The issues presented for decision in this case are whether Respondent violated Section 760.10, Florida Statutes, as alleged, by discriminating against Petitioner in her employment on the basis of her sex and her condition of pregnancy, and, if that violation occurred, what relief is appropriate.Petitioner failed to demonstrate that employer`s action of placing her on leave under the Family Medical Leave Act was discriminatory, where evidence established that her difficult pregnancy prevented her from performing the essential elements of her job.
