I live in New York. My fiancee recently passed away. She has a 14 year old daughter who I have raised for the last 12 years. I covered her on insurance and everything. Anyways she wants to stay here at our home where she has lived all her life. She does not want to leave her family where she has a 26yr old brother and a 10 year old brother. The 26yr old is slightly mentally challanged and that is why he still lives at home and always will. Since I have had a stable job for 11 years, insured her, raised her, and have a stable household what are my chances of her being able to stay. He lives in PA but said he would move back to Rome just to get her. (A judge placed a temp order for her to stay with me at this time) I have read were it is the Best Interest of the Child and since the child is 14 and want to stay I should be ok. Also I have read where Detrimental to the Child includes removing the child from the only place she knows as home and from the person who has supported her both physically and emotionally for the most of her life. But I have read where NY does not take these things into concideration. Her father is not a bad person except he likes to play emotional games with her. She constantly cries when she is with him.

My attorneys told me today that my husbands' attorney had a heartattack & my OSC next Mon. will probably result in a continuance. Furthermore since husband will not pay my attorneys now they are finished w/my case. I am practically destitute paying months of (unknown) unpaid bills and taking care of 1 minor child & 1 full time student--------Can't temporary support be ordered by the judge anyway? I'm afraid my attorneys have not been upfront about this........Husband is in another state lucratively working (finally)w/a 3 yr. restraining order & will drag this out at all costs. Meanwhile he hasn't paid taxes since 2003 and we owe over $150,000. I am a teacher and only want to move on w/my life after 22 years. Husband is a registered sex offender and yet wants to continue visitation argument for minor child. Oldest 2 want nothing to do w/him. How can I have some amount of support awarded to me this next day in court regardless of the fact that his attorney will not be there and his representative is asking for a continuance?

I have 2 months old baby. We sign a declaration of paternity in the hospital, but I cancelled he paternity before the 60 days. I am receiving food stamps and medical for the baby. He doesn't want child support, so he is buying stuffs for the baby instead of giving money. Do i have to report the things he is buying or they are considere gifts.

Move out of state

I have a desire to move out of state, My ex will not agree freely. I live in TN and I am wondering what my rights are. I am looking at a quite large pay increase to do this move for myself and my current husband. Is ''life improvement'' considered a good enough reason in the courts eyes? My child is 4 and her father is current on child support and visitation with her. I have asked him to move or let me take her, he says no leave her here. I will not do that, but I hate to pay up such a great opportunity financially for my family. What do I need in order to prove its for the benefit of all my children for me to take this job?

If I have already taken her to court for not letting me see our children and nothing has been done about it in the past and she keeps continuing to not let me see our children what do I do? I also have gotten two showcauses on her for not allowing me to see out children and filed two motion to amend for childsupport and visitation. I'm at a loss for anything right now and confused. It makes me not want to even see our children because of all the things that she puts in their heads and makes me go through to even see them. I do know that she has had 8 boyfriends, 4 dirrerent homes to live in, 3 different daycares for them, and has been supposedly 2 different pregnancies. The guy she is with now abuses her and im just finding this out after 3 weeks. She was pregnant with twins but lost one of them from the abuse. She is always being garnished for outstanding things that she gets like loans against cars and she expects for me to either pay or help pay and i can't. We have been split up for 3 and a half years and i have had the same girlfriend for all the 3 years. Im not perfect but i miss our children and want them with all the time just so i know that they can have the care nad love that we all no they need. Im just scared.

in a separation where one spouse leaves the home, is that spouse legally bound to continue to pay ALL the household expenses, even when the remaining spouse can pay those bills themselves?

Modifying a court order or making it null/void

I have a court order that was done in Feb.2005 my children were ages 2 and 5 months, but not they're 5 and 3. This is for joint managing conservators and I want to move out of the state of Texas just to be near family, and just a complete change. The issue is I can't move out of state due to this order. The agreement hasn't been followed through with the visitations. He see the children when he feels like it he's not working now and still doesn't get them as scheduled. Plus, my concern is that he's not stable enough, financially, and with where he lives. He's moved so much and I know he loves and cares for them, but leaving them in his care permanently. I know isn't the best move. I want to know how can I get the order modified where he can only have visitations in the summer, and other holidays would have to be worked out. Or just have the whole order voided. We agreed at time of the order not to file childsupport on one another, and he claims them on his taxes. I would like all of this reversed. Is this possible. I know he'll fight, but I do have concern for their environment especially around their father side of the family. I'm not comfortable moving and having to leave them here because of this order.

No child support for 17 yrs - No DNA - can't get the father served

Her father and I were never married, and I just started persuing support five years ago, when I decided to return to school (and had to quit working). He has since gotten married, and every time CSE tries to have him served with papres (including the order for DNA), his wife tells the server that he no longer lives there. I don't know what to do. This is ripping my daughter apart, as she would like to meet her father. I can't believe he would be so heartless, that he would run.

My husband and I recently got married. He has a child with another woman who is, surprise, never cooperative. She has sole custody by default. Am I allowed to watch the child and/or pick up the child if my husband is not able to do so on his visitation times or does she have to ok this? If she does, is it a reasonable request to bring up when we go back to court?

my x told me that a law went into effect jan. 1 1984 which states that any community property owned takes inot accvount pre-marrage equity. Any married couples sharing a title before that splits the equity 50/50. I purchased the home 1973, got married in 1980. Does she get 1/2 equity from 1973?
