contract cancellation

If a contract states three business days to cancel a contract, I signed a contract on friday, monday was a holiday and I advised them I wanted out today, wednesday. They state this is more than three business days. The contract does state business days are monday - saturday. However, I would assume sunday and holidays don't count so the end of business day on wednesday would be my final day. please help.

''This contract may only be canceled by sending... postmarked by midnight of the third calendar day from the date of this agreement.'' Does the counting of the 3 days begin the day of signing- or the next day is day one? We signed Friday... this is Sunday. Is tonight the deadline, or Monday night?

Shipped windows to wrong address

we were having a home built..we started not trusting the contractor so we went to the window company ourself ordered and paid for the windows with the delivery to our address. the window company knew the contractor so they delivered them to the contractors home instead. Since we have fired the contractor and he refuses to give us the windows. Can the window be accountable for not shipping them to the the address stated on the invoice????

Possible Rebate Ripoff

Six weeks ago, I purchased new brakes for my car. In doing so i was eligible to retain a $60 rebate. I mailed out the necessary papers and waited. I called on two occasions to inquire about the status of my rebate as it had been six weeks. I was told by the rebate center that i am not in their system yet and i should call back in about 5 days. I then requested to speak to a supervisor and both times none was available. I'm starting to think i am not going to ever get my rebate. What can i do to ensure that i receive my rebate ?

Boyfriend Buying a Car

My boyfriend of 3 years wants to buy a car for me but purchase it in my name so when its paid for I own it. But I want to have a contract stating that he is responsible for payment, and if we break up he will give me the amount he sold my car for (i gave him my old vehicle as a trade) and he will take possession of the vehicle and make the appropriate payments.

vehicle title & loan

I was approved for a loan on a vehicle i purchased in 2006. i called the lender and explained that i wanted to refinace the loan for a lower interest rate. When they did the prequal, the interst rate was much higher @ 11%. I immediatly called them and said no thanks. My current rate was at 7%. In january 08 i recieved the Title and a letter in the mail saying thanks for using our services, your loan has been paid in full. I recieved it as a blessing. 4 months later the lender sent a letter stating that they mailed the title becuase they paid off my old loan, and started the new one with the increased interest rate of 11%. they said that they sent the title so that i could let the new lein holder view it. They asked me to mail the title back. i explained that i told them that i did not want the new loan, because the interest rate was much higher than my currant rate. They are now requesting that i return the title, and pay the past due amount on the new loan they put in place. Where do i stand legally in this matter? Can they forcebly reposess my vehicle? Is the vehicle mind becasue i have the title?

Is there either a State (Virginia) or Federal law that allows consumers to return items sold in their own homes for a full refund? e.g., door-to-door sales.

Service by Mail

Is an attorney considered, or not considered, a third party, as necessitated by the requirements of an adult over 18 years of age who is not a party to the action, as is required to serve documents (such as an amended compliant or interrogatories) by mail service?

Additionally, what if this attorney is an employee (in legal department) of the Plaintiff? Does this not make the attorney a party to the action?

Do you know of the actual California Code of Civil Procedure which defines who is or who is not a ''party to the action?''

Termination Fee

In July 2006 I contacted Nextel Sprint to cancel my service. At that time the Customer Service agent informed me that she could adjust my plan to a better plan that would be more affordable. I specifically stated that I did not want to enter into a contact and she stated that would not be necessary. No new hardware was provided and the only change was to the service being provided. This month we changed cellular providers and were billed an early termination fee. Contacted CS and was told we were on a verbal contract becasue their agent told us so and it was in their notes. We have paid our bills on time and did not receive any additional hardware or service, only a rate change. We did not authorize a new contract and did not sign anything. They just signed us up without authorization and now claim that use of the service constitutes acceptance of the new contract. We made every good faith effort to resolve this matter however the supervisor at Sprint directed us the the terms and conditions section of the Sprint website. There is states and dispute must be handled through arbitration. They can not produce a signed agreement and refused to produce a tape of the conversation in which the agent changed our service.

car recall

I had a loan for a 2000 grand prix automobile and my car insurance had just run out, but I was still driving the car, and the engine caught on fire (after I had parked).

