented times three. She had fluent speech and she was able to ambulate without difficulty. She was instructed to make an appointment with her primary care doctor in one week and to follow up in the Jackson Memorial’s Stroke Clinic in 4 to 8 weeks. Petitioner was discharged to home in a stable condition. Petitioner scheduled an appointment with Milton R. Bengoa, M.D., and on June 18, 2007, she kept that appointment. No finding is made as to Petitioner’s physical status as determined by Dr. Bengoa because nearly all of his notes of that meeting are illegible. In response to questions from her attorney, Petitioner testified as follows beginning at page 27, line 12: Q. And Ms. Tennie, can you please describe what your current health conditions are? A. Right now it’s not very good, because after I had the aneurism I have been having problems walking and problems breathing and I have seizures that I never had before until I had the aneurism and I take all kinds of medicines. And I just found out last week I have a brain mass and they don’t know if it is cancer or what, because the blood that was left in my head was still there so I have excruciating headaches. Q. And could you please explain what your health condition was at or about the time you suffered the stroke or shortly after you had suffered the stroke? A. Well, shortly after I suffered the stroke I had to try and walk all over again, because my memory where I had the stroke at, the neurologist said that it was so deep in my brain that they couldn’t do surgery and that it was going to mess my motor skills up. So I had to learn how to swallow. I forgot how to swallow meat and stuff, so I started eating soft food. I had problems breathing, so when I come [sic] home I had a breathing machine – oxygen machine there. My daughter had to help me try to walk all over again. Q. And so I take it you had someone helping you? A. Yes. My daughter. I moved home with my daughter, because they wanted to put me out at Purdue, it is a nursing facility, but she wanted me to come home with her, so that is what I did. I went home with my daughter and I stayed there for six months. Then I found the place down the street, close to her, which was a two bedroom. Q. Now, prior to suffering the stroke, how was your – can you describe what your health condition was. A. Before I had the stroke, I was sick too. I have congestive heart failure, so I kept going back and forth into the hospital because of my breathing. When the water built up around my heart it had [sic] me to where I can’t breathe. So I have to go in and let them pull the water off. And I was sick before I had the stroke. Petitioner also testified that she could not timely request a hearing and blamed that inability on her general medical condition. Petitioner’s testimony as to her medical condition shortly after the hospitalization is unconvincing because it contradicts the description of her medical condition as described by her treating physician in the discharge notes. The evidence established that Petitioner received Ms. Smith's letter dated July 6, 2007, and understood its contents. Petitioner’s testimony is insufficient to establish that her medical condition caused her failure to timely request an informal hearing to appeal of the termination of her participation in the Section 8 program. Petitioner failed to establish that she required an extension of the expired deadline to request an informal hearing as a “reasonable accommodation” of her condition.
Recommendation Based upon the foregoing Findings of Fact and Conclusions of Law, it is hereby RECOMMENDED that the Florida Commission on Human Relations enter a final order finding Respondent not liable for the acts of discrimination alleged in the subject Petition for Relief. The Issue Whether Petitioner was the subject of unlawful discrimination in the provision of services or facilities in connection with his dwelling based on his handicap, and whether Respondent refused to make reasonable accommodations in its rules, policies, practices, or services necessary to afford Petitioner equal opportunity to use and enjoy a dwelling in violation of the Florida Fair Housing Act, chapter 760, Part II, Florida Statutes.
