letter received from lawyer

My mom and step dad received a letter in the mail from an attorney's office regarding custody of my 10 year old sister. My step dad and mom got into an argument about one month ago where unfortunately my step dad had been drinking. The most damage he did was go around the house yelling while my 10 year old sister slept in the room. My biological dad had a letter drawn up from a lawyer's office stating that my sister was no longer to be left alone with my stepdad and if she was, he would file for full custody? (Just a little history, my older brother and I ended up in foster care under my biological father's care when we were younger because of abuse, so he is no ideal father.) The letter from the lawyer is in question because my biological father is known to be very dishonest. In the letter, one line references him as ''me'' instead of with his legal name. The authencity of letter is in question as we wait to hear back from the lawyer. My question is, is this letter legally binding? It has not come from a judge or any court, just a lawyer's office. Does that mean I can just go to any lawyer and ask them to draft up a letter requesting that any person stay away from my child without the other party having their side heard?

My husband and I married in 1984. His 1st wife told him she had filed and gotten a divorce from him. She then remarried. Now she divorced husb.#2 and is claiming that she never divorced MY husband. Is our marriage even legal? Who is his wife? She had him 2 yrs, I've had him 25. What is my status?

Drunk father is in and out of kids lives

I am divorced and have full legal and residential custody of my three kids. Visitation is listed as being worked out amongst the parents in the divorce decree. My exhusband has been an alcholic and drug user (cocaine and pot) for about 15 years now. He comes in and out of the kids life, calls about every 3-6 months or so and hasn't seen the kids in 3 years. Now that he is working a rehab program and seeing a therapist again for the billion time he would like to come and visit the kids for like 1-2 days the most. He lives in a different state. He is also $5,000 in child support debt. The kids are doing great and are stable, have a great step-dad and family. I am afraid all this in and out is unhealthy for the kids. Is there something I can do? The kids don't even want to talk to him when he calls and don't want to see him. My eldest child has a love hate thing for him and I am tired of this whole situation, its been so many years. Please help, I don't want my kids to grow up screwed up. Thanks.

I am in the middle of a divorce and custody case I don�t work. My father was no longer able to pay my lawyer so he remove him self from my case and told he I have to represent my self in court. My husband is threatening to take full custody of my daughter and take her out of the country. And have me follow by a private detective during his visitation I really don�t feel safe and I don�t know what to do about this matter.

child neglect

I have three children 7,9,& 10. the mother and my three children moved to Jupiter recently with her new boyfriend. My 9yr son told me this weekend that my oldest daughter 10 was babysitting them while their mother and boyfriend were working and that they w for ere alone in the house for more than 4 hrs. There is a minimun age for children to be alone and not being considered child neglect?

amicus attorney fee

My wife and I are adopting our nehpew. His amicus attorney is charging us $1200. Our lawyer mailed him back saying that $500 was the most he has ever seen. Would just like a second opinion.

My ex-husband has my daughters for his summer visitation and will not release them back to me. He says this is because my papers are vague. My custody papers say ''summer months'' and do not specify dates.

Divorce

I am considering divorce after 28 years of marriage with my wife. I have consulted to an attorney and was told the divorce itself is simple and can be done with ease. We have a house with an equity approximately $100,000. 3 children are over 21-year-old. We have no other assets, no savings except a tons of my wife`s toys. I am an unemployed right now. The question is I just want to divorce her, I do not need anything including the house. My wife looks healthy and be able to sustain normal living including driving vehicle, however, she is a S.S. Disabled person. Can I divorce her easily even though I presume she cannot afford to pay the mortgage payment?

teen emancipation

Hello, I'm 16 years old old in a desperate situation. My mom and dad are divorced and my dad went to a rehab center for a while but is now released and has been cleared by doctors and all that.Having that said, when this happened my mom pulled me away from my dad and now i'm living 70 miles away from my dad,family,girlfriend, etc.... My mom and i do not get along at all and are constantly fighting, my dad on the hand we never fight, we have things in common, and we always spend time with each other. With all this being said what can i do to get to live with my dad?

false accusations

My girlfriend and I have been fighting problems, with her ex-husbands new wife, for about 6 yrs. The last straw was about a week ago when she (ex's wife) called the Department of Childrem and Families on her (my girlfriend) for drugs and prostitution. All accusations are false and DCF is aware that they are false. I want to know what legal actions we can take ensure this does not continue to happen. Also these two women have been to court and granted restraining orders against each other.

Full Custody

My 2 girls are living with me and only see their father maybe once a month, He rarely calls to check on them. Because we have joint custody, he picks them up from daycare and school without discussing it with me and has on occasion. he is always several months late on his child support and does not pay for anything else like doctors or school needs or clothes. child support

My husband and I have recently separated after 18 yrs of marriage He was having an affair and left our home to live w/ this other woman. After 6 wks he wanted to come back and save the marriage. I agreed and we went to marriage counseling and things were great. Two weeks ago I found out he was still seeing the other woman. He again has left the home. We have 2 sons together. I was a stay at home mom for 16 yrs until last Oct when I returned to work part time because of him leaving the house and creating a financial burden. Also, if I file for divorce can he bump me off his health ins? I have no health ins working part time.

Garnisment

My employer recieved a garnisment letter for me to take out a certain amount, the last court order for the amount is much less, the amended notice t with hold income also looks doctored up.Can a lawyer get in trouble for this he also signed that he certifys that he mailed a copy with order, and he didnt, he just mailed amended notice no order attached

Enough clean time?

I have been in active recovery for 6 months now. I am taking it very seriously. Will a family court judge think that is enough clean time for me to regain custody of my son? Or atleast give me more time with him??
