legal guardianship

I am a career counselor for youth. One of my clients/and siblings are being raised by her grandparents for the last 15 years. Do the grandparents have legal rights over the children? There are no court documents stating guardianship of children. Thank you

The grandparents are operating in a sort of middle ground, from the way you describe it. Legally, presently, they don't have any particular rights.

However, if they were to go to court, whether on their motion or the parents' motion, there is an excellent chance that they could be awarded legal rights over the children.

If they are considering doing so, or being faced with a suit, they definitely need to consult an experienced family law attorney. They will need assistance to navigate the technical aspects of their case.
