Whether Respondent is, for purposes of Chapter 760, Florida Statutes, an "employee" of Petitioner. Whether Respondent has committed an unlawful employment practice against Petitioner by failure to hire him on the basis of race, to wit: African-American.A tie vote of the City Commission, which resulted in the defeat of an interlocal agreement, was not sufficient racial animus or connection to the sheriff`s employee, who might be hired if the agreement passed. There is no jurisdiction.
