My mother passed away in 2003. My family ''laywer'' or legal representative has done a terrible job over the years handeling her money and distribution of it, which has affected me over the years. Shoud I seek real representation in order to rectify the situation???

bank account with 2 peoples name

if a bank account has 2 peoples names on it, and one dies, who does the bank account go to if not mentioned in the will in the stare of mi.?

Next of Kin

My mother has a cousin who died in New York City. She is In Florida.

She beleives she in the only living relative. Does she have a right to set funeral arraingments and take care of his estate? What does she need to do to prove she is next of kin? Thanks

Executor Abuse???

My grandmother passed away and left money to be split between me and my mother and sister, my mother did some of the estate stuff but then decided to hire an attorney because it was to much work. She told my sister that she was going to keep 5,000 of mine and 5,000 of my sisters to repay her for the work that she did. . which wasn't much. . at all. .is that legal???

My wife and I are drawing a will to prepare our young daughter in the case of our death.

Is it possible after establishing a legal guardian to set up a trust that would be payable to the child when she turns 25? We own a house that should be sold if both of us should pass and would like the proceeds to go only to the child and not the guardian.

I have 2 children with my wife and child from a prior relationship (not marriage) that was given up for adoption at birth. Does that adopted child have any rights to any inheritance should me and my wife pass away? We have no Will currently.

My brother is a convicted felon in New York State and is currently in a prison. Our mother has passed and is currently in a funeral home for the last three weeks because he will not sign to have her cremated. He also claims he is her power of attorney and executor of her will. Does he have these rights?

paying the debts of a deceased parent

My mother recently passed away. My father has been gone for 18 years. I had power of attorney prior to my mother's death. My mother left no estate, she had no assets. My sister and I paid for her funeral expenses ourselves. Bills are coming in and there is no money to pay them. Am I legally obligated to pay my mother's bills? She was a resident of Pennsylvania. The probate office in her county told me I am not responsible for her debts but the companies she owes money to are harrassing me to pay her debts. I did not sign any paperwork assuming responsibility for my mother's debts. One company states that I owe them simply because I was her POA and the services were rendered prior to her passing and as her POA I should have paid it. The bill did not arrive until after her death. What can I do or say to make these companies understand I am not responsible for those debts? Is there something I can quote to them? There is no money of my mother's to pay the debts. She has no estate. Is there an agency I can contact to resolve this without it costing me a lot of money? I don't want these companies turning me into a collection agency for a debt that clearly isn't mine.

My mother passes away in March, she died intestate and was married at the time of her death - she owned her house for 20 yrs prior to their marriage. they were married for 2 1/2 yrs. He abandoned her for several months. He then had a stroke and she let him come back - He has paid nothing towards the upkeep of the residence no house payments, electric bills, water , cable, phone etc.. - can he still file for a life estate in the property? Everything in the house was hers before the marriage and he has been back for only a year.

I am the black sheep of the family, only child from fathers first marrage.

When he died he had a realty trust for his 4 other kids, We got along and worked with each other over the years but I was not on the trust because I could not be controled to do unethical things. 3 of the 4 others are now lying, stealing and destroying the property. I get along only with the next oldest sister who is being kept out of everything because she also is not unetical. The short question is there a legal way for me to be placed on the trust, my father had no will and also owed a construction company

executive of will keeping me in the dark

My fathers home was left to me in his will. There is a second mortgage on the home with approx. 28,000 left to pay. My sister is the exec. of the will and is telling me that the house will have to be sold because liquid assests of the estate will not cover the mortgage in full. My question is what order are creditors paid in and is this mortgage top priority over med. and other bills. my father had a bankruptcy about a year ago so does not have much new debt and has a retirment fund of $20,000 along with a small life insurance policy. Would the house be sold even if the majority of the mortgage is paid? How could i go about paying the remainder or what other steps could i take to keep the house if his debts exceed the money in his estate? Who does the house belong to legally from the time of his death until probate is completed? I was under the impression that the full amount of the mortgage along with the other bills would be sent into probate and it would take some time to know what is going on. How much does the executive have to notify me of what they are doing with the estate?

My Dad lives in Queens, NY. My father made up a will many years ago and it said that all his assest are to be divided equally amoun his 4 children. A yr and a half ago my brother passed away. Last night he told me his wishes are to have my dead brothers portion divided among his 3 children. Does his will need to be rewritten or would something like that cause the will to go into probate? I want to advise my father correctly so that his wishes are carried out. Please advise
