At the land use hearing, Dade County presented the testimony of Hamilton S. Oven, Jr., J. Michael Ellis, Tanhum Goldshmid, Robert Usherson, and Reinaldo Villar. Dade County's Exhibits 1 through 9 were admitted in evidence. No other party offered any testimony or exhibits. The transcript of the proceedings was filed on November 6, 1992. Dade County, the Applicant, filed its proposed findings of fact and conclusions of law on November 6, 1992. No other party filed a proposed recommended order on the land use proceeding. All proposed findings of fact and conclusions of law have been considered. The Jupiter Inlet District, a special taxing district located in northern Palm Beach County maintains that the definition of "public navigation project" found in Rule 18-20.003(26), Florida Administrative Code, is invalid. It reads: "'Public navigation project' means a project primarily for the purpose of navigation which is authorized and funded by the United States Congress or by port authorities as defined by Section 315.02(2), Florida Statutes." The term public navigation project is substantively used in Rule 18- 20.004(1)(e), Florida Administrative Code, which establishes management policies, standards and criteria used by the Board of Trustees of the Internal Improvement Trust Fund when deteremining whether to approve request for activities on sovereignty lands in aquatic preserves. That rule states that: "(e) A lease, easement or consent of use may be authorized only for the following activities: a public navigation project; maintenance of an existing navigational channel..." Other portions of the rule provide that eligible requests for a lease, easement or consent of use will be evaluated according to stated social, economic and environmental benefit criteria.Petition dismissed. Definition of ""Public Navigation Project"" found to be valid under Rule 18-20.003(26), Florida Administrative Code.