Findings Of Fact Petitioner is a homeowner in the Royal Highlands community in Leesburg, Florida, and has been a member of the RHPOA since moving into his home in April 2001.1/ From September 2010, through February 2011, Petitioner served on the RHPOA Board of Directors. Respondent is a property owners? association, membership in which is limited to property owners in the Royal Highlands residential community in Leesburg, Florida. There are 1,499 homes in the Royal Highlands community. The community is divided into twelve “districts.” Respondent?s Board of Directors (Board) consists of one representative from each of the twelve districts. Meetings of the Board are held monthly, except for August when community activities are typically sparsely attended. Leland Management is a community association management company that provides management services to the RHPOA along with other community associations. Petitioner alleged that he suffers from a disability because he walks with the use of a cane, and that his ability to speak is impaired as a lingering effect of a 2004 neck surgery that involved insertion of an endotracheal tube during and immediately after the procedure. During the month of February 2011, Petitioner was running for reelection to the RHPOA Board of Directors. On the day of the election, and prior to the vote of the membership, Petitioner appeared at the RHPOA meeting to make a final statement and thank his supporters. He walked to the front of the community meeting room, known as the Great Hall, but did not want to take the steps up to the elevated stage for fear that he might lose his balance and fall off. Petitioner was given a microphone and he thanked his supporters from the base of the stage. Afterwards, he walked back to his seat. Petitioner was not reelected to the Board, but continued to attend meetings as a member of the RHPOA. A monthly meeting of the RHPOA was held on July 13, 2011. The agenda included four items, including an item that would authorize the Board of Directors to retain legal counsel in the event a threatened lawsuit was filed against Bob Fitzpatrick, who was then the president of the RHPOA. The nature of the potential lawsuit was not in evidence, except that it involved a complaint filed with the Lake County Sheriff by Petitioner against Mr. Fitzpatrick. Mr. Fitzpatrick recused himself from the vote, since any legal fees would be expended on his behalf as president. John Banahan, then the vice-president of the RHPOA, acted as chair during the consideration and vote on the agenda item. The RHPOA allows members to speak regarding any issue on the agenda. Members must sign a “Sign-Up Sheet to Speak to Agenda Item” for each item on which they wish to be heard. Members are allowed three minutes to speak on each issue for which they have signed up. The minutes regarding a particular agenda item typically reflect only whether a motion was made, who seconded the motion, who voted, and the results of the vote. When there is a significant amount of discussion, the minutes may, as did the minutes for the legal counsel agenda item of the July 13, 2011 meeting, include something no more detailed than “[m]uch discussion, residents and Board Members.” Neither the comments of property owners nor the discussions of the Board members as to an agenda item are recorded in the minutes of meetings of the RHPOA. When Petitioner was on the Board, he would routinely take notes at meetings, and then destroy the notes after the meeting was concluded. That was consistent with the practice described by other testifying members of the Board. Petitioner attended the July 13, 2011 meeting of the RHPOA with his wife. He entered the meeting room on his own power and without difficulty, though he used a cane, signed up at the door to speak on the agenda item regarding the Board?s proposal to retain legal counsel, and took a seat at one of the tables. Petitioner made no request for assistance of any kind at the time he signed up to speak. Stacey Peach attended the July 13, 2012 meeting as a representative of Leland Management. Ms. Peach periodically attends meetings of the various associations served by Leland Management. Her attendance at the July 13, 2012 RHPOA meeting was coincidental. Ms. Peach was seated at a table in front of Petitioner. When it was his turn to speak on the legal counsel agenda item, Petitioner was recognized by Mr. Banahan. Petitioner announced, without assistance of a microphone, that he could not go to the podium. Mr. Banahan noted “confusion” in the audience, but did not realize what was going on with regard to Petitioner?s request to speak on the agenda item, though he understood that Petitioner was unable to come to the podium at the front of the room. Mr. Banahan testified convincingly that he had no problem with Petitioner speaking from his seat. He was aware of at least two other instances in which a microphone was taken to an attendee of a Board meeting so as to allow them to speak while seated, one of which occurred when he was a member of the Board. Ms. Peach heard Petitioner state that he was not able to go to the podium to offer his comments. She thereupon got a portable microphone and handed it to Petitioner. Petitioner asked Ms. Peach if she would speak on his behalf. Petitioner had not spoken