The issues in this proceeding is whether Petitioner was the subject of unlawful sexual harassment by Respondent and whether Petitioner was subjected to unlawful retaliation for participation in an activity protected under Chapter 760, Florida Statutes.The evidence was insufficient to demonstrate sexual harrassment or retaliation when Petitioner was terminated for refusing the required random drug test at a specified time, even though she changed her mind two to three hours later.
