This case was presented for consideration based upon an administrative complaint brought by the State of Florida, Department of Professional Regulation, against Saul N. Sherman. The Administrative Complaint charges Respondent with violations of Rule 21D-15.01(2), Florida Administrative Code, and Subsection 460.413(1)(d), Florida Statutes, related to advertisements placed in newspapers of local circulation in the area where Respondent practices chiropractic. By the Administrative Complaint, allegations are made that the advertisements were false, misleading and deceptive, and were intended to create the impression that the chiropractor disseminating the advertising material possessed superior attributes to that of other chiropractors. Respondent is also accused of involvement with advertising which failed to conspicuously identify the chiropractor referred to in the advertising.Respondent failed to review ad which was deceptive or misleading. Fine $500.
