The issue for determination is whether Petitioner’s application for certification should be approved as a result of her successfully completing the Firefighter Minimum Standards MIN. STD. PRACTICAL RETEST retest.Petitioner demonstrated that the scoring of the Ladder Operation of the Practical Examination re-test failed to comply with the State's established testing protocol and was, therefore, arbitrary or capricious. Recommend re-testing the Ladder Operation.
