The issues to be determined in this proceeding are: (1) whether the challengers have standing; and (2) whether Proposed Rule 40E-8.221(2) is an invalid exercise of delegated legislative authority.The Petitioners and Intervenors proved standing to bring the proposed rule challenge. The District proved that the proposed MFL for the Caloosahatchee River was not an invalid exercise of delegated legislative authority.
