Should the franchise agreement held by Nolette Motors, Inc., d/b/a Plaza Mazda (Nolette) be cancelled for the alleged abandonment of the agreement by that dealer's failure to be engaged in business with the public for ten consecutive business days in relation to promotion of products of Mazda Motors of America, Inc. (Mazda)? See Section 320.641(4), Florida Statutes. Additionally, should the Nolette franchise agreement with Mazda be cancelled for alleged breaches of the franchise agreement which are material and substantial? See Section 320.641(1) through (3), Florida Statutes.Petitioner, Nolette Motors, Inc., abandoned its franchise with Mazda Motors.