with Ms. Peach earlier, and his request caught her off guard. Not knowing what Petitioner wanted her to say, she declined to speak for him. Her refusal was based on surprise and uncertainty, and not on any discriminatory motive. After Ms. Peach declined to speak on Petitioner?s behalf, Petitioner took the microphone provided to him, and offered his comments on the agenda item from his seat. Petitioner testified that as long as the microphone was working, he saw no reason why he would not have been heard. Except for Ms. Hoffman, whose testimony is discussed below, the witnesses who were asked indicated they had no problem hearing what Petitioner had to say, though none could remember the substance. Petitioner testified that he made a specific request of Mr. Banahan to allow someone to speak on his behalf, and that Mr. Banahan refused the request. Petitioner?s testimony was contradicted by Ms. Peach, who was directly involved in the incident; Mr. Norden, who was seated next to Petitioner; Mr. Reichel, who attended the meeting as a Board member; and Mr. Banahan. The greater weight of the evidence establishes that no request for another person to speak on Petitioner?s behalf was made to any member of the Board, and that the only such request was made, without prior notice, to Ms. Peach. Petitioner?s claim that his request was denied by Mr. Banahan was supported only by the testimony of Ms. Hoffman. However, Ms. Hoffman?s testimony was undermined by the fact that her overall account of the incident differed in several significant and material respects from the testimony of other witnesses, including that of Petitioner. For example, Ms. Hoffman indicated that Ms. Peach was not asked to speak for Petitioner, that Petitioner asked someone seated next to him to speak, that Petitioner had difficulty reading his notes, that Petitioner was unable to complete his comments, and that Petitioner?s speech was, at best, marginal. Whether Ms. Hoffman?s description of events was the result of a poor vantage point or of poor memory, it is not credited. Mr. Banahan testified that if Petitioner had been unable to speak, he would have allowed someone to read a statement on his behalf.2/ However, Mr. Banahan testified that he was not asked to make such an accommodation, and that Petitioner was able to comment on the agenda item from his seat. Mr. Banahan?s testimony is credible and is accepted. Mr. Banahan testified that he has known Petitioner from his service as a member of the Board and never perceived him as having a handicap. Mr. Banahan knew that Petitioner walked with a cane. However, Mr. Banahan?s wife walks with a cane and he does not consider her to have a handicap. Petitioner provided Respondent with no medical records, letters from his physicians, or competent evidence of any kind to establish that he had a disability or that he required an accommodation in order to participate in the July 13, 2011 meeting, nor did he produce any such evidence at the hearing. At the hearing, based upon the undersigned's observation, Petitioner had little or no difficulty walking or speaking. Petitioner failed to prove that he has a physical impairment that substantially limits one or more major life activities, or that he was regarded by any director or member of the RHPOA as having any such physical impairment. To the contrary, the greater weight of the evidence demonstrates that Petitioner does not suffer from a handicap as defined in the Fair Housing Act. Ultimate Findings of Fact There was no competent, substantial evidence adduced at the hearing that Petitioner suffered from a handicap that hindered his ability to actively participate in the July 13, 2011 RHPOA meeting. There was no competent, substantial evidence adduced at the hearing that Respondent knew of any alleged handicap or regarded Petitioner as being handicapped. There was no competent, substantial evidence adduced at the hearing that Respondent failed to reasonably accommodate Petitioner when he asserted that he would not be able to walk to the podium. The evidence adduced at the hearing established that Petitioner made no direct request to any member of the RHPOA Board of Directors to allow someone to speak on his behalf. The evidence adduced at the hearing established that Petitioner was able to clearly state his comments on the legal representation agenda item by using the portable microphone provided to him by Ms. Peach. The evidence did not establish that Petitioner was the subject of unlawful discrimination in the provision of services or facilities in connection with his dwelling based on his handicap, or that Respondent refused to make reasonable accommodations in its rules, policies, practices or services necessary to afford Petitioner equal opportunity to use and enjoy his dwelling.
Recommendation Based on the foregoing Findings of Fact and Conclusions of Law, it is RECOMMENDED that the Florida Commission on Human Relations issue a final order dismissing the Petition for Relief filed in FCHR No. 2012H0158. The Issue Whether Respondent discriminated against Petitioner in the terms, conditions, or privileges of rental of a dwelling; or provision of services or facilities in connection therewith, in violation of the Florida Fair Housing Act (“the Act”), section 760.23, Florida Statutes (2019).
