PTSD from rape while in the Army

Hello, it has been almost 16yrs since being honorably discharged from the Army and I have recieved Counseling for PTSD for at least 12 of those years from both outside counselors and at the VA. I have a 50% disability for a back injury and airthritis caused in the army mostly from Fibromyolgy that developed after I was raped by my one of the Majors. Can I increase my disability rating with my PTSD. chronic,severe. Diagnosis from VA medical center that I recieved last year?

Brother's Death Without a Will

My brother was a vetran with a trust fund with the Veteran Administration. He is survived by his two adult kids and three siblings. Does his trust fund monies get divided up by all or just his kids?

unwarranted surgery

In 1993 I was told that I have overbite and need surgery to correct my overbite. Idid. I am not getting compensated for it. the fifth crainial nerves were damaged during the surgery. I have applied for compensation and was told that it was a pre-existing condition that causes the surgery to be brought into play. I never had a problem with overbite. but since the surgery I have been having problem eatin, I cannot even open my mouth without the joint popping and causing serous pain what do you think I shoud do? Do you think I should continued to suffer (as they have told one of my friend about his broken back he received while in the military and not getting compensated) or do you think I should file a law suite or go to the news media.

PTSD + Compensation

I have been rated at 50% for 4 years now, due to a back and head injury that happened while deployed to Kuwait. Since I have gotten back I have been seen and diagnosed with PTSD. I have been utilizing the VA clinics regularly and have multiple prescriptions for this problem. Can I apply for additional compensation now?

Increase in disablity rating

I have been receiving 10% disability for hypothyroidism since i got out of the service in 92. About 5 years ago I was given a 30% rating for my kidneys I have nephritis that I contracted when I was in the service and the specialist finally service connected it. I would like to see if i can get 100% disability rating as I am no longer able to work because of the condition I am in because of the combination of these two illnesses. I have gained alot of weight and can't loose it and have severe swelling and fluid retention. Shortness of breath etc. etc.

The Regional Office

I initially filed a claim with the VA for service connected Bi-polar disorder in 2001 & was denied. The claim was refiled in 2006, DAV represented me before the BVA. The BVA sent me(in Apr. '08)a 5pg.decision that they remanded it back to the RO and informed them that there is new and compelling evidence to re-open my claim. Will I receive back pay to 2001?

this in regards to my previous question. I file a claim in 1970 soon after I returned from Vietnam. The claim was subsqently denied on the ground that hearing loss wasn't service connected. In 2003 change of VA policy allow for my claim to be reopened even though I had not file an appeal of the 1970 claim within the perscribed one year time limit. Let me add that I failed to file an appeal on the advice of my American Legion service rep. In addtion the hearing test adminstered at Fort Lewis Washington as part of my return from Vietnam physical was bogus as hell. Approximately forty of us took the test at the same time. All failed. The guy administering the test informed that if we wanted to go home we had to first pass to test. With the aid of his cues, we all passed on the second go around

I was discharged from the army in 1970 with a mental disorder at

100%. It was rated as 100% by the VA. They kept me at 100 % and then with each susequent exam they down graded me eventually to 0 %.

I did not appeal because the VA Dr. saw thinking and health improvements with Sychophrenia

that was my diagnosis.

I've been rated at 100% for PTSD

I did not appeal my previous ratings because I had no medical

proof of any kind except what the

VA told me as they didn't have PTSD at the time.

I now have proof of service connection for PTSD but they say I did'nt appeal before one year was up each time I was down graded

so I'm denied for not appealing sooner.

What recourse do I have now since the true dianonis has been

proven?

In April of 2003 I filed claim with VA for service connected loss of hearing. As part of the evidence in support of my claim, I submitted four audiograms administered by the U.S. Postal Service circa 1980-1981. The result of these test was similar to audio grams administered by Audio Dept Sepulveda VA facility and QTC facility in 2003. Subsequently I was awarded a 30% disability rating effective the date my claim was failed

Given that evidence was submitted showing clear and convincing proof that said service connected hearing loss exited as far back as 1980, should the effective date of award also have been dated back to either one year prior to the date claim was filed or back to the date of the earliest Post Office audio gram.

Secondly does this constitute Clear and Unmistakable Error on the part of VA rating board.

VA Loan and House Title

My fiance is buying a house with his VA loan. Since we are not married, I cannot be on the loan. However, I need to know if I can be listed on the title/deed to the house?

Durable Power of Attorney

I hold DPOA on my Father. His Nursing Home bill was not paid in full as would not provide detail summary of care and disputed amount due and owing. Father was moved to another home due to abuse he received at this facility. They are now suing me for his past bills at this nursing home. Am I liable for my Fathers debts?

Long-term care for Veteran

I was asked numerous questions about our house, my income, etc. before being named Federal Fiduciary over my husband's VA benefits. Our house is in my name alone and I owned it 10 years prior to our marriage. The Estate Analyst wants us to use VA benefits to pay mortgage payments, home owners insurance and real estate taxes. In the event my husband should require long-term care, could the VA demand that the house be sold to pay for it? My husband thinks the VA would take care of him without cost but I think that's a pipedream. Please advise whether I should use the monies to pay for the mortgage and related expenses. I worked very hard to keep my home before meeting my husband so I don't want to jeopardize it now. Thank you.

VA DIC Compensation for spouse.

Wife married to U.S. Enlisted man. He was killed in military plane crash while on duty in 1963. Wife remarries. New spouse passes away. Is she eligible now, since she is 71 years old and not married?

missing evidence

I just got my decision from my video conference with the BVA. The claim was once again denied. The bva stated they sent my records for a second opinion. The second opinion stated my labor and delivery record was not forwarded, however they gave their opinion anway, and once again my claim denied.My service connect is for hysterectomy post uterus prolapse, which was caused by my traumatic labor and delivery while in the military. There is no way that doctor could have given an opinon without my labor and delivery record. The BVA threw out my testimony they stated I wasn't a medical doctor. I only spke facts made by doctors who studied and reseached uterine prolapse. There is obvious evidence in my medical record but they can't seem to find any of it. When i came into the military my uterus was anteverted (normal) which is not prone to prolapse;after the birth of my son, still in the military, it changed to retroverted; which is prone to prolapse. yet the va states there's no evidence my uterus prolapse in the military or from any incident that happen while in the military. It obvious that the va is overlooking vital evidence that would support my case. Is there anyone i can speak with befoore the case goes to court? help

Harassment from landlord??

Gave notice on Apr 8 to vacate on Apr 30 (supplied a letter from my command --on active duty--that my military duties will conclude on April 30), but leasing company said I was rent responsible until May 7 since less than 30-day notice... so on my vacate form, mgr said and wrote that vacate date is pending if May's 1 week rent could be waived by corporate management. They would not waive the week's rent, but are still making me leave on April 30 and any time after requires another 30 day notice! Can they do this to me? I would like to leave Apr 30 but can they still make me pay for an extra week and not let me stay for that week?

I served in vietnam in 68-69, have type2 diabetes and neuropathy since 1996, take 4 daily shots of insulin, (20-40 total units daily) 3200mg gabapentin total daily. How much dis. should i expect?

Denial of veterans claim

I have been recieving treatments since 1985 in a va mental health clinic for major depression and major aniexty disorder. In 2005 the doctor changed my diagnosis to ptsd. I applied for ptsd benefits and was denied because the doctor did not specify a stressor for it. Should they not have contacted the doctor on this before dening my claim
