The issue for consideration in Case No 00-2973, is whether the licensee, Holly Hill Care Center, Inc., should be subject to administrative fines for failure to timely correct four (4) Class III deficiencies; two (2) Class IV deficiencies, and one (1) unclassified deficiency at Holly Hill Care Center, an assisted living facility (hereinafter Respondent) and, if so, the amount.Agency showed Assisted Living Facility (ALF) failed to correct faults revealed by inspection. ALF showed Agency did not prove ALF provided services beyond its license and was responsible for providing medication. No basis for consulting pharmacist.
The issue is whether Respondent's Law Enforcement and Correctional Officer Certificates should be disciplined for the reasons set forth in the Administrative Complaint.Public assistance fraud constituted a lack of good moral character; sanctions against certifications are appropriate.
