The ultimate issue to be resolved in this proceeding is whether the Petitioner should be granted a Certificate of Need to construct a 120-bed kosher nursing home in Broward County, Florida. Petitioner contends that there is a real need for such a facility; that there existed a numerical need in Broward County even under the bed need formula contained in Section 10.5- 11(21) Florida Administrative Code, and that, alternatively, Petitioner has demonstrated and established extenuating and mitigating circumstances to justify the Certificate of Need. The Respondent contends that there is no need for the proposed facility; that the Petitioner's application failed the bed need formula methodology contained in the rule; and that there exist no extenuating and mitigating circumstances sufficient to warrant the granting of a Certificate of Need.Application for Certificate of Need (CON) for new nursing home should be denied where evidence shows no need for additional nursing home beds.
