Credit for time served?

My son has pleaded guilty in multiple charges. He has been incarcerated in the parish (LA) jail since 05/15/2007. On 3 of his charges, he has been sentenced to total 12yrs in the Dept of Corrections, with suspended all but 3yrs. On 5 lesser charges, he's been sentenced to total of 15 months, to run concurrent, credit for time served. My question is: Will he actually spend time in the State Prison, or will time served in the parish jail count toward his sentence?

possesion of alcohol by a minor

17 yr old son found a bottle of liquor on the floor in the backseat of a friends car. He lifted the bottle showed 3 other friends and put back down. An adult saw it and came to car with phone in hand. She insisted on talking to mother of the driver in which she called the her mother and the adult didn't believe her. Her own son offered to hand over the bottle, she refused to take and called the police. She pulled her son and another person out of the car and left my son and the driver in the car and the police were on scene quickly giving my son no time to get out. This could of all been avoided if she had waited until the mother got there. The mother of the driver hung up on her daughter and told her to sit tight and would talk to the adult when she arrived. The mother states the adult was screaming in the background and it scared her just as much so she hung up and ran for her car. The adult also called my son several names such as a troublemaking little snot nosed kid. I feel she was out to get my son in trouble and called the police on purpose. My son wants to plead not guilty. Advise from a lawyer said we could use De minimis infractions as a defense. Would this work? Does he have a chance defending himself?

DUI Court Date

I was charged with a .09 BAC DUI in Montgomery County Maryland in mid April 2008. I hired a lawyer and immediately took the alcohol counseling classes. I have been waiting and it has been more than 140 days since the offense, & I have not received a court date yet. My lawyer said he filed for a motion to dismiss and nothing has happened. How long until the court gives me a court date or dismisses the case? Isn't there a speedy trial issue here? Don't they have to dismiss it after a certain amount of time?

On probation for DWI

I have been placed on probation for 1 year after entering a no contest plea to DWI.. I have an ignition interlock device. My parole officer called me yesterday to inform me that I warrent has been issued for my arrest because I ''tested positive for alcohol''. I do not understand this considering, when I met him last week, all was fine. I have never been in trouble before with the authorities and my only arrest was quite unsettiling since I has no prior knowledge of what was happening. I would greatly appreciate any advice.

I was charged and arrested in January 2008 with a OWI. I was supposed to complete a alchohol evaluation. I failed to do so. I tried to at least get it started in July when i called to have an apptmnt set up. There was a 2 month waiting list. My evaluation is set for sept 11. My court date was today. I went and was sentanced to 20 days because i had not completed this course. I'm supposed to serve from DEC 12 - Jan 2. I'm going to miss the holidays. Since it has gone this far is there anything I can do? I'd rather pay a lawyer a bunch of money if i can get out of this...

My son recently got a DUI ticket. He is parapalegic and in a wheelchair. He uses his vehicle to go wherever he needs to go as he can't walk. Does the DMV make any exceptions on the restricted licence? He works and goes to school.

Gainesville Florida underage D.U.I

i was pulled over for speeding (36 in a 20) i just left a party where i had been drinking. i noticed the cop was behind me, but without his lights on. so i pulled into a parking lot and turned off my truck. he pulled in behind me and turned his lights on. so he smelled the alcohol on my breath. and i told him i was drinking. they did the field sobriety test etc. they took me to central booking and i blew a .197 . i am 18. those are the details. the cop had my cell phone next to the brethalyzer and his phone. it clearly said NO CELL PHONES on the machine. the cop also wrote on my tickets that i drive a chevy tahoe, when i drive a gmc yukon. will these be helpful in my case?? and what will be the likely punishments if i decide not to fight it?? i was very cooperative with the cops

After 10 years of no DUI's I broke a total abstinance rule. they are saying i must abstain 6 years now before reinstatement of licsen. Wow... Can a Variance be granted by the commissionor for a contional use permit to drive for work? Is there anything I can do do not lose my Business and livelyhood. is this something an attorney can help me with?

DUI without moving

This weekend my friend received a DUI. He was sleeping in a truck, not his, in a parking lot b/c he was too drunk to drive. He put the keys in the glove box. The truck was impounded. He was put in handcuffs and given a ride to the hotel. They then released him with his license & a DUI citation. He has a CDL as well. Any chance that this will stick? What about the CDL?

first time fourth degree dwi questions

my wife got pulled over for a fourth degree dwi. She is a 49 year old with no prior tickets what so ever. She only blew a .082 She was going to plead guilty because we were told as first timer it would reduce the license suspension from 90 days to 30 days. Is that the case? Should we fight it as it happened in rainy weather and the reason for pulling her over was they officer said she crossed the center line. He made her take the walk in the line test in the shoulder in partial grass in the rain. She was going to just plead guilty but the courthouse can not get her a court date before 12/19? So is there any other way to plead guilty and get it down to a 30 day suspension without waiting three months for a court date or is that the only option? Please advise
