At issue in the proceeding is whether Ava Katherine Nagy, a minor, suffered an injury for which compensation should be awarded under the Florida Birth-Related Neurological Injury Compensation Plan.Infant suffered mechanical injury at delivery (a subgaleal hemorrhage resulting from traumatic application of vacuum extractor) which ultimately resulted in brain damage and death. Consequently, claim held to be compensable.
