This case involves the issue of whether the Respondent's license as a doctor of veterinarian medicine should be suspended, revoked or otherwise disciplined for negligence, incompetence, or misconduct in the treatment of a black labrador retriever. On March 16, 1982, the amended administrative complaint was filed by the Petitioner adding a second count to the original administrative complaint. On May 26, 1983, the Petitioner filed a notice of voluntary dismissal of Count II of the amended administrative complaint. The formal hearing was held upon Count I of the amended administrative complaint. At the formal hearing, the Petitioner called as witnesses John Gahn, Steve Arthur, Wilma Joan Kelly Arthur, and David L. Wood. Respondent testified on his own behalf. The Petitioner's Exhibit 8 for identification which was the original records of Dr. Woods was offered but was not admitted based upon the fact that these records had been annotated by Dr. Woods by his own testimony subsequent to the time that he was interviewed by the investigator from the Department of Professional Regulation. The records of Dr. Wood, without these annotations, were already in advance. The Respondent offered no exhibits.Respondent was not negligent or incompetent in course of treatment for injured dog. Recommend complaint be dismissed.