Findings Of Fact Petitioner is a female residing in Tallahassee, Florida, who purports to have diagnoses of depression, attention-deficit/hyperactivity disorder (“ADHD”), and a learning disability. Petitioner offered no evidence regarding how her diagnoses affect her daily life. Petitioner originally signed a lease with Respondent to rent apartment F201 at Sabal Court Apartments, 2125 Jackson Bluff Road, Tallahassee, Florida, from November 1, 2017, to October 31, 2018. Petitioner moved into the apartment with her two minor children on November 2, 2017. Petitioner testified her two minor children also have ADHD. On October 24, 2018, Petitioner renewed her lease for the apartment for the term of November 1, 2018, through October 31, 2019. Petitioner testified that, during the term of both leases, she experienced problems with the apartment; including mold in the bathroom, bed bugs, ants, roaches, spiders, and cracked flooring. Most distressing to Petitioner was the air conditioning unit, which Petitioner alleges was filthy and failed to cool the apartment. Petitioner testified she submitted several requests for the unit to be serviced, but it was never repaired to good working condition. Petitioner complained that the apartment was too hot—frequently reaching temperatures in excess of 80 degrees—for her and her children to sleep at night. On August 7, 2019, Petitioner executed a lease renewal form, requesting to renew her lease for an additional 12 months—through October 31, 2020. On September 23, 2019, Respondent posted a Notice of Non-Renewal of Lease (“Notice”) on Petitioner’s apartment door. The Notice notified Petitioner that her tenancy would not be renewed and that she was expected to vacate the premises on or before October 31, 2019. Petitioner testified that she did not know why her lease was non- renewed, but believed it to be additional mistreatment of her and her family by Respondent. In response to the undersigned’s question why Petitioner believed Respondent’s treatment of her to be related to her handicap, or that of her children, Petitioner replied that she does not believe that the non-renewal of her lease, or other issues with Respondent’s management, was based on either her handicap or that of her children.
Recommendation Based on the foregoing Findings of Fact and Conclusions of Law, it is RECOMMENDED that the Florida Commission on Human Relations issue a final order dismissing Petition for Relief from a Discriminatory Housing Practice No. 202021115. The Issue The issue to be determined is whether Respondents engaged in prohibited conduct against Petitioner by discriminating against him based on his race and/or national origin in the terms and conditions, privileges, or provision of services or facilities in the sale or rental of real property in violation of Section 760.23, Florida Statutes (2009).
Findings Of Fact Based on the oral and documentary evidence adduced at the final hearing and the entire record in this proceeding, the following Findings of Fact are made: The Florida Commission on Human Relations is the state agency charged with investigating complaints of discriminatory housing practices and enforcing the Fair Housing Act. It is also charged with investigating fair housing complaints filed with the federal Department of Housing and Urban Development under the Federal Fair Housing Act, 42 U.S.C. Section 3601, et seq. Petitioner, Emmanuel Agbara, is an adult, black male, who is of Nigerian decent. On or about September 18, 2008, Petitioner submitted an offer to purchase Condominium 406 in Orchid Springs Village. Because the real property sought to be purchased was a part of a condominium, there were several contingencies imposed by the declaration of condominium and associated house rules. Respondent, Orchid Springs Condominium, No. 200, Inc., is a non-profit corporation charged with the management of the condominium. Incidental to this responsibility, in conjunction with Bay Tree Management Company, the board of directors has the responsibility to approve or disapprove of the sale of a condominium to a third party. In the event the board of directors or Bay Tree Management Company disapproves of the sale, the condominium documents outline a procedure wherein the proposed sale can be pursued by the property owner and prospective buyer (Petitioner herein). After Orchid Springs advised Petitioner that it had not approved his sale, this alternative was not pursued. Orchid Springs is a part of a mixed-use development of condominiums, patio homes, and private [single-family] residences and is diverse in terms of religion, national origin