The car was totaled, and the bank reposessed it, because I couldn't pay for it because I couldn't get to work. I recently received a letter in the mail from the car-maker stating that there is a recall on my car because the super-charger can cause a fire. Do I have any rights, or is it the bank that reposessed it?

two week old cadillac

I bought a cadillac cts two weeks ago but with the Easter Holidays it's really been less. I cannot drive or ride in it because I am handicapped due to three titanium rods in my back. My head hits the door everytime I get in or out causing severe pain over time. The dealersays My recourse is to buy another car and treat this car as a used car trade in. It was bought on a Smart Lease option with a down payment of $6,ooo.oo What can I do?

Damage to a loaner car

We had some work done at a dealership and they gave us a loaner. We returned the car o the dealership and the next morning at 11:00 they called us and said the car had damage. They are wanting us to pay for the repairs. I believe that when they take possession of the car they have ended the contract. Neither my wife or I noticed the scratch and we do not believe we did it.

incomplete sales agreement

I went to appliance store in Overland, Mo on 12/15/07. I agreed to purchase five Whirlpool appliances presented on the floor. I gave them my Discover card to pay. To this date they have delivered four of the five appliances. The inside of dishwasher is badly damaged, doesn't work; the washer/dryer are not whirlpools, nor do the function properly; I haven't been able to hook up range, so don't know if it works; weeks late of agreed delivery, they attempted delivery of refrigerator badly damaged and not the one promised. All of my calls, letters, efforts to protect myself have been met with broken promises or refusal to cooperate (with BBB, for e.g.). Any fair resolution seems hopeless. I followed FCRA procedure to the letter in disputing charge with credit card co. They say that I must pay because the sales receipt says 'all sales final'. Wouldn't that be contingent on receiving all five of pieces agreed upon and all pieces in working order? Sales receipt also indicates whirlpool brand ; only one item on it has money amount next to it and that is the refrigerator that has never been delivered.

Used Vehicle Extended Warranty

I purchase a used vehicle in Aug 2007 with an extended warranty. I have not had to use this warranty on the vehicle. I sold my vehicle and wanted a refund for the contract. I work as a warranty administrator and know that if the contract has not expired you can be reimbursed (prorated) for the contract. When i called they said that it is not refundable-just transferable. The back of the contract states under refund: ''Except as indicated otherwise below under SPECIAL STATE DISCLOSURES or as required by law, under no circumstance may you obtain a refund of monies you paid to the dealer under this agreement''.

What is the ''required by law'' part? Does that mean Virginia Law where I purchased the vehicle and contract? What can I do?

auto service

We had a new engine put in our truck in 04 for 10,000. The engine leaked diesel. We have had the truck serviced six times since then for 100-700 each time and the engine continues to leak. They always seem to find something else wrong. The service director is not being of much help other than to tell us to bring it back in. 3,000 plus now not to mention the lost diesel. What steps can we take to get justice?

Rooster

Texas Law.

My husband have one rooster and 5 chickens. cage is clean, and feed well. we have had them about 28 years in between the youngers. now, the new neibor move in about 6-8 hours ago. At first he wanted the eggs if he buy us some more chicknens. they live in a cage 10x10x10 with food, water, and hay.

now, his wife conplain about waking her up 5:00 am and she called the animal control on us. we live in the dallas city, we have about an acrea of land. my husband is 86 and he also was get fresh eggs.

what can we do about the grandfather clause in texas. do we have any rights?

Auto Purchase

I bought a car from an individual recently. After the purchase I took the car for the needed inspections and it failed. The items that need to be fixed total $500. The person I bought the car from refuses to take the car back or pay to fix the problems. What are my rights as far as getting my money back or making this person pay for the repairs?

merchandise order from two years ago

I went to an eye doctor in 2006 and ordered contacts. They took forever ordering them and getting back to me to tell me they were in. So I went else where and got them. Today I got a invoice in the mail for the contacts.. two years later! Is this legal? Can it hurt my credit if I don't pay them? Am I legally bound to pay them?
