The issues in this case are, one, whether Respondent unlawfully discriminated against Petitioner on the basis of her alleged handicap in violation of the Florida Fair Housing Act; and, two, whether Respondent subjected Petitioner to acts of coercion or retaliation as a result of Petitioner's exercise, or attempted exercise, of a protected housing right.Petitioner failed to prove that Respondent had unlawfully discriminated against her on the basis of national origin, religion, or handicap in violation of the Florida Fair Housing Act.

On April 13, 1999, Maria T. Thornhill filed a Housing Discrimination Complaint with the Department of Housing and Urban Development, in which she accused the Admiral Farragut Condominium Association ("Association") and certain individuals of "[d]iscriminatory acts under Section 818 (coersion [sic], Etc.)" and of "[f]ailure to make reasonable accommodation." In due course, the complaint was forwarded to the Florida Commission on Human Relations ("Commission") for investigation pursuant to the Florida Fair Housing Act, Sections 760.20 through 760.37, Florida Statutes (1999).Petitioner failed to prove that Respondents discriminated against her on the basis of handicap and failed to prove that Respondents retaliated against her by filing a lawsuit. The lawsuit was not objectively baseless and was protected by First Amendment.