and income. Prospective buyers, and the Petitioner herein, were required to complete an application that inquired into the prospective buyer's background, intended use of the property, and required three character references. In addition, prospective buyers were required to pay for a "background" check. On September 20, 2008, Petitioner traveled from his home in Maryland to meet with Respondent, John Carroll, president of the condominium board of directors. As they met, an inspection of the condominium unit was being conducted by a home inspection professional. Petitioner anticipated that he would meet with Carroll and two other board members for the personal interview required by the condominium documents as a prerequisite for board approval. The two board members were not available to meet with Petitioner during his September 20, 2008, visit. During the course of the discussion between Petitioner and Carroll, it became apparent that Petitioner anticipated being an "absentee landlord." Carroll advised Petitioner that the owner/residents had various problems with renters, including recent police activity incidental to a drug laboratory in one of the rented condominium units. Carroll also related that four of the absentee owner units were in foreclosure and that placed an economic burden on the remaining owners. During the discussion between Petitioner and Carroll, Petitioner inquired as to whether he could do the three-board member interview by telephone. Mr. Carroll advised him that a telephone conference might be arranged, but that one board member could not do it alone. On October 8, 2008, Petitioner submitted his Association Application. As a part of the application process, Petitioner certified that he had been supplied copies of the Articles of Declaration of Condominium Ownership and By-Laws of Orchid Springs Village, No. 200, Inc.; the Service and Maintenance Agreement; and the manual, "Condominium Living--The Seville." The Association Application includes the following language: "[A]pplicant purchasing Condominium certifies that he/she has . . . read [and] agrees to abide by" the foregoing documents. The Association Application states that "[i]mmediately after submission of the application, Applicant is requested to arrange with the President for a personal interview with at least [three] Board Members present. Such personal interview is a firm requirement [and] may not be waived." Following receipt of a prospective buyer or renter's Association Application, the tasks of conducting the customary background and criminal checks are divided among board members. In this instance, Mrs. Thibodaux, now deceased, did the background check; and Mrs. Douglas did the criminal background check, which, apparently, was a local records check utilizing the county records available through the internet. Testimony reveals that Mrs. Thibodaux reported that she had some problems with two of Petitioner's character references and that the Social Security number he provided was incorrect. This testimony is discounted as Mrs. Thibodaux is dead and not available to testify, and there is no indication that Petitioner's Social security number is incorrect. In addition, two of Petitioner's character references testified at the final hearing. Mrs. Douglas' local criminal background check revealed a January 13, 1997, arrest for battery--domestic violence. The case was "nolle prossed" after the Petitioner was placed in pre-trial diversion. Orchid Spring's critical examination and appraisal of prospective buyers and renters is apparently "slipshod," but not atypical when the prospective cost of a thorough examination that would involve an investigation of an individual's credit history and a thorough criminal and background check. Concern raised by the background and criminal check prompted Carroll to contact Petitioner and request that he come to Florida and meet with three board members for the interview required by the condominium documents. Petitioner was unable to meet with the interview committee. On November 7, 2008, Petitioner was advised by Respondents that his application had been denied. No evidence of damages was advanced by Petitioner.
Recommendation Based on the foregoing Findings of Fact and Conclusions of Law, it is RECOMMENDED that the Florida Commission on Human Relations enter a final order dismissing the Petition for Relief. The Issue The issue in this case is whether Respondent, Cordell John, (Landlord) discriminated against Petitioner, Denise Johnson- Acosta (Johnson) on the basis of her or her daughter’s alleged handicap in violation of the Florida Fair Housing Act.
