This is the first installment of our guide to defeating motions for summary judgment made by foreclosing banks in New York residential foreclosure cases. The purpose of a bank's motion for summary judgment is to obtain a judgment of foreclosure without giving the homeowner the benefit of a trial.
Real Estate of a Deceased Family Member
My mother died about 3 days ago and she owned a house. She didn't have a will, but I'm her only child, she is not married, and has no brother's and sisters. She has left everything to me. She still owes on her mortgage. I was wondering if it is necessary for me to get an attorney to take care of the house situation. At this time I'm unsure if she had insurance to cover the entire cost of the house afer her death. Will the house go into probate? What is the best thing for me to do?
Crazy Ex-Boyfriend
My Ex-boyfriend is friends with theowner of the only night club in my town. Last week he saw me going to the club and called and told the owner not to let me in. When I got to the door I was refused entrance due to ''favoritism'' later that night my girlfriend asked the guy at the door about it and he said that I was banned for life becuase my ex was a valued customer. Is this legal??? they are a private business but I did absolutly nothing for them to treat me this way other than that I am not 21 until June so I dont spend alot of money on drinks when I go to their bar. What can I do? If I cant go after the business is there any way I can make it where he wont be able to go to the bar either. its just not fair
