i just got a divorce and the ex changed the paper work from joint costody to full costody with out my knowledge and i ask the judge about it and he said you signed it right and i did but it was changed with out my knowlege what can i do about this?just file joint costody or what i am lost.. also my check from the goverment now that we are dioviced can i use that to pay the rrears?

Child taking Step-father's sir name

My daughter is 12. I was never married to the biological father and my daughter has my maiden name, like me. The biological father left when she was two, after protective order filed in Dallas court for physical violence against me. I am going to marry soon. I will be taking my husband's sir name. I have no clue as to the whereabouts of the biological father. I know he left the state when she was two. He has had no contact and pays no support. How do I change her name to match mine after the marriage?

child's last name

I am in the process of establishing paternity for my 4 month old son. I want to change his last name to my last name. His mother gave him an entirely foreign name (e.g., Khalid Tayib) to match her ex-husband and other son - she has always kept her maiden name. She and I are both of European descent and I would like, at least, his last name to reflect this. Do I have any legal grounds to do this?

My ex-wife has remarried. Her household receives three income: one from herself, one from her new husband, and a third income from my monthly child support. Am I able to ask for a reduction in child support?

EPO respondent never served?

I filed an Epo 2 mths ago I was under the assumption that this person would have been picked up within at least 5 days. This person was never served. I came home a little over 2 weeks ago to find a business card in my door asking this person to call the police to be served a warrant or to turn their self in. This person was living in my residence at the time I filed the EPO but disapeared for over the 72/hr period. When they finally came back I never said anything about it and they never said anything about it. I was to afraid to bring it up. However after receiving the card I finally a week later had to let this person know what I had done as they were still living in my residence. So why was this person not picked up after I was told they would issue a warrant for their arrest because now this is has become a very serious issue as far as my saftey. This person has left my home after I told them they had a outstanding warrant very angry to say the least.

Can you explain why this took so long?

My husband and I are having problems with his ex-wife. There was never a court order on custody, child support, or visitation. My husband was paying her $100 a week for quite some time for my stepson and I saw the checks, money orders, and cash he gave her in addition to the hundreds of dollars worth of clothing, food, and toys that we got him. My husband didn't keep the receipts. Now she says that he never gave her anything. He hasn't given her anything in the last couple of months because my stepson was staying with his parents not with her in the summer. She also won't let us see my stepson. We only saw him once or twice in five months and then she dropped him off for several weeks. Then she took him back again & won't let us see him. Now she says that we will never see him again & that she is going to change his last name. I want to know if we will have to pay back child support, what chance we have of getting shared custody, and if she can change his name.

Submitting False Evidence

Is there a penalty for a Plaintiff and/or thier counsell for submitting exhibits into evidence that are different than an exhibit given to a witness on the stand? Furthermore if a piece of evidence is meant to prove a certain coorespondence with an individual and the evidence is actually a coorespondence with another individual but is being portrayed as the coorespondence to the individual in question, is that legal?

My daughter is being abused

My daughter is 15 and living in Michigan with her father, she wants to leave because of abuse. I was under the understanding that his current wife had adopted both my children years ago, but have since found out from my son when he found me it never happened. She is being abused and CPS is not helping her. She wants to move to Florida with me, and if her father finds this out things will get harder for her. We do have joint custody from the divorce, but I haven't seen her in 13 years because I thought the adoption was final. What can I do to help her.

my ex-girlfriend has custody of our 2-year old son. She is going to jail for 3 weekends for a DUI. What rights do I have to take my son for those weekends if custody is already established? I have visitation every other weekend and she wants her mother to watch him while she is in there.

If a US Citizen wants to marry a Non US Citizen in America, what kind of documents do they need, and especially the non US Citizen? This would be in the Washington State. The Non US Citizen will not stay in America for the time being, so no VISA application neccessary.

What are the steps that I should take in order to receive conservertorship for a family member that is mentally ill and is currently residing with me.

going back to court for alimony after divorce

We live in NJ. my husband was divorced 4 years ago.

Now after 4 years ex-wife got a lawyer and taking him back to court asking for alimony and lifetime medical benefits.

She has always worked and had benefits before the divorce, hasnt worked in about 1 1/2 years. She lives off the child support she gets every month for their children. There are no disabilities on her part, so there is no reason why she cannot work.

What are her chances of winning this case?

Can a divorce be changed once it is signed by both parties and the judge?

Married for 8 years. I owned the home since 1990. My husband received a lump sum buyout/retirement in 2007 of $140,000, foregoing all health care benefits. We signed a post-nup stating in case of separation he will quit claim the house to me, which he has, and in return I will stay married to him so that he can have my health insurance. I did not receive any of his buyout money due to this agreement. Now he has decided to file for Divorce. The post-nup also states if HE filed I would not be responsible for his health care but if I filed I would be. Now he says that he should be entitled to some of the equity in the house. Does this Post-nup stand up in court? Would adultery play a part on the courts decision? He is also trying to force me to re-finance the home immediately. I retired in 2005, and not sure if I can qualify at this time due to my fixed income. He was having the affair when all of these decisions between us were made. I would have kept my $50,000 a year job had I known all the facts. I stand to lose quite a bit of money due to legal fees, refinance costs and possible equity. I also started a business, but currently at a loss. I could lose my home. I am planning on hiring an atty. but would like your thoughts.

In 1990 I got married to my husband in LAS vegas Nv. We lived in California until 1996 when we seperated because of him going back to prison.
