Whether Respondent properly fined Petitioner the sum of $115.00 for the reasons set forth in Commercial Motor Vehicle Citation No. 1026031, issued July 28, 2003, as modified by the Commercial Motor Vehicle Review Board on November 6, 2003.Overweight penalty on Petitioner`s truck and trailer was properly imposed; however, ALJ could find no statutory authority for imposing an administrative penalty on Petitioner regarding its driver`s possessing the wrong class of license.
