my son is being charged with dwi and I think the charges are very weak but I'm not sure. He was never technically arrested or marandized and his BAC was .06 but he is still being charged. The initial reason for the stop was a tail light out. It was the field breathalyzer that measured .089 and which created the suspicion however everone knows those are very inaccurate. He blew a .06 at the station just a few minutes later. How likely is it that the charges could stick given he was under the legal limit and he was never technically arrested? He never had to be bailed out and the cop even gave him a ride home because he had his car towed. Anyone I've ever know that got charged with dwi was ''arrested'' and had to post bail and find their own ride home. He can't afford a lawyer so I'm not sure if I can gather enough evidence on my own to challenge the charges or if I should foot the bill for an atty.

a friend was arrested for dui but police reports show he was not driving at any time. this is his 6th dui in 26 yrs, but only 3rd in 10 yrs. they won't drop the dui charge. he has a public defender but not going well there either. is there any way to fight this? he also missed one day of court during the year this has been going on due to 1st stage pneumonia (with a dr note) he emailed court and called and notified them, got put back on calendar right away, but judge revoked bail anyway and placed him in custody.

insurance coverage not willing to pay

If I was involved in a roll over accident caused by a drunk driver, wouldn't the owner of the vehicle's insurance fully cover the driver? Does the other driver need to be named in the policy for it to become a drop down policy? Foreign minor in possession of alcohol

My friend is a UK citizen, working for the summer at a camp in Maine. He just turned 21 yesterday but was issued with a minor in possession or a drunk in public ticket (he was unclear) a few weeks ago when he was 20. The officer only wrote his full name and the first 2 lines of his address on the ticket (not the country or the UK county, just the street number & name and village). If he fails to pay this ticket, will there be an issue the next time he tries to enter the US?

Several days ago I lost control of my vehicle and ran it off the road late at night. The only damage was to my car, which was substantial. A citizen stopped to help me, and offerred to call a tow truck, but I had no money. I left the scene to get money (also I had been drinking). When I returned the car and everyone was gone. I later found out the citizen contacted the police who had the vehicle towed and took a statement from him. I have yet to file a report. What should I do now? Should I expect to be charged with something? Can I retrieve my belongings from the vehicle?

Driving on a suspended during accident

I was rear ended while driving on a suspended license. The officer smelled alcohol on the man's breath but he was not given a Breathalyzer or a citation. I received life threatening injuries. Do I have a case against the police as well? Also this person was self insured, so what does that mean for my case I'm pursuing against the driver?

Driving Privilege Suspended in NY...NJ/PA/FL license

I'm going to get my driving privileges suspended in NY for DUI. I still have to go to court, so for now it's not suspended. I can apply for a NJ, FL, or PA license because I have family there and I can use their address. Here is the question....

If I get pulled over in NY with the license for those states, will I get in trouble? Is it the privilege to drive in NY that is suspended or just the privilege to have a license from NY?

i refused to submit to a breathalayzer and got an als for one year. wondering if the bmv will terminate the suspension since i pleaded no contest to and was found guilty of the ovi under Section 4511.191 K of the ohio revised code. Also, wondering if they terminate immediately when they recieve the conviction?