Findings Of Fact Johnson is a Hispanic woman. She has asthma and other medical conditions. Johnson has a teenage daughter, Ashley Denise Rivera. Ashley has a seizure disorder and has bipolar disorder. Johnson is engaged to Alexis Pons. The Landlord is an African-American male. He owns the property located at 13847 Beauregard Place in Orlando, Florida (the Property). The Property is a single-family residential townhouse. At some unspecified time during calendar year 2012, Johnson approached the Landlord expressing an interest in leasing the Property. At that time, another tenant was living in the Property but was in the process of moving out. The Landlord showed Johnson the Property. Johnson expressed her complete satisfaction with the Property and that she would like to lease it (and possibly buy it in the future). At first sight, Johnson liked everything about the Property except for the back yard. On September 10, 2012, the Landlord emailed a Rental Application to Johnson. The email advised Johnson that there would be a $50 application fee which must be paid when the application was delivered. In response to the email, Johnson confirmed that she wanted to view the Property on the upcoming Thursday. On September 11, 2012, Johnson filled out the Rental Application and provided it to the Landlord for review. The application listed Johnson as the primary tenant and Ashley and Pons as additional residents. The application also noted that Johnson had a pet, a petite Chihuahua, which would be living in the unit. After reviewing the application, the Landlord notified Johnson via email that he would need pictures of the Chihuahua. He also asked how much the dog weighed. The Landlord also told Johnson that the rent would be $1,250 per month and that a $200 nonrefundable pet fee must be paid. Johnson replied that the dog weighed four pounds. She was concerned that the Landlord was now quoting $1,250 per month when earlier discussions had indicated the rent would be $1,200 per month. Johnson thanked the Landlord and agreed to provide a picture of the dog. The Landlord replied to Johnson that when pets are involved, the rent is increased slightly. Johnson and the Landlord had a conversation on September 17, 2012. By email dated September 18, 2012, Johnson told the Landlord that she had decided to withdraw her application because of “multiple misunderstandings” between the parties. At some point thereafter, Johnson decided to go through with the lease after all. On October 20, 2012, Johnson did a walk-through inspection of the Property. By way of her signature on the walk-through check list, Johnson agreed that the living room, kitchen, dining room, both bathrooms, both bedrooms, and all other portions of the Property were satisfactory. The only caveat was that there was stain on a counter in the kitchen area. Johnson said she would “advise at time of move” as to her feelings about the parking areas and the patio/terrace/deck area. On November 2, 2012, Johnson and the Landlord entered into a binding Residential Tenancy Agreement. Johnson initialed each page and signed the agreement. The agreement was witnessed by two individuals. On or about that same date, Johnson gave the Landlord several money orders: A $250 money order for the pet deposit; $50 for Pons’ application fee, and $880 for prorated rent for November. Johnson did not complain about the pet deposit at that time. Johnson moved into the Property on or about November 2, 2012. About two months later, on January 1, 2013, Johnson mailed a letter to the Landlord via certified mail, return receipt requested. The letter advised the Landlord that Johnson would be moving out of the Property on or before January 14, 2013. The letter cited several bases for the decision to move out, including: Air condition vents were “visibly covered with dust and dark surroundings”; Johnson and her daughter have severe allergies; Johnson has acute asthma and bronchitis; and The dwelling is unlivable. Johnson also claimed many violations of Florida law by the Landlord concerning the lease, including: Taking a deposit for a pet when that pet was in fact a companion dog. (Johnson submitted a letter into evidence from a behavioral health care employee. The letter, dated some five months after Johnson vacated the unit, said that Ashley would benefit from having a companion dog as she did not have many friends. There was no evidence that the Chihuahua was ever registered or approved as a companion dog.); Smoke alarms which were not in working order; Electrical breakers tripping throughout Property; Unreimbursed expenses, e.g., for changing locks; Failure to put Pons on the lease agreement despite doing a background financial check on him; and Harassment from Bank of America employees trying to collect the Landlord’s mortgage payment for the Property. In the letter stating she would be moving, Johnson expressed her sorrow that the housing situation did not work out. She then set forth the amount of deposit money she believed should be returned to her. In response, she received a letter from the Landlord’s counsel advising that her security and pet deposits had been forfeited. On January 4, 2013, the Landlord posted a notice on the Property door demanding payment of outstanding rent within three days. In lieu of payment, Johnson could vacate the premises within three days. Johnson vacated the premises. On January 14, 2013, Johnson did an exit walk-through of the Property, along with the Landlord, his mother, and Pons. At the completion of the walk- through, Johnson turned over the keys for the Property to the Landlord. Johnson claims discrimination on the part of the Landlord because he failed to recognize or accept the companion dog, failed to put Pons on the lease agreement, and failed to make accommodations for Johnson’s claimed health conditions.
