The issue is whether Respondent South Florida Water Management District is entitled to an environmental resource permit from Respondent Department of Environmental Protection to construct a weir in Collier County on the Merritt Canal about 3600 feet south of Interstate 75 for the purpose of extending the hydroperiod on the Florida Panther Federal Wildlife Refuge.District provided reasonable assurance as to criteria in Rules 40E-4.302 and 40E-4.301, Florida Administrative Code, for issuance of environmental resource permit for weir in Merritt Canal.
