Bankruptcy is a way to deal with your creditors. The filing of a bankruptcy stops all legal action against you and your property. It stops all lawsuits and collection activities. It stops foreclosure, repossession, eviction, wage garnishment.
A Chapter 7 bankruptcy is what is known as an individual liquidation. The theory is you sell everything you owe for the benefit of creditors. If everything you own is exempt then you get to keep it. The Chapter 7 is a good option if you are a below median income individual or couple with a lot of unsecured debt. If you own a home that is underwater or if you just want to start over.
Chapter 13 bankruptcy is what is known as an individual reorganization of debts. The theory is you pay back some of what you owe over a period of 3-5 years. If you are a homeowner with non-exempt equity or you owe money on a vehicle or back taxes or exceed the income qualifications of Chapter 7 then you may want to give serious consideration to Chapter 13 bankruptcy. Chapter 13 can also be used to remove or "strip" liens where the value of the collateral is less than the amount owed.
Chapter 11 is a reorganization for business. Individuals who exceed the Chapter 13 debt limits and have non-exempt assets can also file for Chapter 11.
