How long, in the state of texas, does a furniture have to be liable for the furniture after it is sold? All of our furniture is sold on an ''all sales final'' basis and this is on our receipts.

reclaiming $ spent on satellite dish services

A neighbor told me that he can recommend someone who could supply boxes and all satellite dish stations for a one-time, flat fee of $800. The man (who works for one of the prominent dish network companies) set this up for me...I did not realize this was illegal. The TV channels were received the first weeks, and then kept going on and off. I told him I wanted my $ back...he then said his partner would not return the $. I said, then pay my bill to the company with a normal contract (and the company he actually works for) until my bill reaches $800--then I will take it on from there. He agreed. He only paid appx. $338 and stopped. Do I have any recourse legally? Thanks for your help.

Getting the word out about a bad contractor...

We recently endured a bathroom remodel that went horribly wrong. The contractor substituted inferior materials and installed damaged materials. He even made an unauthorized charge on our credit card.

We filed a complaint with the PA AG's office, but he simply ignored the complaint. We were told our case would remain on file so that if others report him, a case could be brought against the contractor at that time.

After a prolonged dispute through our credit card company, we did receive our money back. The money was not returned from the contractor but by the credit card company as a result of their ineffective handling of our dispute.

My question is, how can I get the word out about this contractor without opening myself up to litigation? Can I send a flyer to customers currently receiving service from this contractor? Would it be best to talk to those folks instead? I would like to direct them to the AG's office if they have problems.

I would love to leave well enough alone, but no one should have to endure what we did at the hands of this criminal.

Delenquent Credit Cards

I went to a legal settelment group. They sold me on a settlement plan in march 2008. I've paid 700 a month being escrowed to be used in negotiations with the creditors. The minimum payment on the credit cards was over 1400 a month. 1st creditor is taking me to court 30 Oct 08. I Now understand that until the creditor accepts the plan I am viewed as delinquent? In the event of a judgement, what can the creditors take. I live in central Illinois.

bought a 1976 trans am out of state, got screwed.!!

was watching a 1976 trans am on ebay. the seller stated that the car was in mint cond. and that it was close to SHOW ROOM CONDITION,as she stated.the car was in kent washington, and i live in brighton mich.the auction ended with a person buying it for 16000.00. i emailed her back and told her if somthing happens call me,well she did the guy couldent come up with the money so i offered her 16000.00 and she pay half the shipping charges. agreed.so i get the car home and Im shocked and p.o.!! the interior of the car was a reck,too sum it up,the car was not mint,nor was it ecx. it was good. I told here i was not happy and that i wanted at least 2000.00 refunded back to me and she refuses,she never once told me i was buying it as-is. do i have any recourse.?

My husband And I met with a mortgate consultant recently. Needless to say he told us we were not approved w/his company. He then proceeded to contact our real estate agent and her that he did not approve us and the reasons why! Is this legal? We are talking about my finances and credit information here! I don't think that was his job or business to pass that information on.

Auto Dealer Fraud

I bought a car from a dealer after going to an auction with him. I paid cash for the car. After 90 days, I called the dealer back since my title and plates had not arrived. I then filed a complaint with the DMV. I was refer to an investigator who informed me that this dealer failed to pay the flooring company thus the lienholder was still the flooring company. This dealer has done this more than once (who knows how many).

What are my rights? what can I do to protect them? should I be very worried? Do I have a case to claim title since I have proof of payment?

We have a lease with a coin operated washing machine company. The lease has an automatic renewal clause. Is it the law that before the lease is renewed there is to me a notification that the lease is about to renew. This lease is about 25 years old and was signed by a person who has been dead for about 15 years. We have never even seen the lease nor had a notification of the renewal.

Judgement

On Thursday my husband's bank account was frozen. The bank had received a court order to freeze our money. This judgement was from 1998 in Buffelo, NY. My husband and his friends moved out of a rental house without paying rent. So he is being sued from 1998, but this law office bought this lawsuit in 2004. Can they legally do this? We were never notified and this was never on our credit report as of July 2008. We live in Atlanta, Georgia now. We live paycheck to paycheck. We are not disputing he owes this money, we just don't know how they can legally take all our money without any kind of notice. Can they do this? Do we have any kind of recourse?

Mandatory Arbitration

I'm a business owner. My customer entered into a contract with me. There is a binding arbitration clause. However, I can't get him to appear in arbitration. I would prefer going to court, having him served, and getting a judgment. Will the mandatory arbitration clause preclude me from doing that even if I have tried every attempt to get him to arbitration?

Credit Card Debt - Elderly Parent

My Mom has recently been admitted to a skilled nursing facility for long term care. A few years back, we executed a durable power of attorney in NYS; now I am acting as her POA given her medical situation (dementia). She has accumulated over 25K in revolving credit card debts. Since she has no assets or resources, and will leave no estate, I would like to notify her creditors of her situation so they will stop sending threatening letters and collection calls. I know I have no personal liability with regard to her debts. If I notify her creditors, are they likely to stop billing and suspend the account or will we continue to be plagued with their tactics.

travel refund

i have paid for a vaction for beaches resort, turks and caicos, and was told the trip was cancelled due to hurricane damage. i purchased hurricane ins. for that reason. i am being told they won't refund my money, that i would have to reschedule, which isn't poosible because i scheduled it with my son and his family and that was to be a trip of a lifetime for us. we were not informed that it was nonrefundable at the time and the ins. is telling us the same thing. also , iwas informed that if i did reschedule and the rates changed, i would have to pay the difference. is there any way i can get my money back?

Decided to have an alarm installed in home. Husband signed contract, copy of contact given to husband. Husband failed credit check so company put my name next to husband's on contract and had me sign next to his name. Did not receive copy of this change. Called 2-3 times and finally got copy of contract only to find company altered contract. Took husbands name off, changed term, and has information in several different handwritings but original had info. in just one handwriting. Is there anything that can be done since the only original copy I have doesn't have my name? This was a carbon contract so I should have received a carbon copy not a copy machine copy. I tried talking to someone at company-locally was told originally that this should not have happened and person would investigate and call next day but didn't. When I tried calling back never could get same gentleman and the one that I could talk to yelled at me-corporate ignored inquiries and then said to call local number. BBB wasn't able to help either. Gentleman at local office said he didn't understand what they problem was-why it mattered if it was 2 or 3 years. I tried to explain it was illegal to change a contract but he just started yelling so I hung up.

Nursing home bill

I signed a contract (as power of attorney) when I admitted my grandfather to a nursing home in 2007. They misfiled for Medicaid and it took several months to get it started, now they want me to pay the bill personally and have a bill collector trying to collect. They mislead me into thinking I had to sign to get him admitted. I don't think I should be liable to pay. Please advise.

the managers are rude.

that if i break the contract and they

cannot find someone who wants to

have an event on the same day, I

am responsible for the entire amount

I would have paid if i had had my

wedding there anyway. How do I get

out of this one?

Auto Contract

We purchased a new vehicle on 7-7-08. After we signed the contract, I noticed they gave me $4700 for my trade-in instead of the $3700 we agreed on. I notified my salesperson who told me he would call me back. I never heard anything else from the dealer. Today I received a new contract in the mail with the $3700 trade-in. Am I required to sign this new contract or are they required to honor the initial contract?
