My mother passed away. She

appointed my uncle as the executor.

My uncle wants to rent my younger

brother my mothers house for 1,200

a month fair market value is

1,800.00. I have no problem with

him renting the house as long as he

is working or going to school. I do

not want him living there with no job

and just hanging out partying Am I

allowed to have a say in stipulations?

2 Why should he get money at the

end? Wouldnt he be paying even

less if he gets it back 42% his share

after the estate is settled. Can and

do I have a say in the matter. He is

not very responsible and that

concerns me

Important papers lost by Attorney

What happens when your Attorney loses your only copy of an important document. My aunt is in her 80's and her nephew, who is an attorney, requested she send it to him so he could read it over. Now he informs her he lost it! It is a document of her mother's, my grandmother's, property that all of my uncles, my aunt, and my mom signed over to her.

We believe he did not lose it but does not want her to have it back because he and his sister wants their part of the old farm! He also is a Gambler. His father said before he died that he was ashamed that his son would do this.

My divorced son passed away leaving life insurance to his 15 yr old daughter, his ira to me, his mom, lots of medical & credit card debt, very few assets & 2000.00 in bank account. I paid for his funeral, can I take the 2000.00 from his bank account to help pay for his funeral costs? or must it stay for the creditors? which ones get paid first?

Will vs Property Taxes

I found out recently that my brother in laws name is solely on my mother in laws property taxes. She is 85 and pays the taxes but he supposedly claims them on his taxes.

He asked this of her after my father in law passed 3 years ago, unbeknownst to the other siblings.

Doing her taxes this year I found out about all this.

My question to you is:

Can he use this against his siblings inheiritance of the property in any way? Because his name is associated with this property by being on the taxes.

The will states the property be divided equally among the children.

I was just wondering if he was trying to pull a fast one on us. You know like a loophole of some sort.

If I have been contacted a year ago by the attorney representing the estate of the deceased, stating not to contact the heirs and that he will handle the matters of the estate and probate, because I have a claim of debt and damages as the deceased last landlord. This attorney told me to forward the total bill and all evidence (bills & witnesses etc), and he'd review it and get back to me, starting the process of settling via negotiations. So, I did, along with police report, insurance report, and photos etc. for a total of over $7,000. However, this attorney has not once responded to my calls or monthly letters requesting response, nor has the estate been filed for probate (per the courts). I will be filing a suit against the estate, as is advised. Do I direct it to his attention? I am not a lawyer, but am trying to handle this myself because this loss leaves me no money to retain an attorney, which I'd rather do.

However, I'm stuck at the moment.

Would you kindly give me some advise please, on some key points I should be aware of. It seems very odd that this attorney has been ignoring this, and my question if he is even representing the estate anymore.

My Aunt came to South Carolina and became ill. She appointed me her power of attorney, and I have the appropriate documentation. She also has a will that was done here in South Carolina. Her property and such are in Jersey City, New Jersey. Does the will that was done here in South Carolina has to be on file with the courts of New Jersey in the event of her demise??
