The issue in this case, as set forth in a Notice of Violation initially issued by Respondent, Department of Transportation (the "Department"), on February 15, 2011, is whether Petitioner, North American Media, Inc. ("NAM"), illegally erected and maintained a roadside billboard for which a permit was required, but not obtained.1/Petitioner's sign is not visible from a regulated highway and needs no permit.
