Legal Action against a journalist (local newspaper)

Can legal action be taken against a journalist (newspaper) for fabricating and taking given information and using it out of context?

Landlord Tenant

I have a tenant who hasn't paid April rent. She's lied about payment several times. She's evasive and doesn't answer phone calls or respond to notices on the door. I did manage to confront her 1 week ago and she said that she would be out by the 1st... that would be good enough for me. Except she is still there, I've advertised the apartment and have a young couple with 1st month and Security deposit ready to move in today or ASAP. Three Qwestions:

1. Do I have to do the standard Civil Proceedings that could take another month and about $500?

2. Can I legally rent a POD to move her belongings into to get the paying tenants into the apartment before they go elsewhere?

3. What kind of trouble could I really get into if I do an illegal eviction and put her stuff to the curb... she did tell me that she would be out by the 1st in front of 3-witnesses?

Contract

I was contracted to write a book for an educational publisher. After completing the book and turning it in before deadline, they have come back saying that they are not sure about the concept and the format of the book. They want to do a market survey to see if it will sell.

But this is after the fact, after I fulfilled a contract signed by both parties. Many emails and drafts were sent in since last January and never once did they suggest it was not on the right track.

In fact, they actually conducted a focus group beforehand to determine the concept of the book, and kept telling me to go ahead.

I just want to be paid for keeping up my end of the contract.

Question

After living with a person for 16 years and contributing to home improvements etc I was asked to leave and would like to reclaim any gifts given in the 16 years and lien her house for 75,000 even though I have no reciepts.

invalid lien placement

a man who had a contract to buy my mother's house in oct 2003,but could not get the banks or credit unions to finance it for him in a years time and was told the property was no longer for sale per her children. During a 12 month stay without paying any rent he proceeded to rremoldel the kitchen and two bathrooms to his taste....no permits were pulled and no licensed contractors involved. He's since put a construction lien on the property for 20,000 and we are now in civil court about the matter as he's claiming my mother gave him the ok to improve ( unjustly enrich) the property by signing a power of attorney over to her in 2 handwritten statements...but these were clearly for speaking on her behalf in downtown miami to clear or at least reduced some code enforcements liens that were on her property. these 2 power of attorney letters are the ''proof'' he and his lawyer states gives him the right to place a lien and sue us in court which by the way includes me with my mother even though i am not listed on the property, but since i'm a ''doctor'' i quess they had to name me in the suit also...they didn't name my sister , but she works at the waffle house.Can you tell me if a person who did work himself has the right to place a lien

voice-room recording

I work for a public entity. I believe a person I work with is recording conversations in our break room. Can he do this (he is not in the room), or how can he use this against the rest of us?

Judgment Enforcement

Last year, my fiance was cheated on her taxes. A supposed friend of her father agreed to complete her taxes, give her cash for the amount, and have the actual refund deposit into his own checking account. She need the money quickly, so she agreed. However, the guy did two different returns. He gave a fake one to my fiance and filed the other one which claimed a nonexistent dependent. She has since taken him to court and won the case because he never showed up to court. Now, how does she get her money? The guy will not pay and she keeps going to court to try to get the court to enforce the judgment, but she has to incur incremental cost each time with no change in the situation. Does she have to take him to court again to get this enforced? Maybe criminal court?

Personal Jurisdiction

Can a party sue another party under an alias? For example, Party A sue Jack Jones, but Jack Jones is not Paul Jones' legal name.

employment contract

I was offered another job when I suspected my job was at stake when my company merged. I then looked for other employment and was offered another job. They (cuurent employer) offered me a contract bascially offering me 6-months severance if my employment is terminated for any reason other than ''cause'' or resignation-to stay.

My company has now decided to relocate 2200 miles away and has offered me to relocate and cover expenses.

My question is, ''If I decide to decline this offer, are they required still to pay my severance pay?.'' I am not sure if it would be considered that ''they'' (the company) is terminating my employment, or if I am quitting??? Please advise. I had bascially touched on the main points of the contract. ''Cause'' is defined by them as getting arrrested, drug use, theft, etc...

I understand not everything is available on line. I am asking because my sister was in a motorcycle accident and now only has one arm as well as brain damage. She loaned a neighbor over 8,000.00 of which he only made one payment and then stopped. I know nothing about the law but was trying to find out as much as I could for her. Small claims limit is to low. With her accident being a hit and run, her finances are being bled dry paying for all of the bills. I wasn't looking for a easy way but rather answers I could give my sister.

unpaid loan

I loaned someone 9,000.00. We put into writting what the arrangement was and we both signed it. He made the first payment but nothing since. Where and what forms do I need to sue him?

verbal agreement

My sister was widowed and did not want to live alone. She suggested that she move to Virginia from Utah and buy a home that she, myself and my husband could live together in. Before moving in, she set the terms that we did not pay anything except 1/2 of the monthly operating expences of the home. That it was not ''her'' home but ''our'' home.
