By the filing of an application with the Department of Environmental Protection ("DEP" or the "Department"), Florida Power and Light Company ("FP&L") initiated a proceeding for the certification of the siting of its proposed West County Energy Center Power Plant (the "WCEC Project" or the "Project" or the "WCEC") in Palm Beach County. This order follows the "land use hearing1" mandated by Chapter 403, Part II, Florida Statutes, as a step in the consideration of the application. Pursuant to Section 403.508(2), Florida Statutes,2 the sole issue for determination in this order is whether the site proposed for the WCEC Project "is consistent and in compliance with the existing land use plans and zoning ordinances."Certification should be granted to Petitioner for Units 1 and 2 at the West County Energy Center in Palm Beach County (with an ultimate site capacity of 3300 MGW) to be fueled by natural gas with light oil as a back-up fuel.
