At issue is whether the Respondent, Edmund C. Valentine (Respondent or Valentine), as owner of Palm Paradise Park (Palm Paradise or the mobile home park or park) assessed an improper pass-through charge to the mobile home owners in Palm Paradise in violation of Section 723.003(10), Section 723.031(5)(b), and Section 723.037(1), Florida Statutes, as set forth in a Notice to Show Cause issued by the Petitioner, Department of Business and Professional Regulation, Division of Florida Land Sales, Condominiums and Mobile Homes (Petitioner or Department) on May 1, 2002, and if so, what remedy should be imposed.Pass-through charge for emergency vehicle access a legally proper pass-through to mobile home park tenants.