Recommendation Based on the foregoing Findings of Fact and Conclusions of Law, it is RECOMMENDED that a final order be entered by the Florida Commission on Human Relations dismissing the Petition for Relief filed by Denise Johnson-Acosta in its entirety. Findings Of Fact On or about January 20, 2009, the Petitioner filed a Housing Discrimination Complaint with the Florida Commission on Human Relations (Commission). Pursuant to the Commission's procedure, an investigation of the matter was completed that resulted in a Notice of Determination of No Cause. Essentially, the Commission found that based upon the allegations raised by the Petitioner there was no cause from which it could be found the Respondents had violated the Florida Fair Housing Act. Thereafter, the Petitioner elected to file a Petition for Relief to challenge the determination and to seek relief against the Respondents for the alleged violation. The Commission then forwarded the matter to the Division of Administrative Hearings for formal proceedings. The Division of Administrative Hearings issued a Notice of Hearing that was provided to all parties at their addresses of record. The postal service did not return the notices as undelivered. It is presumed the parties received notice of the hearing date, time, and location. No party appeared at the hearing.
Recommendation Based on the foregoing Findings of Fact and Conclusions of Law, it is RECOMMENDED that Florida Commission on Human Relations enter a Final Order dismissing the Petitioner's claim of discrimination. Findings Of Fact Based on the undisputed facts included in pleadings filed in this proceeding and on the documentary evidence attached to the Association's Renewed Motion to Dismiss, the following findings of fact are made: On or about April 16, 1999, Ms. Thornhill filed a complaint with the Department of Housing and Urban Development, in which she accused the Association of housing discrimination on the basis of handicap and coercion. The complaint was apparently based on the Association's attempts to make Ms. Thornhill remove a set of steps leading from the terrace of her apartment. In June 1999, the Association filed a civil lawsuit against Ms. Thornhill in the Circuit Court of the 11th Judicial Circuit in and for Miami-Dade County, styled Admiral Farragut Condominium Association v. Maria Thornhill, Case No. 99-15567 CA 22. On or about September 21, 1999, Ms. Thornhill, through her attorney, filed Defendant, Maria Thornhill's Answer to Complaint. Included in the answer was a Counterclaim filed by Ms. Thornhill, through her attorney, against the Association, in which she sought injunctive relief and damages against the Association pursuant to Section 760.35(1) and (2), Florida Statutes. 1/ She asserted in the Counterclaim that she had filed a discrimination complaint against the Association with the Department of Housing and Urban Development, which had been referred to the Commission and that this complaint was still pending before the Commission. Ms. Thornhill alleged in the Counterclaim that the Association had engaged in housing discrimination against her on the basis of her handicap because it had refused to accommodate her disability by giving her permission to retain the steps she had installed leading from the terrace of her apartment. Ms. Thornhill also alleged that the Association had "authorized or acquiesced in a series of actions intended as harassment and retribution" against Ms. Thornhill for having filed a housing discrimination complaint. The factual and legal bases on which Ms. Thornhill requests relief in the Petition for Relief filed with the Commission and in the Counterclaim filed in circuit court are virtually identical.
Recommendation Based on the foregoing Findings of Fact and Conclusions of Law, it is RECOMMENDED that the Florida Commission on Human Relations enter a final order dismissing the administrative complaint filed by Maria T. Thornhill to enforce rights granted by the Florida Fair Housing Act, Sections 760.30 through 760.37, Florida Statutes.
