The issue to be resolved in this proceeding concerns whether the Petitioner was discriminated against based upon his age, in the manner addressed by Section 760.10, Florida Statutes.Petitioner failed to prove he was fired because of his age; failed to show he was qualified for his job (bad performance); and failed to show he was replaced by a younger employee. Petition should be dismissed.
